NOTICE FOR FILING AGENCY PROTESTS
United States Coast Guard Ombudsman Program
It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.
Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:

The U.S. Coast Guard (USCG) Surface Forces Logistics Center (SFLC) intends on awarding a contract with Firm-Fixed Price (FFP) Contract Line Item Numbers (CLINS) for Ultrasonic Side Scanning. The solicitation and award will be conducted in accordance with the procedures set forth in FAR Part 13.5. (i) This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
(ii) Solicitation number HSCG40-16-R-60629 is issued as a Request for Proposal (RFP).
(iii) This solicitation incorporates provisions and clauses in effect through Federal Acquisition Circular 2005-86 and as supplemented with additional information included in this notice.
(iv) This is considered a 100% total small business set-aside associated with NAICS code 541330, with a small business size standard of $15 Million.
(v) Contract line items - See Attachment 2: Schedule of Supplies/Services
(vi) Description of Requirements - The requirement is for Ultrasonic Side Scanning testing. The Contractor shall provide the necessary labor, equipment, materials, and supervision to safely perform side scanning services and comply with all Federal, State, and Local requirements. The offeror shall accomplish all work as scheduled in Attachment 1: Statement of Work (SOW).
(vii) Date(s) and place(s) of delivery/services and acceptance and FOB point - The period of performance (POP) is for a base year and four (4) option years. Performance shall take place on board vessels in dry-dock at USCG Yard, 2401 Hawkins Point Road, Baltimore, MD 21226. Acceptance shall take place after review and approval of submitted side scan report.

INCURRING COSTS
The Coast Guard shall not be liable for any cost incurred by the Offerors in submitting offers in response to this solicitation, including any site visits by Offerors.
SUBMISSION OF ELECTRONIC PROPOSALS VIA ELECTONIC MAIL (EMAIL)
(a) In the “TO” line, Offerors shall submit their proposals to the following email address: erin.t.dugan@uscg.mil.
(b) Offerors shall submit their signed proposals as “PDF” documents except when specified otherwise.
(c) The Offeror’s electronic proposal shall be submitted according to the requirements set forth below:
(1) The entire proposal shall be submitted in .pdf format,with the exception of Attachment 2, Schedule of Supplies/Services. Attachment 2 must be submitted in an MS Excel format.
(2) Adobe Acrobat shall be used to create the “PDF” files. Separate files are required for Technical, Price and Past Performance submissions.
(3) In order to facilitate secure transmission, it is recommended that emailed files are compressed (zipped) into one, ZIP file using WinZip.
(4) The WinZip password shall be submitted under a separate email by the closing date and time of this solicitation.
(5) All submissions shall include PROPOSAL FOR HSCG40-16-R-60629 in the subject line of the email.
(d) Proposals submitted electronically will be considered late unless the offeror completes the entire transmission of the proposal before the closing date and time for receipt of proposals under this solicitation. Late proposals will not be eligible for award. Proposal transmission must be completed by April 4, 2016 at 11:00am EDT. Please Note: As applicable, these submission instructions will also apply to any future correspondence related to this solicitation.
(ix) FAR 52.212-2 -- EVALUATION -- COMMERCIAL ITEMS. (OCT 2014) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered BASIS FOR AWARD Lowest Price Technically Acceptable (LPTA): In accordance with FAR 15.101-2, award of this contract will be made upon the basis of the lowest evaluated price of the proposals that are found to meet or exceed the acceptability standards for non-cost factors. The Government will evaluate the lowest-priced proposal first for technical acceptability and acceptable past performance. If found to be acceptable, evaluations will stop and award will be made to that offeror. If found to be unacceptable in either technical or past performance, the Government will move to the next-lowest-priced proposal and repeat the evaluation. This process will be followed until award is made. The following factors shall be used to evaluate offers:

(2) Past Performance Government evaluators will not assume that the offeror possesses any capability or knowledge unless it is specified in the proposal.
(1) TECHNICAL (a) Key Personnel A rating of Technically Acceptable or Non-Acceptable will be assigned upon completion of the Personnel evaluation.
(i) All Scanning operations shall be completed by personnel meeting the following qualifications at a minimum: American Society for Nondestructive Testing (ASNT) Recommended Practice No. SNT-TC-1A as stated within the SOW under Section 1.3 Objectives/Scope.
(ii) The Offeror shall submit resumes for SNT Level III Analysts (Supervisor and alternate) as stated within the SOW under Section 1.4.10 Key Personnel. This individual will be directly responsible for all work performed and possess the necessary authority to act on behalf of the Contractor.
(iii) Scanning Personnel: The Offeror shall submit resumes detailing qualifications such as experience, training, and certifications for all scanning personnel in accordance with Section 1.4.11 Scanning Personnel of the PWS. Scanning personnel shall have a minimum of two (2) years documented experience providing scanning operations and possess current certification from ASNT recommend practices number SNT-TC-1A.
(1) TECHNICAL (b) Response Time A rating of Technically Acceptable or Non-Acceptable will be assigned upon submission of statement ensuring Contractor shall meet the 48 hour response time after notification. The offeror shall submit a statement that they are able to provide requested side scan services within 48 hours of notification as stated in Section 1.3.5 of the SOW.
(1) TECHNICAL (c) Quality Control Plan A rating of Technically Acceptable or Non-Acceptable will be assigned after completion of Quality Control Plan Evaluation.
The Offeror shall submit a Quality Control Plan in accordance with Section 1.4.1.1 of the SOW. The plan will be evaluated based on quality and thoroughness of the plan. The plan shall include, at a minimum, the following information:
(i) The quality control organizational structure.
(ii) A description of the methods of identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable.
(iii) A description of the methods of documenting and enforcing quality control operations of Contractor, and any Subcontractor, work, including inspection and testing
(1) TECHNICAL (d) Equipment A rating of Technically Acceptable or Non-Acceptable will be assigned upon submission of ownership or the ability to lease the following side scan equipment as stated within the Statement of Work 1.3 and 1.3.1.6. The Offeror shall submit proof of ownership or the ability to lease the side scan equipment indicated in Section 1.3 and 1.3.1.6 of the SOW. Note: The echo to echo transducer is not authorized due to inconsistent readings and technical difficulties.
(2) PAST PERFORMANCE
A rating of Technically Acceptable or Non-Acceptable will be assigned upon completion of the Past Performance evaluation.
(a) Offerors are required to forward Attachment 3 Past Performance Questionnaire to three (3) past or current contracting references (including Federal, State and local Government) for which the offeror has provided similar Ultrasonic Side Scanning Services. The reference shall return the completed PPQ via electronic email to erin.t.dugan@uscg.mil by the proposal response day and time of March 22, 2016 by 11am EDT.
(b) Offerors without relevant past performance history will receive a Neutral Rating for past performance. The offeror will be evaluated neither favorably nor unfavorably on past performance. Relevant Past Performance history will be rated higher than Neutral past performance.

(3) PRICE
All CLINS shall be priced. The offeror shall complete the Excel Spreadsheets Attachment 2 Schedule of Supplies/Services for all CLIN pricing information. This shall be considered the pricing proposal. Spreadsheets shall be in EXCEL; not PDF. Any formulas should be locked, but prices shall be able to be copied for the Government’s ease of use. Incomplete schedules WILL result in the offer being determined nonresponsive and WILL be excluded from further consideration for award.
(a) The Fixed Price CLINS shall be multiplied by the estimated number of scans per vessel to arrive at the estimated Total Cost of each year of the contract.
(b) The Government will evaluate offers for award purposes on the total of all CLINs including all option years, added together to arrive at an aggregate total.
(c) Evaluation of options shall not obligate the Government to exercise the option(s).
NOTICE OF AWARD
A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(x) Include a completed copy of the provision at 52.212-3, Offeror Representation and Certifications – Commercial Items (Feb 2016) The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (q) of this provision.
(a) Definitions. As used in this provision--
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
“Subsidiary” means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
“Veteran-owned small business concern” means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
“Women-owned small business concern” means a small business concern --
(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and
(2) Whose management and daily business operations are controlled by one or more women.
“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
(b)
(1) Annual Representations and Certifications. Any changes provided by the offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications posted on the SAMwebsite.
(2) The offeror has completed the annual representations and certifications electronically via the SAM website accessed through https://www.acquisition.gov. After reviewing the SAM database information, the offeror verifies by submission of this offer that the representation and certifications currently posted electronically at FAR 52.212-3, Offeror Representations and Certifications—Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard applicable to the NAICS code referenced for this solicitation), as of the date of this offer and are incorporated in this offer by reference (see FAR 4.1201), except for paragraphs ____________. [Offeror to identify the applicable paragraphs at (c) through (q) of this provision that the offeror has completed for the purposes of this solicitation only, if any. These amended representation(s) and/or certification(s) are also incorporated in this offer and are current, accurate, and complete as of the date of this offer. (B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability.
