Re: Amendment to the Phase I Environmental Site Assessment for El Paso Fence Section K-1B:

Soil Sampling and Analysis Report – W9126G-09-D-0067-0026

Dear Ms. Pollmann:

This letter report will serve to amend the Phase I Environmental Site Assessment for the El Paso Fence Section K-1B corridor to reflect the results of soil sampling and analysis to address historical contamination of surface soils from the now-closed ASARCO copper smelter.

Introduction and Methods

U.S. Customs and Border Protection (CBP) proposes to construct a pedestrian fence (Section K-1B) in El Paso along the north and east side of the American Canal between West Paisano Drive and the Rio Grande. The majority of the property within the construction corridor belongs to the U.S. Section, International Boundary and Water Commission (USIBWC), with some construction on private property and highway right of way belonging to the State of Texas. Along with the fence, a maintenance and patrol road will also be constructed. A Phase I Environmental Site Assessment completed for the construction corridor revealed risk concerns due to an active petroleum contamination plume from adjacent private property, and possible soil contamination from previous emissions from the ASARCO lead and copper smelter located in the vicinity.

The El Paso K-1B Fence Segment project corridor is located within the area of concern for lead and arsenic contamination of surface soils from the closed ASARCO smelter facility, located approximately

0.5 mile to the north. In order to characterize the level of surface soil contamination present in the project corridor, surface soil samples were collected along the 3,100-foot long project corridor using the same sample collection protocol used previously by U.S. Army Corps of Engineers (USACE) and U.S.

Environmental Protection Agency (USEPA) contractors for testing soils in the surrounding neighborhoods (USEPA 2001). It was previously determined that highest lead and arsenic levels were found in the top 1 to 2 inches of soil.

The sample collection was accomplished on July 7, 2010. Ten samples were collected within the top 1.5 inches of soil, within an approximately 3-inch diameter area at evenly spaced intervals to cover the entire length of the project corridor (see Sample Location Map attached to this report). Samples were placed in laboratory-supplied glass sample jars, labeled and sealed, and then brought back to Gulf South Research

Letter Report

Corporation (GSRC) offices and held until authorization for analysis was received. Analysis was accomplished at Gulf Coast Analytical Laboratories in Baton Rouge, Louisiana on September 2, 2010 for the eight Resource Conservation and Recovery Act (RCRA) metals of concern (arsenic, barium, cadmium, chromium, lead, mercury, selenium and silver) using standard USEPA-approved methods. The sample holding time for mercury analysis was exceeded, but the analysis was done at the request of GSRC, since mercury is not a contaminant of concern based on previous soil analysis reports in the area.

Sample Analysis Results

The results of the sample analyses are presented in Table 1. All samples tested above USEPA Regional Screening Levels for arsenic in soil, and eight samples tested above USEPA Regional Screening Levels for chromium in soil. Based on previous published reports by USEPA for remediation work proposed and accomplished in the surrounding areas of El Paso for contamination from the closed ASARCO smelter, the remediation action levels for arsenic and lead in soil were determined to be 24 milligrams/kilogram (mg/kg) for arsenic and 500 mg/kg for lead (the USEPA screening levels for residential property) (USEPA 2002). Only two samples tested above the remediation action levels in the project corridor, Sample 8 and Sample 9, both located near the north end of the corridor.

Discussion of Soil Analysis Results

The results of the soil sample analysis in the project corridor confirm previous speculation that surface soils in the K-1B fence project corridor may be contaminated by heavy metals historically emitted by the ASARCO smelter. While not all of the samples collected had arsenic and lead contamination at levels above the remediation action levels established by the Texas Commission on Environmental Quality

Letter Report

(TCEQ) and USEPA, the level of sampling done for the project corridor was at a screening level only, and varying levels of lead and arsenic were found in all samples collected.

The project corridor varies in topographic elevation from highest at the north end to lowest at the south end of the corridor. The south end of the project corridor is within the established flood zone for the area, and is flooded during heavy rain events. This is reflected in the sample analysis results, and likely resulted in dilution of most metals concentrations at the south end of the project corridor by flood waters and other disturbance (see Chart 1). The higher elevations and relatively undisturbed surface soils at the north end of the corridor more clearly reflect the contamination levels normally expected from the ASARCO contamination in this area. Sample 10 was taken in road fill adjacent to West Paisano Drive, since it was not possible to sample within the American Canal due to lack of access (closed fence and concrete-lined canal).

Chart 1. Graphic Presentation of Soil Metals Concentration

Properties adjacent to the project corridor include a public city park (Doniphan Park), and several buildings with occupied residential apartments. These properties would fall within the action level parameters for properties requiring removal of lead and arsenic contaminated soils above the ASARCO action levels. A prior correspondence from USIBWC dated February 11, 2008 (attached), requested a remediation plan for soil excavation in the vicinity of the ASARCO smelter, and recommended that proper precautions be taken for worker protection when disturbing contaminated soils on USIBWC property in that area. The levels of arsenic and lead found in soils in the El Paso K-1B fence construction corridor are such that a remediation plan for soil disturbance during fence and road construction should be prepared, and any excavated soil removed from the project site should be tested for lead and arsenic levels prior to disposal. If excavated soil analysis results show levels of lead or arsenic above the ASARCO action levels, then notification to USEPA and TCEQ would be required, and consultation to determine a proper disposal site would be necessary.
