3.3 52.212-2 EVALUATION - COMMERCIAL ITEMS. (JAN 1999)
(a) This is a best value acquisition. The Government will award a single contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be the most advantageous to the Government, price and all other evaluation factors considered. Selection and award of the resultant contract award will be based on a review of the offerors’ technical approach (including subfactors), the offerors’ relevant past performance, and the offerors’ price. The Technical Approach subfactors are equal in weight. Technical Approach is more important than Past Performance. When combined, they are more important than Price. The Government reserves the right to award to other than the lowest price offerors. The following factors shall be used to evaluate offers to determine best value:
Factor 1 – Technical Approach (Proposals shall be evaluated on the factor level. The use of the following equally-weighted subfactors is an aid to determine the overall factor rating.):
Subfactor 1– Technical Capability: The Government will evaluate each offeror’s Technical Proposal, including their draft curriculum, in order to determine their capacity to perform all the requirements outlined in the Statement of Work (SOW) [ATTACHMENT 1].
Subfactor 2– Management Approach: The Government will evaluate each offeror’s approach and project plan towards managing the effort, demonstrating their ability to provide timely, cost effective and efficient contract and program management to include any subcontractors or teaming partners to accomplish the requirement in the SOW.
Subfactor 3 – Staffing: The Government will evaluate each offeror’s Staffing Plan and Resumes in order to determine their ability to attract, retain and motivate top quality personnel with the critical skills and abilities IAW the SOW, both at contract award and during contract performance, and to determine the offeror’s policies regarding employee conduct including, criminal background, sexual harassment, training, and attire.
Factor 2– Relevant Past Performance: Provide past performance information for services directly related and relevant to the services to be performed under the SOW. To be considered relevant, the services must have been performed within the past three years.
Factor 3 – Price: The Government will evaluate the total overall price to determine price reasonableness.
Technical Approach is more important than Past Performance. When combined, they are more important than Price.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
3.4 52.212-3 -- OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL ITEMS. (AUG 2009) Alternate I (APR 2002)

This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159.
