About this file

This document is a set of Questions and Answers (Q&A) for Solicitation HT940625R0006 for the Digital Imaging Network Picture Archive and Communication System (DINPACS) Workflow Analysis and Training at Naval Medical Center Portsmouth. The Q&A covers multiple topics related to the solicitation, including incumbent vendor details (CP Marine, LLC with contract number N6264521P0019), key personnel requirements, proposal submission guidelines, and technical specifications.

Significant details include a CMMC Level 1 certification requirement, clarification on key personnel (a contract manager and alternate contract manager), and specifics about the contract's technical scope. The solicitation is a firm fixed-price, non-personal services contract for 8(a) participants, with a base period from June 2025 to November 2025 and four potential option periods through November 2029. The government has been intentionally limited in disclosing certain contract details, recommending interested parties submit FOIA requests for additional information about contract value, level of effort, and past performance.

30. FAR 52.222-42 Statement of Equivalent Rates for Federal Hires is missing. Is this an oversight? Please provide a statement of equivalents for the positions. (GS Equivalent/SCA Code).

Answer: We have added this clause via full text in addition to its inclusion in FAR 52.212-5 per this amendment.

31. Since this is a non-personal services contract (section 1.1) the Furlough process described in this section for contractor personnel is inconsistent with existing labor regulations and FAR (FAR 37 / Subpart 37.101). Specifically, there will be no employer-employee relationship between the government and the contractor sta (i.e., they will not be government employees) we are unclear under the authority the government will have to furlough a person that is not a government employee. Request the government remove this clause and make it consistent with prevailing labor laws and regulations with respect to furlough authority to non-government employees.

Answer: The purpose of PWS Section 1.7.3.2 is to notify o erors that in the event of a government furlough, contract personnel will be assigned as either mission essential or not.

Mission essential personnel will be required to report to work during a government furlough.

Non-mission essential personnel will not be required to report to work during a government furlough. The Government will not remove this paragraph from the PWS.

32. Withholding funding on awarded FFP contracts during government shutdown is inconsistent to current and historical funding practices for FFP contracts considering the contract is expected to be fully funded for the performance period and the contractor is assuming all risks to perform requirements specified in the PWS. Recommend the government remove this section/clause or change the contract terms from FFP to T&M to accommodate this uncertainty.

Answer: Funding is expected to be obligated in full at the beginning of each period of performance for the entire period of performance. However, in the event funding is not available at the beginning of a period of performance due to government furlough or continuing resolution, the Government has the ability to execute option periods subject to availability of funding in accordance with FAR 52.232-18. This contracting clause is being added to the solicitation via amendment 02. The Government will not change the contract type from an FFP to a T&M.

33. Request the government confirm all PACS components contracts are covered under manufacturer warranty or maintenance service contracts.

Answer: Yes. Maintenance contracts are the normal process for our systems, although the PACS o ice is expected to repair/troubleshoot as much as possible without possibility of harming functionality / warranty of the systems.
