About this file

This document is a set of Questions and Answers related to a Request for Proposal (RFP) for the Market Technology Integration Office (MTIO) Special Projects, Solicitation No. HT001124R0069.

The key details are:

  • The RFP is set aside for 8(a) companies.
  • Regarding eligibility, a joint venture (JV) where one partner has a Top Secret (TS) clearance is eligible if both partners in the JV have TS facility clearances. If only one partner has TS clearance, the JV would need to obtain its own TS clearance to be eligible. Alternatively, a partner with TS clearance could be the prime contractor.
  • The solicitation has been amended to clarify that it is an 8(a) set-aside, and not an Economically Disadvantaged Woman-Owned Small Business (EDWOSB) set-aside as previously stated.
  • The solicitation is for commercial services required by the Defense Health Agency.

HT001124R0069 Q&A

Question Govt Response

1. Is a company eligible under either of these scenarios:

1a.Using a JV where the 49% has a TS clearance?
1b.Using a partner with a TS clearance and we can sponsor ours post award?

1a. The JV does not need a separate TS clearance if BOTH companies (49% and 51%) forming the JV have the TS facility clearance. Ref:NDAA 2020 Page 545 SEC. 1629. The JV does not automatically get TS clearance if the company with 51% does not have it. In that case, the JV needs to get its own TS clearance to be eligible.

1b. This may work if the partner with the TS clearance is the prime contractor on the award. The prime is required to have the TS clearance IAW 32 CFR 117.9(a)(5).

2. Could you please confirm the correct Set-Aside. As per document its showing two Set- Asides. One is 8(a) and second is EDWOSB. See Amendment 1, this is set-aside for 8(a)'s
