Amendment 0001

Questions and Answers

Question 1 Section/Subsection Number:

Section A (Standard Form 1447), Page 3 of 10, CLIN 0001G

Question:

There appears to be a typographical error beneath CLIN 0001G where it should be corrected to read Base Period (November 1, 2014 – August 31, 2015)”. Will the government please provided a corrected Standard Form 1447?

Answer: Due to systemic programming, the CLINs on the Standard Form 1447 of the solicitation are unable to be revised. The period of performance dates will be corrected on the Contract Award. In the interim, the performance period for the base period should read:

November 1, 2014 – August 31, 2015.

Question 2

Attachment E-Price Proposal Spreadsheet, Tab “Transition & Base”

Question:

Cells C26 and C27 appear to have the wrong calculation of days for the base period Nov 1, 2014 – Aug 31, 2015. They should each be 106,400 days (350 inmates X 304 days). Will the government please provided a corrected Attachment E?

Question:

Page 1 of 8, Base Period Nov 1, 2014 – Aug 31, 2015 appears to provide the quantity for 11 months but should correspond to the Base Period of 10 months as provided in Standard Form 1447 and Section B.2.2. Will the government please provided a corrected Attachment E?

Answer: Attachment E, Price Proposal Spreadsheet has been amended to (a) correct the calculation for Cells C26 and C27 and (b) to correct the base period to 10 months (November 1, 2014 – August 31, 2015).

Question 3

Section A (Standard Form 1447), Page 4 through 10, CLIN 1001 through CLIN 6007

Question: For each CLIN 1001 through 6007, there is a date “03/01/20__” listed below “(Option Line Item)”. These dates do not correspond with the actual Option Periods and appear to be in error. Will the government please correct these dates to match the correct Option Periods and provide a revised Standard Form 1447?

Answer: Due to systemic programming, the CLINs on the Standard Form 1447 of the solicitation are unable to be revised. This dates below the “Option Line Item” will be removed on the Contract Award.

Question 4

Section C, Subsection II – Introduction, Item A, Page 10

Question: The SOO indicates the housing of 700 low and medium-low level detainees. What is the breakdown between males and females? The current capacity is 105 females and 595 males. Can the government please confirm that this capacity breakdown is acceptable?

Question 4 Answer: The current breakdown of males (595) and females (105) still applies and is acceptable.

Question 6

Section C, Subsection VII, Item C, Page 51

Question: The SOO indicates the Contractor shall assign a minimum of one officer to monitor each occupied housing section. As approved by the Miami Field Office, the current civil detention facility’s layout, which features multiple occupancy rooms, has been operating successfully for 12 years and does not assign an officer to each room. Does the Government accept the current staffing model of officers assigned to patrol the outside of the rooms instead of each individual room?

Answer: No. Offerors shall ensure its proposal submission meets the minimum requirements of the SOO. In this case, “…The Contractor shall provide supervision of all detainees in all areas, including supervision in detainee housing and activity areas, to permit Detention Officers to hear and respond promptly to emergencies. The Contractor shall assign a minimum of one officer to monitor each occupied housing section. This position is separate from the housing control post.”

Please note that “housing sections” does not mean individual rooms. Housing sections can be listed as north, south, and west housing sections.

Question 7

Section C/C. Health Requirement for All Detention Officers #2

Question: The vision requirements in the SOO are unusually high compared to the requirement for like federal law enforcement positions. Typically, the basic vision requirements are as follows:

• Uncorrected distance vision must be equal to or better than 20/100 binocular.

• Binocular distance vision must be correctable to 20/30.

• Binocular near vision must be correctable to 20/40.

• Depth perception must be normal.

• Peripheral vision must be normal.

• Color vision must be normal. X-chrome lenses may not be used during testing.

• Refractive surgery is acceptable. Individuals who have undergone refractive surgery (for

Question: The SOO indicates the staffing level shall not fall below a monthly average of 95% of the ICE-approved staffing plan. Is it correct to expect that this 95% level will apply only to the minimum guaranteed bed level staffing plan?

Answer: No. There will only be one ICE approved staffing plan. The 95% level will apply to the entire staffing plan. There will not be a separate guaranteed bed level staffing plan.

Can the government please confirm the typical vision requirements for similar federal positions are acceptable?

Answer: No. Offerors shall ensure its proposal submission meets the minimum requirements of the SOO.

Question 8

Section II.N.4, Armed Transportation Services/ Section II.N.5, Stationary Guard Services

Question: Does ICE anticipate Armed Guard Services to be required for Asylum hearings?

Answer: Yes.

Question 9

Section C Subsection VI, Required Services, managing the receiving and discharge of detainees (B) page (46)

Question: The paragraph contained in the above referenced section states, “Detainees will be classified upon arrival, before being admitted to the general population. The contractor will periodically re-classify detainees, in accordance with the ICE PBNDS.”

Question: Can the government please confirm that it will provide initial classification and that the Contractor will only re-classify detainees as needed in accordance with ICE PBNDS 2011?

Answer: The Contractor shall follow ICE PBNDS 2011 2.2 Custody classification system.

Contractor will be provided with all necessary information to perform classification and re-classification.

Question 10

Section II.N.4, Armed Transportation Services

Question: The Performance Work Statement states: "The Contractor shall use Government Furnished Vehicles listed on Attachment 1 as needed. "Attachment 1 does not provide a list of vehicles to be furnished by the Government. Are Contractors allowed to use their company owned vehicles for transportation services required under this contract?

Answer: Yes, contractors will use their own vehicles to meet the transportation requirements under the contract. Additionally, Government owned vehicles will be available to the contractor for use in case of emergencies and or instances that dictate the need to use them (i.e. airport transports, or justified instances where the contractor can’t supply a vehicle). The RFP has been amended to add Attachment 11 Furnished Government Owned Vehicles to Section J.

Question 11

Section M: Evaluation Factors for Award/Attachment_2_-

_QASP_04_03_14

Question: The Quality Assurance Surveillance Plan (QASP) references Attachment A (Performance Requirement Summary) and Attachment B (Contract Discrepancy Report);

Question 11 however, these referenced attachments are not provided in Solicitation Number HSCEDM-14-R- 00002. Will ICE please make these attachments available?

Answer: The Quality Assurance Surveillance Plan (QASP) has been amended to add Attachment A (Performance Requirements Summary) and Attachment B (Contract Discrepancy Report).

Question 12

Sections A-B, Minimum Guarantee of 350 beds

Question: Historically, the average daily population has been in the range of 70% - 75%. A 75% minimum guarantee is typical of many ICE contracts. Will the government consider a minimum guarantee of 70% for this contract?

Answer: No. The Government will only consider a minimum guarantee of 350 beds per day.

Question 13

L.3, Page L-4

Question: In the chart on Page L-4, the pages Volume 1 are "limited to identified form", but there is no form provided for the Legal Offer (cover letter). Does the government have a page limitation for the Legal Offer?

Answer: The solicitation has been amended to clarify that the Legal Offer (Cover Letter) is limited to three (3) pages.

Question 14

L.3, Page L-5

Question: The chart on Page L-5 refers to Tab 2 as Technical Approach, but the instructions on Page L-8 and the information Page M-3 refer to “Performance Work Statement” for that required response section. Please confirm which title should be used for Tab 2.

Answer: The solicitation has been amended to clarify that the title “Performance Work Statement” shall be used for Tab 2.

Question 15

Section L.3, L-5 and L-10

Question: The instructions on Page L-10, Item “e” identify Attachment E as the document to be included in Volume IV. However, the chart on Page L-5 lists an Attachment “4” for Volume IV.

Attachment 4 is actually a listing of Authorized Restraint Devices and seems to be an incorrect reference. Can the government please confirm that Attachment E is the correct document and the reference on Page L-5 is a typographical error?

Answer: The solicitation has been amended to clarify that Attachment E, Proposal Excel Spreadsheet is to be completed and submitted as part of the Price/Cost Proposal (Volume IV).

Question 16

L.3, Page L-10

Question: There seems to be a typographical error in the lettering for Volume IV. On page L- 10, the instructions begin the layout with letter “c” rather than beginning at letter “a”. Also, for that section, items “f” and “h” appear to be instructions and not separate documents to be included in Volume IV. Can you confirm that the requirements listed for Volume IV on page L-10 are the same four items required in the chart on Page L-5?

Answer: No. Offerors shall ensure its proposal submission meets the minimum requirements of the SOO. The solicitation has been amended to correct the lettering of Volume IV, Price/Cost Proposal from “c–h” to “a-f”. As indicated in Section L.3, Volume IV of the Price/Cost Proposal must include Standard Form 1447, Section B, Attachment E and Supporting Documentation.

Please see Page L-10, Volume IV – Price/Cost Proposal for additional instructions on preparing Standard Form 1447 (item a), Section B (item b), Attachment E (item c and d), Supporting Documentation (item e). Additionally, please review instructions regarding contingency pricing (item f)

Question 17

L.3, Page L-6

Question: Page L-6 of the RFP requests Offerors "include a copy of the Offeror's FY2002 SF295 and SF295 subcontract reports". Is this a typographical error, and is the government actually asking for the SF294 and SF295 forms for FY 2012 instead?

Answer: The solicitation has been amended to clarify that the SF294 and SF295 subcontract reports for FY 2013.
