QUESTIONS AND ANSWERS
Request for Proposal (HTC711-20-R-R007)
RFP Citation, if provided QUESTIONS ANSWERS
| 1 | Atch_2 SOR Every commodity type listed for LO/LO Shore Crane Type (Gantry/Mobile) | Please clarify on whether you would like Offerors to propose a rate for the Gantry Crane, or a Mobile Crane. The price difference between the two is exorbitant and would make for two wildly differing commodity rates. | Answer: No, the commodity rate should not include crane rental, gantry is ordered and paid by the 832nd to the port directly, and shore cranes are rented through the contractor and paid separate by OOP (section 4.13 of the PWS) the contractor should only include his equipment, labor (including crane operator) needed for LOLO operations. |
| 2 | Atch_2 SOR Lines 83 - 211 | For all rail and truck commodities 1B1, 1B2, 1B3, and 1B4 |
It is very rare that commodities are discharged directly from a vessel to a truck or rail conveyance, and also rare for the opposite. The ships crane or shore crane in military movements are used to discharge equipment to the pier where it is subsequently drayed to a point of rest in the terminal to await follow on transportation via truck or rail.
All of those commodities above are asking for rates for ships crane and shore crane to discharge to and from rail and trucks. The above commodities are typically loaded one of three ways. Lift On / Lift Off with a crane(Heavy Equipment only), Lift On / Lift Off with a forklift or stacker, or they are driven on using a ramp.
The reason I am asking is that the schedule does not support the work that will be conducted. It will leave some holes in the schedule that will have to be interpreted when it comes time to load the commodities via rail or truck.
For rail and truck there needs to be a lift on lift off with forklift or something similar Answer (a): Yes it’s rare that this could/would happen, however it has been performed in past years. Should this take place the contractor would receive both commodity rates, one for discharging the vessel and the other for loading the conveyance (section 5.10.6 - 6.7.1.3 – 6.8.1.2 of the PWS). If by chance there is commodity that needs to be loaded directly to the vessel from truck or rail (ammo, or priority cargo) the contractor will receive both commodities for discharging/loading. Answer (b): True, however there are 5 methods the Government uses. See definitions in the Glossary Appendix B Answer (c): What holes are you referring too? Answer (d): For rail and truck, (see section 6.7.1.2 of the PWS) If the contractor elects to lift operational cargo (drivable) for track or rail, for their ease or convenience, the Government will only compensate the contractor loading or discharging cargo for the intended commodity rate (e.g. lifting operable vehicles instead of driving them)(section 5.9.6 of the PWS)
| 3 | SF Form 1449 CLIN0001 | Since the proposal is for a five year period of performance I wanted to address the fact that the schedule of rates contained no provisions for a price escalator to account for inflation and costs that go up every year. What the current RFP is asking for is one rate for the entire five year period. This would cost the Government more money due to the fact that Offerors would have to base their rates off of what they estimate their costs will be in May of 2025 when the contract ends. While this would ultimately be more beneficial to the contractor, it will make our rates look inflated initially. | The five year base period is equal in length to a 12-month base with four 12 month option periods. The Government expects the total costs of both scenarios to be equal. |
| 4 | SF Form 1449 | Secondly for 372 Miscellaneous, Out of Pocket Pool, I am not certain what is being asked. Are they asking us a max per month that the company is willing to go out of pocket? | No, there is no rate required for the Miscellaneous, Out of Pocket Pool . See amended SOR Atch_2. |
| 5 | SF Form 1449 Period of Performance | The current RFP states that the Period Of Performance for both CLIN’s would begin on 01-Jun-2020. Currently Portus Stevedoring’s extension goes through June 30th. Please confirm the Period of Performance on HTC711-20-R-R007. |
Period of Performance (POP) is 1 Jul 2020 - 30 Jun 2025. Updated POP provided on RFP Amendment 1.
| 6 | Due to the current state of the nation will any additional time or considerations be given with regards to the due date for the proposals. I only ask because I know many people will be working from home to try and put this together collaborating mainly over the phone and through emails. | Yes, see Solicitation Amendment 3. | |
| 7 | Since the Service Contract Act requires contractors and subcontractors performing services on prime contracts to pay service employees no less than the wage rates and fringe benefits found prevailing in the locality, or the rates contained in a predecessor contractor's collective bargaining agreement (CBA) can you please provide the current contractors CBA with the current wages and fringe benefit rates being paid to their employees and subcontractors | CBA provided on Solicitation Amendment 2, Atch 8. | |
| 8 | In the CBA it shows the wages and Pension amounts paid to the employees but under auricle XXII Benefits it only gives the amount the employee must pay not how much the company pays. Can you please provide the amount the company contributes per hour towards their employees for SDDC hours worked? | The employer’s actual cost to provide Health and Welfare benefits described in the Collective Bargaining Agreement (CBA) with International Union of Operating Engineers, Local No.673, AFL-CIO are as follows. The cost per hour for each employee is $4.51. | |
| 9 | Atch_2 SOR Various Lines | Do the all the line items in the Schedule of Rates that are showing zero in the Unit Quantity column require rates? There are many items in the Schedule of Rates with a unit Quantity of zero so I provided these as an example: SOR Line items 86, 94, 97, 117,125,128, 148, 156, 159, 179, 187, 190. | No, there is no rate required for the lines with "zero" . See amended SOR Atch_2. |
| 10 | On attachment 4 the Technical Worksheet, Section 1, Page 1, Paragraph 1. | The question asks about how we will access labor, equipment, and facilities in 72 hours but the reference PWS 2.1 thru 2.3 discuss General Security Requirements and Ground Rules and Constraints is that correct? | Paragraph references have been removed. See revised PWS for the scope of requirement details. |
| 11 | In attachment 4 the Technical Worksheet, Section 2, Page 1, Paragraph 2 | The question is: Describes how you will receive and unload military cargo from Military and commercial trucks. The Reference is: PWS 5.14 covers Nesting and de-nesting cargo. Is that correct? | Paragraph references have been removed. See revised PWS for the scope of requirement details. |
| 12 | In attachment 4 the Technical Worksheet, Section 2, Page 1, Paragraph 2a. | The question references PWS 6.17 but there doesn’t seem to be a paragraph 6.17, is that correct? | Paragraph references have been removed. See revised PWS for the scope of requirement details. |
| 13 | In attachment 4 the Technical Worksheet, Section 3, Page 1, Paragraph 3a. | The question references receiving cargo via trucks but the reference PWS 6.7.3 & 6.7.4 talks about rail. Should it be PWS 6.8 Truck Operations? | Paragraph references have been removed. See revised PWS for the scope of requirement details. |
| 14 | 6. In attachment 4 the Technical Worksheet, Section 3, Page 2, Paragraph 3f. | The question about describing Supervision and Management Services per PWS 1.2 & 1.2.1 which talks to the Background and the scope of the PWS. Is that correct? | Paragraph references have been removed. See revised PWS for the scope of requirement details. |
| 15 | In the PWS page 41 of 80 section 6.2.4 & 6.2.4.1 Container Security wall. | Paragraph 8. 6.2.4.1 states the contractor shall provide two rates for the container wall, one for the daily container wall and one for the cost of transportation, placement etc. to construct the wall, however there is only one line item for container rental in section 6 of the schedule of Rates. | Please provide the rates on the SOR to include setup and removal, per 20' and 40' container. See revised PWS attached to Solicitation Amendment 3, for clarity. |
| 16 | Page 7 & 8, Paragraph 3.6. and 3.6.1 of the PWS | Can you please clarify that training on military/specialized military equipment will not be paid for by the military, as customary, but will be at the Contractors expense? If at the Contractors expense, how will the contractor be compensated for the cost of the wages paid to labor? |
The contractor should have qualified drivers in support of this contract. The Government may offer training on specialized vehicles due to new start up and shut down procedures and electronics. For these training events, the Government will compensate the contractor using man-hour rates for drivers designated to attend training.
