Number Reference Question Response

Attachment 03 – Pricing Table a. Please confirm whether the listed number of flight hours are all minimum guaranteed, and that the contractor will be paid this minimum regardless of actual utilization. Further, please confirm that hours flown or standby/delay time incurred in excess of these minimum listed hours will be charged at the unit price rate. Reference: 150 flight hours for FW Air Transport (4 Passengers), 200 flight hours for FW Air Transport (8 Passengers), 50 FW Aircraft Standby /

Delay Time hours, 75 flight hours for RW Air Transport (3 Passengers), 300 flight hours for RW Air Transport (5 Passengers), 100 flight hours for RW Air

Transport (9 Passengers), 150 flight hours for RW 500 lb. Drone Recovery, 50 flight hours for 2,500 lb. Drone Recovery, and 300 RW Aircraft Standby / Delay

Time hours.

No minimum guarantee exists for this requirement. Flying hours shown are estimated and payment will be made at actual hours. Standby hours will be paid at contract Aircraft Standby / Delay Time in accordance with PWS

1.3.2.4..

Attachment 03 – Pricing Table and PWS Section 1.3.1, Page 1 (FW and RW Aircraft Specifications)

a. Please confirm whether the mission types listed for RW and FW aircraft will be conducted concurrently, or whether the contractor could coordinate with

USG to schedule flights to not conflict. This would allow the contractor to fulfill all mission types with one (1) RW aircraft and one (1) FW aircraft that are capable of performing all respective RW and FW mission requirements.

FW & RW flights could be flown concurrently, for the same or different missions. Tasking may be for single or multiple aircraft.

Reference PWS Section 1.2, Page 1, Paragraph 1 Are contractor aircraft required to be based at a specific airfield? No specific field is required

Reference DFARS clause 252.207-7012 I do not see that FAR Clause in this Solicitation but rather 252.204-7012, which does not necessarily require the CMMC3 certifications. Is this missing FAR clause an oversight?

The CMMC DFARS clause , 252.204-7021, “Cybersecurity Maturity Model

Certification Requirement”, is NOT in contracts prior to 30 Sep 2025, unless approved by OSD/A&S, as OSD/A&S is taking a phased approach to implementation of this framework. However, DFARS provision 2252.204-7019, “Notice of NIST SP 800-171 DoD Assessment Requirements” and DFARS clause

252.204-7020, “NIST SP 800-171 DoD Assessment Requirements” has been added to the solicitation. Under this clause, the Contracting Officer will be required to verify the contractor has posted a summary level score of a NIST SP

800-171 DoD assessment to SPRS for covered contractor information systems.

Reference Atch 5, Question 3 This attachment asks if the Operator is a US “Flag Carrier”. The common definition of that is a Sovereign Airline that carries 30 or more passengers on international routes. While we are an “Air Carrier” under FAR 135, I don’t think we are a “Flag Carrier”.

U.S. flag air carrier service is service provided on an air carrier which holds a certificate under 49 U.S.C. 41102 and which service is authorized either by the carrier's certificate or by exemption or regulation. For purpose of this solicitaion US flag carrier would include US owned and operated carriers.

Foreign flag carrier would include foreign owned and operatied carriers.

Instructions to offerors- commercial items, Page 24 of

44 (Volume III-subpara 4)

The offeror shall demonstrate that all personnel, air crew, pilots, mechanics, and corresponding subcontractor personnel (if applicable) possess the necessary qualifications. This could be 100’s of pages.

Responses must be within page limitations. The offeror should show how these qualifications meet the requirement not simply a listing of license numbers. To demonstrate qualificator of personnel, the offeror may list the qualifications by category. While individual license numbers for each person is not necessary, we would require type ratings/ qualifications and FAR Part qualification for proposed categories.
