Exhibit 9C
Nuclear Regulatory Commission (NRC) Drug Screening Requirements
The following drug testing requirements are applicable to any PSO assigned to an NRC facility.
Note: The NRC drug testing standards are in addition to, not in lieu of, current FPS drug testing requirements.
9C-1: The NRCs Headquarters Assistant Drug Program Coordinator (ADPC) shall be responsible for implementing and managing urine specimen collection and drug testing of PSOs assigned to NRC locations in accordance with Department of Health and Human Services Mandatory Guidelines and NRC’s Contractor Drug Testing Program. Upon request, NRC will provide to FPS and the Contractor information (e.g. internal policies, directives etc.) concerning its Contract Drug Testing Program
9C-2: The NRC Headquarters ADPC function is carried out by the Drug Program Manager in the Division of Facilities and Security, Office of Administration.
9C-3: The NRC Drug Program Manager will schedule drug testing for all PSOs. The Drug Program Manager will coordinate scheduling with the COR and Contract Manager to ensure continuity of PSO operations.
9C-4: PSOs shall be subject to pre-assignment, random, and NRC-Directed drug testing.
9C-5: A negative pre-assignment “applicant” drug test result must be received prior to assignment to an NRC facility.
9C-6: Random testing will be conducted at a target annual testing rate of 50 percent of all NRC contractors, (to include those PSOs working under this contract at NRC locations) at a frequency of at least one time per year and no more than three times a year, in addition to a pre-assignment (applicant) drug test.
9C-7: All sample collection, testing, and review of test results shall be conducted by the NRC "drug testing collection contractor, laboratory and Medical Review Officer." Notice of results will be immediately provided to the FPS COR and PSO employer. Sample collection may be conducted at the NRC facility or at the NRC’s drug testing contractor’s facility.
9C-8: PSOs who receive a verified positive drug result, an invalid test result that cannot be medically justified, or who refuse a drug test will be immediately removed from working at NRC locations by direction of the CO or COR and permanently disqualified from working under any FPS contract.
9C-9: PSOs found to be using, selling, or possessing illegal drugs while in a duty status will immediately be removed from working at NRC locations; removal shall be at the direction of the CO or COR.
9C-10: PSOs, PSOs employer, and the COR will be immediately notified of conditions requiring the denial or revocation of the individual's authorization to perform duties at NRC locations;
removal shall be at the direction of the CO or COR.
9C-11: Due process procedures under NRC's Drug Testing Program are not applicable to PSOs.
PSOs will be subject to the procedures and terms of their employment agreements with their employer.
9C‐12: Cost for collecting, testing, and reviewing test results will be borne by NRC. Any cost associated with filling post(s) that are vacated by a PSO for purposes of drug screening shall be borne by the contractor.
