Page 32, Part 1, Paragraph 7

It states that we must include ‘The offeror’s Federal Aviation Authority or Civil Aviation Authority Air Operator Certificate’. As an aircraft charter broker we do not have an AOC but could provide the AOC for the airline that we procure to meet the requirements of the solicitation. Is this acceptable?

No, per TRANSFARS clause 5552.247-9001(a), this contract is conditioned upon the Contractor (if the contractor is a team arrangement, applies to each team member) being an air carrier and holding a Certificate of Public Convenience and Necessity issued under Section 401 of the Federal Aviation Act (FAA of 1958, as amended), or otherwise authorized by the Department of Transportation (DOT) to engage in direct air transportation services, holding an Air Carrier's Operating Certificate issued by the FAA under Part 121 of the Federal Aviation Regulations (14 CFR 121) for airlift operated by the offeror, and participating in the CRAF, if applicable.

I have a question in regards to the below paragraph in the tender documents:

“(6) Online Representations and Certifications. Offerors are required to register in the System for Award Management (SAM) database (Caution-https://www.sam.gov) and complete electronic representations and certifications in the SAM. The Government will reference the date of SAM verification and include a paper copy of the electronically submitted representations and certifications in the contract file.”

I thought originally, when reading the text, that we had to fill in a document called “Representations and Certifications”, but when logging into the SAM we realized that it was more likely the attached SAM.gov FAR & DFARS Report the tender document was referring to.

Is our SAM registration and our confirmation for having read the representations and certifications, and having included the attached SAM.gov FAR & DFARS Report, enough to comply with paragraph 6 of Part I – Business Proposal on page 32 of the tender document?

An active registration in System for Award Management (SAM) and completion of the Representations and Certifications are required to demonstrate compliance. The FAR & DFARS Report generated by SAM.gov is sufficient.
