Student Support Services Solicitation

Questions and Responses

1. Reference Amendment # 000003: Question #3: This question was seeking guidance relative to the requirement of resumes. The answer states "Resumes are still required in accordance with Section M - Technical Factor 4." Initially, the instructions provided in Section L stated that resumes were to be included in Volume I right after the Reps and Certs, but with the incorporation of Amendment 00001, this requirement has been removed (it was completely marked out and now shows "Resumes required by this solicitation"). Since the instructions on where resumes are to be provided was removed from Section L, in what volume does the Government want Offerors to include resumes?

Response: See Section L.9.b.(3)(iv) Personnel Qualifications

2. Reference Amendment # 000003: Question #13: This question was seeking guidance relative to which positions required resumes. The government response referred offerors to the response for Question #1 which is not relevant to the question asked. Please advise.

Response: Key personnel are Project Manager, Alternate Project Manager, and Quality Control Technician.

3. Reference Amendment # 000003: Question #20: This question asked if the Driver Training Range Master position was conformed. The government response indicated that it was not a conformed position. What is the proper classification of this position, since it is not listed on the Area Wage Determination? Is this position tied to the AWD or is it an exempt position?

Response: Reference the conformance process in the wage determination. Historically, this has been tied to the Automotive Service Occupations.

4. Reference Amendment # 000003: Question #35: This question was seeking guidance relative to what is considered "normal maintenance" on the Government-furnished forklift. The government's response referred offerors to subsection C.3.3.1, which discusses Motor Pool Operations and is not relevant to the question asked. Please advise.

Response: Reference FAR Clause 52.245-1 Government Property (APR 2012) – to be maintained in accordance with manufacturer’s standards.

5. Reference Amendment # 000003: Question #49: This question was seeking guidance relative to the Not-to-Exceed amounts on Schedule B. The government response referred offerors to the response for Question #47 which is not relevant to the question asked. Please advise.

Response: This CLIN amount should be left blank as it is a not-to-exceed amount that will determined by the Government prior to award.

6. Reference Amendment # 000003: Question #51: This question was seeking guidance relative to whether Roleplayers are paid for time spent studying scripts. The government responded "no". Wouldn't this be a violation of the Department of Labor’s FLSA definition of "Hours Worked", which ordinarily includes all the time during which an employee is required to be on the employer’s premises, on duty, or at a prescribed workplace? Section C.3.10.2.d requires the contractor to provide scenarios to roleplayers at least one week prior to an exercise. Per the “Note” under section C.3.10.2.d. roleplayers are not permitted to take scenarios off the premises. Since performance of assigned roles requires them to study and learn the scripts a minimum of one week in advance, then time spent studying these scrips on Center would fall under the definition of "Hours Worked". As such, under what CLIN does the Government want this time/expense charged?

Response: This cost has not been addressed as an issue by the incumbent or past contractors.

The 15 minute prep time has seemed to be adequate. If role players require additional time on-site for studying scripts, this will need to be identified, requested and approved by the Contracting Officer prior to reimbursement under the role player CLINs.

7. Reference Amendment # 000003: Question #55: This question asked if a resume was required for the Driver Training Range Master position. The government response referred the offeror back to the response for Question #1 which is not relevant to resumes. Please advise whether the government wants a resume submitted for the Driver Training Range Master position?

Response: See Question 2 Response above.

8. Reference Amendment # 000003: Question #66: Can the Government please clarify the response provided to this question? It was asked whether or not Contractors are responsible for insuring the Government furnished vehicles. The answer referred offerors to the insurance requirements in Section H.26, which leads offerors to believe these vehicles are not insured and must be insured by the Contractor. If these Government vehicles, buses to be specific, have to be insured by the Contractor this could be a significant expense. Insurance premiums on large buses average around $20,000 - $30,000 per year for one bus. We understand that the employees must be insured, but this coverage would be provided under a "hired/not-owned" policy. If it is the Government’s intent to have all Government furnished vehicles insured by the Contractor, please provide all years, makes, models and VINs of the vehicles so accurate insurance quotes can be obtained. Failure to provide this information will most definitely favor the incumbent.

Response: Government vehicles are insured by the Government.

9. Reference Amendment # 000003: Question #70: Can the Government please clarify the response provided to this question? It was asked whether or not Contractors would be reimbursed for the Government furnished safety and occupational training. The answer states that training is scheduled during normal work hours and is provided on Center. It fails to address the question about whether or not Contractors will be reimbursed for this training. It is understood that employees who are working during normal working hours can attend the training while they are already at work and it would not result in any additional expense to the Contractor. However, part-time and on-call staff (such as the Roleplayers) would need to be called in to attend the training, which would result in additional expense. Will Contractors be reimbursed for this additional expense?

Response: The contractor would be reimbursed under the role player CLINs for role players that attend this training.

10. Reference Section C.3.3.1.b.(5), Motor Pool Operations: This section states that contractors are to manage and recycle used oil in accordance with EPA 40CFR279, and the FLETC-OAO HWMP provided in Section J – Attachment 71. It is not clear if there is a cost associated with the recycling of the used oil. Is there a cost associated with the recycling of the used oil and if so who is responsible for bearing this cost?

Response: The Government is responsible for the cost of recycling.

11. Reference Section C.3.3.1.b.(6), Motor Pool Operations: This section states that contractors are to manage and recycle used antifreeze in accordance with Environmental Compliance for Automotive Recyclers (ECAR) Antifreeze Fact Sheet for New Mexico provided in Section J – Attachment 71. It is not clear if there is a cost associated with the recycling of the used antifreeze. Is there a cost associated with the recycling of the used antifreeze and if so who is responsible for bearing this cost?

Response: The Government is responsible for the cost of recycling.

12. Reference Section C.3.6.4, Sports Drink: The "Note" in this section states that "current sports drink consumption averages approx. 10 cases per day." However, the historical data in Attachment 23 states that the current contractor uses approximately 6 to 7 cases per day. Which is correct?

Response: C.3.6.4 NOTE is corrected to reflect 6-7 cases.

13. Reference Attachment 1, SCA Wage Determination: It is our understanding that the Educational Aid position was once a conformed position, however, it is not included on WD 2011-0084. Is this position no longer Conformed? If not, what position on the SCA Directory of Occupations is the Educational Aid now tied to?

Response: Request for conformance was denied by the Department of Labor because the job description reflects duties of the General Clerk, Document Preparation Clerk, and other administrative classifications already listed on the WD. DOL also stated “Furthermore as specified in 29 C.F.R. 4.152(c)(1) conformance of helpers, trainees and aides and lower levels of established families cannot be conformed”.

14. Reference Attachment 1, SCA Wage Determination: WD 2011-0084 includes two Conformed positions, one for a Role Player and one for a Firearms Rangemaster. There is no position, however, listed for the Driver Training Range Master. The Driver Training Range Master does not tie to any position on either Wage Determination that was provided. What position on the SCA Directory of Occupations is the Driver Training Range Master tied to?

Response: See Question 3 Response above.

15. Reference Section C.3.5.1.a.(8) – This sections states “The Contractor shall establish a respirator program, unless the Contractor’s Industrial Hygienist testing indicates that lead levels are below the acceptable level per 29 CFR 1910.1025. As required, a respirator shall be provided to employees who work with lead. The respirator program shall comply with the standards of the National Institute for Occupational Safety and Health Administration and Mine Safety and Health Administration and the DHS/FLETC medical surveillance program.”

Questions: Are there any areas where lead has actually been confirmed to be present in the air above the minimum levels stated in 29 CFR 1910.1025 (i.e. 50 micrograms per cubic meter of air over an 8-hour period)? When was the last time the lead testing/monitoring was performed? If there are areas above the minimum levels what type of respirators are currently used?

Response: There are no areas where the level of lead in air exceeds the minimum levels stated in 29 CFR 1910.1025. Baseline area(s) monitoring was conducted in 2010. As stated, the Contractor’s Industrial Hygienist will need to determine through monitoring and evaluation if a certain work area or task involving the contractors employees would warrant the need for and use of an approved respirator and the employees involvement in a medical surveillance program.

16. Reference Section C.3.6.4 – This section states “The Contractor shall provide sports drink and cups… Drink and cups shall be available seven days per week, at government designated locations in ice filled coolers”. The “Note” under C.3.6.4 states that “coolers and towels will be government furnished.” It does not mention whether or not the ice is provided. Is the ice provided with the coolers or is the contractor expected to furnish the ice? If the Contractor is responsible, is ice available on Center?

Response: The Government has ice machines that the contractor may utilize to obtain the ice.

17. We have a quick question on the bicycle repair requirement in para C.3.7 of Section C.

Please inform us how many bicycles are in inventory?

Response: 80 bicycles

18. We would like to ask about the 350 Border Patrol vehicles cited in the reply to the question in amendment 5:

Question 8. C.3.4 Driver Training:

C.3.4.1 (9) Daily Vehicle Inspection

Question a.: How many vehicles are allocated to the Driver Training Fleet and does this requirement include Border Patrol vehicles?

Response: Reference Section J – Code 342. There are 350 border patrol vehicles.

We could not locate the U.S. Border Patrol vehicles in Section J Code-342 list. We checked the other equipment lists. We want to be sure we account for this large number of vehicles in our resource and staffing estimates. We are thinking these vehicles may be supported by another contract, with our responsibilities to inspect the Border Patrol vehicles sent to the driving range for training purposes, not to support all 350 vehicles on a recurring basis.

Response: See the attached current list of Border Patrol vehicles. The current amount is 312 border patrol vehicles. FLETC vehicles are included in Section J – Code 342.

19. Reference Amendment # 000003: Question #6: It was asked if the Simunition Practical Exercise Training delineated in C.3.10.2 Note 3 could be scheduled during the 4-week Phase-In period to which the government responded Yes. Please clarify that the incumbent contractor will be responsible for continued performance during the phase-in period. If so, how can a successor contractor schedule the predecessor's personnel for training while they are still on the predecessor's payroll?

Response: Correction – This training will need to be scheduled after the phase-in.

20. Reference Amendment # 000003: Question #24: Is the shuttle/bus driver required to wait for students transported to medical appointments until they are ready to return to the Center? If so, what is the average wait time?

Response: Amendment 000003 – Question 23 referenced medical appointments. Appointments out of town, yes. Wait time will depend on type/reason for medical appointment and medical office location.

21. Reference Amendment # 000003: Question #30: The government's response is ambiguous. Please confirm that the contractor will only be required to furnish furniture, equipment and copiers in their project management offices that it deems necessary for contract management.

Response: The Government will only furnish furniture and equipment for the Educational Aide positions. For all other areas, reference Subsection C.1.7.

22. Reference Amendment # 000003: Question #46: The request was made for the government to number the pages of the RFP to which the response was No. This is ridiculous. As it stands, numerous revisions have been made to numerous sections of the RFP for which replacement pages are being provided which now run onto other pages. It is very difficult to incorporate these replacement pages when they are not numbered and now do not format to the original RFP. Request the government be reasonable and provide at least a new Section C that incorporates all the changes to date and include the page numbers. How difficult can this really be!

Response: Revised Section C with page numbers attached.

23. Reference Amendment # 000003: Question #47: The seniority of the workforce has a direct impact on offeror's costs and determining the number of actual FTE's necessary for contract performance. The government has indicated it will be provided to the awardee. Since the government is refusing to furnish this information prior to proposal submission, we are assuming that the government will allow for an equitable adjustment to correct any miscalculations made attempting to estimate the workforce seniority. If not, then please provide the number of staff that currently accrues two, three, four and five weeks vacation.

Response: It is up to each offeror to propose their staffing levels and pricing.

24. Reference Amendment # 000003: Question #50: The government has indicated that the contractor will not be reimbursed for time spent by Role Players to study scripts and learn their roles. This is a significant cost element as scripts cannot be taken home for the Role Players to study during their own time and they have to be paid for this time if they are studying at the site.

How many hours are spent annually to study and learn scripts so offerors can adequately cover this cost in their FFP portion of the contract?

Response: Reference Question 6 Response above.

25. Reference Amendment # 000003: Question #56: The question asked was whether a resume was required for the Firearms Range Master. The government response refers offerors back to the response for Question 1 which was about the Service Plan. We do not understand the reference. Please simply tell us whether a resume is required for the Firearms Range Master position.

26. Reference Amendment # 000003: Question #59: The question asked was whether a resume was required for the Recreation Specialist. The government response refers offerors back to the response for Question 1 which was about the Service Plan. We do not understand the reference. Please simply tell us whether a resume is required for the Recreation Specialist position.

27. Reference Amendment # 000003: Question #60: The question asked was whether a resume was required for the QC Technician. The government response refers offerors back to the response for Question 1 which was about the Service Plan. We do not understand the reference. Please simply tell us whether a resume is required for the QC Technician position.

28. Reference Amendment # 000003: Question #63: The question asked was if the Technical Proposal serves as the Service Plan. The response by the government is ambiguous. If the Technical Proposal is not the Service Plan, then please confirm that a separate Service Plan is to be provided with the Technical Proposal and IS NOT counted toward the 175 page limit of the Technical Proposal.

Response: Reference L.9.b.(2)

29. Reference Amendment # 000003: Question #67: The government response does not answer the question asked. Please advise whether the contractor will be reimbursed for personnel called out for unscheduled after hours support. This can be a significant cost factor and lead to requests for equitable adjustments if sufficient information is not provided by the government to enable contractors to properly assess risk and costs.

Response: Normal operation hours are identified under subsection C.3.5.2. Hours outside of normal operation will be reimbursed under xxx4D.

30. Reference Amendment # 000005: Question #5: This was a two-part question of which the Government only provided a partial response. The second part of this question asked if the contractor is responsible for the cost of the bicycle parts noted to be repaired. Can the Government please provide an answer to this part of the question? In addition, it was noted that the Section J Inventory Listings did not include any bicycles. Can the Government please provide a comprehensive listing of the bicycles the Contractor will be required to maintain, and an annual cost for replacement parts and repairs?

Response: 26 cruisers, 53 mountain bikes (variable speed), and one BMX bicycle. Reference subsection C.3.7(3)

31. Reference Amendment # 000005: Question #6b: Can the government describe the type of certifications that are required for submachine guns and sniper rifles? Specifically the types of weapons that are included in "sub machine guns" and "sniper rifles" so as to search for candidates with those specific weapon's certifications? If the certifications presented are not required to match the weapons the government has on site will any certification for any type of submachine gun, (e.g. MP-5) or sniper rifle (e.g. M-40) fulfill the requirement? Please clarify.

Response: The type of weapons that fall under the Sub Machine Gun class that we use at the Artesia Facility are the Colt M-4, Sig Sauer M-400, Colt 9mm Sub Gun, Heckler & Koch MP5 and UMP 45, UZI Carbine and Ruger AC556. Sub Machine Guns that are being acquired for FY16 include the Fabrique Nationale (FN) P90 and the Heckler & Koch UMP 40.

Rifles that fall into the Sniper Rifle category at the Artesia Facility are the Remington 700.

Certifications from Authorized Factory training should be required for all “core” weapons used at the FLETC. “Core” weapons are weapons used by the majority of students and their agency which is FLETC location specific. Weapon certification should be required to match the weapon the government has on site. Weapon certifications do not cross over from one to the other. They are specific to their own weapon according to their design. A couple reasons you need the specific certification from the factory is a majority of manufactures will only honor their warranty if it is repaired and maintained by a factory trained Armorer. Along with that is a liability issue of an untrained non certified repair of a weapon.

Factory Certifications that should be required for our “core” weapons at the Artesia facility are Colt, Sig Sauer, Remington, Glock, Smith & Wesson, Springfield, H&k and Beretta.

32. Reference Amendment # 000005: Question #7a: This question asked if Contractors will be required to furnish the equipment, supplies/repair parts for Brake and A/C repairs for all cars (SUVs and sedans) and buses, and whether there was historical data available on the number of repairs annually. The Government's response refers contractors to the Section J Inventory Listing and the Section C area which talks about on and off center repairs. Neither of these sections address the question being asked. Can the Government please answer the two questions that were asked?

Response: Approximately 2,234 PMs completed in FY15. For FY15, Oil – approximately $30,000.00 (approx. 5,823 gallons); Parts – approximately $81,500.00; approximately 3,149 items for repair service. Equipment is provided by the Government for brake repairs for light vehicles. Major A/C repairs are sent off center for repair. Brake and A/C repairs on buses have historically been sent off center for repair. Off-center repairs are Government reimbursed.

33. Reference Amendment # 000005: Question #7c: Is maintenance/repair of brake pads and motor vehicle air conditioning (MVAC) units for the buses currently being performed by the incumbent contractor on the current contract?

Response: The Government currently does not have the equipment to perform these bus repairs.

They are sent off center for repair.

34. Reference Amendment # 000005: Question #8a: This question asked how many vehicles are allocated to the Driver Training Fleet and whether this requirement included Border Patrol Vehicles. The Government's response states "there are 350 border patrol vehicles." Upon review of the Section J Inventory Listings we only found 127 vehicles listed. Can the Government please provide an updated listing that includes every vehicle the Contractor will be required to maintain along with their year, make and model? Without this information, Contractors cannot accurately estimate the cost for vehicle maintenance and repairs and will leave the government vulnerable for a future claim for not adequately identifying the scope of work. Failure to provide this information will most definitely favor the incumbent.

Response: See Question 18 Response above.

35. Reference Amendment # 000005: Question #8c: The question was asked whether a Driver Training Range Master performed the daily inspections or if another qualified individual could perform the inspections. The government response referred offerors back to c.3.4.1.(9) which would indicate only a Driver Training Range Master can perform the daily inspections. It is our understanding that on the current contract Maintenance Helpers perform much of these inspections. Please confirm that on the follow-on contract the government mandates that only Driver Training Range Masters can perform any of the inspections and not a lower pay level staff.

Response: As stated in subsection C.3.4.1.(9), Driver Training Range Masters are to conduct daily inspections as identified.

36. Reference Amendment # 000005: Question #9a: Is the incumbent contractor currently performing daily inspections on ALL Driver Training Vehicles on the current contract?

Response: No

37. Reference Amendment # 000005: Question #13a: Is the incumbent contractor currently transporting the self-dumping hoppers to building 78 as well as operating the conveyor and balor?

Response: Yes

38. Reference Amendment # 000005: Question #15a: This question asked if the contractor is required to perform repairs on Airsoft weapons mentioned in, C.3.6.3.(7) which discusses issuing and inventory of airsoft weapons and supplies. It also states that " Damaged weapons returned shall be tagged by Government personnel with information identifying the damage/malfunction" implying either that the government will handle the repairs or that the government will tag the weapon needing repair and then issue to the contractor for said repair.

Which is it? Additionally, C.3.6.3.(7) lists airsoft accessories that the contractor is responsible for replenishing. Are these parts reimbursed by the government or should the contractor account for these supplies in the FFP proposal?

Response: The Government will tag the weapon. The Contractor will repair. Yes, accessories are Government reimbursed. Also reference FAR Clause 52.245-1 Government Property (APR 2012).

39. Reference Amendment # 000005: Question #16: This question referenced C.3.6.3.(8) Note 4 and asked that given that employees will be handling garments possibly soiled with blood, will said Uniform Issue staff be required to have Bloodborne Pathogen Training?

Response says to reference C.3.6.3.(8) Note 4 which describes the method by which employees will handle garments soiled with blood. Please answer the question.

Response: Steps are in place to prevent the actual handling of contaminated waste. However, the risk of a contract employee coming into contact with the contaminated waste remains. While blood borne pathogen training will not prevent an exposure, it will give the employee an understanding of proper decontamination of themselves and reporting the exposure.

40. Reference Amendment # 000005: Question #17: This question asked if historical data would be provided on the purchase of cups. The Government's response states that the cost of the cups would be reimbursed. Can the Government please incorporate this into the note under C.3.6.4? Currently it states "the coolers and towels will be Government furnished" but it does not state that Contractors will be reimbursed for the cost of the cups. Will the cost of the sports drink also be reimbursed?

Response: See revised subsection C.3.6.4 NOTE. Sports drink will not be reimbursed.

41. Reference Amendment # 000005: Question #25: This question asks if the government will take any action if contractor's employees are late for their assignments (e.g. role players). Please confirm, will the government consider this an instance of non-compliance? Will the government take steps to expedite inspection, or allow the role to be delayed due to inspection with no fault assessed to the contractor? It is understood that it is the contractor's responsibility to provide direction to their employees, but we do believe that was the intent of this question. Please clarify.

Response: It is up to the contractor to schedule employees to ensure that contract requirements are timely provided.

42. Reference Amendment # 000005: Question #26: This question asks for clarification with regards to section C.1.2: Project Workload, specifically last minute changes. The example provided asks what would happen if the number of role players scheduled for a role are increased a few hours before the role is to begin and the contractor is unable to provide the requested number of additional role players. The response references C.1.2.b. which only reiterates that the contractor is responsible for last minute changes. This does not answer the question. What actions will be taken by the government if the contractor is unable to meet last minute changes in the amount/type of role players needed?

Response: A contractor is responsible to fulfill the requirements of the contract. The Government will take appropriate recourse.

43. Reference Amendment # 000005: Question #28: This question asks for historical data regarding the percentage of last minute changes as compared to those provided five days in advance. This information is necessary in knowing how many man hours should be dedicated to accommodating these last minute changes, as completing these tasks can be time consuming, involve several personnel to effect, and often result in overtime costs. This information should be readily available given that the government sends all changes to the contractor and should be provided to offerors in order to properly estimate the number of staff needed to effect last minute changes. Please answer the question.

Response: Reference Amendment 000006 Question 52 Response.

44. Reference Amendment # 000005: Question #29: This question notes the percentages of last minute changes at another FLETC location involving role players and overtime needed to effect changes required by last minute changes. It also asks what the government's expectation is for the contractor to have replacement role players on short notice given Artesia's remoteness and small size. The answer to the first question was " no overtime will be paid", as such, will the government provide percentages of last minute changes over the past several years so the contractor may project labor costs as accurately as possible? As for the second question, C.3.10.2 Note 2 was referenced, which speaks to the average daily number of role players required and the maximum role player requirements, stating that the contractor shall hire additional role players to meet any increase in demand. This does not answer the question. Due to Artesia's remoteness and small size, many if not most roleplayers and other staff live a considerable distance away. What is the government's expectation for the contractor to have for replacement role players on site and ready to work with little or no advance notice? Please advise.

Response: Reference Question 42 Response above.

45. Reference Amendment # 000005: Question #32: The question asks for historical data regarding the average number of last minute class changes per month as this can have a significant impact on staffing. This data should be available if last minute changes are recorded in SASS. Please provide this information.

Response: Reference Amendment 000006 Question 52 Response.

46. Reference Amendment # 000005: Question #34: We realize the number of airport shuttle runs to each airport is dependent on student population. The question was asked for the government to provide the historical number of airport shuttle runs to each airport for the past 12 months. This information is readily available and easily extractable by the government. As such, we request the government provide this information.

Response: In FY15, approximately 50 to El Paso, TX; 137 to Roswell, NM; five to Carlsbad, NM; one to Lubbock, TX; and one to Midland, TX. The contractor is expected to have sufficient staff to provide multiple/simultaneous trips.

47. Reference Amendment # 000005: Question #35: This question asks if the contractor will have necessary access to SASS to perform the requirements of the contract. The response states:

"The contractor will be provided access to SASS on a need to know basis." Please clarify, if delays occur in the approval process due to lengthy investigations required for access to SASS will the government work with the contractor to assure access is granted in order to perform the contract requirements by the end of the phase in period?

Response: Historically, access is granted within 1-3 days if proper background check has been completed and Government provided IT Awareness training is completed which normally takes about one hour and is Government provided.

48. Reference Amendment # 000005: Question #37: Are all ten offices/work stations and the 1,600 sq. ft. for Project Management located in the same building or in separate buildings?

Response: Separate buildings

49. Reference Amendment # 000005: Question #40: This question asked for clarification on conflicting information that was provided in section C.1.6.b and Attachments 2 and 23. The Government's response states "reference C.1.6.b" which does not answer the question. The question asked if there are five separate property lists or six property lists. Section C.1.6.b indicates there are only five, but the Government provided six. If bidders are to reference section C.1.6.b then that would mean there are only five. So, which of this six provided should be disregarded?

Response: Corrected – Reference Amendment 000006.

50. Reference Amendment # 000005: Question #41: This question asked the government to provide what office furniture would be provided for contractor use according to section C.1.7. The answer referenced back to section C.1.7. This does not answer the question. Can the government please provide a list of what furniture is provided by the government?

Response: Reference Question 21 Response above. It is up to each individual offeror to determine the facilities, equipment, and materials required that not provided, for each functional area.

51. Reference Amendment # 000005: Question #42: Refers to C.2.1.2.e: Reducing Payment/Assessing Liquidated Damages: "'… a written notice shall not be a prerequisite for reducing payment or assessing liquidated damages for non-performed service(s).' Is the intent of this statement that the Government will deduct from a contractor's invoice without discussion of the concern, without seeking the Contractor's explanation or potential extenuating circumstances, without issuance of a CDR, or provide an opportunity for timely correction? Have there been any payment reductions on the current contract? Have there been any liquidated damages assessed on the current contract?" The response references Section E, which does not answer these specific questions. Please answer the questions or list the parts of Section that pertain to these questions.

Response: Reference Section E – Technical Exhibits 1 and 2 for deductions.

52. Reference Amendment # 000005: Question #44: This question asked if the government provides any bench stock for weapons repairs. The response provided states that the weapons repair inventory will be transferred to the awardee. It is our understanding that on the current contract the Contractor is responsible for maintaining this bench stock as it is used. On the previous solicitation it was estimated that the value of the bench stock was approximately $5,000.00/year and a list of bench stock items was provided with section J. Has this requirement changed? Will the Contractor be responsible for maintaining this bench stock or are these materials now paid for by the Government? If this will be a Contractor responsibility, can the Government please provide the annual cost expended of bench stock per year with a list of the items used?

Response: The requirement that referenced the bench stock of $5,000.00/year was for target assemblies and was removed from the Student Support Services contract. Weapons repair inventory is provided by the Government.

53. Reference Amendment # 000005: Question #45: The question asked was who is responsible for the cost of trash disposal. The government's response simply referred the contractor back to the paragraph being questioned. Request the government answer the question as to who pays for the cost of the trash disposal, contractor or government?

Response: Government – Please See Chapter 4 Turning in Waste - Funding requirements of the FLETC-OAO Hazardous Material and Waste Management Plan (dtd March 2015) provided in Section J, Attachment 71.HMWMP - Chapter 4.

Turning-In Waste

Funding Requirements

The FLETC will pay for HW disposal costs with the following exception.

Organizations, Activities and contractors will pay for their HW disposal at the time of turn-in if any of the following conditions apply:

1. Organizations, activities or contractors whose waste disposal cost is not included in the terms of a Contract, Inter-Service Support Agreement (ISSA) or Memorandum of Agreement (MOA)

2. Any organization or activity that must dispose of HM as HW because of gross negligence in material management, it is the result of a spill or release caused by negligence, unauthorized HM ordering or procurement, or failure to manage shelf life.

54. Reference Amendment # 000005: Question #48: The question asked how long the contractor has to call in a driver for trips that provide no advance notice, to which the government responded Immediately. We understand the contractor is required to immediately take action to respond to ad hoc trips with no advance notice, but how long do they have from the time of notification to have the driver on-site and available for the trip, i.e., 1 hour, 2 hours, etc?

Response: The contractor is expected to have sufficient staff to meet the requirements.

55. Reference Amendment # 000005: Question #51: The answer provided to this question directly contradicts an answer the Government provided to an almost identical question that was answered with Amendment #000003, question #24. The Government's response on Question #24 with Amendment #000003 was "This happens rarely." The Government's response on

Question #51 with Amendment #000005 was "Approximately 25-35 per month. Dependent on student population." Can the Government please clarify which response is correct?

Response: Amendment 000005 Question 51 Response is correct.

56. Reference Amendment # 000005: Question #57: This question asked if Inventory Listing Code 342 was a comprehensive list of all the vehicles that are to be maintained and for the year of each vehicle to be provided. The Government's response states "See Question 8.a. Response.

FLETC year models vary from 2006 to 2013. They include Crown Vics, Impalas, Expeditions and Tahoes. Mileages vary from 1,945 to 156,887." Question 8.a. states there are 350 border patrol vehicles. Does this mean the total vehicles requiring maintenance is 350? The Inventory Listing provided in Section J only lists 127 vehicles. Can the Government please provide a listing of the missing vehicles to include year, make and model? Providing a range of the years of the vehicles is not helpful to bidders trying to price this requirement and leaves the government open for a future claim for not adequately representing the scope of work. This information should be readily available and failure to provide it clearly favors the incumbent.

Response: Reference Question 18 Response above.

57. Reference Amendment # 000005: Question #57: Since it appears the government is requiring contractors to insure the government furnished vehicles in accordance with H.26, a comprehensive listing of all vehicles including year, make, model, VIN, and mileage will be required in order for the contractor to obtain quotes for the necessary coverage.

Response: Reference Question 8 Response above.

58. Reference Amendment # 000005: Question #60: This question asks where hoists can be found in the GFP lists in section J. The response states that the hoists were not included because they were below the $1,500 threshold. As these expenses will affect the projected costs in the proposal please provide what other GFP is provided but not listed in section J due to the $1,500 threshold.

Response: There is currently no hoist provided. See the attached GFP listing – Non Accountable Property.

59. Reference Amendment # 000005: Question #63: This question asks if a special license is required to operate the Wrecker listed in C.3.3.1.b.(22). The response states: "It is the contractor’s responsibility to comply with New Mexico Motor Vehicles rules and regulations". Please provide year, make and model of the wrecker so offeror's can determine what credentials are needed for operation.

Response: The wrecker is listed under Section J – Attachment 2 – Code 342 – Barcode 513244.

60. Reference Amendment # 000005: Question #64: This question asked for clarification on who was responsible for bearing the cost of the On and Off Center Repairs. The Government's response referred bidders to section C.3.3.1.a. This section does not address the question asked. Upon further review it appears that On-Center repairs would be the responsibility of the Contractor and Off-Center repairs would be reimbursed by the Government. Is this correct?

Response: Yes, but repairs that can be accomplished on-center should not be sent off-center.

This also requires prior approval through the COR and C.O.

61. Reference Amendment # 000005: Question #68: This question asked for more information on the ice towels. The Government's response referred bidders to section C.3.6.4.(6), which states that ice towels are to be furnished to all ranges in use during hot weather. Are the towels Government furnished? If not, can the Government please provide historical data for this requirement. Is there a Government furnished freezer provided for these towels?

Response: Towels are Government furnished. No, historically the Government has provided ice chests.

62. Reference Amendment # 000005: Question #71: This question asked the government to provide the historical monthly number of classes that pertain to the requirement for the last 12 months cited in C.3.4.1.(7) "A range master will meet the class and instructors at the parking lot prior to the beginning of class.". The response replies " no historical data". Historical data is provided, however, in J-Atch. 23 listing the current number of range masters. Has the current staffing been adequate to meet these requirements? Is the contractor to assume that the current contractor has the appropriate amount of range masters to meet the requirement stated in C.3.4.1.(7)?

Response: C.3.4.1.(7) is not on the current contract so no historical data is available.

63. Reference Section C.3.8.2.(1): Audio/Visual: This section states that the "Contractor shall inspect, test, maintain, and repair audio/visual equipment such as overhead and slide projectors, tape recorders and public address systems using hand tools, soldering iron, and special testing devices (see the Inventory Listing of Government Furnished Property in Section J-Atch 2)". After reviewing the referenced attachment, we could not find anything that fell into the category of "special testing devices". It is assumed this equipment could be voltage test equipment, or perhaps, coax cameras, but naturally, we do not want to assume anything. As such, can the Government please clarify what specific “special testing equipment” is required or what is currently in use? Also, is this equipment government furnished or is it Contractor provided?

Response: See the attached GFP listing – Non Accountable Property.

64. Reference Section C.3.10.2, Note 2: Role Player Requirements: States that should the Government have a rapid increase in the training efforts, the Contractor shall hire additional role players as is necessary and as ordered by the Government to meet the increased training needs. This is easier said than done given that it can take from 30 - 90 days to get employees through the FLETC badge/access investigation process. How much notice will the contractor receive of an increase in training needs? If the contractor has submitted all required paperwork to FLETC for the background investigations to hire the additional personnel but FLETC cannot provide access timely, how will that situation be handled if the increased training needs cannot be met due to FLETC not getting personnel approved for access?

Response: Requirements are input into SASS 90 days in advance. The Government will strive to provide as much advance notice as possible. Also, see Question 41 Response above.

65. We would like to know if the reply to Question #2 (Motor pool operations material expenses for the contractor) in Amendment 5 is the dollar amount for parts and material costs over the performance period of the current contract or do the dollar amounts show expenses on an annual basis? We need the clarification for estimating pricing.

Response: October through August, 2015

66. We’re been working on completing the FACTS Sheet for our relevant contracts and are finding that it is more than challenging to answer all of the questions on this form and have it stay within the four page limitation. The instructions provided on the form take up nearly two pages themselves, which leaves only two pages for our response. We have tried to curtail our data but we simply cannot provide sufficient information for everything required within the limited space available. I believe there are some possible options that we want to throw out for your consideration that could solve this dilemma.

1. Allow offerors to duplicate the FACTS Sheet information in a table format with the instructions removed?

2. If the first option is not possible, would you please allow a smaller font size ( 8 or 10 pt) so that all information required can be provided without exceeding the 4 page limitation?

3. Increase the FACTS sheet page limitation from four pages per contract to six.

Response: Offerors are allowed to duplicate the FACTS Sheet information in a table format with the instructions removed.

67. Please confirm we use the FTC-ADM-1A "FLETC Purchase Requisition to obtain approval to procure the Go Pro batteries listed in bold text below.

"C.3.6.3 (18) Issue on an as needed basis Bose mini speakers and Go-Pro cameras. These items will be captured on a contractor generated form. Charge or recharge prior to use. Disinfect Go- Pro headsets after use. Replace Go-Pro batteries as needed and keep a supply in stock. Damaged Bose mini speakers and Go-Pro cameras returned must be tagged by instructors with a brief description of malfunction. Damaged speakers and cameras shall not be repaired by the contractor. Upon identification of the malfunction, the Government will make a determination whether or not to replace the item. The contractor will replace these items by submitting a purchase requisition (FTC-ADM-1A "FLETC Purchase Requisition") to the COR. For the initial count of speakers and cameras, reference Section J-Attachment 85. "

Response: Confirmed.

68. The Government requires the Contractor to solicit bids for materials/parts/supplies/services.

(Section C.3.11) during the contract period of performance. Therefore, will the Government provide a total estimated cost for CLIN 0006 to keep all bids consistent or is the Contractor expected to provide a price to not exceed for CLIN 006?

Response: This CLIN amount should be left blank as it is a not-to-exceed amount that will be determined by the Government prior to award.

69. Reference Amendment # 000003: Question #15: This question asks for clarification and further instruction on how to correctly complete section N of the Section J, Attachment 31 FACTS Sheet. The Government's response refers offerors to paragraph F of the FACTS Sheet and says that instructions are provided. All paragraph F says about section N is "Completion of the relevancy grid as identified in paragraph N. below will supplement the data provided in response to this paragraph." These are not instructions. This is simply stating the purpose of section N and how it will be used. (1) We request that the government please provide clear and concise directions on how to properly complete all items of section N of the FACTS sheet. This relevancy grid is confusing, cumbersome and would require several pages to compare every aspect of the solicitation to each relevant contract, which would exceed the four page limitation. The narrative provided under section F should be sufficient for providing relevancy. (2) Item #2 of section N of the FACTS Sheet requests details on "Required Types of Construction". Since this solicitation does not include a construction requirement, can the Government please clarify why this is even relevant? (3) Item #5 of section N of the FACTS Sheet asks for the "Cost/Scope". It is the Government's intent for offerors to address price for the proposed effort in the past performance section? (4) Can the Government please clarify what is intended for "scope"? Square footage would not be applicable to this contract and the various areas of responsibility of the contract will have been discussed in both the section F narrative and item #1 of section N. Does the Government want this repeated here?

Response: Information provided under N columns are examples only. Reference L.9.c. for instructions.

70. Reference Amendment # 000005: Question #60: Asks where hoists can be found in the GFP lists in section J. The government’s response states that the hoists were not included because they were below the $1,500 thresh-hold. As these expenses will affect the projected costs in the proposal, please provide: (1) what other GFP is provided but not listed in section J due to $1,500 threshold. (2) How many lifts are provided? (3) Are there multiple types of lifts that will require varied inspections such as large vehicle/bus lifts in addition to the standard automobile type lifts? This information is necessary in order to estimate the cost of the required inspections. (4) Are there in-ground service pits on site in addition to lifts? (5) If so, are there any costs and/or responsibilities required of the contractor for them, such as environmental services and disposal?

Response: See the attached GFP listing – Non Accountable Property. The Auto Shop currently has one alignment rack with lift, two lifts, and one wash bay. The Government will reimburse the contractor for the annual lift inspections.

71. Reference Amendment # 000006: Question #20: The answer provided states that the Government does not have plans to replace the washer and dryer and provided a reference to FAR Clause 52.245-1. Should Contractors plan on having to replace this equipment or should costs to have the items laundered off Center be included in proposals (assuming Contractors will be permitted to take the soiled training garments off-center)? If laundered off-Center it will require a vehicle for drop-off and pick-up and the costs will far exceed that of using the government equipment.

Response: Current washer and dryers have been sufficient.

72. Reference Amendment # 000006: Question #21: The answer provided states that the Government provides one sewing machine for the requirement under section C.3.6.3.(10). Can the Government please provide the workload or quantity of repairs that are required? Has this one sewing machine been sufficient to meet this requirement or does the current contractor also provide additional sewing machines?

Response: Yes,…
