AMENDMENT I
Vehicle Maintenance Requirement
Solicitation No. HSFE70-17-R-0018 4/5/2018
Questions/Answers
1. The Government requests approximately 120 pages of printed and responsive technical, past performance, and pricing material from small business Offerors in 11 business days. In order for contractors to satisfy these requirements, provide the best possible responses to the Government, and promote robust competition, will the Government please consider an extension to the response closing date of 04/27/2018?
The Contracting Officer has considered the circumstances of the Vehicle Maintenance acquisition, such as the complexity, commerciality, availability, and urgency, when the solicitation response time was considered. Based on those circumstances, the established response closing date remains.
2. Solicitation paragraph C.9 identifies only the Project Manager as Key Personnel. However, PWS paragraph 1.13.2 states that six additional Senior Technicians are also Key Personnel. As Factor 2 indicates that proof of experience with equipment makes and models is necessary, will offerors be required to submit a resume for only the Project Manager with the proposal or also for all other personnel supporting the contract?
Correction was made to solicitation and PWS with Amendment I.
The following personnel will be designated as Key: Project Manager, Senior Technicians (Lead), and Junior Technicians. Prospective bidders must demonstrate that potential employees are qualified to perform the necessary work under the solicitation. Resumes shall be submitted for Key Personnel and does NOT count against page limitation.
3. The solicitation states that there will be a 6-month base period of performance. However, the dates provided in the table in solicitation paragraph B.8 and PWS paragraph 1.4 reflect 18 months, and subsequent option years are 1 year later than they would be with only a 6 month base. Will the Government amend the solicitation and PWS to correct this discrepancy?
Yes. This typo has been corrected via Amendment I
4. In the Technical Volume instructions in Paragraph E.9, it states there will be a 100 page limit, but also states the Government will not evaluate any material beyond the 50 page limit. That implies that there is a 50 page limit for Factor 1 and a 50 page limit for Factor 2 with an overall 100 page limit for the Technical Volume. Would the Government please clarify the page limit for the Technical Volume?
The Technical Proposal Volume I page limitation shall not exceed 50 pages total. Each page shall be one-sided. Resumes does NOT count against page limitation.
5. PWS paragraph 3.1 states that, "the Contractor will be allowed to use the on-site vehicles for the vehicles intended purpose. However, it may become necessary for the Contractor to provide their own service vehicles in the event the Government vehicles are needed elsewhere." As a firm-fixed price contract, the vagueness of the requirement and lack of historical data introduces significant cost risk to Offerors. Would the Government please provide historical data of service vehicle availability across the six locations identified?
Historically for the duration of this contract a government furnished vehicle has not been removed from Contractor utilization. However, dependent upon disaster response there is a possibility that these vehicles could be assigned to FEMA organic personnel only and the Awardee has to have the ability to replace this vehicle if the need should arise.
6. PWS paragraph 3.1 states that, "all sites have tools for use by the contractor. However, the contractor shall not depend on the availability of these tools for use. The use of the tools will be at the discretion of the site and that site’s internal policy." Would the Government please provide a list of those tools, historical data regarding their availability, and copies of site internal policies for Offerors to adequately estimate the tools they need to provide?
The contractor can expect to have access to the equipment. However, the below list of items are not all inclusive or guaranteed.
Note: Also, if the equipment breaks, it will fall upon the Contractor to replace at no cost to the Government if it is due to negligence or misuse.

7. Would the Government please provide the Wage Determination to be utilized for this effort?
Yes. The Government will include wage determinations with Amendment I
8. Para 3.1 states “all sites have tools for use by the contractor.” However, the next sentence states: “However, the contractor shall not depend on the availability of these tools for use.” The second sentence seems to contradict the first sentence and the government does not state what tools would be available should they be available, and/or the quantity based on personnel requirements to sustain the fleet at each location. Can the government clarify whether tools necessary to perform requirements outlined in Part 5 of the PWS are available or not per location? Reference answer to question #6
9. When and where will the contractor be trained in SAMS?
The contractor will be afforded the opportunity to take training on SAMS once they have been credentialed by FEMA personnel security and receive a FEMA email address.
10. This was previously set aside for SDVOSB can you tell us why it is not being set aside for SDVOSB when you have two SDVOSB currently performing the work and IAW the FAR when two or more known SDVOSB entities are available the effort should be set aside as such?
IAW FAR 19.502-2 although past history of an item or similar items is always important, it is not the only factor to be considered in determining whether a reasonable expectation exists.
The Contracting Officer has determined to solicit a Total SB set aside to obtain the best sources consistent with the demands of the required acquisition, for the best mix of cost, performance, and schedules.
11. FAR clause 52.225-1 Buy American is being imposed yet the agency has equipment on sites which are not American and any such replacement parts would also be non-American.
Correct, if the equipment is non-American and if American parts are not available to complete the job then non-American parts will suffice.
12. In the Labor CLINs for pricing are you seeking the full burden rate as a plug in number.

13. VM__Solicitation_HSFE70-17-R-0018.PDF, page B-1, paragraph B.1: Paragraph B.1 PRICE/COST SCHEDULE states to see Attachment D. Attachment D is Attachment_D_IT_Security_Directive_FD_140-1. This paragraph should be mentioning Attachment_B_THE_SCHEDULE_SECTION_B.

14. VM__Solicitation_HSFE70-17-R-0018.PDF, page E-13, paragraph E.9: Paragraph states “The content of the Technical proposal shall not exceed 100 single spaced pages using a font size of 12.” Then on page E-14 it states “FACTORS 1-2 TECHNICAL - VOLUME I- 50 page limit.” Can you tell me what the correct past count is for Volume I-Technical?

16. VM__Solicitation_HSFE70-17-R-0018.PDF. Also, on page E-14 it states “In addition to the above, all proposals shall be emailed to Oneko.Dunbar@fema.dhs.gov with the subject line: “Solicitation Number HSFE70-17-R-0018 Proposal”.” Does this mean that the proposal is to be submitted via certified mail or hand carried and emailed or can the proposal be mailed, hand carried, or emailed?
The proposals shall be submitted via certified mail or hand carried AND the proposal shall be emailed to the email address within the instructions of the solicitation.
17. VM__Solicitation_HSFE70-17-R-0018.PDF, page E-17: Can a subcontractor submit past performances if the PRIME offeror is neutral with their past performance?
No. Only the Offeror (Prime Contractor) shall submit past performance information.
18. PWS_Attachment_A_Performance_Work_Statement.PDF, page 4 of 28: Does the Government have a preference of the six performance locations for the Project Manager?
The Project Manager is not required to be on any one site. The Project Manager can be a dedicated full-time employee of the contractor and can reside at the contractor’s headquarters. If there is a situation at any one site which cannot be resolved remotely and the Project Manager is required to travel to the site, then the cost of that travel is incurred by the contractor and is not reimbursable by the Government.
19. Attachment B: It looks like the Government is using 2080 for their Hour calculations. Question: Should we base our pricing on 2080 hours, or use Productive Hour calculations?
Option Year pricing shall be based off of 2080 hours. Base Year pricing shall be based off of 1040.
20. In RFP para B.8, and PWS para 1.4, the text says the Base period will be 6 months.
However, the tables and Attachment B reflect a Base period of May 16, 2018 to November 15, 2019, which is actually an 18 month Period of Performance, which cascades to the Option Year dates. Will the government please clarify the base period of performance (POP), and correct Option Year Period of Performance dates.

21. Who is the incumbent?

22. What is the incumbent contract number? The incumbent’s contract number is public information, offerors may obtain the contract numbers.
23. The locations and labor categories reflects WD labor categories. There were no WDs provided with the final RFP. Will the Government provide the current WDs for the six (6) FEMA locations? Yes, to be provided with Amendment I.
24. Will the Government provide an extension since the WD was not included in solicitation?
There are no changes to the proposal due date/time.
25. Are we required to submit both hard copies (original and six (6) copies), and an electronic copy by email? Yes. Offerors are required to submit both hard copies and through electronic email. The number of the hard copies were reduced to two (2): One (1) Original + One (1) Copy. One (1) email.
26. It states that the Offeror shall identify three (3) to five (5) contracts or task orders (from the PRIME offeror) with the Federal Government or Industry that demonstrate recent and relevant past performance. Will the Government accept past performance from a major subcontractor in addition to the PRIME's past performance? No. Only the Offeror (Prime Contractor) shall submit past performance information.

37. Reference: PWS Page 17, Para. 4.1 Is there any equipment that the current contractor is currently providing that will not be provided by the Government under this new contract?
All equipment currently being provided under the solicitation will be made available to the awardee.
38. Reference: PWS Page 24, Para. 5.5 Is the contractor allowed to use the FEMA asset management system to track parts inventory and purchases?
There is not a FEMA system to track parts inventory and purchases per se. The system allows for notes to be added to work orders, but not track parts.
39. Reference: PWS Page 24, Para. 5.5 What information is the contractor required to input into the FEMA asset management system?
The contractor is required to input work orders to include task(s), repair(s) and service(s) completed.
40. Reference: Attachment B Is the travel of the project manager to the various sites included under the ODC numbers or is this to be included in the burden rates?
This should have been included in the burden rates.

45. Reference: Attachment B The Government appears to be using 2,080 annual hours per position. Does this include non-productive hours to include holiday, vacation, sick leave, and other paid time off?
Yes.
46. Reference: Attachment B Does the Government intend the contractor to bill for productive hours only?
Yes.
47. Reference: Attachment B On the summary page, it states “Annual Labor Rate Escalation: 2%”, but the spreadsheet is not calculating this escalation. Should the spreadsheet be manually adjusted to include a 2% escalation in Option Years I - IV?
Yes. Each proposed year after the base should include escalation.
48. Reference: Attachment B Is the 2% escalation rate to be applied to SCA labor rates given that these rates are governed by the Department of Labor SCA wage determinations and are not normally adjusted unless a revised wage determination is issued? Wage determination will be issued.

50. The government has indicated by marking 52.222-41 that this is a SCA-based contract? Is it correct that this contract is solicited and governed under the SCA directives and policies?

51. The government marked 52.222-41 indicating this to be an SCA contract; doe EO13706 apply to this solicitation as 52.222-62 is not marked or otherwise identified as applicable?
52.222-62 is applicable to this contract. Correction was made to solicitation with Amendment I.
52. As per this section, the PM is the only key personnel indicated. Is this correct?

53. The government places a page limit of 100 single spaced pages then has a statement that it will not review content exceeding the 50 page limitation. Please define whether this is a 100 page limit or a 50 page limit clearly.

54. The government has indicated a requirement to print, produce, and ship/hand carry proposals (approximately 21 volumes total) to be delivered to DHS/FEMA/OCPO/Acquisitions Operations Division. Directly following, the government also directs all proposals to be emailed as well. In an announcement for the Federal Emergency Management Agency (FEMA)(released May 13th, 2013), Tonya Schreiber, deputy assistant administrator, reported that other organizations across the government are seeing the benefits to modernizing processes and information management solutions.
She revealed that in an effort to enhance current business practices, FEMA is participating in these initiatives. "If we continue to use systems that are mostly paper-based and rely on outdated technology, FEMA will not inherit all the benefits that could accompany the FEMA Workplace Transformation," she stated." We request the government remove the hard copy requirement and accept emailed proposals for compliance with climate/conservation best practices and other “green” initiatives.

55. The government states Volume I to have a 50 page limit in this section, but also defines a 100 page limit in section E.9. Request the government define the limits clearly.

56. The government states that Past Performance (3 to 5) must come from the Prime contractor.
We have strategically partnered specifically to address the requirements/needs of the government in this support, and this restricts our ability to provide the best information for the government to evaluate our team. Request the government change this requirement to a minimum of 2 PP’s from the prime, with up to 3 PP’s from partners.
Only the Offeror (Prime Contractor) shall submit past performance information.
57. The government states that if a partner is to be used that a copy of the teaming agreement shall be provided. If the government does not allow the use of the partner’s past performance, then why is the government concerned over a teaming agreement copy? Unless the change for inclusion of partner performance is made, we request the government remove this requirements as it has no value or determination as to the solicitation requirement.
Request denied.
58. If all reps and certs are up to date in SAM, may a single statement to that fact be acceptable for compliance with representations and certifications?
No.
59. Performance Work Statement
The government states it has relied on contractor support to assist with preventative maintenance and repairs over the past decade. Please provide the associated contract numbers for all support contracts over that period (10 years) that encompass/correspond to the requirements as specified within this PWS.
This request will not be provided in response to this solicitation.
60. As the government states this is a re-compete of a current contract, please provide the current incumbent and associated contract award number/amount of award.

61. The government states:” The Contractor shall provide scheduled/unscheduled inspections, maintenance and repairs, to include accident repair for FEMA National Fleet.”. There is no provision, requirement, or mention of accident repair within PWS tasks. Request the government either define specifics of this requirement or remove it from the solicitation.
An accident repair is an unscheduled repair.
62. The government states a Base period of 6 months with four one-(1) year option periods, with base year beginning on May 16, 2018. To conform with this defined base period, should the base end date be Nov 15, 2018 instead of Nov 15, 2019 as defined in the associated table?
The base period is 6 months. This typo has been corrected via Amendment I
63. Please define the specific risk levels associated with each labor category/role, along with the respective access to information systems.
Each position listed in the PWS that performs maintenance will have access to FEMA system.
The risk level associated is moderate for all.
64. Please define all acceptable/required certifications, experience, and qualifications currently approved and accepted by FEMA in regards to the specific labor categories/roles requested. As stated earlier, this work has been in progress for over a decade, and with a current incumbent..
this is information that should be readily available to the government and will assist offeror’s in refining staffing/cost proposals.
Acceptable/ required certifications, experience and qualifications that will be accepted for this contract is Automotive Service Excellence (ASE) certifications, Military Occupation Specialty Qualifications, and Vocational/Trade School Education.

73. The government states: “Supervisors shall be easily identifiable from other Contractor personnel.” Are uniforms required to work in shop areas to support this contract, or we ask the government to define the expected dress code.
Uniforms are not required, however to be able to identify supervisors a simple laminated sheet of paper with ‘Name of company and supervisor embossed’ will suffice. This is in conjunction with all Contract personnel being expected to dress in accordance with government standards and displaying FEMA Identification as outlined per agency standards.
74. The government states:” The Contractor shall ensure that all personnel display the badge on the outermost garment at all times when performing work under this contract.” Is this a FEMA-issued badge (identification) or a contractor issued badge?

75. This section is confusing in its intent. Typically, travel to and from the worksite (for work reporting/daily efforts) is not reimbursable; however, travel conducted in direct support of work requirements typically is. Please define this section more fully, with specific examples of the government’s intent in addition of the wording of the paragraph. Also, there is no specified location provided in the section.
The only travel that might be done besides work reporting/ daily efforts on site is picking up parts. Picking up parts will be accomplished using FEMA vehicles, therefore there will not be a need for reimbursement.
76. The government states contractors are authorized to use FEMA on-site vehicles, but may have to provide their own vehicles. This is vague for pricing parameters; are vehicles available for use by the contractor to support work at each site, or do contractors have to provide vehicles for each site?

77. There is no preventative maintenance schedule provided as an attachment to the PWS as indicated. Request the government provide this missing attachment, and extend this solicitation to allow for adequate review of the contents for planning.

78. FEMA states it retains the right to “swap” equipment (e.g. substitute) of comparable classes without submitting a price modification. We can support this to the extent that substituted equipment does not require specialized support certifications, tools, etc. that would NOT have been encountered under the terms of the original equipment inventories. Will the government agree to provide relief for the contractor in these events?
Yes. The Agency will not swap equipment that falls outside of the current outlined equipment types as laid forth in the equipment listing, but an individual listing will be provided.

Current bench stock levels are maintained by the incumbent and have not been released to the Agency. It is maintained in accordance with each individual location. Prospective bidders can review the equipment list and identify common parts/supplies that will be required according the manufacturer recommended maintenance and standards.
81. No PMS schedule is provided for review; request the government provide the PMS as an attachment as specified within the PWS.

82. How is the contractor reimbursed or are towing operations invoiced (as are DOT inspections)? The government does not indicate how the offeror is to invoice for towing requirements.
The government will not reimburse towing expenses for equipment that requires towing outside of the DC Location. If the equipment breaks in the possession of the Contractor, then it is the Contractor’s responsibility to ensure the equipment is returned to the Distribution Center.
83. Attachment B – Price/Cost Schedule The base period indicates 1,040 hours yet has the dates for the Base period of 5/16/2018 to 11/15/2019. Both of these numbers we believe are wrong for delivered hours. Request the government review and correct. The base period is 6 months. This typo has been corrected via Amendment I
84. Is there any overtime expected to be performed in support of this contract?
Overtime is not expected to be performed under this solicitation.
85. The Contractor is required to keep a minimum of 5% bench stock of commonly expendable items to include lubricants, fluids, and trailer tires. Will the government provide the current historical listing of the Bench Stock No. Prospective bidders should review the equipment list and identify the requirement for bench stock in line with manufacturer recommended maintenance.
86. The personnel provided in response to this solicitation and future hires must have current maintenance certifications, qualifications and experience as documented through submission of résumés. Will the government do away with the resume requirement since the contractor must insure that all the employees need to be qualified and the requirement to give first right of refusal to the incumbent work force?

97. Per evaluation criteria for Factor 2, offerors should document the experience and qualifications of their workforce performing these services on relevant equipment. Is it acceptable and not counted against page limitations if offerors provide documentation as attachments or appendices to their technical volume? All responses to Factor 2 shall fall within the page limitation of 50 pages. Deliverables required for proposal submission (such as PWS deliverables) are NOT included within the page count limitations.
98. Paragraph 5.6 of the PWS states that SAMS is to be utilized for entry of all work orders. It also states that “in the event where SAMS is unavailable, an alternate database must be maintained in coordination with FEMA personnel.” Is SAMS currently unavailable at any sites under this contract? If an alternate database must be maintained, is it provided by the Government? If the contractor must provide the database, will there be reimbursement for any necessary procurement, development, and/or training for this alternate database?
If SAMS in unavailable there will be no reimbursement for any database provided by the Contractor. The method of alternate database utilization will be discussed upon award.
99. Could the Government please clarify if the deliverables required for proposal submission (e.g., #4 Bio-Based Product List, #11 Quality Control Plan, etc.) included within page count limitations? Also, the PWS requires Offerors to provide certain deliverables in full (e.g., PWS paragraph 4.8, “The QCP shall be submitted as part of the technical proposal.”) while other deliverables do not have that explicit requirement (e.g., PWS paragraph 4.7.2, #7 Safety Plan).
