Atch 5 - Q&As

9 March 2021

SUBJECT: QUESTIONS AND ANSWERS IN RESPONSE TO HTC71121QR015, REQUEST

FOR QUOTES (RFQ) FOR STEVEDORING & RELATED TERMINAL SERVICES –

ZADAR, CROATIA

To all potential Quoters, The following questions were submitted and answered in response to the subject RFQ:

1. Will the US Government request the performance of services in Zadar Port with a Chinese Owned entity involved?

A. No, the US Government is not requesting performance with a Chinese-owned entity.

2. Is there a waiver process we are not aware? (referencing FAR 52.204-24, DFARS 252.204-7016, 7017 & 7018 which prohibits use of “covered defense telecommunications equipment and services” from certain Chinese or Russian sources) A. Yes, there is a waiver process. However, the US Government relies on the vendor’s representation in provision 52.204-24, 252.204-7016 and 252.204-7017 to determine whether a vendor provides “covered defense telecommunications equipment and services”. Unless a vendor indicates it does use prohibited equipment and services, a waiver does not apply and the Government is currently unaware of additional reasons to question that representation.

3. Can the Government advise which terminal they plan to call?

A. The local passenger/RORO/ferry terminal identified in the picture below, specifically at dock/pier #7.
