B. Questions will only be considered from interested parties (i.e. Small Businesses in NAICS 561612).

C. Page 1 of the 1449 is hereby deleted in its entirety and replaced with the attached to reflect a 100% Total

Small Business Set-aside.

D. For purposes of determining past performance relevancy (in terms of magnitude) a minimum of 110,000 hours per year (annualized) is required for a past performance reference to be considered relevant past performance when compared to the present requirement.

E. Section E Solicitation Provision, is hereby revised to reflect the following: The Contractor is requested to submit any questions regarding this requirement via email as soon as possible but no later than 12:00pm EST on November 1, 2011 to Katelyn.McCullough@dhs.gov. Prospective contractors may contact the Government while preparing a proposal in order to obtain clarification of the statement of work or to obtain other information needed to prepare a proposal. Any clarifying information issued by the Government will be provided to all prospective contractors. (Page 12 of Section E).

F. CBA-2009-2783 Rev. 2 including the Collective Bargaining Agreement (CBA) between the International

Union of Security, Police, and Fire Professionals of America (SPFPA) and DTM Corporation is hereby deleted from the Solicitation. This amendment incorporates CBA-2011-4622, the Collective Bargaining Agreement (CBA) between the International Union of Security, Police and Fire Professionals of America (SPFPA) and Master Security Company, LLC as attached, which covers MD0326 and MD0778.

G. Section 12.1.2.1 of the Statement of Work is hereby deleted in its entirety and replaced with the following:

Exhibit 1 to the Statement of Work specifies which posts require provision of a relief PSO if the assigned PSO is taking a break or meal period to ensure continuous/uninterrupted coverage. The Contractor must provide a replacement PSO for each employee on an authorized break. Patrol (rover) PSOs shall not be used to provide breaks/relief. Supervisors shall not provide relief while working in a supervisory capacity (i.e. a supervisor shall not perform supervisory and productive PSO services simultaneously). In order to provide breaks and/or relief, a supervisor must sign-off as a supervisor, remove any supervisory insignia, and sign-in as a productive PSO. PSOs working a minimum 8 hour shift shall be provided a paid 15 minute break for each 4 hours of work. This break should normally be scheduled in the middle of each 4 hour period. A 30 minute unpaid lunch break shall also be provided to those individuals. All PSOs working a 6 hour shift shall be provided a paid 15 minute break and an unpaid 30 minute lunch break.

PSOs working a minimum of 4 hours shall be provided a paid 15 minute break.

H. Section 15.3.7 is hereby added to the Statement of Work as follows:

The contractor shall provide a monthly report to the Contracting Officer and COTR no later than the 15th calendar day following the month that the report is due (i.e. the April report would be due May 15th). At a minimum, this monthly report shall contain all the information found at Exhibit 11.

I. Exhibit 11 is hereby added to Attachment II, Exhibits (see attached).

J. References to “hourly” in SOW Sections 5.3.1.12 and 5.4.2.5 are revised to “monthly.”

K. For purposes of satisfying the contingency round requirement each post shall have, at a minimum, 15 additional contingency rounds.

The following information is provided for informational purposes only:

L. Before asking any questions, please read the solicitation completely and carefully.

M. The seniority lists for the current Contracts are attached. C&D Security, SecTek, and Master Security Company are the incumbent contractors for the sites under this effort.

N. An excel version of Attachment 6 – Price Element Breakdown is attached. It is required to include a breakdown of the pricing by specific Building. The Government does not guarantee that the formulas within the spreadsheet are correct. If contractors choose to use the spreadsheet, they should check all calculations for accuracy.

O. An excel version of Exhibit 1A – Onsite Supervisory Post Exhibit is attached.

P. Word versions of Attachment 3 – Past Project Form and Attachment 4 – Past Performance Questionnaire are attached.

Q. With regard to questions concerning the CBAs, the Government will not interpret provisions of these documents for potential offerors (e.g. supervisory positions etc.). Please refer to the applicable Federal Acquisition Regulations and Code of Federal Regulations as they relate to the Service Contract Act.

Service Contract Act price adjustments pursuant to FAR 52.222-43 will be conducted on the anniversary date of the contract (i.e. May 1, 2013, May 1, 2014 etc.).

R. Reference Paragraph F of this Amendment, failing to price out relief in accordance with this section will result in your price being determined to be unrealistic for this requirement.

S. With regard to questions concerning the training of incumbent PSOs, most of the PSOs are trained in accordance with most of the requirements of the solicitation; however, there are some notable differences.

The current Contracts do not require body armor or OC spray (and the associated training). In addition, PSOs will have to qualify with their individually assigned weapon semi-annually. The current Contracts require annual qualification. All contract PSO personnel must meet the requirements of the solicitation before they can work under the new awarded contract. The current Contracts require the 9mm handgun.

Please note that shotguns are not required under this solicitation.

T. With regard to questions concerning medical standards, note that the instant solicitation’s requirements differ from the requirements in the current Contracts. All contract PSO personnel must meet all the requirements of the solicitation before they can work under the new awarded contract.

U. With regard to questions concerning implementation of FPS/PTS and assignment of the associated personnel identification numbers (PINs), the following applies: PTS is not currently operational.

Information regarding PTS and assignment of PINs shall be provided post award and upon full implementation of the PTS. DHS Form 139 will be utilized prior to PTS implementation, and then only when PTS is not operational.

V. With regard to questions concerning the incumbent PSO training records, as the incumbent contractors maintain all training records, the Government cannot guarantee which records will be available to the successor contractor although the Government will make its best efforts to obtain all training documentation for the successor contractor. PSOs shall have all training records in relation to the contract’s requirements in order to stand post under this effort.

W. With regard to questions concerning potential site visits, site visits will not be provided to potential offerors.

X. With regard to questions concerning GSA Schedules, the following applies: This RFP is not for a GSA Schedule acquisition conducted in accordance with FAR 8.4; therefore, offerors are not required to have a GSA Contract and the Industrial Funding Fee (IFF) does not apply.

Y. With regard to questions related to current levels of supervision, this is not considered relevant to the present requirement as the Government is looking for an offeror’s approach to supervision at these facilities. When filling out the onsite supervisory post exhibit (Exhibit 1A), productive posts (Exhibit 1) shall not be converted to supervisory posts. Please note that only onsite supervision shall be listed on this exhibit (e.g. shall not include Contract Managers, Trainers, Quality Control, Etc.).

Z. With regard to questions concerning weapon storage, there are areas designated for weapon storage at most or all of the sites included under this effort. Space for contractor personnel will be at the discretion of the individual agencies as well as use of computers, fax machines etc..

AA. Please include your representations and certifications as well as the SF 1449 and signed amendments with your price proposal. If these documents are included in the technical proposal, they will count against the page limitations. Continuation pages for the Past Project forms do not count against the page limitations.

BB. In relation to the post exhibit (Exhibit 1), all posts are armed. Further, “M-F” posts exclude federal holidays while “7 days” posts include federal holidays.

CC. Please note that all supervisory personnel shall be trained, uniformed, equipped and armed per the contract requirements.

DD. Currently, security officers do not have PIV cards and will be required to obtain them under the contract awarded from this solicitation. Costs to obtain these PIV cards (e.g. travel costs) shall be included in an offeror’s pricing.
