1. Amd. 4, Q. 18

Please define what ICE means by “as soon as they are referred during the transition period”. Does this imply the incoming contractor must be prepared to accept participants at any and all locations at ICE’s direction, possibly even on day 1 of transition or does it mean once the specific location or service type is transitioned from the incumbent contractor during the transition phase? The winning contractor must be ready to accept new enrollments as well as transition participants at any and all locations.

2. Amd. 4, Q. 46

Question 46 in Amendment 4 noted the Government anticipates opening C, G, and T-sites in the future based on funding availability, operational capability and programmatic need. Since significant costs are associated with establishing and operating a new office, will DHS consider providing a projection of prospective locations, timelines, and capacities for establishment of these offices? Providing this baseline to bidders will provide consistency across the bidders, which is advantageous to DHS. No. The Government cannot predict future need.

3. Amd. 4, Q. 56

DHS’ answer to Question 56 in Amendment 4, would indicate that DHS would delete either one of the following Section M bullets under Transition Plan, either: “> Handle influx/transition from other ATD program(s)” or “>Simultaneous execution of day to day operations during transitions” as they are duplicative. Will DHS delete one of those Section M bullets? No, nothing will be deleted. The offerors must indicate how they plan to handle influx/transition while executing day-to-day operations and non-transitional enrollments.

4. Amd. 4, Q. 46

Please provide the number of new C, T, and G site offices opened each year under ISAP II? The requirement began with 30 C sites. We currently have 44 FS locations (C and G) and have TO in the locations provided in Attachment 4.

5. Amd. 4, Q. 18

Please confirm that during the 60 day transition period, the current incumbent will enroll new participants at a location until such time when the awardee has fully established their facility and operation at that location? No. As soon as the contract is awarded, the contract winner will be expected to take all new enrollments as well as handle transition cases. If the incumbent does not win, the Government sees it as redundant and unnecessary work to enroll only to have to transition the participant within weeks.

6. General

How many days does ICE plan to have between contract award and transition start? This information is not known at this time. The Government will follow all procedures for notification outlined in the FAR and HSAR that apply to this acquisition.

7. Amd. 3, Q. 76

The volume of damaged, lost and/or stolen equipment can make a significant impact on pricing. The incumbent should have the volume of damaged, lost and/or stolen equipment during 2013. By not providing this information, the incumbent has an advantage in knowing additional costs to the program. We respectfully ask the Government to request the information from the incumbent. The information provided by the incumbent was approximately 11% of active units in Full Service Supervision and approximately 40% of active units in Technology Only.

8. Amd. 3, Q. 76

Can ICE provide the number of participants the incumbent prosecuted for criminal damages to monitoring equipment and the number of participants who made restitution to the incumbent? This also impacts pricing since vendors can better calculate the financial risk involving damaged, lost and/or stolen equipment. One was convicted to the Government’s knowledge. One to two other cases were ongoing.

9. Amd. 3, Att 4

Two G-Sites have a currently listed FS population of zero (Fresno, CA and Miramar, FL). Is there a requirement to have them staffed at this time and is there an expected immediate influx of new participants?

Fresno just started as a G-site in mid-June 2014 and has a maximum population of 100. Miramar is a special case where they were contractually modified as a G-site so a case specialist could be in the ERO facility to assist with enrollments, device assignment, etc. That CS in Miramar does not have an independent docket but refers the cases to Miami or Delray.

10. Amd. 3 Is space available at G-Sites for the incoming contractor and incumbent contractor to work simultaneously during the transition phase? Yes.

11. Amd. 4, Q.31 Will DHS please change Attachment 4 to reflect Marlton as a C-Site, per Q. 31 in Amendment 4? Yes, this has been done. Marlton is a C-site and has recently been authorized to move to 400 participants.

12. Amd. 3, Q. 156 Will DHS please change Attachment 4 to reflect the answer to question 156 in Amendment 3 to show Suggested FS capacity of Baltimore at 600 and Denver at 700? Yes.

13. Amd. 3. Q. 60

Does the incumbent currently have a program orientation/information handbook? If yes, Will the contents be made available to the awardee for revision upon contract award? The orientation/information handbook was developed by the incumbent on their own and final approval was received by the Government. The winner of the ISAP III contract will be expected to develop their own orientation/information handbook with final approval by the Government based upon the ISAP III contract requirements.

14. Amd. 3, Q. 100

Does the incumbent currently have a program orientation/information video? If yes, will a copy of the video be made available to the awardee upon contract award? The orientation/information handbook was developed by the incumbent on their own and final approval was received by the Government. The winner of the ISAP III contract will be expected to develop their own orientation/information video with final approval by the Government based upon the ISAP III contract requirements.

15. Amd. 3, Q. 60

What minimal requirements does the government have for what needs to be included in the program orientation/information handbook? The program orientation/information handbook should include all information that is applicable to the participant with regards to expectations, requirements, and other necessary information. The winning contractor is expected to develop the handbook with final approval by the Government.

16. Amd. 3, Q. 100

What minimal requirements does the government have for what needs to be included in the program orientation/Enrollment video?

The program orientation/information handbook should include all information that is applicable to the participant with regards to expectations, requirements, and other necessary information. The winning contractor is expected to develop the video with final approval by the Government.

17. Amd. 3, Q. 118

Office visits are currently scheduled in advance for participants as part of their ISPs. Please confirm participants will be required to conduct an ‘unscheduled’ office visit necessary to conduct transition with the incoming contractor or must the incoming contractor conduct this transition with the participant at their next regularly scheduled office visit? The Government expects that the transition will be minimally disruptive to the participants’ schedules. Performing the transition at the already scheduled office visit is most appropriate and preferred.

18. Schedule B

Q&A #31 from Amendment 3 states the Government will consider volume discounts if participant numbers increase. Does this indicate that discounting at volumes over and above the Section B CLIN PD is the only permissible form of discounting allowed in an offeror proposal or does it mean that discounts can be offered at different levels within each CLIN as the listed participant days in schedule B are stated to be a maximum, and how would that be displayed within the schedule B? The government will not consider Volume discounts. This is a revision of the answer provided in Amendment 3. Price will be evaluated in accordance with the procedures outlined in Section M.B.3 of the RFP.

19. Schedule B

Given the unknown impacts of immigration reform on future PD volumes and the fact that the current number of full service participants would only result in about 40% of the participant days if that average is maintained throughout the year, the offeror requests the ability to provide discounted rates at multiple PD volume tiers that provides adequate cost savings to the government reflective of fixed cost recovery while allowing for proper risk management approaches.

An example may be up to 5 million participant days on a specific CLIN is $5, which changes to $4.75 once 5 million is exceeded up to 8 million participant days, which then changes to $4.50 once 8 million is exceeded. How should this be displayed within the schedule B which is set at a single unit price for the maximum possible participant days that will result in the total evaluated price? No, the Government will not consider discounted rates. The Government is responsible for reporting costs incurred and having a tiered approach complicates calculation accuracy.

Pricing

Is the contractor to enter unit price in the upper block (21,170,000) or in the lower quantity breakdown blocks? The contractor should enter a unit price in the lower quantity blocks below. The Government is seeking a price per visit selection. The same is true for the Technology. The Government is seeking a separate price for GPS and for telephonic reporting.

21.

Amend 5, Q&A #3 provides a Wage Det code of 27101 for Case Specialists. This code is NOT listed on the wage determination. It may be listed in the 5th Edition Job Codes book, but it is not on the wage determination. Additionally, 01280 “Receptionist” code does not appear to cover all duties assigned to Administrative Assistants, and the RFP “Title” for these positions points to Wage Det Code 01020 Admin Assistant (or at least WD Code 01113 General Clerk. If code 27101 is appropriate for Case Specialists, are contractors to submit SF1444 “Request for Authorization of Additional Classification and Rate” (aka Wage Conformance) documents with our proposals per the instructions in the Wage Determinations? The labor categories as determined by the Government are Receptionist 01280 for the Admin Assistants and a Guard 1 27101 for the Case Specialists. Guard 1 and Receptionist are listed on the Wage Determinations at the Department of Labor SCA website.

22.

Will the Government please provide direction on how price volume discounts should be formatted in the pricing submission? Volume discounts will not be considered by the Government. See Answer to Question 18.

The contract ceiling for the ISAP II contract was $371M. The ISAP III statement of work calls for advancements in technology, different (lower) staffing ratios, and mandatory Administrative Assistants for the ISAP III program.

Please confirm that the ISAP II contract ceiling is not expected to be applicable to the ISAP III contract.

The contract ceiling was provided for informational purposes only and is not directly applicable to this acquisition.

25.

Pricing Instructions – Volume Discount

. Question 31 asked about whether ICE would consider volume discounts in the participant numbers increase. The answer was:

“Yes, the government will consider volume discounts.” Question 45 asked whether ICE would consider tiered pricing and the answer given was: “The offeror should use Schedule B to submit pricing”.

Given that the CLIN structure of Schedule B must be used to submit pricing, would you please clarify how an offeror would offer volume discount pricing if it wished to? Volume discounts will not be considered. Please see the answer to Question 18.

26.

Price Evaluation Methodology.

As a follow up to the question above, Section M of the RFP (pg 123) states that “the evaluated price will be determined by the sum of multiplying the unit price and the estimated quantity for each contract line item”. Given this, will you please clarify how an offer of a volume discount would be treated in the price evaluation? Volume discounts will not be considered. Please see the answer to Question 18.

Question from Pre-proposal Conference

During the pre-proposal conference, Mr. Carbonneau was asked a question about the CLIN structure on the new contract that would allow ERO more flexibility in ordering individualized services from a “menu” of options. During his answer, Mr. Carbonneau mentioned that the current ISAP II contract had been modified to incorporate some of these flexible options. Could you please describe how the current contract was modified and the date that this change was made? Is this the “pilot program” that is mentioned in Attachment 9 which was provided in Amendment 3? The contract modification went into effect in approximately February 2011. It provided the Government the option to assign a participant to a particular ‘billing stage’ CLIN that had the requested reporting frequencies in spite of the participants current legal stage. (If a participant was pre-order but the Government wanted more frequent OV/HV, they would be assigned to the ‘post-order’ billing stage). This was not a pilot.

28.

Service Contract Act applicability.

Amendment 5 clarified that the RFP contains FAR Clause 52.222-41 and that the Service Contract Act applies to both the Case Specialist and Administrative Assistant positions. Can you please clarify if this is a change from the current ISAP II contract? Was there a DOL decision between 2009 and now that determined that these positions were subject to the SCA? If so, when did this change occur? Is the incumbent contractor currently operating in accordance with the SCA for these two positions?

Under the previous ISAP II contract the Service Contract Act was determined by the Contracting Officer as not applicable. The DOL advised recently that certain positions were subject to SCA. The Government made that information available to offerors as soon as it was made aware.

29.

Multiple Technology Submissions and Multiple Prices.

Question #2 in Amendment 5 states that “Offerors may include multiple technology submissions as part of their response. Any difference in pricing should be clearly identified using the format in Section B.” Can you please clarify how price will be evaluated when more than one price is submitted? Will the government select the “primary option” to calculate the actual evaluated price? The Government preference is for a one-piece. The price will be evaluated in accordance with the procedures outline in the RFP. A trade off analysis will be used.

30.

Amd. 5, Q.3 Please verify the SCA occupation codes. Occupation Code 27101 is indicated for the Case Specialists.

This occupation code is listed in WD schedules as Guard I with the following duty description: This guard protects property from theft or damage, or persons from hazards or interference. Duties involve serving at a fixed post, making rounds on foot or by motor vehicle, or escorting persons or property. This worker may be deputized to make arrests, and may help visitors and customers by answering questions and giving directions. This person may be required to demonstrate proficiency in the use of firearms and other special weapons and continuing physical fitness. This guard carries out detailed instructions and procedures primarily oriented to insure that emergencies and security violations are readily discovered, and reported to appropriate authority. The primary duty is to observe and report security and emergency situations. This guard intervenes directly only in situations which require minimal action to safeguard property or persons. Duties require minimal training and physical fitness standards.

This does not seem to fit at all with the identified duties of a Case Specialist in the solicitation. Additionally, the rate for Guard I is lower than the rate for Receptionist, the identified occupation code for solicitation category Administrative Assistant. The example is for Washington, DC. Occupation Code 27101 has a rate of $12.71.

Occupation Code 01280 has a rate of $14.43.

Please see the answer to Question 21 above.

31.

Amd. 5, Q.3 Question 3 included in Amendment 5 states that FAR 52.222-41 applies. It is then necessary to identify the appropriate SCA Wage Determination for each work location. FAR 22.1007 Requirement to obtain wage determinations, states, “The contracting officer shall obtain wage determinations…..” Please provide the appropriate wage determination for each work location.

Due to the requirements of the contract (i.e. the contractor choosing the office site), it is not possible for the Government to obtain all wage determinations for offerors. It is, however, possible for offerors to obtain the rates based on their selected facility at http://www.wdol.gov/ using the provided labor categories (i.e., Guard 1 and Receptionist). The specific wage determinations selected by the Contractor will be incorporated in the resultant contract.

Was the current contractor required to utilize WD Code 01280 “Receptionist” for Administrative Assistants under ISAP II?

No.

33.

Based on information from 5th Edition SCA Directory of Occupations below, will the government please confirm that “Receptionist” fully describes the duties of the Admin Assistants or is some other code more appropriate?

Yes.

34.

Amend 5, Q&A #3 states that 27101 is the appropriate code for Case Specialists. This is a guard service code per 5th Edition SCA Occupational Codes Book; can the government provide the appropriate SCA code for Case Specialists, and lacking such code is it the contractor’s option to make these salaried positions?

The Contractor should use the Wage Determination identified by the Government.
