NOTICE FOR FILING AGENCY PROTESTS
United States Coast Guard Ombudsman Program
It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.
Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:

Performance Work Statement for Lease of a Command and Control Aircraft
1. General
1.1. Scope
The purpose of this Performance Work Statement (PWS) is to obtain a lease agreement for an executive transportation aircraft (Gulfstream G-V or equivalent) configured to serve as a Command and Control (C2) aircraft for the Commandant of the US Coast Guard and the Secretary of the Department of Homeland Security. The primary location of the aircraft will be U.S. Coast Guard Air Station Washington, located at Ronald Reagan Washington National Airport.
1.2. Background
The primary mission requirement is to provide the Secretary of the Department of Homeland Security (SECDHS) and the United States Coast Guard Commandant with rapid, safe, efficient transportation to locations around the globe. The lease aircraft must be configurable to provide administrative equipment capabilities similar to the office, and unrestricted secure C2 communication capabilities that provide the flexibility to maintain awareness of emergent situations, enable operational tasking, and perform normal duties while en route. The Commandant, as one of the five military service chiefs, needs to safely and reliably deploy to destinations throughout the world to manage Coast Guard missions mandated by U.S. Statute including Maritime Security, Enforcement of Laws and Treaties, Maritime Safety, Protection of Natural Resources, Maritime Mobility and National Defense. This transport is required to respond to national and international emergencies in which Coast Guard resources are needed, including environmental disaster relief operations (hurricane, flood, earthquake), marine environmental responses, major search and rescue operations, mass migrant interdictions, etc; participate in national security planning and operational military exercises, conduct formal visits to Coast Guard facilities; conduct formal visits to foreign governmental and maritime officials/entities, maintain personal security; and command and control during wartime and/or national emergencies.
1.3. Contractor Personnel
1.3.1. The contractor shall provide a Project Manager (PM) who shall be responsible for all contractor work performed under this PWS. An alternate PM shall be assigned during periods of unavailability of the primary PM. The PM is designated as Key by the Government (see page 25 and 39). The PM or alternate shall be available to the Contracting Officer’s Technical Representative (COTR) via telephone at all times; see page 42 for additional COTR information. The PM shall respond to a request for discussion or resolution of technical problems within 1 hour of notification.
1.3.1.1. The PM will be responsible for coordinating the execution of aircraft modification, maintenance and support functions of this contract. These duties include but are not limited to coordination and logistical support for parts delivery; coordination and scheduling of training, aircraft modifications and depot repairs; tracking and entering of maintenance actions into an FAA-approved maintenance database; and update and delivery of any technical data supplied under this contract.
1.3.1.2. The PM and any alternates shall hold an FAA Airframe and Powerplant certification, shall be familiar with the maintenance program for the aircraft type provided under this contract, and shall be able to read, write, speak and understand English.
1.3.1.3. The PM shall be a single point of contact for the Contracting Officer and the Contracting Officer’s Technical Representative. The name of PM, and the name(s) of any alternate(s) who shall act for the contractor in the absence of the PM, shall be provided to the Government as part of the contractor's proposal. During any absence of the PM, only one alternate shall have full authority to act for the contractor on all matters relating to work performed under this PWS.
1.3.1.4. Due to the nature of operations at Coast Guard Air Station Washington, the PM shall be available to the COTR via telephone at all times. The PM shall respond to a request for discussion or resolution of technical problems within 1 hour of notification. On-site support at U.S. Coast Guard Air Station Washington, Ronald Reagan Washington National Airport, is required for a minimum of one 8-hour workday per week (after the aircraft is delivered), and during any aircraft maintenance activities (not including routine servicing).
1.3.2. Employee Identification. Contractor employees visiting or working at Government facilities shall wear a contractor identification badge that, at minimum, displays the contractor name, the employee’s photo, name, clearance-level and badge expiration date. Visiting contractor employees shall comply with all Government escort rules and requirements. All contractor employees shall identify themselves as contractors when their status is not readily apparent and display all identification and visitor badges in plain view above the waist at all times.
1.3.2.1. Contractor employees working on-site at Government facilities shall wear a Government-issued identification badge. All contractor employees shall identify themselves as contractors when their status is not readily apparent and display the Government issued badge in plain view above the waist at all times.
1.3.3. Employee Conduct. Contractor’s employees shall comply with all applicable Government regulations, policies and procedures (e.g., fire, safety, sanitation, environmental protection, security, “off limits” areas, wearing of parts of military uniforms, and possession of weapons) when visiting or working at Government facilities. The contractor shall ensure contractor employees present a professional appearance at all times and that their conduct shall not reflect discredit on the United States, the Department of Homeland Security or the U.S. Coast Guard.
1.3.4. Removing Employees for Misconduct or Security Reasons. The Government may, at its sole discretion, direct the contractor to remove any contractor employee from U.S. Coast Guard facilities for misconduct or security reasons. Removal does not relieve the contractor of the responsibility to continue providing the services required under this PWS. The Contracting Officer will provide the contractor with a written explanation to support any request to remove an employee.
1.3.5. Conflict of Interest. The contractor shall not employ any person who is an employee of the United States Government if that employment would, or would appear to cause a conflict of interest.
1.4. Key Personnel
The Project Manager is considered Key by the Government in accordance with HSAR 3052.215-70, Key Personnel or Facilities.
1.5. Security
Performance of the requirements under this agreement may require contractor access to Secret information. As such, the PM and alternate PM must have a current clearance appropriate to the level of security. Procedures for handling tracking, marking, and storing of classified material will be outlined in the DD Form 254.
The contractor will be required to provide a person or persons with appropriate clearance obtained in accordance with DOD Manual 5220.22-M, National Industrial Security Program Operating Manual. Subcontractors providing sale/lease or training do not require a clearance.
1.6. Period of Performance
The period of performance for this PWS is one year from the date of award, with (4) four (1) one-year option periods.
1.7. Place of Performance
The primary place of performance will be the U.S. Coast Guard Air Station Washington, located at Ronald Reagan Washington National Airport. Air Station Washington has a secure area with controlled access for the aircraft.
1.8. Hours of Operation
Contractor employees shall generally perform all work between the hours of 0700 and 1600 Eastern Time, Monday through Friday (except Federal holidays). However, there may be occasions when contractor employees shall be required to work other than normal business hours, including weekends and holidays, to fulfill requirements under this PWS at no additional cost to the Government.
1.9. Travel
Contractor travel to accompany the aircraft to depot maintenance can be aboard the aircraft. Any additional travel costs shall be the contractor’s responsibility.
1.10. Kick-Off Meeting
The contractor shall attend a Kick-Off Meeting with the Contracting Officer and the COTR NLT three (3) business days after the date of award, or at a later date with the written approval of the Contracting Officer. The purpose of the Kick-Off Meeting, which will be chaired by the Contracting Officer, is to discuss technical and contracting objectives of this PWS and review the contractor's project plan. The Kick-Off Meeting will be held at Air Station Washington.
1.11. Project Plan
The contractor shall provide a draft Project Plan at the Kick-Off Meeting for Government review and comment. The contractor shall provide a final Project Plan to the COTR not later than five (5) business days after the Kick-Off Meeting.
1.12. Progress Reports
The contractor shall provide weekly reports detailing the progress of aircraft modifications, progress of ongoing depot maintenance, estimated entry date and duration of depot maintenance that will occur within the next 2 months or 200 flight hours. Additional information may be requested at the COTR’s discretion.
1.13. Progress Meetings
The PM shall be available to meet with the COTR to present deliverable status, discuss lease progress, exchange information and resolve emergent technical problems and issues. These updates may take place by telephone or during a weekly PM workday.
1.14. General Report Requirements
The contractor shall provide all written reports in electronic format using applications that are compatible with Coast Guard Standard Workstation III (Windows XP and Microsoft Office Applications).
