Government Estimates that appear in Q&A responses #70 & #77?

ICE Response

Yes.

Amendment 4: Q&A response #70

Question: The response to Q&A #70 states, “Government estimates approximately 10 officers for this requirement”. Does the Government estimate 10 officers total, or 10 per suggested hub?

This means 10 officers total.

Question: The response to Q&A #77 states, “Government estimates approximately 3-5 passenger vans and 1-2 sedans”. Does the Government estimate reflect total vehicles, or are these estimates referring to the number of vehicles per suggested hub?

This estimate reflects total vehicles.

Amendment 4: Q&A response #121: Contractor’s Transportation

Officers must be licensed, and have firearms licensed in each state they operate in

Question: Will the Government reimburse or provide funding for the successful contractor to pay for costs associated with employee licensing in each state? This is not only a huge cost, but also a time and logistics issue if officers need to perform licensing certifications in-person for each state in which they operate.

ICE Response

No. The Government will not reimburse the contractor for costs/fees associated with licensing of the officers.

Amendment 4, Q&A Responses #70 and #77

Question: Regarding the Government estimate for officers and vehicles (Amendment 4, Q&A

Responses #70 and #77) – If the Government estimates reflect the resources (+25%) currently being used to execute the contract, would the Government consider that the current contract is being performed adequately, or inadequately?

The +25% is to cover expected increase in our need for services in the future.

Section C.4 – Tour of Duty Restrictions

Question: Solicitation states, “If an employee is performing other duties for either the Contractor or another employer, those hours shall count against the fifteen (15)-hour on duty limitation.”

Does this indicate that contractors may not make use of part-time employees who have an alternate, full-time job?

ICE Response

Please refer to the PBNDS 2011 Transportation By Land Standards under Driving Hours and

Number of Operators. The vendors are expected to follow both PBNDS 2011 and applicable

DOT standards.

Amendment 4, Q&A Responses #70 and #77

Question: Because the Government has made its estimates of staffing and vehicles (Amendment

4, Q&A Responses #70 and #77) available to all offerors, there is a strong possibility that offerors may simply propose 10 Transport Officers, 3-5 vans, and 1-2 sedans. Our calculations based on the number of trips, mileage, drive time, wait time, and detainees to be transported reflect a gross understatement in the estimates provided by the Government. Does ICE prefer for the contractor to formulate their offer based on the PWS or based on the Q&A responses regarding staffing and vehicles estimates?

ICE Response

The combined information (PWS, estimates, and Q&A responses) provided by the Government should factor into the Contractor’s decision as to how they respond to this solicitation.

Question: Will the estimates that the Government provides in the Q&A (Amendment 4, Q&A

Responses #70 and #77) be incorporated in the solicitation’s PWS?

No. These numbers are merely estimates, and do not reflect the requirements exactly; therefore, they will not be incorporated into the PWS.

Question: If the successful contractor follows the Government estimates (Amendment 4, Q&A

Responses #70 and #77), and it is discovered after award that staffing and vehicle estimate do not meet transport demands, will ICE issue a Modification to increase staffing and vehicles?

ICE Response

The staffing and vehicle numbers are not determined in the PWS. The concept of PWS is for the

Contractor to determine Government’s solution without having the Government explicitly dictating what the Contractor should do. Therefore, the Contractor is to determine what staffing and vehicles are necessary for this requirement. The pricing table is structured so that the contractor is being compensated by the mileage and hours expended; therefore, if Contractor utilizes more mileage and more hours due to increased demand of this requirement or change in scope, a modification would be considered to increase scope.

Amendment 4, Q&A Responses #70 and #77

Question: Amendment 4, Q&A Responses #70 and #77 provide an estimate of Transport

Officers and Vehicles needed to perform this contract, however the PWS does not specify a total number of officers and vehicles required, only estimated number of detainees to be transported weekly. Will the Government amend the solicitation to include the estimates from Amendment

4, Q&A Responses #70 and #77?

No. PWS will not be amended.

General

Question: Will the government release completed, name-redacted G-391 forms for the past 3 months so that offerors can get an idea of wait times/movement types/etc?

ICE Response

The wait time is no longer separated. Please refer to revised CLIN structure under Amendment 4 of the solicitation. Over the past 6 months, the number of miles driven to meet the requirement has averaged approximately 20,000 per month. The Stationary Guard hours have averaged approximately 200 hours per month over the past 6 months. The number of detainees transported per month is approximately 460. Over the past three months, 1,282 detainees were transported.

Over the month of January 2017, 454 detainees were transported, 66 trips were performed, and on average, 13 trips were completed per week. Number of detainees per trip varied from 1 to 22.

Amendment 4, Q&A Responses #70 and #77

Question: Even using the least number of trips to be performed per week and not accounting for traffic, wait time between stops, or other factors such as speed, our estimate of the number of vehicles and personnel needed to successfully perform this contract within the law (as well as within the 1 hour response time dictated by the PWS) far exceeds the Government’s estimate

(Amendment 4, Q&A Responses #70 and #77). Does the Government intend to incorporate their estimates into the Solicitation now that all offerors will likely only use the bare minimum to remain competitive? What if the officer/vehicle estimate is not sufficient and it is discovered that additional officers/vehicles are needed? Will a modification or other contract adjustment be made after commencement of performance?

Reference Q&A Number 70.

Question: Does the ICE response of “approximately estimates 10 officers” refer to 10 officers per shift to cover 24x7 contractor responsibilities at both hubs?

This means 10 officers total, not per hub or shift.

14.

Number:

Reference Q&A Number 77

Question: Does the answer, “The Government estimates approximately 3-5 passenger vans and

1-2 caged sedan(s).” If the Government estimates 450,000 transportation miles per year this number of vehicles seems insufficient, especially when coupled with the estimated staffing.

Please explain.

ICE Response

The Government believes the estimate is reasonable. The estimates were made taking into consideration the number and types of trips historically required to satisfy the requirement. The actual future needs are not possible to predict for a requirement such as this.

Question: Can the responsibilities of the contractor Corporate Security Officer be collateral responsibilities of the Project Manager?

ICE Response

This can be considered if the proposed personnel have the adequate qualifications and authority within the company to meet the responsibilities of both Corporate Security Officer and Project

Manager.

C.2.A references armed and unarmed Transportation/guard Fixed Posts services.

Question: Does the unarmed aspect apply to the Fixed Posts services provided by the contractor?

ICE Response

The amendment 4 has taken out the unarmed part of the sentence. Refer to amended Section B-

M.

C.2.A references armed and unarmed Transportation/guard Fixed Posts services.

Question: If C.2.A does not apply to Fixed Post, what aspects of the contract can be provided by unarmed guards?

Question: Are Transportation Officers currently allowed to take their weapons with them at the end of their shift?

ICE Response

The contractor shall have its own internal policy to manage the company weapons that are issued to the contractor officers. It is entirely the contractor’s responsibility how the weapons are stored or where they can be kept after the officers’ duty hours.

Question: It is our understanding that aspects of this contract support operations in the

Philadelphia district. Please clarify.

ICE Response

The primary area of transportation is Maryland, but contractor maybe required to provide transportation in the Pennsylvania area.

Q&A 70

Question: The Government states that it estimates 10 officers are required. Does this mean that the Government estimates approximately 10 Transportation Officers (total # employees) in order to meet the maximum requirement of 500,000 miles per year (450,000 POV & 50,000 GOV)?

ICE Response

Refer to revised CLIN structure regarding guaranteed minimum miles per month. The

Government’s estimation is based on historical knowledge. The Contractor shall develop a staffing plan on total number of employees based on the requirements of the PWS and all other information provided by the Government throughout this solicitation process.

Question: Is the 10 officer estimate based on the current hours, which per other Q&A are 25% less than estimated in the RFP?

This includes 25% increase.

Officers in order to meet the minimum guaranteed requirement of 20,000 miles per month?

This estimate was to meet the total monthly estimate.

Question: Approximately how many employees are there on the current contract and how many hours is the current workforce able to provide each month?

This cannot be provided because it is incumbent’s proprietary information.

Question: Would the Government please advise what formula was used to base the estimate of

10 officers? For example, miles per officer, per team, with wait times and traffic factored in?

ICE Response

This is based on miles utilized and Government’s historical knowledge of managing the transportation contracts over the years.

Question: ICE responded. “The Contractor must be licensed and certified in each state they operate in and make sure that the insurance is valid in all of the states they operate in as well.

The Contractor is required to acquire all applicable state licenses, certifications and insurances.”

Question: Would the Government please advise the definition of “operate”?

ICE Response

It is up to the contractor to ensure they are operating legally in all states in which they may be required to transport detainees and thus carry fire arms. Operate in this response refers to transport or guarding of detainees.

Amendment 4, Q&A Responses

Question: The Q&A stated that “on call” time is not billable; what about “on duty time”? For example, a contractor schedules one 2-person transport team from 0800-1600 each day. During the day, runs are performed, but not necessarily starting at 0800 and ending at 1600. For example, 2 officers come in at 0800, and make a run from 0900-1300, return to Hub and make another run 1400-1600. Is the contractor able to bill the entire 8 hour period, since officers need to be on duty to respond within 1 hour to emergent runs?

ICE Response

No. The contractor shall only invoice for the hours that the officers were actually performing the transportation.
