Question: RE: Clin xxx4: If wait time exceeds 1 hour, even by 10 minutes, does the contractor bill the government for 1 hour?
ICE Response The CLIN structure has been changed and the contractor is not required to separately invoice for the wait time. The total hours that the Transportation Officer incurs during a transportation route inclusive of their wait time shall be invoiced to the Government under the Transportation Officer CLIN X004. However, the total hours of wait time shall be separately recorded for the monthly report per trip. All time should be billed rounded up to the nearest 15 minute increment (1 hour 15 minutes = 1.25 hours, 1 hour 22 minutes =1.5 hours).

ICE Response The Government estimated 450,000 miles based on current experience and the estimated work required for the future.

Question: RE: Clin Structure: The government is asking contractors to pin costs to a moving target in asking for a per mile rate for services as if we were a taxi service. Due to the unique nature of response times, variety of vehicles required, and mandatory wage compliance rules, the contractor will have to maintain certain infrastructure to support operations that are above and beyond “taxi” like service. In view of the overall RFP requirements, can the government provide a monthly fixed price CLIN that the contractor can use to recover fixed costs for training and other overhead hours and for other direct expenses (uniforms, ammunition, physicals, drug screening, etc.) rather than charging them to the “per mile rate”?
The CLIN structure has been changed to provide minimum guaranteed miles. See revised RFP.

Question: RE: Government mileage estimate: Are the 450,000 miles “guaranteed” by the government to the contractor?
ICE Response No, 450,000 miles are not guaranteed. However, the Government shall guarantee 20,000 miles per month under CLIN 0001, and the Option Year CLINs 1001, 2001, 3001, 4001, and 5001, if exercised.

Question: RE: If the 450,000 miles are not guaranteed, the contractor has nothing “solid” to use as the mileage rate divisor, and thus could very well “lose” money if mileage billed does not cover its costs. Can the government establish 2 mileage Clins as follows:

Question: RE: Is the offeror allowed to submit an “alternate” CLIN structure (alternate pricing) for this contract?
ICE Response No. RFP Section B.3 clearly indicates, “The Government will not consider alternate pricing structure.”

Question: RE: The xxx1 description states Billable time begins at pick-up point and ends at drop-off point; without a trip chart that CLEARLY defines daily, weekly, monthly frequencies it is not possible to accurately compute mileage or labor hours. Since this is a follow-on contract, can the government provide a better estimate of frequencies to avoid higher pricing than necessary?
ICE Response The Government believes the anticipated transportation routes table provided in the RFP Section C.3 is sufficient. In order to assist in the pricing of the proposal, the RFP has been revised to include the monthly guaranteed minimum and the Transportation and Guard Officers’ hours may now be billed separately from the mileage CLIN. See Attachment 4_CLIN Description_Amendment 4.

Question: RE: The RFP suggests the establishment of Hubs in Baltimore and Salisbury areas.
The first route in the Trip Matrix (C.3) lists this route as from Westminster to Frederick to Jessup to Baltimore; if the contractor’s Hub is in Baltimore, then the route would be Baltimore to Jessup (16 miles) to Frederick (46 miles) to Westminster (33 miles) and back to Baltimore (36 miles).
Since the Clin description for miles says billable miles are from point of pick up to drop off, are the billable miles 0 from Baltimore to Jessup; 16 to Frederick, 33 to Westminster and 36 to Baltimore (assuming detainees are picked up on Westminster and dropped off in Baltimore); or exactly which miles on this route would be billable?
ICE Response The CLIN Structure has been changed to include “Allowable Mileage for Hub Trips” under Transportation Services using contractor vehicles CLINs. Billable mileage from contractor hub to point of pickup is capped at 30 miles per trip. Billable mileage from point of drop off and back to hub is capped at 30 miles per trip. If actual mileage is less than 30, the actual number of miles should be invoiced. If actual mileage is greater than 30, only up to 30 miles per trip shall be invoiced.

Question: RE: Rather than asking the same question and typing out all routes from suggested hubs, it seems like the mileage rate only applies to one leg of the transport triangle; the triangle consists of the (1) distance from the Hub to the pickup point (2) to the drop off point and (3) return to the hub. Is the RFP stating that the 450,000 miles estimate applies ONLY to the distance between pickup point and drop off point, and that the contractor must determine the miles and time required to drive all three legs and build that into its mileage rate?

ICE Response The Government has determined including the cost of fuel in the Transportation Mileage CLIN is the best option for this requirement.

Question: RE: 1 hour response time is not realistic for all routes listed in C.3; in other ICE contracts involving transport, including the San Antonio AOR, a 2 hour response time was allowed; why is this different especially considering the density of traffic in this area?

No, 1 hour response time only applies to the Baltimore area listed in the RFP.

Question: RE: If an ad hoc route is required from Baltimore to Atlanta, the distance (per map quest) takes 10.75 hours which exceeds the daily allowable drive time per USDOT regulations.
Presuming the trip “could” be made in 10 hours with heavy foot (speeding), USDOT regulations would require an overnight stop. One has to either presume a Hub is required in each of the ad hoc field office locations (such as Buffalo, New York, etc) or that the mission would be identified the day prior to the pick up being required. Even then, the Baltimore to Atlanta run is problematic with regulations. Is it the government’s intent that contractors establish vehicle staging areas (Hubs) at these remote locations in order to comply with Federal rules for driver hours of service? (The USDOT will NOT bend to DHS requirements or exempt contractors from hours of service rules.)
ICE Response No, Hubs are not required in ad-hoc field office locations. The Maximum driving time (time on the road) is governed by USDOT. In the event that drivers may exceed the daily allowable drive time per USDOT regulations, the COR and/or the agency designee will approve for overnight lodging as required for the transporting of a detainee. Please refer to https://www.fmsca.dot.gov/regulations/title49/part/395 for federal motor safety regulations.

No. The Government will not provide the contractor with buses.

Question: RE: The RFP states: “The Contractor shall provide the interior security specification of the vehicles to ICE for review and approval prior to installation.” Does the contractor’s submission of interior specifications in its bid and the government’s award of a contract to a contractor suffice as meeting this requirement, since all vehicles have to be fabricated during the transition and contractors may already have ICE approved vehicles in their inventory?
ICE Response No, it is not sufficient. The Contractor shall adhere to the Government’s approval of interior security specification of vehicles as stated in the RFP. All vehicles need to be reviewed and approved by ICE prior to performance regardless of whether or not the Contractor believes their vehicles are approved by ICE.

ICE Response The award will be made on a Best Value Trade Off basis and the factors to be evaluated are listed under Section M of this solicitation.

Question: RE: The RFP provides information as to types of service required; the ad hoc locations (outside of Baltimore such as Atlanta, Buffalo, New York, etc) list “hospitals” as a service requirement. Are you telling us that we need to provide stationary guard services (and thus hire guards in order to respond in 1 hour) for the “rare” occasions they are needed?

Question: RE: If we need to hire in each ERO Office AOR, can you at least tell us if the stationary guards will only be required in the city listed (such as Atlanta, etc.)?
ICE Response The Contractor shall only need to hire stationary guards in Baltimore area. The RFP and the requirements described are for the Baltimore AOR. The anticipated routes listed as well as the cities listed (such as Atlanta, etc.) will be based on transportation needs from Baltimore AOR to that designated area.

Does Daily mean M-F? Does M-F include Federal Holidays? The same “swings” apply to “weekly” trips.
ICE Response The Government anticipates that various trips will commence 24 hours a day, seven days a week, 365 days a year, including Holidays as specified in the solicitation. Therefore, daily includes all days of the week, inclusive of Holidays.

Question: RE: As this is a follow-on contract for these services, were any metrics data collected by the government with respect to total miles performed (since the CLIN structure was based on miles in the current contract). Were any metrics collected that could help a contractor compute labor requirements for each “route” listed that are more definitive than “2” or more or “2” or less?
ICE Response The Government used the historical annual mileage and an escalation factor to determine the Government estimate. The Government does not aggregate metrics at the route level.

Can ICE clarify this by adding the revised response time for these cities?
ICE Response The explanation of the asterisks is listed in the Legend. The Government expects the Contractor to respond within the time specified in the solicitation in the Baltimore area.

Question: RE: The RFP States in Subparagraph 8: “The use of any hearing aid to comply with the medical standards is unacceptable.” (emphasis added). This restriction calls for violation of the ADA and is considered an unreasonable bar to employment. Will ICE reconsider this restrictive language as the DOT physical requirements should provide the standard for health?
ICE Response The Government will consider the DOT physical requirements as the standard for health requirements for transportation and guard service positions.

Does this language require the contractor to provide a wheel chair van?
ICE Response Yes, in the event that the detainee is wheelchair bound, the contractor is responsible for transferring the wheelchair bound detainee. However, the wheel chair vans have not been necessary in the past.

Yes, trainings can start upon receiving the award and can be completed prior to EOD. However, Contractors shall not perform duties under this contract until they have successfully completed all initial training and the COR receives a written certification.

ICE Response Section K.2., FAR 52.212-3 indicates, “The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Website located at https://www.sam.gov/portal.
If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.”

Question: RE: RFP includes: FAR 52.222-17 Non-Displacement of Qualified Workers; in view of this provision, will ICE provide (via the incumbent contractor) a name redacted employee seniority list to enable the accurate computation of vacation entitlements for incumbent employees?
ICE Response Per FAR 52.222-17(d)(2), “Immediately upon receipt of the certified service employee list but not before contract award, the contracting officer shall provide the certified service employee list to the successor contractor…” The Government will provide the list in accordance with the clause.

Question: RE: The RFP requires:
Automobile liability. The contractor shall require automobile liability insurance written on the comprehensive form of policy. The policy shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $60,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.
Will ICE change this section to ADD the following: (in order to comply with USDOT/FMCSA):
The Contractor will obtain and maintain throughout the life of the contract, the automotive insurance requirements as stated in FMCSA regulations:
Public Liability Insurance (bodily injury, property damage, environmental restoration):
$5,000,000 for passenger vehicles carrying more than 15 passengers; $1,500,000 for passenger vehicles carrying 15 passengers or less.

ICE Response The Government will not change the RFP language since it already states, “The amount of liability coverage on other policies shall commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.” The Government expects the Contractor to purchase insurance coverage that complies with state limits, rules and/or regulations for all transportation vehicles.

ICE Response The Government does not have historical data available to demonstrate the frequency or volume.
However, the Government expects the Contractor to provide all ground transportation of anticipated runs listed, including Worcester and Howard.
