DHA cannot comment on hypothetical situations. See Section L, DFARS Clause 252.215-7009 and paragraph 2.1.9 Competition. The Government will proceed in a manner that is in the best interests of DHA and as permitted by Solicitation and the FAR/DFARS.
15
Section L, paragraph 7.0 VOLUME III, PAST PERFORMANCE INFORMATION (FACTOR 2, PAST PERFORMANCE)
Is the requirement for three past performance contracts for each first-tier subcontractor a minimum or a maximum ?
It is a maximum per Section L, paragraph 7.2.2, Past Performance Contract Descriptions. In addition to the Past Performance Narrative, the offeror shall provide a maximum of three recent contracts for itself and for each of its first-tier subcontractors. See Section L, paragraph 7.7 and Pre-proposal Conference PowerPoint presentation, Slide 35.
May a First Tier sub be compliant with a minimum of 1?
See response to question 15. DHA will evaluate past performance in accordance with Section M. paragraph 5.0. Also see Section L, paragraphs 7.2.2 and 7.7.

Common Proposal Mistakes:

Failure to read entire Solicitation carefully, including all sections, attachments and background information and any amendments.

· Section L contains the Instructions, Conditions, and Notices: Proposal preparation instructions.

· Failure to comply with the solicitation instructions could result in the proposal being non-responsive and ineligible for award (Section L, paragraph 2.1.5).

· Past performance: Inadequate specifics in its cover letter or the PPQ, so the Government cannot identify to which offeror the past performance refers and the specific contract referenced.

· Factor 1, Technical Approach Volume II

· Factor 2, Past Performance Volume III:

· Failure to submit PPQs related to the Past Performance Contracts in Factor 2.

· Failure to comply with paragraph 7.7.3. The Client authorization letters are required for each identified past performance effort (Section L Exhibit L-1, Sample Client Authorization Letter).

· Past performance contract POC fails to send the completed PPQ to DHA in accordance with Section L, paragraph 7.7.1, “The Government will not accept or evaluate any PPQs sent directly to Government from a proposing offeror or its subcontractors. For expediency of evaluation, offerors shall instruct past performance POCs to email the completed PPQ to cynthia.d.turk.civ@mail.mil and margaret.a.zancanella.civ@mail.mil as soon as possible but not later than the date specified in Block 9 of the SF 33.”

· A “secure email” from an unknown sender with links to past performance information is not an email with “the completed PPQ” and violates DOD security protocols.

· Failure to submit the consent of proposed first-tier subcontractor(s) and teaming partners, as applicable (see Section L Exhibit L-3, Sample Teaming Partner/Subcontractor’s Consent).

· Section M contains the Evaluation Factors: General information about how DHA will evaluate proposals.

· The solicitation and resulting contract are interpreted as a whole.

· Plain English takes precedence over technical language except where terms are defined within the solicitation.

Offeror is unfamiliar with the applicable FAR and DFARS references and industry best practices and standards.

Offeror emphasizes its capabilities without clearly identifying how it will meet the solicitation requirements to meet agency’s objectives.
