FAR (48 DFR) 53.243

A. The hour and date specified for receipt of offers is hereby extended to March 3, 2008 at 16:00 EST.

B. Paragraph A of Section 11.9 of the SOW is hereby deleted in its entirety and replaced with the following:

The Contractor is responsible for providing any training required by state or local jurisdictions pertaining to the use or carriage of any lethal or less-than-lethal weapons (i.e. expandable or straight police baton, sprays or repellants, conducted energy weapons, stun weapons, etc.), equipment, or devices required in this Contract.

C. Exhibit 4F is hereby deleted in its entirety and replaced with the attached.

D. Volume I, Technical Proposal shall include the socio-economic plan.

E. The following questions and answers are hereby provided for informational purposes only.

1) Amendment 2 – Question 9(b) : Indicates NO to “Should the Socio-Economic Plan be included in Volume I instead of Volume II?

There seems to be a contradiction with the above – should the Socio-Economic plan be in Vol I or II?

Answer: The answer to Question 9 (b) in Amendment 02 is hereby changed to “Yes”. See paragraph D of this amendment.

2) Question #1 in Amendment 6 states: "Amendment 3 answer to question 21 states Yes, the contractor is responsible. Is it then your determination that the contractor is responsible for 32 hours of annual firearms training? Answer: Yes" With over 500 officers on this contract, this amount of annual firearms training will result in a huge cost to the Government over the term of this contract. Is it the Government's intent for the successful offeror to provide 32 hours of firearms training per year per officer?

Answer: The 32 hours of training refers to the basic firearms training only. Annual weapons refresher training is required as per Exhibit 4F (See paragraph C of this amendment).

3) Generally, we would like to know whether to base our proposed option year labor rates on the wages in out years specified in the collective bargaining agreements attached to the solicitation.

Specifically, whenever one of the collective bargaining agreements attached to the solicitation specifies a wage rate covering one of the optional ordering periods (options I, II, III, or IV), should offerors base their offered labor rates for that option period on the wages specified in the collective bargaining agreement for the option ordering period?

The reason we are asking the question is that FAR 52.222-43 (which is included in the solicitation) contemplates price adjustments based on revised wage determinations effective at the beginning of each option year, but includes a certification by the contractor that "the prices in this contract do not include allowance for any contingency to cover increased costs for which adjustment is provided under this clause." Including a contingency in an offered price to account for a wage determination that might or might not be issued in the future would clearly be such a "contingency" under the clause. However, wherever the collective bargaining agreements attached to the solicitation already specify the wage that covers an option year, it is not clear to us whether basing our offer on that already known and required rate would be considered a prohibited "contingency" under the clause.

Answer: Predecessor CBA/Existing CBA out year rates are not enforceable rates after the base period of performance.

F. All other terms and conditions remain unchanged.

EXHIBIT 4F

The Contractor must present and certify eight (8) hours of annual baton and/or OC Spray (as appropriate) refresher training and annual weapons qualification using the course of fire in Exhibit 4E of this Contract. The Contractor must coordinate with the Contracting Officer for FPS to monitor the course of fire.
