L.2.1.1, Tab B, Section 1, Factor 1 and
Collective Bargaining Agreement (CBA) Page
No. RFP
Executive Order (EO) No. 13495, Nondisplacement of Qualified Workers Under Service Contracts, requires contractors to offer the right of first refusal to employees working as “service employees” under the Service Contract Act (SCA). The SCA definition of service employee does not include personnel who work in supervisory or management positions. This would normally mean that the RFP positions of Sergeant would not be covered by the SCA.
However, the CBA provided with the RFP incorporates Sergeants as SCA-covered employees, thereby including them in the Area Wage Determination (AWD) under the SCA.
Therefore, there is an inherent conflict between the SCA provisions of the RFP and the EO, regarding the right of first refusal for the Sergeants. Please resolve this discrepancy.
Sergeants have been traditionally incorporated into the CBA for this requirement despite their supervisory status. Our expectation is to have them covered for this effort as well.

13 Sec. L L.2.1.1, Tab B, Section 1, Factor 1, RFP Page
Executive Order (EO) No. 13495, Nondisplacement of Qualified Workers Under Service Contracts, requires contractors to offer the right of first refusal to employees working as “service employees” under the Service Contract Act (SCA). Section L requires the submission of resumes and/or letters of intent for several positions, including the Desk Sergeants and EMT-Certified Officers. Non-inclusion of these resumes will disqualify an offer from consideration for award. These positions are incorporated into the CBA and associated AWD, and are therefore covered under the SCA.
Therefore, Executive Order 13495 requires the successful awardee to offer the right of first refusal to incumbents in these positions. This gives the incumbent contractor an unfair competitive advantage, as other offerors may not be able to obtain resumes from the incumbents, and may exclude qualified offerors from being considered for award. We request that the requirement for resumes/letters of intent for these two labor categories be removed, to comply with the EO and to ensure a fair and open competition.
The seniority roster was provided as Attachment 8 to provide a list of incumbent personnel. The resume requirement will not be removed.

14 11.4 7, Page 43 The DCJS license is typically associated with the licensing requirements for the Commonwealth of Virginia. The Metropolitan Police Department for Washington D.C. issues a Special Police Officer (SPO) license, however only provides a license to personnel who carry the .38 caliber firearm, the approved firearm for carry in Washington D.C. by private security officers.
Since PSOs on this contract carry a semi-automatic firearm, an SPO license and associated protections would not be recognized by the MPD. Given this discrepancy, will the government confirm that PSOs do not need to be licensed as SPOs? In order to ensure consistency of training and parity among offerors, will the government confirm that all offerors are to deliver training to the standards required by the Virginia DCJS?
The DCJS license requirement can be from a similar training or licensing program/service as stated from any state.
A Special Police Officer license from the District of Columbia would be a comparable training program / license, but SPO licensing is not required by this contract.
Please see revised Section 11.4.
15 15.3 1, Page 54 Per section 15.3, the government requires the Contractor to provide vehicles. Exhibit 10 (Contractor-Vehicle Requirements) is blank. The previously asked questions identify three vehicles being associated with this contract. Will the government confirm that three vehicles are still required and provide the estimated annual miles required for each vehicle?
The Government does not require a specific number of vehicles, but vehicles are required and necessary. The current number of vehicles is 3.
Annual estimated miles is 4,000 which includes patrolling campus, fuel runs, and possible training transportation.

4, Page 108 Offerors are to provide resumes and letters of commitment for all key personnel. Is it the government’s intention to displace all key personnel currently assigned to the contract? If not, will the government allow offerors to contact incumbent personnel for the purpose of proposing them for this new contract in accordance with the solicitation requirements?
If not, will the government consider revising the key personnel requirement for resume submissions to encompass solely the Program Manager?
The government will not revise the key personnel requirements. Offerors are required to provide resumes and letters of commitment for all key personnel. It is up to the offeror to determine if they want to propose incumbent or new personnel.
17 Exhibit 10 Uniform table, Page

23 1149 LO, Page 2 Please provide definition on the term LO.
Should the contractor provide annual costs for the total of all labor categories?
LO is defined as Lot. We would like you to project out the hourly rate per the eight (8) labor categories and multiple that by the number of hours provided in Schedule B and then add up that total price for the base year and each option year. That total price will equal one (1) LO for CLIN 0001, 1001, 2001, 3001 and 4001.
24 CPT NWDTP Are any of the incumbents NWDTP Certified? If so, how many?
Estimated 90% of incumbents would meet the weapons detection training requirement.
25 CPT Active Shooter
Do any of the incumbent staff meet the initial sixteen (16) hour Active Shooter Training Requirements? If so, how many?
This is a new requirement.
26 CPE Weapon The government indicated that they are currently utilizing the Glock 23, .40 caliber under this effort. Can the contractor change this weapon to a 9mm?
No the requirement is to use .40 caliber ammunition.
27 RFP Factor 1, The Government has requested resumes for several key personnel under the contract.
Two of the roles, Desk Sergeant and Emergency Medical Technician (EMT) Certified Officers are dictated by the Collective Bargaining Agreement and under FAR Part 52.222-17 Nondisplacement of Qualified Workers the contractor who was awarded this contract would be required to hire the incumbent officers for these positions. As a result, can these positions be removed from the technical submission requirements?
The offeror is not required to hire these individuals, but is required only to make a bona fide express offer.
No, the positions will not be removed from the technical submission requirements.

This is a new requirement.
33 RFP Radios, RFP indicates that the government has provided radios for PSO use but that the contractor is provided to obtain a frequency permit / license. Please clarify.
The Government currently provides 50+ radios for the contract security force.
Additional radios are recommended (15- 20, see question #36). A permit or license would be necessary if/when providing additional radios
34 RFP Gun Lockers, The RFP states the Contractor shall provide applicable accessories such as clearing barrels; trigger locks, gun lockers, cleaning products, etc. Please identify if there are any on site accessories that will be available to the contractor. If not, how many of each of these items is required.

Key Personnel Resumes – Are Desk Sergeants required to meet the same qualifications (2 years of specialized experience – supervisory experience within the military, law enforcement agency, or security force, administrative responsibilities, management, staffing, and scheduling of a workforce, and inspection and operational compliance) as the Lieutenants?
Yes
36 Exhibit 10
3 Section 3: The Communications Equipment Requirement states that the contractor shall provide, maintain, and supplement, as may be necessary at the site identified above the following number of radios/cellular phones and described associated equipment to equip each security officer on post a method to communicate with FPS. In the table that follows this paragraph, no Quantities are provided.
Would the Government please provide the missing quantities? Could the Government please provide the make, model and frequency required for the communications equipment?
This is a typo in the exhibit, it should state communicate with FPB, not FPS.
The Government suggests 15-20 additional radios.
Current model: Motorola, XTS 2500.
Additional models must be compatible with current model and frequency spectrum.
Please see revised Exhibit 10.
37 Section II
5.1
Does the government want the contact information (mailing address, email address, and telephone number) provided for Key Personnel with their resumes or after contract award?
Please do not provide personal contact information on the resumes.
38 Section II
5.1
The RFP states, "Key Personnel resumes not submitted with the proposal are due 10 calendar days after award." Could the government please clarify which Key Personnel resumes should not be submitted with the proposal?
If your company is proposing a number of individuals beyond the number of key personnel required for Factor 1 (see section IX, 2.1), resumes for those individuals are to be submitted after award.
Please see revised page 20.
Question Answer Resulting Change to
39 Section II
5.5
The requirement for Command Center Personnel requires a minimum of six months on the future contract. How should the Offeror demonstrate compliance with this standard for the proposal purposes? Are we allowed to propose Officers with similar command center experience at other similar sites?
Yes, during the transition phase officers with similar experience will be acceptable but will be required to achieve the 16 hours of Command Center OJT upon their selection. The full requirement will be adhered to 6 months into the base year.
40 Section II
5.5
Section 5.0 of the SOW identifies Command Center personnel "to include Desk Sergeant" as key personnel. However under Section IX instructions, conditions, and notices: in 2.1.1 Technical proposal, Tab B, it seems that under Key Personnel, Command Center Personnel are identified only as "Desk Sergeants". Should the Dispatchers and Alarm Monitors also be identified as Key Personnel or only the Sergeants?
The government is requesting key personnel resumes for the “Sergeant” position only because all other positions referenced as Sergeant (e.g. Desk Sergeant, Alarm Monitor and Dispatcher) would be differentiated by on the job training post award.
41 Section II
6.1, 6.9 Page 23 and
The eligibility of resident aliens contradicts the paragraph 6.9 requirement to achieve a security clearance for all PSO and administrative personnel to be cleared at the Secret level.
Could the Government please clarify the requirement?
The contradiction is not apparent upon our review.
42 Section II
6.2.2 Page 23-24
Will incumbents be required to pass the Physical Efficiency Battery (PEB) standard prior to contract start or will they be grandfathered in for the duration of the transition period?
Yes. A 120 day grace period will be authorized for all incumbents to meet the requirement.
Question Answer Resulting Change to
43 Section IX
1.3
Would the Government consider allowing a reduction in font size for Tables and Graphic to 10 point Arial text to aid in readability and formatting?
Yes, for Tables and Graphics a 10 point Arial font is acceptable.
Please see revised Section IX, 1.3.
44 Section IX
2.1.2
Statement: Therefore, Supervisors are not covered under the Service Contract Act and increases to Supervisor wages and fringes are not subject to contract price adjustment under FAR 52.222-43. As a result, any escalation associated with these supervisory costs, including wages and benefits, should be included in the price proposal. Question: As Sergeants and Lieutenants are Supervisors for the PSOs. Sergeants are covered under the CBA which shows a wage determination. Lieutenants are not. Could the Government please confirm that Sergeants are subject to contract price adjustments under the FAR?
Sergeants have been traditionally incorporated into the CBA for this requirement despite their supervisory status. Our expectation is to have them covered for this effort as well.
45 Schedule B and Attachment
12-Post Exhibit
1.1
The hours provided in the CLIN Structure Tables in Schedule B do not reconcile with the hours provided in the Attachment 12 - Post Exhibit.
Could the Government please provide clarification around the required hours?

Pre-employment drug screening is currently required. The frequency is a new requirement.
48 Section II 7.1.2
The SOW states, "The Contractor must provide a replacement PSO for each employee on an authorized break where the Post exhibit specifies relief/continuous coverage". Neither the state requirements nor the CBA provide guidance on comfort breaks that need to be given to the PSOs. It is recommended that one fifteen minute relief break should be given to PSOs for each 4 hours of scheduled work. Please confirm if the stated comfort break schedule is required by DHS OCSO FPB.
The schedule of breaks and the coverage of posts during the breaks is for the contractor to determine as part of its proposal.

n Page 113-
The description of the briefing includes two sets of requirements. The first listed requirements states "The Offeror shall address the following:
weapons qualification process, equipment training (metal detectors, x-rays, CCTV, handcuffs, baton, and firearms), record keeping procedures (electronic time and attendance and certification requirements), staff accountability process (penalties for non-compliance), and process of protecting a Level 5 Security Facility 24/7." Then later in the same section, 17 distinct bullets and sub-bullets are offered of information that offeror's should address in the briefing, some of which that are not directly related to the first set of criteria on page 113. Is it safe to assume that the Government is not dictating the order in which items are to be addressed but instead providing a overall scope of what should be addressed in the order and organization of the offerors choosing (within the 20 slides)?
Correct, the Government is not dictating the order the of importance in which items are to be addressed in the briefing but the overall scope as to what needs to be included and addressed in the briefing presentation.
63 IX; 2.1.1;
Tab B;
n Page 113-
It is stated that the Government may ask clarifying questions. Should offerors allow for a set amount of time at the end of the presentation to answer these questions or will questions asked/answered be in addition to the one hour time allotment?
Offerors will have the full hour for their Technical Proposal Briefing and their Scenario challenge. If the Government chooses to ask clarifying questions then it will be after the completion of the one hour allotment time slot.
Question Answer Resulting Change to
RFP
64 Do the individuals being proposed for the required resume positions have to have a current / active security clearance at the time of submission? Or can the individual have interim or be in the process of their clearance renewal at time of submission.
Individuals being proposed can have interim or be in the process of having their clearance renewed.
65 The RFP includes a process for each new hire to be approved for EOD similar to the standard FPS Suitability process. Can you explain the process required for this EOD through ISMS?
All potential employees must possess a Secret (or above) clearance from DOD.
They will then be submitted to DHS Personnel Security for processing/review. By the end of this process the employee must have a clearance and a favorable final fitness determination.
66 The ISMS process seems to be required even though new candidates must have at least a Secret clearance and in many cases a TS. Would the Government consider removing or expediting this requirement for new hires who have a valid clearance?
This is not allowed per DHS policy. The Personnel Security Division follows DHS protocol and grants approval or denial (fitness and clearance status) for this contract.
67 Will PSOs with an existing FPS Suitability be given a waiver for the ISMS process?
No, this is not an FPS contract nor is there reciprocity between suitability and fitness determinations
68 Historically, the ISMS process has taken an average of over 90 days plus delays in getting PSOs read on to the SCI, with a dozen recent candidates taking as long as or currently waiting more than 100 days for approval – the longest of which is over 210 days. What is the Government doing to streamline the process to assure contractors that new staff will be processed in a more reasonable timeframe?
The length of the process depends upon the individual, their background, and the timeliness with which their documentation is submitted.
Question Answer Resulting Change to
RFP
69 Will the Government consider paying overtime when the EOD process exceeds 60 days or when the manpower drops below 75% of the projected staffing need?
No
70 Can you confirm that there is no FPS involvement in the proposed contract, ie: no FPS inspectors, CORs, PSO PMs, etc?
Confirmed, this contract is strictly under DHS Management’s component and managed by the Force Protection Branch within the Office of the Chief Security Officer.
71 If above is true, can you confirm that there are 15 LEOs on site as part of FPB who has jurisdiction over the proposed contract who participate in the enforcement of on-site standards, rules and daily activities?
This information cannot be shared at this time.
72 The orals are a new component of the bid requirement. Are they evaluated separately?
Yes. They are evaluated as a separate factor, Factor 2.
73 If not evaluated separately, are the orals evaluated as part of the MA?
No they are evaluated separately as Factor 2, Technical Capabilities and Understanding. Please refer back to Section X Section Factor 2.
74 If not, are the orals evaluated at all?
The oral presentation is evaluated as Factor 2. Please refer back to Section X Section 2.
75 Can the Government confirm that all EMTs, whether current or future personnel, are required to possess complete armed PSO qualification, as well as a Secret clearance, in addition to their certification as an EMT through the National Registry?
Yes, all qualifications apply to the EMT position.
Question Answer Resulting Change to
RFP
76 The new RFP has a requirement for active shooter training. It appears from the language that this is a contractor responsibility but that the course needs to be approved by DHS. Has anyone been approved yet to provide such training?
No, the contractor will present proposed providers for this training to the Government.
77 If not, how long will it take to get DHS approval on a new active shooter class and what are the requirements for that approval, for instance if we develop our own curriculum will that be acceptable or does it need to come from an already accredited program?
3-5 Business days for approval or denial.
78 The language of the RFP requires that officers qualify with their duty weapon on the range. This means that the since there are no ranges in Washington, DC, the successful offeror will be required to transport weapons across state lines and back again into the District. Will DHS provide a letter of transfer that will allow a contractor to transport weapons to and from the range?
The offeror is responsible for ensuring proper licensure of firearms and meeting state requirements for their transfer.
79 It appears that the deduction schedule in sections 17 & 18 are a new requirement. How stringently will these provisions be enforced at the start of the contract? Is there a 6 month grace period before these deductions kick in, especially considering the length of time required to get EOD for new hires is extensive?
A grace period of 90 days after the transition period ends will be permitted.
See revised Section II, Subsection 17.1
Question Answer Resulting Change to
RFP
80 Given the size of the campus and the requirement that every officer must report to roll call prior to standing post, has the Government prepared any type of a walk time survey to determine how much additional time is required for each officer to get to post from roll call?
The 30 minute roll call consists of 25 minutes roll call briefing prior to the start of shift and 5 minutes added at the end of the shift for “walk time.”
81 If none, does that suggest that walk time to post is included in the 30 minutes of roll call or is roll call expected to be officers in their seats for the full 30 minutes?
See question # 80 above.
82 In the same fashion, each officer must return to the ready room for gear down at the end of their shift. How much walk time and gear down time is included in the post schedule for each post?
See question #80. No additional walk time is included in the post exhibit/schedule.
83 The RFP includes an attachment with the DoL WD, which is the CBA between the incumbent and the Union. It has since expired. Based on FAR, are bidders expected to price the last know economic provisions in the CBA?
The CBA was extended when the current contract’s Period of Performance was extended. Please use the last stated wage.
84 If not, will this revert to the Washington area Wage Determination at contract start?
Please see the response to #83 above.
