Q+A Addendum Matrix Q+A Addendum Matrix
Question Number Industry Question/Comment Industry Recommendation and Resulting Benefit to DHS DHS/USCG Response
| ADDITIONAL TIMELY QUESTIONS | ||
| 1 | If offerors include text in tabular/table form for resumes and past performance (Attachment 4), can we use single line spacing and 9 font size? If not in tabular/table form, can we use single line spacing and a reduced font size? | See the amended Section L-6 of the RFP. |
| 2 | For proposal subsection II.A.4 (“Miscellaneous”), will DHS consider other information/data that does not logically fit in the other sections of Volumes I and II, and make it available to the evaluation panel as part of Volume I data? | Per the RFP, the "Miscellaneous" section" may include "other information necessary for your proposal to be complete that does not logically fit in the other sections of this Volume II, such as any Organizational Conflict of Interest (OCI) Mitigation Plan." |
Information provided in Volume II shall be limited to non-technial information. Technical information shall be provided in Volume I.
| 3 | Are there uniform standards for the evaluation of Miscellaneous (subsection II.A.4) information/data and if so, what specific information/data should offerors consider in the Miscellaneous subsection for evaluation? | See the amended Section M-4 of the RFP. |
| 4 | The first paragraph of Section D: Price (Factor 4) indicates that "The aforementioned rates and savings clause discounts offered in the attachment shall be (1) used to evaluate the offerors price". Section M-3.1.4 Factor 4: Price further states that "The offeror's proposed Section B.7 discounts and cost reductions will be evaluated in terms of potential benefits and savings to the government." Can the Government elaborate on their intended evaluation techniques of the discounts and provide examples? | The previous two Section B-7 savings clauses have been removed. |
Please see the amended Sections B-7 and M-3.1.4 in the RFP.
5 The provisions of this Cumulative Volume Discount Clause indicate that the contractor will be required to remit to the Government an amount equal to the value generated by multiplying the amount of the Awarded Task Order(s) within a calendar year by the proposed percentage within the corresponding dollar value range. Based on this discount application methodology, can the Government please clarify the following:
A. For purposes of assessing and applying the proposed discount, does the "total value of all Task Orders awarded within a calendar year" refer to Base Period of the Task Order(s) only, or the total value to include Base and any Options?
B. If an Awards are received at the end of a calendar year whereby the contractor is expected to receive little or no associated revenue in that calendar year, will the Government require the contractor to render the discount credit in advance?
| See the answer to question 4 above. |
| (continued from above) |
C. In the event that the offeror provides the Government with an invoice credit based on the total face value of Awarded Task Order(s) within a calendar year, and/or the total amount of a task order is not fully realized (collected) by the Contractor during Task Order Performance, how does the Government intend to credit the contractor the overpayment of discount?
| 6 | For the Cumulative Volume Discount, since paragraphs (a) and (d) indicate that offerors are responsible for the tracking and accurate reporting of when discounts are applicable, will the Government permit offerors to propose their own range of values with proposed discounts? | See the answer to question 4 above. |
| 7 | The volume discounts referenced in this section are based on awarded task order values by calendar year. It is recommended that this language be changed to measure and calculate volume discounts against task order revenue realized by the offeror by calendar year. | See the answer to question 4 above. |
| 8 | Section B-7 contains the foot note [*These values are to be provided by the Contractor in its proposal - See Section J, Attachment 3]. Please confirm that offerors are permitted to propose a zero discount for all or some of the discount values for either part (A) Cumulative Volume Discount or (b) Cost Reductions for Repetitive High-Dollar Value requirements. | See the answer to question 4 above. |
| 9 | Paragraph (b) implies that task orders that qualify as Repetitive High-dollar Tasks will be identified in the task order solicitation. Paragraph (d) of RFP Section B-7 Savings Clause indicates that Contractors are responsible for accurately reflecting this information in response to task order solicitations. For planning purposes, and to better understand the application methodology, please confirm that the offeror's proposed discounts at the contract level for Repetitive High-dollar Value Requirements would be included in the task order proposal response. | See the answer to question 4 above. |
| 10 | Please confirm that this Savings Clause related to Cost Reductions for Repetitive High-Dollar Value Tasks applies to both FFP and T&M type task orders and that the reductions may be proposed to hourly rates, level of effort, or a combination of both. | See the answer to question 4 above. |
| 11 | To assist offerors in preparing their response to this savings clause, can the Government provide specific parameters of what constitutes a high-dollar value task order? For example, is there a minimum dollar threshold or a minimum task order duration period (in terms of years) associated with a high-dollar value task? | See the answer to question 4 above. |
| 12 | Please confirm that the Yearly Reduction profile presented in B-7 (b) is Task Order Years, not IDIQ Contract Years. For example, if a qualifying task order consisting of a Base Year plus two One-year Options is issued in the third year of the IDIQ base ordering period, the corresponding discounts applied from the % Reduction table would be as follows: |
- Task Order Option Year 1 = % Reduction Year 2
| - Task Order Option Year 2 = % Reduction Year 3 | See the answer to question 4 above. | ||
| 13 | Can the Government provide examples of repetitive task areas eligible for the Repetitive High-dollar value requirements, in the context of what is presented in RFP Section C - Description/Specifications/Statement of Work? | See the answer to question 4 above. | |
| 14 | Columns E and F of this Attachment 10 spreadsheet require offerors to provide the "Offeror Proposed Education" and "Offeror Proposed Relevant experience" respectively. Spreadsheet columns C and D provide the stated minimums for education and minimum relevant years of experience for each category. Since offerors will be proposing their own position descriptions per RFP L-8 Section D: Price (Factor 4), are offerors permitted to propose different educational and experience minimums in Attachment 10, based on their own position description for each labor category? | No. Offerors must meet the amended Attachment 10 qualifications. | |
| 15 | For pricing purposes, what starting date should offerors assume for the five year base ordering period? | Anticipated award and effective date are both fourth quarter of 2011 (July-Sept). | |
| 16 | Please confirm that offerors are not required to bid on every TO issued under a domain in which they are an IDIQ contract holder. | See the amended Section G-4.1 of the RFP. | |
| 17 | The Cumulative Volume Discount is stated to be based on the Task Order Award Amount. Will there be a defined process for retroactively adjusting the discount applied - considering that the total value of a year and thus the discount % may change as well - if the actual task order value realized during performance is less than or greater than the Award Amount? | See the answer to question 4 above. | |
| 18 | When evaluating each offeror's price for fairness and reasonableness, and in determining unrealistically high or low pricing, will the government review an offeror's proposed price in the context of the position descriptions they provided, given that offerors will be providing a wide variety of labor category definitions and descriptions that may have a material impact on how an offeror priced their labor categories? | The offeror must meet the amended Attachment 10 qualifications. |
Per the amended Section M-3.1.4 of the RFP, "The Government expects adequate price competition to establish fair and reasonable pricing. The Government will also evaluate the proposed rates and prices to determine if they are realistic using proposal analysis techniques consistent with FAR 15.404-1, Proposal Analysis Techniques."
| 19 | Can resumes be single-spaced - in order for the Government to be able to have more information about the proposed candidates? | See the amended Section L-6 of the RFP. |
| 20 | Given the level of detail requested in Volume II, will the Government allow single spacing for all sections of Volume II? | See the answer to question 19 above. |
| 21 | The RFP is very prescriptive about the "DHS Acquisition Lifecycle Framework" in the introduction to Domain 1 (C.2-1 on page 5). Should the offeror presume that DHS intends for this same Framework to apply to Domain 2 (C.2-2 on p.6)? | See the amended Section C-1.2 of the RFP. |
| 22 | Please clarify the Government's expectations in writing, "Where applicable, the Offeror shall submit documentation demonstrating offerors’ teaming arrangements." Specifically, which details does the Government wish to know? | "Documentation" does not necessarily mean the entire legal agreement between offerors. Offerors may summarize or describe their teaming arrangements but must provide enough information to meet the Section L-8 of the amended RFP requirements, keeping in mind the page limitations specified in Section L-6. |
| 23 | What is the weight distribution among the non-price factors? | See the amended Section M-3 of the RFP. |
| 24 | Please explain how the Government will quantitatively evaluate the discounts proposed for both the Cumulative Volume and Repetitive High-dollar Value Clauses. | See the answer to question 4 above. |
| 25 | Does the scope of Domain 2 include traditional CFO services such as financial audit readiness/remediation, OMB circular A-123, Appendix A, and financial statement audit support? | All Domain 2 requirements are related to acquisition. |
| 26 | Because the clause, 52.212-4 Contract Terms and Conditions – Commercial Items sets out a number of contractual provisions including some that are at variance with other provisions in the solicitation including the order of precedence in 52.212-4 with clause 52.215-8 will the Government amend the solicitation to clarify that the provisions at 52.212-4 have precedence over any conflicting terms due to the fact that this is a commercial item acquisition? | See Section H-34 of the amended RFP. |
| 27 | Contract Clauses 52.237-3 Continuity of Services - Is it the Government’s intent that the awardee offer employment to the employees of any incumbent contractor? If so, Please identify every incumbent contractor and state whether this provision was included in any incumbent contract. | FAR 52.237-3, Continuity of Services, may be applicable at the task order level if deemed appropriate by the Task Order Contracting Officer. |
| 28 | The government states that DHS seeks prices substantially lower than prices on existing contract vehicles. Given that this statement appears in Section M as part of the Factor 4: Price evaluation criteria, can the Government explain how this evaluation will be conducted. To assist offerors in better understanding this facet of the Price evaluation, could the Government elaborate on: |
A.) If the types of contracts included in this analysis will be aligned with FAR Part 8.4 Federal Supply Schedules and FAR Part 12 Acquisition of Commercial items for consistency with the TABSS acquisition strategy?
B.) How price comparisons will take into consideration differences in labor category titles, position descriptions, functional alignment, minimum qualifications and the time frames associated with the offeror's other contracts?
| Per the amended Section M-3.1.4 of the RFP, "The Government expects adequate price competition to establish fair and reasonable pricing. The Government will also evaluate the proposed rates and prices to determine if they are realistic using proposal analysis techniques consistent with FAR 15.404-1, Proposal Analysis Techniques." | ||||
| 29 | Pursuant to the instructions in L-8, Section D: Price that Offerors are to provide their own position description for each TABSS labor category; May offerors develop and propose different descriptions for a labor category that applies to multiple domains based on the functional specificity of that Domain? | Position descriptions are being provided by the Government. Offerors should meet the proposed requirements outlined in the amended Attachment 10. | ||
| 30 | Please confirm that DHS will post any information pertaining to TABSS on a DHS INTRANET site (not "internet site"), and that it will be accessible only to DHS officials - not anyone from industry. | See Section H-24 and the amended Section H-25 of the RFP. | ||
| 31 | Regarding the sentence, "The Offeror must clearly demonstrate its knowledge of DHS, DHS components, and the scope of requirements involved in the offeror’s proposed Domain." Please confirm if the offeror must demonstrate experience in each SOW area in each DHS components - or only at a broader level throughout DHS given the page limitation. | The offeror has discretion as to how they choose to meet this requirement as long as they comply with the page limitations. | ||
| CLARIFICATIONS | ||||
| 32 | ||||
| (Originally Question 8.251 in the TABSS Q+A Matrix) | May we use a blended labor rate? | "Blended labor rate" is not used in the RFP. All labor rates should be ceiling rates. |
DHS requires a single rate for each labor category to be performed by the offeror and subcontractors. Since this is a competitive procurement, DHS is not advising how the contractor should develop labor rates.
| (Originally Question 8.277 in the TABSS Q+A Matrix) | Is the Offeror required to have an approved Government Cost Accounting System under this contract? Is a DCAA compliant system acceptable under this contract? | Under T&M orders, the Contractor shall maintain an adequate accounting system to substantiate billings (including any subcontractor hours reimbursed at the hourly rate in the schedule) for labor hours billed and labor qualifications. |
| 34 |
| (Originally Question 8.283 in the TABSS Q+A Matrix) | For Other Direct Cost, is the “Contractor Rate” a percentage or total amount of the Government Estimate? | Contractor rate means the contractor's proposed indirect rate(s) applicable to material, subcontracts supplies and incidental services, and ODCs. |
| 35 |
| (Originally Question 8.303 in the TABSS Q+A Matrix) | Attachment 3A – Price Spreadsheet, Domain 1: What is meant by “Contractor Rate” for Other Direct Costs (ODCs)? | See the answer to question 34 above. |
| 36 |
(Originally Question 8.312 in the TABSS Q+A Matrix) Reference Section H.29 Uncompensated Overtime. Will an Offeror be permitted to bill on a total time accounting (for all hours worked) assuming the scope has been approved by the Contracting Officer and such billing methodology is IAW the Offeror’s standard practices? If the established accounting practices described in the contract are to record and bill all hours worked, including uncompensated overtime, the contractor will be permitted to propose and bill all hours worked accordingly at the task order level.
However, invoicing must be consistent with the type of task order and other terms and conditions of the IDIQ contract and individual task order.
