Each offeror's proposal submitted in response to this solicitation shall be prepared in two volumes: Volume I - Business Management Information - Cost/Price Proposal and Volume II - Technical/Technical Management Proposal. Each of the parts shall be separate and complete in itself so that evaluation of one may be accomplished independently from evaluation of the other.
The proposals shall be submitted both in hard copy and electronic media (3.5" floppy disk or CD-ROM) using Word 98 or higher for text submissions and Excel 98 or higher for spreadsheet submissions.
Proposals must be prepared in accordance with these instructions and provide all required information in the format specified. The required format is designed to ensure submission of information essential to the understanding and comprehensive evaluation of the offeror's proposal. There is no intent to limit the contents of proposals. The instructions permit inclusion of any additional data or information on offeror deems pertinent.
Elaborate brochures, binders, and the like are neither required nor desired. Legibility, clarity and completeness are important. The submission of brochures or flyers alone without an accompanying explanation specific to this proposal is not acceptable.
Proposals shall be prepared on standard 8 ½ x 11-inch paper with at least 1-inch margins on all sides. All pages of each part shall be appropriately numbered, printed on one side only, and identify the solicitation number. To aid in evaluation, proposals will be accurate, specific, concise, and complete.
Ring binders shall be used for each volume. Proposal text shall be 12-point type size. All text shall be single space. Each volume shall include a Table of Contents than provides enough detail to quickly locate key elements of the offer and tab/dividers separating each volume section.
Proposal submitted in response to this RFP must be prepared and tabbed in format described below. Failure of a proposal to comply with these instructions may be grounds for exclusion of the proposal from further consideration.
Failure of a proposal to comply with these instructions may be grounds for exclusion of the proposal from further consideration.
Proposals must be submitted to the following address by the closing date and time indicated in the Solicitation.
US Mail – If the proposals are returned by US Mail, the address for receipt is:
U.S. Customs and Border Protection Office of Procurement 1300 Pennsylvania Avenue, NW National Place, Suite 901 Washington, DC 20229 Attn: Stephanie F. Alexander

Regardless of the method of delivering the proposals, they must be received by the date indicated in the Soliciation.
A. Volume I - Business Management Information - Cost/Price Proposal
The Business Management Information - Cost/Price Proposal shall be submitted in an original and four (4) of copies.
Section 1 - Signed Proposal The Standard Form 33, Solicitation, Offer and Award, (SF 33) is being used for this solicitation. This form is used by the Government as a Request for Proposal and upon submission by the offeror it becomes the offeror's proposal. As such it is an "offer" which can be unilaterally accepted by the Contracting Officer and awarded on said SF 33. The Contractor's offer and the Government's acceptance form the contract.
Therefore, the following points must be strictly adhered to by the offeror in submitting the proposal.
(a) Two (2) originally executed copies of Standard Form 33 (with Blocks 12 through 18 completed); and
Section K fully executed shall be submitted.
(b) The SF 33 must be executed by a representative of the offeror authorized to commit the offeror to contractual obligations. The authority to sign a proposal, but not an offer, subject to unilateral acceptance and award, is not sufficient authorization to sign the SF 33.
(c) UNDER NO CIRCUMSTANCES MAKE ALTERATIONS OR CHANGES TO THE SF 33 OR THE
RELATED PAGES WHICH ARE A PART OF THE ENCLOSED REQUEST FOR PROPOSAL AND
PROPOSAL PACKET. Offerors are to complete those parts that require items such as prices, place of performance, etc., when such items are called for in the enclosed request for proposal. A place is provided to insert such information.
Section 2 - Exceptions Any exceptions taken with respect to the clauses in the solicitation shall be noted. For the purpose of facilitating discussions, for every instance where the offeror does not propose to comply with or agree to a requirement, the offeror shall propose an alternative and describe its reasoning therefore.
Section 3 - Financial Capability The offeror shall provide the following data for itself and for any subcontractors for which the total value of the subcontract is greater than $550,000:
(a) Provide a copy of annual financial statements including CPA certified balance sheet, profit/loss statement and statement of retained earnings covering each of the offeror's last three annual accounting periods, including the most recent partial period, if currently available.
(b) Specify the financial capacity, working capital and other financial resources available to perform the contract.
(c) Specify whether or not the organization's accounting system has been approved by a Government agency; if so, state the name and location of the cognizant audit agency, the name and telephone number of the cognizant auditor, and the types of Government contracts for which the accounting system has been approved.
Section 4 - Cost or Pricing Data
In accordance with FAR 15.403-5, offeror's are required to provide cost and pricing data in the format indicated in Table 15-2 of FAR 15.408 and further supporting documentation as required hereunder:
General – The offeror shall provide pricing for all Contract Line Item Numbers (CLIN) identified in Section B of this document. The offeror shall provide the estimated cost (all cost and fees inclusive) to the Government over the performance period and include the basis of estimate (BOE) information used to calculate the total cost. The BOE should be consistent with the proposed PWS and WBS. The offeror shall Identify the limitations and assumptions. The total cost must be based on a fully documented cost model created by the offeror that reflects the offeror’s overall technical solution.
For each location to be supported, provide an Excel spreadsheet that follows the format and contains the same information as in Attachment 4. The cost or price information shall be submitted on a CD-ROM in Microsoft Excel 97.
The offeror shall provide a supporting narrative that fully explains the estimating methodology, and why the estimated costs are fair and reasonable.
If Government approved rates such as hourly, fringe benefits, overhead, G&A and any other indirect rates exist, provide the forward pricing agreement or copy of audit report as supportive documentation. If Government approved rates do not exist, provide detailed background data indicating the cost elements, which have been included in the overhead, G&A, other indirect pools. Indicate how the indirect costs has been computed and applied, including cost breakdowns, and showing trends and budgetary data, to provide a basis for evaluation the reasonableness of proposed rates. Indicate the rates used and provide an appropriate explanation. Also, include a statement that such treatment is in accordance with established accounting practices and represents equitable distribution.
Direct Labor - The offeror shall provide separate cost breakdowns and supporting cost/pricing data, which incorporates a breakdown of direct base, labor cost estimated by major functional categories indicating the number of persons/hours required and the applicable hourly rates. Where specific individuals are proposed for a particular labor category, a copy of the individuals personnel contract agreement or payroll register providing base hourly rates, annual salary and other payroll and fringe benefits should be furnished to support the proposed labor rates. Where average hourly rates are proposed, a schedule of individuals by labor category with respective applicable rates shall be furnished to provide a basis of estimate.
Fringe Benefit - The offeror shall provide a Government approved rate of a breakdown of benefits to support the proposed rate. See instructions under General above.
Materials, Equipment, and Other Direct Costs - A breakdown of the costs of materials, equipment and other costs not specifically identified with indirect categories of cost shall be provided with supportive documentation. If an offeror proposes to employ the use of Information Technology, supporting data concerning proposed costs should include the following:
- Type of equipment to be used.
- Hourly usage rates for the proposed equipment.
- Estimated time expected to be used for each type of equipment.
Transition Costs - If required, transition period costs shall be included with the basic contract period costs but shall be broken down separately in the proposal.
Travel - The amount estimated for travel shall be supported with a breakdown including where travel originates, destination, estimated duration of each trip, number of persons who will travel, and specific reasons for each trip.
Consultants - If utilized, consultant costs shall include estimated number of consultant days plus hourly or daily rate. If proposed consultants have provided previous services to the offeror, submit past invoices to support the cost data.
Subcontracts - The offeror shall identify each subcontractor by name and location with a description of work to be performed by each subcontractor. Supportive documentation shall be provided for each subcontractor.
Indirect Costs - The offeror shall provide a Government approved rate for Overhead, G&A and any other indirect rates or a breakdown of the related pool and identify the base for which the rate is to be applied.
See instructions under General above.
B. Volume II - Technical Proposal
The Government seeks a competitive, innovative, integrated, solution set for its needs. Identify, throughout the proposal, inherent performance, delivery, and/or cost risks and the plans to mitigate those risks.
The Technical Proposal shall be submitted in an original and four (4) of copies. This volume must not contain any reference to cost; however, resource information (such as data concerning labor hours and categories, materials, subcontracts, etc.) must be contained in the technical proposal so that the Contractor's understanding of the requirements may be evaluated.
The Technical Proposal shall be prepared in such a manner as to enable the Government reviewers to make a thorough evaluation and arrive at a sound determination of whether the proposal meets all technical requirements of the solicitation. To this end, the Technical Proposal should be sufficiently specific, detailed, and complete as to clearly and fully demonstrate that the offeror has a thorough understanding of the requirements set forth in the solicitation. Proposals which merely offer to perform in accordance with the Government's requirements or which merely paraphrase the requirements document, or use phrases such as, "standard engineering practices will be employed," or "well established techniques will be employed," etc. may be considered non-compliant and ineligible for award. The Contractor must submit an explanation of its proposed technical approach in conjunction with the tasks to be performed in achieving the project objectives.
The technical approach should be in as much detail as the offeror considers necessary to fully explain the proposed technical approach or method and must demonstrate a clear and concise presentation that includes, but not limited to, the requirement of the volume instructions. The volume should reflect a clear understanding of the nature of the work being undertaken.
This volume shall consist of the sections described below.
Section 1 - Transmittal Letter/Executive Summary
A letter that formally transmits the proposal and states in general terms how the offeror meets the solicitation requirements. Discuss your proposed processes for planning, monitoring, and controlling work effort and communicating the information to the Government.
Discuss your understanding and ability to support CBP potential surge requirements.
Discuss your approach for obtaining/training/retaining qualified personnel to fulfill proposed positions, and meeting all contractual requirements.
Identify any anticipated problems/risks associated with the approach and provide an explanation of the proposed solution.

Identify resources needed to efficiently and effectively provide appropriate resources to sustain required support during the transition phase.
Section 4: Current/Past Performance
Submit past performance information for both the Offeror and proposed subcontractors (if applicable).
(1) The offeror shall identify all contracts or subcontracts performed in the last three (3) years, which required work in comparable areas to this contract. The list should be in chronological order, beginning with the most recent project and continuing backwards. Offerors that are newly formed entities without prior contracts should list contracts and subcontracts as required for all key personnel. Projects shall be identified with the name(s) of individuals who worked on them. Identify each contract by type, age, and dollar amount. Provide the following information for each contract:

The contracting officer will schedule oral presentations/negotiations based on an estimated four (4) hour time frame, with the order of presentation determined by the Contracting Officer. Offerors must provide all necessary audio-visual equipment and materials.
b) The purpose of the oral presentations is to give the offeror an opportunity to describe its proposal. The format, agenda, and conduct of the oral presentation are entirely at the offeror’s discretion. However, Government participants must be able to ask questions throughout the presentation. The offeror will also be given the opportunity to ask the Government questions during the presentation. The four (4) hour time frame may be extended should the Government determine that additional time is necessary to gain a thorough understanding of the proposal. The exchanges may rise to the level of “discussion” as defined in FAR Part 15.306(d).
c) The presentation must be given by the individuals identified in the offeror’s proposal as key personnel and/or senior management. It is important to the Government that the individuals responsible for performance of the proposed contract conduct the oral presentation.
