JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below using FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirement.

1. Identification of Agency and Contracting Activity

a. Requiring Agency:

Pentagon Force Protection Agency - RRMC CBRNE - RRMC 1155 Defense Pentagon Washington DC 20301-1155

b. Contracting Activity:

Washington Headquarters Services Acquisition and Procurement Office 1155 Defense Pentagon RPN—Suite 12063 Washington DC 20301-1155

2. Nature and Description of Action: This justification and approval authorizes and approves the purchase of a Flir FIDO X3 explosives trace detection system from Federal Resources

The Force Protection and Emergency Services, of the Pentagon Force Protection Agency Raven Rock Mountain Complex has a requirement for a FLIR FIDO X3 explosives trace detection system from Federal Resources.

The required system must have the ability to perform multi threat monitor for explosives compound detection. The FLIR FIDO X3 is able to identify, in a closed system, explosive organic compounds, homemade, military grade and liquid explosives. The easy-to-use, light weight system has a nanogram level of detection. The FLIR FIDO X3 uses a “plug and play” sensor system, for quick configurations of sensor configurations. Furthermore, the ability for 1st responder to use while in personal protection equipment.

3. Description of Supplies and/or Services: The purpose of this effort is to supply the Pentagon Force Protection Agency (PFPA) Raven Rock Mountain Complex with two (2) FLIR FIDO X3 handheld trace explosives detectors and provide training to responders, and warranty with support for up to 5 years.

4. Identification of Statutory Authority: FLIR is the only company that has developed and marketed reliable Multi – Threat Trace Explosives detection equipment that meets the requirements of a secure DoD facility. The statutory authority permitting other than full and open competition is 10 U.S.C 2304(c) (1). The FAR citation is 6.302-1 and the FAR citation is only one responsible source and no other supplies or services will satisfy agency requirements.

5. Demonstration of Contractor’s Unique Qualifications: PFPA RRMC CBRNE requirements are met by FIDO X3 handheld trace explosives detector from FLIR Systems. The system has the weight and dimensions to fit in our facility.

Is proven by years of use in the security industries, to include aviation and maritime security. The system requires minimal training and ease of operation. Routine maintenance is simple and minimal, and the equipment has a well documented reliability.

6. Description of Efforts to Ensure Other Potential Sources: In Accordance With FAR Part 8.405-6(b) (1), Only one source is capable of responding due to the unique or specialized nature of the work. Market research was conducted by survey and with Subject Matter Experts (SME) and FIDO X3 from FLIR Systems found to be only the machine to meet all of the Government’s requirements. Although other technologies exist none were found that meet all of the Government’s requirements.

7. Determination of Fair and Reasonable Costs: The total estimated dollar value of this contract is $XXXXXXX.

8. Description of Market Survey: Market research was conducted February 2019 and mid- March 2019, to identify systems that would meet all of the Government’s specifications and requirements. Additionally, internet searches were conducted. A final consultation with SMEs in the field, one of which does market surveys for CBRNE equipment as part of their job, was conducted, and the FIDO X3 is the only system available for detection that meets all of the Government’s requirements. There are other technologies and systems that can be used to detect military grade, conventional, homemade and liquid explosives but they all have drawbacks, such as high-complexity use of instrumentation, requirements for advanced training.

9. Any Other Supporting Facts:. Market Research was conducted by the use of several search engines on the internet. There is only one instrument that is most sensitive, lightweight and user friendly trace explosives detector and that is by FLIR System. The procurement of any other product will put RRMC at risk that will result in failure of mission and possible loss of life.

10. Listing of Interested Sources: There are no other known sources for this machine that meets all of the Government requirements. It is only available through the manufacturer, FLIR Systems.

11. Actions Taken to Remove Barriers to Competition: The procurement of any other product will put RRMC at risk that will result in failure of mission and possible loss of life. The possibility to increase competition is driven by the market that will meet the Government’s requirements. If other systems become available that meet all the requirements, future acquisition could be competed.

12. Statements of Delivery Requirements: Delivery within 60 days after contract award .

13. Total Estimated Dollar Value of the Acquisition Covered by this J & A: The total estimated dollar value of this contract is $XXXXXX

14. Reference to the Approved Acquisition Plan or Equivalent Documentation: This requirement does not meet the acquisition threshold that requires a written acquisition plan.
