Part I Technical Part II Price
3. Please contact the POC if you would like to contact information for any of the incumbent contractors.
4. General submission information:
(1) The two parts of the submission shall be independent of each other. The quoters are cautioned that no reference to the quoted prices/cost shall be made in the technical portion.
(2) If submitted in hard copy, then paper size shall be 8-1.2 X 11 inches, or DIN A4 one-sided typed or printed using standard size fonts (10 to 12 point). Printing shall be double-sided.
5. SUBMISSION CONTENTS:
Part I – Technical: Submission shall be presented in narrative form, in the English language, in a clear and logical manner. It must be confined to essential matters sufficient to permit a thorough analysis. For Factor 1 and Subfactors, the contractor shall submit information for all four (4) instructors proposed for the first Task Order.
Factor 1. Key Personnel – Level 3 Instructor.
The quoter shall submit information in support of four (4) Level 3 Instructors as defined in Attachment B to the contract.
Subfactor 1.1. English Language Proficiency (Pass/Fail).
Submission Requirements: The proposed instructors must be native speakers of English or have fluency in English with the ability to listen, speak, read, and write at a level consistent with that of an educated native speaker. The quoter will provide documentation of each instructor’s fluency in English, either as a native speaker, through formal education, or language proficiency certification. If the proposed instructor is a non-native speaker of English, documentation must be submitted to demonstrate he/she has obtained Level 5 fluency in English by the American Council for the Teaching of Foreign Languages (ACTFL).
Subfactor 1.2. Education.
Submission Requirements: The proposed instructor shall have a minimum of a Master’s degree or equivalent. The quoter shall demonstrate the proposed instructors’ qualifications by providing transcripts, certificates, and diplomas of all courses taken at institutions of higher learning.
Subfactor 1.3. Teaching Experience.
Submission Requirements: The quoter shall provide a detailed narrative of the proposed instructors’ EFL/ESL/ESP and EAP teaching experience and experience working in a government or military environment including dates and location of teaching experience, subjects taught for each experience listed, target audience for each experience listed, and number of contact hours for each experience listed.
Factor 2. Corporate Experience.
Submission Requirements: Quoters shall provide documentation to demonstrate their (and their major subcontractor’s if applicable) experience developing and teaching EFL/ESL/ESP and EAP curriculum and associated materials that is relevant to the work required by this solicitation; managing multiple concurrent Task Orders; and responding to emergent requirements. If proposing a major subcontractor, the offeror shall describe the services to be performed by the major subcontractor. A “major subcontractor” is defined as any subcontractor that performs 50% or more of a task, to include individual options. Contracts provided may include those entered into by the Federal Government, agencies of state and local Governments and commercial customers. For each project identified, the contractor shall provide the following information (for the offeror and major subcontractor, if applicable):
1. Contract identification number;
2. Contract title and general scope of the contract;
3. Contracting agency or organization and user organization (if different from the contracting agency);
4. Contract award date and period of performance;
5. Contract value at time of award (total and per year);
6. Final (or current) contract dollar value, including all modifications and exercised options, with an explanation of any cost growth;

9. Major subcontractors’ name(s) and function(s) performed under this contract;
10. Identify the portion of the total contract value (per year) self-performed by your firm; and

Factor 3. Corporate Past Performance.
Submission Requirements: Quoters shall provide at least two references for each project identified under Factor 2 above that has a performance period within the last three years. Contracts provided may include those entered into by the Federal Government, agencies of state and local Governments and commercial customers. Each reference should complete and return the Questionnaire (Attachment I to the RFQ) by the closing date of the RFQ. The
Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside the Government.
Factor 4. Price.
Submission Requirements: The quoter shall provide firm fixed unit and total prices for all items, including options, listed in Attachment A to the contract and Attachment A to the first Task Order.
6. EVALUATION:
(a) The Government will award a contract resulting from this RFQ to the responsible contractor whose quote conforming to the RFQ will be most advantageous to the Government, price and other factors considered.
(b) Subfactor 1.1 English Language Proficiency is pass/fail. To be considered further, the contractor must receive a pass rating for Subfactor 1.1. The proposed instructors must meet the minimum requirement described under Subfactor 1.2. Education. Subfactor 1.2. Education is less important than Subfactor 1.3. Teaching Experience.
Factor 1 is more important than Factor 2 and Factor 3. Factor 2 and 3 are of equal importance. Factor 1, Factor 2 and Factor 3, when combined, are more important than Factor 4.
Factor 1. Key Personnel – Level 3 Instructor.
SubFactor 1.1. Pass/Fail , English Language Proficiency.
In order to be eligible for award, the quoter must satisfactorily demonstrate that the proposed instructor meets the requirements spelled out by Factor 1. The Government shall ensure that only those quotes that meet these requirements will be evaluated further.
If the Government receives evidence that all proposed instructors are native speakers of English or the proposed instructors obtained English language proficiency through formal education (courses completed at an institution of higher learning taught in English or English language proficiency certification, or has used English in a work environment where the English was the primary means of communication and has obtained Level 5 fluency in English by the American Council for the Teaching of Foreign Languages (ACTFL), the quoter shall receive a pass under this Factor.
Subfactor 1.2. Education.
The Government will evaluate the level and relevancy of the proposed instructor’s educational qualifications (i.e., MA TEFL/TESL certificate, etc.)
Sub-Factor 1.3. Teaching Experience.
The Government will evaluate the depth, recency, and relevancy of the proposed instructors’ experience as compared to the services required by this solicitation. Relevant experience includes contracts operating in similar working environments (a military or government environment) and contracts involving services that are considered to be similar in scope, magnitude, and complexity when compared to the requirements described in this solicitation (e.g., teaching ESL/EFL/ESP/EAP at a government institution in a formal setting to multinational adult learners for extended periods of time/contact hours). The Government will evaluate teaching experience based on the information received.
Factor 2. Corporate Experience.
The Government will evaluate the depth, recency, and relevancy of the quoter’s (and major subcontractor’s) experience as compared to the services required by this solicitation. A “major subcontractor” is defined as any subcontractor that performs 50% or more of a task, to include individual options. Relevant experience includes contracts that are considered to be similar in scope, magnitude, and complexity when compared to the requirements described in this solicitation (e.g., developing and teaching ESL, EFL, ESP curriculum and associated materials that is relevant to the work required by this solicitation, managing multiple concurrent Task Orders, and responding to emergent requirements).
Factor 3. Corporate Past Performance.
The Government will evaluate the recency, relevancy, and quality of the quoter’s (and major subcontractor’s) past performance. A “major subcontractor” is defined as any subcontractor that performs 50% or more of a task, to include individual options. Relevant contracts are contracts operating in similar working environments and contracts involving services that are considered to be similar in scope, magnitude and complexity when compared to the requirements described in this solicitation. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the offeror’s (and major subcontractor’s) past performance will be used to evaluate how well it has performed similar services in the past. Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably for past performance. To assess performance risk the Government may use both past performance data provided by the offerors and data obtained independently.
Factor 4. Price.
All prices in Attachment A to the contract and in Attachment A to the Task Order, including option years, will be evaluated for reasonableness and in accordance with FAR 52.225-17, Evaluation of Foreign Currency Offers (FEB 2000), as applicable.
The Government will evaluate quotes for award purposes by adding the total price for all line items identified in Attachment A to the Task Order. The Government may determine that a quote is unacceptable if the prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
MINIMUM GUARANTEE
The minimum guarantee for this contract is $50,000.00. The minimum guarantee will be satisfied by issuance of the first Task Order immediately following the award of the contract. There is no minimum guarantee for the option periods. (ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
