QUESTION AND ANSWER ROUND ONE

MILITARY PORTS OF TURKEY (AGALAR & AKSAZ)

HTC711-21-Q-R001

Question 1:

Application of Reception and Disposition charges. Reception and disposition rates requested in Schedule 1C and 1D in SOR are unclear in PWS. Appreciate your guidance on following;

a. Is RECEPTION / DISPOSITION intended as a Gate fee for the cargo to enter / exit the terminal?

Answer: No, Reception / Disposition are not intended to be a Gate Fee. See PWS Section 4.6 Table 1 for a definition of Receipt and Disposition. As noted in PWS Section 4.6, “the table does not define each service as a separate billable item.”

b. Please confirm SOR rates 1C and 1D are chargeable in addition to 1A and 1B in the SOR basis the commodity and the direction of the movement. The activities associated with the movement are:

1. At the Gate, SOR rates 1D or 1C

2. In the Storage yard, SOR rates 1B, 1E, 1F, 4, 5 and 6

3. At the Pier / Vessel, SOR 1A Answer: No, Schedule 1C Reception Only and Schedule 1D Disposition Only rates are not chargeable in addition to Schedule 1A and Schedule 1B rates. Schedule 1E Stuffing/Unstuffing rates are used when the Contractor is requested to stuff and unstuff containers. See PWS Sections 5.20 and 5.22. Schedule 1F Intra Port Transfer rates are used when the Contractor is requested to transfer cargo from one place of rest to another place of rest. See PWS Sections 5.19 and 6.4.14. Schedule 1E Stuffing/Unstuffing rates and Schedule 1F Intra Port Transfer rates are not chargeable in addition to Schedule 1A and Schedule 1B rates.

Is it the Government’s intention to have the gate fees incorporated in the truck loading / unloading fees of 1B, 1E, and 1F? And the Reception / Disposition charges are only applicable if the Government is performing all handling at the terminal using soldiers.

Answer 1:

See above for answers to 1a. and 1b.

Reception and Disposition charges for cargo moved by commercial conveyance are included in the commodity rate for Schedule 1B4 Discharge Trucks and Schedule 1B3 Load Trucks, respectively. See PWS Sections 5.11 and 5.12.

The Schedule 1C Reception Only and Schedule 1D Disposition Only rates are only applicable if the Government is performing all handling at the terminal using soldiers.

Yes, Schedule 1C Reception Only and Schedule 1D Disposition Only rates are for the receiving and the disposition of military convoys. The Contractor will be compensated per Schedule 1C Reception Only and Schedule 1D Disposition Only if the contractor provides tally and checking services when requested. See PWS Sections 5.14 and 5.25. When Schedule 1C Reception Only and Schedule 1D Disposition Only rates are used, the Contractor is not loading or unloading the conveyance.

Questions 2:

Can the Government explain the circumstances the application of (un)Lasing charges under schedule 1A1a/ 1A2a in SOR outside loading and unloading commodity operations?

Answer 2:

Yes, this schedule is used if the contractor only lashed or unlashed cargo onboard a vessel such as an aircraft. Another example would be if the Government provided drivers to drive specialized vehicles on board the vessel. The contractor would then provide lashing services only. See PWS Section 4.4.2.

Question 3:

Commodity categories (25b, 60b, 61b, 67) on SOR mentioned LOLO by Ship gear / Ship crane.

On PWS Appendix B page 64 / 65 handling of these categories are expanded to add Mobile Shore Crane, Forklift, or Top-Handler. Which are the correct method of handling to be considered?

Answer 3:

Appendix B provides all Commodity Schedule of Rate Definitions. The specific Commodity Numbers for the expected method of movement for this requirement are provided on the Schedule of Rates (SOR). See PWS amendment adding a note to Appendix B.

Question 4:

The application of Overtime differentials and guaranteed time is not clear. What circumstances will trigger payment of these costs and what documentary supports are mandatory to charge these costs.

Answer 4:

Local labor rules/laws determine if overtime is paid after designated normal working hours and if guarantee time (also called minimum time) is applicable. Per PWS Section 4.10, “overtime compensation shall be the calculated time past the normal working shift/s and shall be determined IAW the prevailing CBA (if applicable).” Guaranteed time (minimum time) is based on local labor laws where the contractor may have guaranteed work. See PWS Section 4.7. For example, if the guaranteed work time is four (4) hours and the commodity work performed is only two (2) hours then the Government will pay base pay rates (Schedule 3C) of two (2) hours to the contractor. Per PWS Section 4.7.1.1, “the Government will not pay [guaranteed time] (minimum time) to the contractor where local CBAs do not exist.”

Question 5:

The SOR requests compensation for Mobile wash racks and Concrete wash racks (4 each) for complete lot on Per Mission basis. Please guide estimate time frame for each Mission to be considered. How much notice is expected from the Government to place this equipment?

Answer 5:

All washing services are usually done as cargo is received at the port for export. The contractor will be notified as soon as missions are known; however, the contractor may receive as little as 48 hours’ notice that some services are needed. See PWS Section 6.4.8 for information on the Wash Rack Equipment.

Question 6:

Can the Government confirm for cargo cleaning / washing activities, will include the application of all following in the SOR?

a. Charges per Mission for Mobile / concrete wash rack as per schedule 6

b. Pressure washer charges per day as per schedule 4

c. Cargo cleaning charge per commodity type for each cargo piece as per schedule 6

Answer 6:

Per PWS Section 6.4.8, the contractor is/will be compensated for each mission separately based on what is ordered. Pressure washers are to be priced per each per day. Wash racks (metal or concrete, lots of 4) are be priced per mission. Pressure washers and wash racks (lot of 4) must meet the requirements of PWS Section 6.4.8. Each type of cargo is further paid per Each per the Schedule 6 Cargo Cleaning rate.

Question 7:

Please explain details and requirement for Line Item 168: “CRM” under schedule 8. We are not finding the “CRM” in the PWS.

Answer 7:

Please disregard this line and do not provide a quote for this item. The SOR has been amended to remove this line item from the quote and is now highlighted in grey.

Question 8:

We assume the Unit of measure for stand by time for flatbed under line item 180 should be per Hour instead of Per trip. Can the Government Guide?

Answer 8:

Yes, this is a typo on the SOR. The unit of measure should read Hour (HR) for line item

180. See amended SOR.

Question 9:

SOR / PWS does not specify expected requirement of staging space and duration of use. Our Understanding is there will be no staging area charges in the Contract. The US Government has separate agreements with ports for the space. Can the US Government advise the structure on space use at the port?

Answer 9:

Per PWS Section 6.4.12, there is no cost to the contractor for providing staging. The Government usually estimates its need based on the cargo footprint. Those amounts may change for each mission. See PWS Section 6.4.12.1 for staging yard requirements, when requested by the COR, and shall be included in the commodity rates.

Question 10:

On the Section SF 1449 of the above referenced solicitation for notice ID: HTC711-21-Q-R001 Military Ports of Turkey, Page 3 of 62, Min/Max Value “The minimum order value for this indefinite delivery/indefinite quantity contract is established at $2,500.00”.

Please clarify the minimum $2,500.00 minimum. Does this mean the TOTAL contract minimum value as indicated is $2,500.00 per task order? No, the total contract minimum value as indicated ($2,500) is not per task order. Could it be the only task order? Please help us understand this minimum order value specification.

Answer 10:

No, the total contract minimum value as indicated ($2,500) is not per task order. The minimum guarantee for the contract is satisfied when the Contractor has been offered sufficient terminal services totaling $2,500. The Minimum Order Value is satisfied when the Contractor is given a task order, or multiple task orders, which results in a combined total of $2,500.00.
