Justification and Approval for Other than Full and Open Competition under FAR Part 13

This document is a Justification and Approval form for a single-source procurement under FAR 13.106-1(b) by the Uniformed Services University of the Health Sciences (USUHS), Acquisitions Directorate. The procurement is for audio-visual systems equipment, installation, and programming for classrooms MS, MS2, and Lecture Hall E1, including One Diversified Assurance Managed Services for installation and programming. The requirement does not exceed the Simplified Acquisition Threshold (SAT) and will be solicited as a firm fixed price contract for a new award.

The justification for single-source procurement is based on technical compatibility and performance risk mitigation. Although the required hardware items are manufactured by multiple vendors, the specific technical architecture requires hardware manufacturers listed in the RFQ to be compatible with the existing audio-visual system, which was originally programmed by One Diversified. Contracting through One Diversified and its authorized contractors mitigates contract performance risk by ensuring continuity with a third-party vendor already familiar with the system programming. The contracting officer determined that the anticipated cost to the Government will be fair and reasonable based on competitive quotes and market research, which demonstrated that multiple small businesses may provide the requirement at fair and reasonable prices. This procurement is designated as a total small business set-aside for commercial items using simplified acquisition procedures under IAW FAR Parts 12 and 13. No synopsis to the Governmentwide Point of Entry is required as the requirement is under $25,000. The justification was approved by the contracting officer.

PROCUREMENT SENSITIVE INFORMATION – FOR OFFICIAL USE ONLY

Justification and Approval for Other than Full and Open Competition under FAR Part 13

In accordance with FAR 13.106-1(b), Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

Per FAR 13.106-1(b)(1), this requirement does not exceed the Simplified Acquisition Threshold (SAT) and will be solicited to one source.

1. Identification of the agency and the contracting activity:

Uniformed Services University of the Health Sciences (USUHS), Acquisitions Directorate

(ACQ).

2. Nature and/or description of the action being approved:

Issuance of a brand name only award. This will be a firm fixed price contract for a new award.

3. Description of the supplies or services required to meet the agency’s needs (including estimated value):

This procurement is for the acquisition of an audio-visual systems equipment, installation, and programming for classrooms MS and MS2 and for Lecture Hall E1. The requirement includes One Diversified Assurance Managed Services for installation and programming.

4. Demonstration that the proposed contractor’s unique certifications or the nature of the acquisition requires use of the authority cited:

The required items are manufactured by multiple vendors and services are provided by authorized contractors associated with the One Diversified Assurance Managed Services program. While the items may be procured via an authorized distributor, the specific technical architecture requires the hardware manufacturers listed in the RFQ to be compatible with the existing system and programming services through One Diversified since the original audio-visual system was programmed by One Diversified. This will mitigate contract performance risk through a third-party vendor who may encounter systems programming issues.

5. Procedures of FAR 13.5 were or will be used in accordance with 41 USC 1901 or the authority of 41 USC 1903 (including publicizing required justifications):

Yes ___X No

If the notice to the Governmentwide Point of Entry (GPE) will not be publicized, indicate which exception applies:

This requirement is under $25,000. No synopsis to the GPE is required. (FAR 5.101(a)(1))
