BLOCK 14 CONTINUATION SHEET
SUMMARY OF CHANGES
c. The following are a result of contractor inquiries and is presented in a Question (Q) and Answer (A) format:
SECTION B
Q1: Section B, CLIN X004 Urgent Roleplayer Hiring: Is this CLIN to be used for the administrative and management cost of hiring a roleplayer on an urgent time schedule, above and beyond existing roleplayers on staff?
A1: Yes. Refer to Section C.2.1.1 e.
Q2: CLINS X009 and X010 include a lump sum amount for these line items, but then indicate
“DO NOT PRICE”. Please advise if that means that offerors should leave that line item blank or if we should include the lump sum provided in the RFP.
A2: Yes, leave the line item blank. No, do not include in proposal.
Q3: Section B, CLIN X011, Lead Roleplayer (AFOSI CTO, Ft. Dix, NJ): (a) Do these lead roleplayers require a secret clearance? b) If so, will the Government provide separate CLINs for pricing?
A3: (a) Scheduled Lead roleplayer will be required to have a Secret Clearance as applicable to CLINS X012 and X013.
(b) See CLIN X011, this refers to Annex E-1, paragraph E.2.1.g.
Q4: Section B, CLINs: Does the Government desire separate Lead Roleplayer pricing blocks at the FLETC location, similar to CLIN X011 (which is for AFOSI, Ft. Dix)?
A4: No.
Q5: Section B, CLINS X011 through X017 asks for pricing in either 1 or 2 hour blocks of time. (a) What is the Government’s intent in having some CLINS 1 hour blocks and others 2 hour blocks? (b) Will the contractor be allowed to bill for time roleplayers need for preparation before and after each exercise?
A5: (a) The two-hour block: minimum scheduling requirement for exercises requiring roleplayers. The 1-hour block: any additional time beyond the two-hour block ordered in at least 15 minute increments.
(b) Refer to Section C.2.1.4, C.2.1.5. and C.2.1.6 for pre-performance, performance and post performance requirements.
Q6: Section B, CLIN X018, Prop and Safety Equipment (AFOSI CTO, Ft. Dix, NJ) … Will the Government provide the storage area for prop and safety equipment at Ft. Dix or will this be the responsibility of the contractor?
A6: Yes, the USAFSIA will provide storage for props, safety equipment, weapons and ammunition. The USAFSIA will maintain props and distribute to the roleplayers at the beginning of the training exercise. During the exercise, maintaining the props will be the contractor’s responsibility. Props will be returned to USAFSIA at the end of the exercise. The USAFSIA will provide simunitions equipment, munitions, and protective gear for contract roleplayers. Annex E-1, Section E.2 (f) is changed to read “RESERVED”; see added statement above in Annex E-1, Section E.2.8.
Remove and replace page 49 thru 51 attached to this amendment.
SECTION C
Q7: Section C.1.2.1: Section states, “A designation letter shall be included with the resume of all management personnel for approval by the CO.” Is a designation letter required for all management personnel, or just the PM/APM?
A7: Designation letters/resumes are required for ‘contract management personnel’ only (See paragraph c of this section). Management personnel would include PM/APM and QCM as well as any additional management positions you are proposing.
Q8: Section C.1.2.3.n. The Contractor shall provide a photograph of all employees. The initial CD shall be provided to the COTR no later than 15 calendar days after the award of the contract. The time line seems very short for a new contractor. Would the Government consider extending the time to 25 days after award of the contract?
A8: No this paragraph will remain unchanged. Various scenario packages require the contractor to electronically provide photographs and biographical information of scheduled roleplayers, as well as, simulated drivers licenses, government ID’s, and other types of identification. The contractor will be required to furnish all paper and laminating supplies related to this requirement.
Q9: Section C.1.2.3.j: Please define “participating service providers.” Does this include outside vendors in addition to roleplayers and/or independent contractors?
A9: Paragraph j shall be deleted. Remove and replace page 24 attached to this amendment.
Q10: Section C.1.3, Government Required Training: Contractor shall, at no cost to the
Government, make appropriate contract staff employees available… If this is training required by FLETC, should it not be a chargeable to this contract in accordance with FAR 31.202? How often will such training be conducted? How many hours will such training last?
A10: Refer to revised Section H.1.1 (b). Remove and replace page 65 attached to this amendment.
Q11: Section C.1, paragraph 1: How many hours of Government training are anticipated, per employee, during an annual period.
A11: Can only assume you meant to reference paragraph C.1.3 since paragraph 1 of the
SOW does not reflect government training requirement; therefore, see answer to Q&A10 above.
Q12: Section C.1.5: The contractor shall provide S4LEOT services to include any associated transportation costs in the Glynn County, Georgia, commuting area and scheduled roleplayer services at the Fort Dix. What is the Glynn County, GA commuting area?
A12: As stated in this paragraph, refer to the Federal Travel Regulation for a definition of the commuting areas for both locations.
Q13: C.1.6.3, 6-day work week: How will Program Management time be accounted for? If there is a 6-day work week within a given month, would the contractor invoice for one 6-day work week (CLIN X003) and a partial month (based on remaining working days) against CLIN 0001?
A13: Historically, a pre-determined date to effectively begin a 6-day work week schedule has been determined and normally lasts for a period of months; however if a 6-day work week schedule was implemented in the middle of a month; the respective CLINS ( X001 & X003) would be prorated & invoiced for accordingly.
Q14: Section C.1.6.4: FLETC closure: Please clarify whether ODC travel incurred is reimbursable if labor is not required due to closure?
A14: No, it is not reimbursable.
Q15: C.1.7, Contractor Required Plans… shall be submitted to the Contracting Officer within
15 days after contract award. Please confirm that the 15-day requirement does NOT apply to C.1.7.4 (Contingency Plan).
A15: You are correct in your statement. The note has been revised to add “unless stated otherwise”. Remove and replace page 26 attached to this amendment.
Q16: C.1.7.1.f states “the Contractor, …, shall be conclusively presumed to have actual knowledge of work not performed, and that therefore a written notice shall not be a prerequisite for reducing payment or assessing liquidated damages for non performed service(s).” Is there an established dispute process?
A16: See Clause I-1, FAR 52.233-1, Disputes.
Q17: C.1.7.8, Employee Roster: This requirement appears to be an unduly restrictive specification. It effectively excludes new contractors from competing for this procurement, particularly when the submittal is prior to contract award. It is unreasonable to expect all non-incumbent bidders to have 150 employees “available” before contract award. Will the Government please re-write the specification of paragraph C.1.7.8 to allow full and open competition, or remove the requirement from the solicitation?
A17: You have misinterpreted this requirement. Paragraph C.1.7.8 a, states “Fifteen (15) calendar days before the start of the contract”; not prior to contract award.
Q18: Section C.1.7.8: Employee Roster: Please define or clarify whether incumbent contractor employees are precluded or allowed to be hired by the Offeror – are there any terminal noncompete provisions of which Offeror should be aware?
A18: Incumbent contractor employees are not precluded and can be hired by the any offeror. Refer to Section H.29a Phase-Out/Contract Completion. Consistent with efficient performance of this contract it is the intent of this paragraph that should award be made to other than the incumbent a good faith offer is made to the current employees currently fulfilling positions allowing them right of first refusal to employment under the contract in positions for which employees are qualified.
Q19: C.1.7.8.a., Employee Roster: Fifteen (15) calendar days before the start of the contract….…Provide a written roster of at least 150 qualified available employees… The definition of “qualified” appears subjective. (a) How will employee qualifications be evaluated for roleplayers? (b) How many weeks advance notice will the Government provide before “start of the contract”? It appears that the intent may be the end date of the transition period. Please confirm.
A19: (a) Refer to Section C.1.2.3, Contract Employees.
(b) Phase-in period will include “30 calendar days after contract award date”.
Refer to revised Section H.28 (b). Remove and replace page 77 attached to this
Q20: C.1.7.8.b., Employee Roster: The roster shall include printed or typed full name and original signature of each proposed employee. This requirement is unduly restrictive.
There is only one contractor (or team) who can have 150 employees “available” before contract award. All other offerors would only be able to provide a roster of contingent hires for this program.
A20: See response to Q&A17, above. The key words at C.1.7.8 b are “….. proposed employee”.
Q21: C.1.7.8.d., Employee Roster: The contractor shall provide an employee report… no more than 10 days after start of initial contract performance period. (a) Is the “employee report” a separate document from the “employee roster”? The requirement for such a detailed report within 10 days of contract award seems to unduly disadvantage any new contractor. (b) Would the Government consider extending this due date to coincide with the 15-day due dates for the other reports in C.1.7?
A21: (a) Yes, the “employee report” is a different document than the “employee roster”.
(b) The Government will not extend the submittal deadline. Paragraph C.17.8.d states ...”10 calendar days after start of initial contract performance period...” not within 10 days of contract award.
Q22: C.1.10.3., Utilities: “… Internet services are the responsibility of the Contractor…” Will separate internet services be available or will the contractor use the Government’s internet services?
A22: Internet and telephone services (other than the one (1) government provided phone line) shall be responsibility of the contractor. The Government provided computer does have LAN services; however restrictions are placed on the number of employees who have access. The government provided computer is designated solely for communicating with Government employees and sending/receiving documents related to the contract.
Q23: Section C.1.11.4: Janitorial service and trash control: Is the contractor responsible for any hazardous material handling and disposal?
A23: Refer to Section C.1.3 Government Required Training; Section H.16 Environmental
Protection and Section I.1, Clause 52-223-3, Hazardous Material Identification and Material Safety Data.
Q24: Section C.2.1.2: Will the Offerors have the opportunity to review any of the existing roleplayer scenarios in order to strengthen our technical approach and QA/QC plan?
A24: The site visit afforded attendees an opportunity to review various roleplayer scenario packages. There will be no other opportunities to review the roleplayer scenarios.
Q25: Section C.2.1.3, paragraph c, states that “…no incentive fee will be paid to the contractor, but each roleplayer will be paid two times the prevailing hourly rate applicable under the contract for roleplayers.” Will this situation result in each roleplayer being paid for 2 hours and the contractor being able to bill the Government 2 hours per roleplayer?
A25: Yes, if an exercise is cancelled at or after the start time, the Government will pay the contractor two times the prevailing hourly rate.
Q26: Section C.2.1.3, paragraph c (1) states that “incentive of four times the prevailing hourly rate for roleplayers” be paid to the contractor. Will this situation result in each roleplayer being paid at 4 times the roleplayer rate and/or the contractor being able to bill at 4 times the roleplayer rate? Is the incentive 4 times the roleplayer rate for each roleplayer provided?
A26: No, if an exercise is changed or added 12 or less hours prior to the exercise start time; then the contractor is entitled to the incentive fee of four (4) times the prevailing hourly rate for roleplayers, as stated in Section B, CLIN X006; not each roleplayer. (Example: Assume the hourly rate is $1.00; then the contractor would be entitled to the incentive fee of $4.00 ($1.00 x 4 hours) for the late change or addition.)
Q27: Could you please explain incentive pay, how it is calculated and how (if) it is passed on to roleplayers?
A27: Refer to Q&A25 and Q&A26 above.
Q28: Could you provide historical data on amount of incentive pay that has been issued in past years?
A28: Approximately 90 incentive fees for late changes, cancellations and additions were paid over a 12 month period. Approximately 45 cancellations were made at or after the start time over a 12 month period; whereby the contractor was paid 2 times the prevailing hourly rate per roleplayer affected.
Q29: Section C.2.1.3.c (2): Will the Government provide data on the number of times a cancellation/incentive has occurred during the current contract period of performance?
A29: Refer to Q&A28 above.
Q30: Does the Government expect for the contractor to participate in the development of new scenarios as new information comes in from the field?
A30: No.
Q31: Please clarify the amount of time and/or types of training that will be conducted in water or at waters edge, and what bodies of water the training will take place at?
A31: Trainees conduct waterborne arrest techniques and boarding techniques on vessels in local waterways along the Georgia coastline.
Q32: Please clarify will employees be subject to pepper spray or mace?
A32: The FLETC, Glynco utilizes inert Oleoresin Capsicum spray (O.C. spray) on roleplayers; or trainees simulate spraying OC spray.
Q33: Please clarify will employees be required to ride on aircraft? Airplanes or helicopters?
A33: No
Q34: Will roleplayers be allowed to drive themselves to and from every worksite in their POVs?
A34: FLETC, Glynco, GA: Yes, except for exercises designated in the scenario package as the Government or contractor providing a means of transportion; to be driven by a roleplayer, in order to drop off/pickup roleplayers at designated exercise sites.
Currently, the only exercise requiring the contractor to provide transportation is the Observed Participants requirement in Annex C-1.
Q35: Is a secure parking area provided for roleplayers?
A35: For FLETC, Glynco, Georgia - the facility is a secure facility meaning access clearance must be obtained before entering. If when you say ‘secure” you are referring to a fenced, locked area the answer is “no”; however, parking space is provided at the designated Roleplayer Services office, Building 29.
For FT Dix – there will be no secure parking area; however, role players may park at the training area for most of the exercises or in the immediate area of the training site.
Q36: Could you please describe where the roleplayers will be allowed to park their vehicles and the location of the area(s)?
A36: Refer to Q&A35 above.
Q37: Will roleplayers be allowed to park inside of the FLETC main gate?
A37: Yes, refer to Q&A35 above.
Q38: How will roleplayers be transported to and from their work site?
A38: Refer to Q&A34 above.
Q39: As the roleplayers are under the operational control of the Contractor once they board a contractor or Government vehicle, if the roleplayers are bussed to the worksite, will the transportation time be counted as hours worked?
A39: No.
Q40: The site visit summary indicates that contractor employees typically do not participate in live fire training exercises, indicating that there is the possibility of them participating in live fire training exercises. Please clarify whether contractor employees will be required to participate in live fire training exercises. If so, please explain the scope and extent of participation and the government precautions for their safety.
A40: NOTE: The “site visit summary” referenced in this question and others was not prepared or provided by the Government. Roleplayers are not required to participate in live fire training exercises.
Q41: The summary indicates that the COTR at the site visit was unclear on the extent of contractor employee involvement on the driving training ranges. Please clarify the scope and extent of contractor employee involvement at the driving training courses.
A41: NOTE: The “site visit summary” referenced in this question and others was not prepared or provided by the Government. Roleplayers participate in low-speed minor traffic violations type exercises throughout the Center at FLETC, Glynco, GA.
Q42: Please clarify whether physical interaction between contractor employees and government trainees will be non-violent in nature.
A42: Exercises require compliant and non-compliant interactions in the form of verbal, non-verbal and physical actions; however most scripted, violent situations are simulated.
Q43: The summary indicates that contractor employees may come into contact with hazardous materials during EPA training. Question: Please clarify extent and scope of contractor employee exposure to hazardous materials during EPA training, what training and personal protective equipment will be provided by the Government to contractor employees, and what substances the contractor employees may be exposed to.
A43: NOTE: The “site visit summary” referenced in this question and others was not prepared or provided by the Government. Hazardous materials are not utilized for training purposes; only props appearing to be hazardous materials are used.
Q44: Do you have any examples of roleplayer scenarios that you can provide?
A44: Refer to Q&A24 above.
Q45: Is the contractor providing classroom training and roleplaying exercises; or just roleplayer exercises after classroom training is complete?
A45: Refer to Section C.2.1.1.a. The contractor shall provide roleplayers to participate in reality-based training exercises. The contractor does not provide training to the trainees/students.
Q46: The synopsis stated training is on a monthly basis. Can we get a copy of a current training syllabus? (Specifically, instructional schedule per training period).
A46: No, the contractor is not required to train the trainees/students.
Q47: The synopsis states that you estimate employees at 375+. Can you explain the breakdown of the staff . . . roleplayers versus oversight, versus trainers, versus administrative…
A47: The statement in the synopsis is an estimated quantity of contract employees for roleplayers and contract staff in support of this requirement. The contractor shall determine the breakdown of the employees. Refer to Section C.1.1.
SECTION C, ANNEX A-1:
Q48: Annex A-1: There is a requirement to launder certain equipment after each use – are there laundry facilities readily available on-site for contractor use?
A48: Laundry facilities are not available on-site for contractor use. Laundry facilities are available off-center in the local area. Refer to updated Section C.1.11.2.a, for maintenance and sanitizing of props, page 32 attached in this amendment.
SECTION C, ANNEX C-1:
Q49: Annex C-1, Section 5.c: Please define the Government’s intent of the requirement
“Transportation for the OPs.” Does the requirement refer to on-base transportation or transportation to/from base?
A49: Annex C-1, Section 5.c is amended to read as follows: Transportation for the OP’s from Building 29 to the exercise site; then, after release by the Instructor, to the OP’s home or released to the pre-designated responsible driver. Remove and replace page 41 attached to this amendment. Also, refer to page 43, Section 6 f Part
IV.
Q50: Are these OP’s transported to and from their homes by the Contractor due to the limitations on Driving that participation in this event causes?
A50: Refer to Q&A49 above.
Q51: Section C, Annex C-1, 6: Will employees be required to drive automobiles, mobile equipment and/or boats for this workshop?
A51: No.
Q52: Section C, Annex C-1-1, Paragraph 2, a: Will employees’ general health information be collected, and if so, will it be protected in a HIPAA-compliant fashion?
A52: No.
Q53: What are the quantity and class of the current contractor vehicles used in transportation of
Observed Participants for the Field Sobriety Testing Workshop?
A53: The current contractor provides a 15-PAX van.
Q54: a) When does the clock start/stop on Field Sobriety Testing? b) If we are providing a safe ride home, and still have control over that employee, are these work hours to be paid and billed?
A54: a) Annex C-1: OP hours begin at the start time of the exercise and OP hours end when the OP’s breath alcohol content is. 05% or less in conjunction with the instructor’s release. b) This time is not included in the scheduled exercise time.
Q55: Annex C-1 under specific requirements, it is listed that “No participant shall be 50 or more pounds overweight”. What guidelines are to be used as a baseline for weight standards?
A55: Refer to the National Institute of Health (NIH) guidelines.
Q56: Annex C-1-1, we have concern with several items in this annex, they are as follows:
Page 44, No. 3 where the employee states, “I must not have any known significant physical impairment”. Page 42.e, Health Requirements: “No participant shall be 50 or more pounds overweight”; “No participant shall be 65 years of age or older”. As an employer we need to be concerned with the Americans with Disabilities Act, and laws that prohibit discrimination against the individuals with, or perceived to have, disabilities or physical impairment. Also, Title VII that addresses disparate impact, which is a policy or action that seems neutral but nevertheless adversely affects a protected class – in this case, age with the limitation of participants who are over 65 years of age. Under what guidelines are these criteria established?
A56: The guidelines established by the National Highway Traffic Safety Administration.
Q57: Annex C-1: Is this OSHA and HIPPA compliant? (We provide employees; are employee resulted injury or illness covered by worker’s comp in Georgia and NJ if employer requires them to consume alcohol? (IE: what about related alcohol diseases, etc?)
A57: Annex C-1 applies to FLETC, Glynco, Georgia only. See Q &A56 above. Refer to pages 44 – 46 of the solicitation.
Q58: We’re also wondering about HIPPA requirements (as cited by the FAR) but note that detailed health histories and personal questions may be required.
A58: Detailed health histories and personal questions are not required. Refer to pages 44
– 46 of the solicitation.
SECTION C, ANNEX D-1
Q59: Annex D-1, 2.a.: “provide a mode of transportation .…have a cargo bed” For what specific purposes will the ATV be used? Why does it need a cargo bed? This information is required to obtain proper insurance.
A59: Annex D-1, 2.a. states a “gas powered utility all-terrain vehicle ….. or small truck”, which will be used for transportation in support of this requirement. The cargo bed is needed in order to ensure furnishings are in proper configuration.
SECTION C, ANNEX E-1
Q60: Annex E-1, Section E.2.1.g: (a) Please clarify or define contractor-required “all transportation costs”, who does this include? Contractor management? Trainees, themselves? (b) Please clarify or define with regards to specified travel unit cost NTE $1,000? Is that per person or per task?
A60: (a) Annex E-1, Section E.2.1.g is changed to read “Reserve” and numbering of
Section E.2.1. has been updated. Remove and replace page 49-50 attached in this amendment.
(b) CLIN X010, Reimbursable Travel Expenses, is an estimated cost reimbursable CLIN in reference to Section C.1.11.2.(c). The Contractor will be reimbursed, when necessary, IAW the Federal Travel Regulation.
Q61: Annex E-1, p. 50 paragraph 8 gives historical data for exercises at Ft. Dix. How many exercises per year does the Government anticipate at Ft. Dix?
A61: The following data is provided on exercises per year: CTOC - Basic: 9 courses - 1 day of exercise in each course; CTOC - Advanced: 9 Courses - 4 days of exercises in each course. This info is added in Annex E-1, paragraph E.2.7 (f), see revised page 51.
Q62: Annex E-1, E.2.d.Contractor shall provide ten blank firing AK-47 rifles and 2 blank firing shotguns as needed. a) Will FLETC issue authorization to carry weapons onto the
Army Base (in NJ)? b) Will the Government provide a suitable armory/con-ex box for proper storage during non-use?
A62: a) No, refer to Q&A80 below.
b) USAFSIA will provide storage for all weapons and ammunition when not in use.
Q63: Annex E-1 para E.2.1.d: Annex E-1, paragraph E.2.1.d states "The contractor shall be responsible for the safeguarding and storage of all weapons and ammunition." Getting weapons and ammo of any type onto a military installation can be a challenge and typically requires significant coordination. Is there an existing SOP/accepted practice for getting weapons and ammo onto Fort Dix, New Jersey, for these exercises.
A63: The weapons will never enter the secured perimeter of Fort Dix. All weapons are used in the range complex, which has access via public road systems. When storage is required, USAFSIA personnel will hand receipt the weapons into our possession and transport them to a storage facility.
Q64: Annex E-1 para E.2.4: Annex E-1, paragraph E.2.4 states "All props will be furnished by the USAFSIA except for protective simunition gear, weapons, and ammunition." Please provide specific quantities for simunition protective gear. It is unclear as to whether the weapons and ammunition referenced in paragraph E.2.4 are simunition weapons and simunition ammo or blank firing weapons and blank ammunition. Please clarify. If the contractor is required to provide the simunition weapons and ammo, please specify quantity of weapons by type of weapon and quantity of ammunition (rounds) per weapon per type of weapon to include color of rounds.
A64: USAFSIA will provide the simunitions equipment, munitions, and protective gear for contract roleplayers. See revised Section E.2.3., page 50 attached to this
Q65: Annex E-1 para E.2.1.j and E.2.5: Annex E-1, paragraph E.2.1.j states "The contractor shall issue, maintain, and clean all props as needed to ensure props are available at all times. The contractor shall furnish individual bags for the issuance of props to each roleplayer." Based upon paragraph E.2.1.j, the requirement to issue, maintain and clean the props makes it appear that the contractor will be in possession of the USAFSIA props.
Paragraph E.2.5 states "The USAFSIA does not provide operating facilities on the base for the contractor and the contractor will not be required to provide a facility outside of the base." In order to assess how to best plan for the logistical impact of the prop operation in support of USAFSIA, please provide a list of the USAFSIA props including quantities. If these props are included in Attachment 3 - Govt Furnished Property, please delineate the location of each item in the list.
A65: USAFSIA Detachment 1 will maintain props and distribute to the roleplayers at the beginning of the training exercise. During the exercise, maintaining the props will be the contractor’s responsibility. Props will be returned to USAFSIA at the end of the exercise.
Q66: Annex E-1 para E.2.1.j: Annex E-1, paragraph E.2.1.j states "The contractor shall issue, maintain, and clean all props as needed to ensure props are available at all times. The contractor shall furnish individual bags for the issuance of props to each roleplayer."
Please provide approximate dimensions of the individual bags required for prop issuance.
A66: USAFSIA will maintain props and distribute to the roleplayers at the beginning of the training exercise.
Q67: Annex E-1: Are there restroom facilities, portajohns and water sources available in each
USAFSIA training area?
A67: Not all training areas have restroom facilities, portajohns, or water sources available. There are portajohns located at various sites in the range complex.
Personnel primarily use bottled water while at the training sites.
Q68: Annex E-1: What is the name of the incumbent contractor and the size of contract?
A68: Gold Belt Eagle; Size of Contract – FY2009 estimated value is $465K.
Q69: Annex E-1: Are the roleplayers government employees or contract?
A69: The roleplayers are all contract employees.
Q70: Annex E-1: What is the current pay rate? If they are employees, has the rate been conformed?
A70: The current pay rate for Roleplayers at Ft Dix is $14.24/hr. Refer to Section J, Attachment 1d, Wage Determination No 2008-0082, Revision 3, dated 05/26/2009, attached in this amendment.
Q71: Annex E-1: Do roleplayers stay on base overnight for these exercises?
A71: Roleplayers are not billeted on the installation during the exercises.
Q72: Annex E-1: Is the contractor required to provide meals?
A72: Meal arrangements for contract personnel are solely between the contractor and their employees.
Q73: Annex E-1: Will the cost for simunition gears (paragraph 4) be reimbursable?
A73: USAFSIA will provide the simunitions equipment, munitions, and protective gear.
Q74: Annex E-1: How many sets of simunition gear will be required?
A74: Not required, see Q&A73 above.
Q75: Annex E-1: Will government training be provided at Fort Dix?
A75: No training will be provided at Fort Dix.
Q76: Annex E-1: What are the transportation requirements at Fort Dix?
A76: Roleplayers are required to be in multiple locations during the exercise and move between training sites for different scenarios. Adequate transportation to move roleplayers between training sites is the responsibility of the contractor either by providing direct support or through an agreement for roleplayers to provide their own transportation.
Q77: Annex E-1: Will a roleplayer staging area be provided on Fort Dix while they are awaiting the start of the scenario?
A77: Some training sites have associated classrooms that can be used as a staging area;
however, facilities are not available at all training sites. Availability will depend on the training site in use during the exercise.
Q78: Annex E-1: Will the contractor management/staff personnel be able to observe these exercises for safety, training and quality control purposes?
A78: Contractor management and staff personnel will be available to observe most of the exercises for quality control, safety, and training purposes. Activities performed in a classified environment will be restricted.
Q79: Annex E-1: Will new roleplayers in training be able to observe these exercises?
A79: New roleplayers in training will be available to observe most of the exercises.
Activities performed in a classified environment will be restricted.
Q 80: Are you aware that it is illegal for a contractor or private citizen to have AK-47s in the state of New Jersey? It is considered be an assault weapon and there are State and Federal laws that disallow the storing or transporting of AK-47s in the State of New Jersey.
A 80: Due to NJ weapons restrictions, the contractor will not be required to provide any blank firing AK-47's. Contractor shall provide two (2) blank firing 12 Gauge shotguns. The weapons are the responsibility of the contractor for the duration of the training exercise. See revised Annex E-1, Section E.2.1.d and E.2.2.e. See revised page 49 and 50 attached in this amendment.
Q 81: Instead of 7.62 x 39 blanks, can we use 8mm blanks for the AK-47?
A 81: Contractor shall provide 3,000 rounds of 7.62X39mm blank ammunition and
250 rounds of 12 Gauge blank ammunition (Winchester Super X Black Powder) per training exercise (four days each). All blank ammunition will be provided to the Government on the start of each exercise. The Government will issue ammunition to role players as needed to ensure sufficient ammunition is retained for all scenarios.
SECTION E
Q82: Section E.4.b. The QCP shall be provided to the Contracting Officer for review and approval no later than five (5) days after Notice of Award. Please clarify the due date.
Section C.1.7.3.b states that the QCP will be provided with the initial proposal; and 2 copies within 15 days after contract award.
A82: Section C.1.7.3, Quality Control Plan is correct. Refer to Section E.4.b, updated change for clarification to question above. Remove and replace page 54 attached in this amendment.
SECTION G
Q83: Section G.7.a: Please clarify or define where or which “Changes” clause U.S.
Government is referring to?
A83: Refer to Section I.1, Clause 52.243-1 Changes – Fixed-Price Alternate II.
SECTION H
Q84: Section H.1.1.b: Please clarify or define days of notice period prior to training?
A84: Refer to Section C.1.3., Government Required Training.
Q85: Section H.1.1.c, Contractor Responsibility: Are employees with convictions of misdemeanor crimes of domestic violence prohibited from working on this contract?
A85: Yes, refer to Section H.13.1, General Requirements.
Q86: H.1.5, Fire Prevention: Please clarify whether the storage of blank ammunition is prohibited on the FLETC.
A86: Yes it is prohibited. The FLETC, Glynco, GA requirement does not require the contractor to provide blank ammunition.
Q87: H.3.a. and H.3.b. CO approval prior to subcontacting What documentation is required for approval of subcontracting arrangements? Does FAR Clause 52.244-2, Subcontracts, apply? Does FAR Clause 52.244-5, Competition in Subcontracting, apply? If a subcontract is anticipated directly upon contract award, at what point is documentation required? If a subcontracting arrangement is proposed pursuant to this solicitation, will CO approval be provided concurrent with contract award or must it be separately requested after award?
A87: Applicable clauses to this requirement are provided in Section I. If the contractor intends to use a subcontractor for a service under this solicitation, the offeror must identify that subcontractor within his proposal. See Q&A89 also.
Q88: H.3.c., Subcontracting: The contractor shall employ roleplaying employee(s) directly.
This statement seems to imply that only the Prime contractor can employ/provide roleplayers, and the roleplaying function cannot be subcontracted out. Is this interpretation correct?
A88: Yes.
Q89: Page 66, H.3.c indicates that the Contractor shall employ roleplaying employee(s) directly. Please confirm that this means that they cannot utilize independent contractors and that formal Teaming Partners (proposed subcontractor – assuming CO consent has been obtained) may also employ roleplayers.
A89: See L.6, Instructions to Joint Venture (JV) Offerors. If the contractor chooses a prime/subcontractor type teaming arrangement, then the roleplayer employees must be on the prime contractor’s payroll. If using JV, then roleplayer employees would be on that JV payroll.
Q90: H.13.2 Access to FLETC Facilities by Contractor Employees, paragraph (d), page 69.
“The contractor and contractor employees that are to be employed on the FLETC in a National Security Position as identified by the FLETC Chief Security Officer (CSO) must be cleared contractors who have received their clearance from the Defense Industrial Security Clearing Office (DISCO).” Will the Government provide information as to which positions will require clearances, and will the clearances need to be SECRET or
TOP SECRET?
A90: Clearance refers to approval of access to the FLETC facility; these positions do not require a facility Secret or Top Secret clearance. However, some employees hired for the FT Dix requirement will require Secret Clearance; see Annex E-1, paragraph 2.d. and refer to Section I.1, FAR Clause 52.204-2, Security Requirements.
Q91: H.13.2.c, Access to FLETC Facilities by Contractor Employees: “…The Contractor will be informed regarding the level of investigation that applies to specific contractor staff position”. This information is found in Section C of the solicitation/contract….We only found one reference to security clearance requirements in Section C, located at C.1.2.3.c., which states “No employees … admitted to the work site unless all security clearance requirements have been properly satisfied, see Section H.13.” Please provide security clearance requirements for contractor employees.
A91: FOR FLETC: All security clearance requirements are provided in Section H.13, Security Requirements.
FOR FT DIX: See Q&A90 above.
Q92: H.13.2.e. and H.13.2.e.(1), Access to FLETC Facilities by Contractor Employees: “… employees that are employed on the FLETC in national security positions as identified by the FLETC CSO…Provide SF85P…. at least 10 calendar days in advance of the contractor employee’s earliest proposed access to FLETC IT systems or facilities”.
Please state if this applies to any management or roleplayer personnel on the contract resulting from this solicitation. If it applies, it effectively keeps personnel of a new contractor off the base for 10 days of the transition period, where data must be collected for many reports that are due within 15 days. How does the Government want to address this disadvantage? If the Contractor provides personnel with active DOD security clearances, how long is the FLETC processing period before the contractor employees are allowed on the FLETC facility?
A92: This clause will apply to the management position identified by the contractor who will be required to have access to FLETC IT system or facilities. See Section H.13.2 (e)(4) for directive on temporary access to facility for contractor employees when application is being processed.
Q93: H.13.2.e. and H.13.2.f., Access to FLETC Facilities by Contractor Employees:
References to publications: HSPD #12; FLETC IT Security Standards; FLETC Physical
Security, Information Security and IT Security policies; FLETC Directive Number 71-01, Access Control. How can these publications be accessed by bidders?
A93: These publications will be provided to the contractor upon award, who will maintain a technical library. See Section C.1.9 (b), Technical Library
Q94: H.13.6.b, Security Requirements Upon Completion of the Contract: Impacts of the failure to do so shall be implemented in compliance with the standards indentified in above paragraph H.15.2.(c). Please clarify to which paragraph this refers. There is no H.15.2.(c) in the solicitation.
A94: H.13.6.b. is referring to paragraph a of Section H.13.6. See revised paragraph
H.13.6 (b), remove and replace page 72 attached in this amendment.
Q95: Are there existing roleplayers that can be carried over to the new contract without having to be vetted, or will they need to be vetted?
A95: Existing roleplayers who will be hired under this award will not be required to be vetted; however, the contractor will be responsible to submit a list of names of the existing roleplayers within 10 days after contract award.
Q96: Can the roleplayers drive on to the facility themselves, or will we need to have a staging area outside the facility and bus the employees onto the facility?
A96: Roleplayers can drive in the FLETC facility themselves as long as they comply with
Section H.13.4, Identification Badges and Vehicle Passes.
Q97: If the employees must be bussed onto the facility, does the 2/4 hour block start from the time they are scheduled to arrive at the staging area?
A97: Employees will not be bussed onto the facility; therefore, start time begins at the start of the exercise.
Q98: H.15.b., Permits: “… required license and evidence of insurance with HAZMAT endorsement (as applicable), prior to driving that vehicle”. We could not find any reference to HAZMAT in Section C. Please confirm if handling of HAZMAT is required and under what circumstances.
A98: Handling of HAZMART is not required for this solicitation. See revised Section
H.15.b, page 73-74 attached in this amendment.
Q99: H.23.c, Indemnity and Liability: Please clarify that contractor does not hold harmless and/or indemnify Government against any or all liability for injuries or death caused by negligence or intentional acts of Government or any employee, agent or representative thereof.
A99: Section H.23.c. remains unchanged.
Q100: H.26, Performance bond: “… in an amount equal to 20 percent of the guaranteed minimum…”. The solicitation does not state a guaranteed minimum. Please provide the amount.
A100: H.26, Performance bond: “Guaranteed minimum” has been changed to read
“contract award amount”. See revised Section H.26, page 75 attached in this
Q101: Section H.28d: Please clarify or define that Contractor’s representative must possess
Security Clearance at the time of orientation for onsite indepth review of total job requirements?
A101: Refer to Section H.13. for Security requirements at FLETC.
Q102: H.28, Phase in/Orientation Period: Please confirm the information provided during the pre-solicitation conference that the transition period will be 30 days after the post-award conference.
A102: Yes, see revised Section H.28, page 77 attached in this amendment.
Q103: H.29.b, Phase-Out/Contract Completion: “… the incumbent Contractor will provide orientation familiarization to the follow-on Contractor as described in the clause above entitled “Phase-in/Orientation Period.” The clause entitled “Phase-in/Orientation Period” only addresses the responsibilities of the incoming contractor, not the level of cooperation of the outgoing contractor. Please address the outgoing contractor’s responsibilities, as effective orientation can only be achieved with full cooperation of the outgoing contractor.
A103: Refer to Section H.29, as stated in page 78.
SECTION I
Q104: I.1, FAR Clause 52.216-11: This clause is to be inserted only into solicitations for solicitations and contracts when a cost-reimbursement contract is contemplated that provides no fee and is not a cost-sharing contract. Please explain the purpose of this clause in this solicitation or remove the clause.
A104: FAR Clause 52.216-11 is applicable for cost reimbursable CLINS X009; X010; and X018, see revised Section I.1, FAR 52.216-7 and 52.216-11, page 81 attached in this
Q105: I.1, FAR Clause 52.223-3, Hazardous Material Identification and Material Safety Data:
Please identify which HAZMATs are anticipated to be provided by the Contractor.
A105: It is the responsibility of the contractor to determine if any hazardous materials will be used to support contract requirements.
Q106: I.9, Section 8(a) Award and I.17, Section 8(A) Direct Awards: The cited clauses at I.9 and I.17 are contradicting. Will FLETC make award to the SBA or directly to the contractor?
A106: Award is directly to the Contractor. See updated Clause I.17, page 89 attached in this amendment.
Q107: I.14, 52.228-16, Performance and Payment Bonds – Other than Construction – Alternate
I: This requirement is unduly restrictive for small business bidders qualifying under NAICS code 561990, and inhibits Full and Open Competition for the contract. The requirement for a performance bond with corresponding bid bond does not seem to be justified to protect the Government’s interests, and it unduly restricts small businesses’ ability to compete for this contract. FAR 28.103-2 provides the criteria for requiring performance bonds, and they do not match this contract. The value of GFE provided under this contract is in no relation to 20% of the original contract price as demanded for a performance bond. Request the Government consider removing the performance bond requirement altogether. Alternately, will the Government reduce the value of the performance bond to an amount that protects the Government’s interest with respect to the current value of GFE or less?
A107: The Performance Bond is required to protect the Government’s interest.
Q108: Is the contractor required to hold insurances for: liability, errors/omissions/workers comp? Are there any insurance coverages that FLETC would provide at all?
A108: Yes, Refer to Section H.23, Indemnity & Liability; Section I.14, 52.228-16
Performance & Payment Bonds – Other Than Construction; I.21, 3052.228-70, Insurance; Section I, 52.228-1, Bid Guarantee; Section I, 52.228-5 Insurance – Work on a Government Installation; Section L.14, Bid Guarantee; Section L.15 Performance Bonds; Section L.16, Irrevocable Letter of Credit; Section L.17, Individual Surety. The FLETC does not provide any insurance coverage.
SECTION J
Q109: Section J – Attachment 1b and 1c. We see there is a roleplayer labor rate listed in the
Glynco Wage Determination, Section J – Attachment 1b. Is there a roleplayer labor rate for the Fort Dix Wage Determination, Section J – Attachment 1c?
A109: Refer to Q&A70 above.
Q110: Section J: (a) Will a DOL Wage Determination be issued for the roleplayer labor category for the Ft. Dix, New Jersey, area? (b) If so, will the wage determination contain three (3) labor categories for the different levels of roleplayers required for this area?
A110: Refer to Q&A70 above.
Q111: We appreciate the Government's effort in obtaining a WD from DOL specific to
Roleplayers in Glynn County Georgia; will a similar WD for New Jersey be provided for the support of the AFOSI training? If not, what WD is to be used for these personnel? In 2008 a Roleplayer WD was issued for Burlington County, NJ of $14.24/hr, is this rate the same for 2009? (Wage Determination No.: 2008-0082, revision 1, 3/18/2008)
A111: Refer to Q&A70 above.
Q112: Section J, Attachment 7 Quality Assurance Surveillance Plan (QASP), Item 10, “Payment
Reductions for Unsatisfactory Performance”: Is the entire value of the contract (Cost+Fee) subject to reduction, or is only the Fee at risk?
A112: Refer to Section J, Attachment 7, QASP, Item 10 b.
Q113: Section J, Attachment 7 Quality Assurance Surveillance Plan (QASP), Item 10, “Payment
Reductions for Unsatisfactory Performance”: Could you provide a detailed list of the AQLs and descriptions of the Standards?
