Past Performance: Offerors Past Performance will be evaluated as a sub-factor of the technical approach and qualification.

i) Offeror’s past performance must address the vendor’s past performance in performing projects similar in size and scope to the effort required by the Performance Work Statement (PWS). The projects referenced by the vendor must have been completed within five (5) years from the date of this solicitation is issued or currently ongoing and have completed at least six (6) months of performance. Past Performance Data must be received before the due date and time for this solicitation. The Offeror’s relevant past performance will be evaluated to assess the extent of the Offeror’s ability to perform the contract successfully (quality of service, completeness, timeliness of delivery/work, business relations, customer satisfaction). The evaluation may include information in Government databases such as Past Performance Information Retrieval System (PPIRS) and Contractor Performance Assessment Reports System (CPARS) that the Government locates in these systems.

ii) The Offeror shall submit completed Past Performance Data Sheets for no more than three (3) Government or commercial contracts for services directly related or similar to the services required in the PWS. If submitting proposal as a Joint Venture, the Offeror shall submit three (3) Past Performance Data Sheet by each individual firm, with a Joint Venture. The Offeror shall submit information for relevant contracts or subcontracts currently in process at least six months before the due date for responses to this solicitation or completed within the past five (5) years from the date of this solicitation.

Each past performance submission shall specifically address the following items:

• The nature of the effort

v) The Government may consider past or current contracts (including Federal, State and local

Government and private) for efforts similar to the Government requirement. The Government may consider information provided on problems encountered on the identified contracts and associated corrective actions.

The Government may also consider information obtained from any other sources when evaluating past performance. Failure of a contractor to disclose a relevant Government contract with marginal or unsatisfactory past performance may affect the Offeror’s past performance rating. (Look the definition for marginal or unsatisfactory in the PPQ).

vi) The Government may consider past performance information regarding predecessor companies, personnel who have relevant experience or subcontractors that will perform the specific tasks of the requirement when such information is relevant. Past performance information about the proposal as a prime contractor may be considered more significant and given more weight in the past performance evaluation.

(End of Addendum)

52.212-2 EVALUATION ADDENDUM

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021) -

Addendum

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforms to the solicitation and will be most advantageous to the Government, price and other factors considered. The Government may reject any offer not substantially in compliance with the terms and conditions of the solicitation and/or any proposal if such action is in the public interest, and waive informalities and minor irregularities in proposals received.

(b) The basis for award is Lowest Price Technically Acceptable (LPTA). After receipt of Offers, the Government will first evaluate the lowest price quotation. If the lowest price offer is determined to be technically acceptable and otherwise properly awardable, no further evaluations will be conducted, and an award will be made. If, however, the lowest price proposal is determined to be technically unacceptable and/or otherwise not properly awardable, the Government will proceed to evaluate the second lowest price quotation.

The process will continue until technically acceptable proposal is found.

(1) The following factors shall be used to evaluate offers:

a) Technical Approach and Qualifications

b) Past performance

c) Price

(c) Evaluation Criteria:

FACTOR I - TECHNICAL APPROACH AND QUALIFICATION

Technical Approach and Qualifications will be rated as Acceptable or Unacceptable. In order to be found technically acceptable, the Government will evaluate the adequacy of the Offerors approach in meeting the requirements in the solicitation and all attached documents. The proposal shall demonstrate how the Offeror will comply with the solicitation.

TABLE 1. Technical Ratings

Rating Description Acceptable Proposal/quotation clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal/quotation does not clearly meet the minimum requirements of the solicitation.

FACTOR II – PAST PERFORMANCE

Past performance is a measure of the degree to which the Offeor satisfied its customers in the past and complied with Federal, State, and local laws and regulations. The Government may contact some, all or none of each Offeror’s customers to ask whether:

(1) the Offeror is capable, efficient, and effective;

(2) the Offeror’s performance conformed to the term and conditions of its contract;

(3) the Offeror was reasonable and cooperative during performance;

(4) the Offeror was committed to customer satisfaction;

(5) the Offeror was able to hire and retain qualified personnel to the satisfaction of the customer; and

(6) they would select the same Contractor or a different Contractor, given the opportunity.

If the Offeror’s proposal receives a “No Confidence” rating under Past Performance, the Offeror shall be ineligible for award, and shall not be further considered.

Past Performance will be evaluated as follows:

1) To be determined recent, the projects referenced by the contractor must have been completed within five (5) years from the date of solicitation issuance or currently ongoing and have completed at least six (6) months of performance by solicitation issuance. If currently ongoing, the extent of actual performance will be considered in determining the project’s relevance.

2) The Government may use other information available from other sources that may include Federal, State and local Government agencies, Better Business Bureaus, published media, and electronic databases to evaluate an Offeror’s past performance. Databases such the CPARS, the Contractor Performance Assessment Reporting System and PPIRS, the Past Performance Information Retrieval System or other past performance assessment tools may be used. The Government may include firsthand experience of the evaluators with the Offerors in this evaluation. The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the Offeror.

3) The Offeror shall submit with its proposal completed Attachment F – Past Performance Data Sheet, for up to three (3) total projects. These projects for prime and 1st Tier subcontractor can be for Government or commercial contracts for services directly related or similar to the services required in the PWS.

To be considered, the referenced project must, at a minimum, involve street sweeping services, similar complexity to the solicited work; and total contract value over $200,000 for any federal or private projects.

The contact value is pertinent to support the Government’s level of confidence when evaluating the Offeror’s past performance experience. The scale and magnitude of tasks under this contract has an associated minimum value that would support a satisfactory confidence level that the vendor has performed street sweeping to the level of complexity stated in the PWS.

Past performance by subcontractors, predecessor, companies or key personnel will be considered for the offeror’s three total projects or each primary subcontractor project if recent and relevant provided the offeror describes how the subcontractor, predecessor company or Key personnel significantly contributed to the referenced project and the subcontractor or key personnel will significantly contribute to the solicited work.

A sufficient relation between a predecessor company’s management and the Offeror must also be established for a project performed by a predecessor company to be considered. The Offeror shall address in Attachment E – Past Performance Data Sheet the following:

• The nature of the effort

• The tasks performed as they related to PWS

• Schedule/Timeliness

• The extent of involvement (as a prime versus a subcontractor, Predecessor Company or Key

Personnel)

• The Period of Performance

• Total dollar value

• Point of contact, phone and email addresses for each contact listed.

4) The Offeror shall complete the top portion of page 1, Attachment E – Past Performance Questionnaire, and send it to each of the customers for the contracts identified on Attachment E - Past Performance Questionnaire. As stated in Attachment E – Past Performance Questionnaire, the customers will complete this form and return it directly to the Government no later than the proposal due date and time. Past performance data must be received by proposal due date to be considered.

5) Failure of a contractor to disclose a relevant Government contract with poor past performance may affect the contractor's past performance rating.

6) The Government may consider past performance information regarding predecessor companies or subcontractor companies if the predecessor’s performance is relevant to the Contractor’s performance under this solicitation. The Government reserves the right to determine the prime Contractor’s past performance as more significant than other partnerships.

There are two aspects to the past performance evaluation. The first is to evaluate the offeror’s past performance to determine how relevant a recent effort accomplished by the offeror is to the solicited work. In establishing what is relevant for the acquisition, consideration should be given to those aspects of an offeror’s past performance that would give the greatest ability to measure whether the offeror will satisfy the current procurement.

Past Performance Relevancy Ratings - In conducting a performance relevancy assessment, each offeror shall be assigned one of the following ratings:

Past Performance Relevancy Rating:

Adjectival Rating Description

Very Relevant

Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant

Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant

Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant

Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

The second aspect of the past performance evaluation is to determine how well the contractor performed on the recent/relevant contracts. The PPQs will be considered in the overall quality assessment for each referenced recent/relevant project. Other sources of information as outlined above may also be considered in the quality assessment. The combination of relevancy and quality of performance will be used to determine the overall performance confidence rating for the offeror.

Performance Confidence Assessment - In conducting a performance confidence assessment, each offeror shall be assigned one of the following ratings:

Performance Confidence Assessments Evaluation Ratings:

Rating Description Substantial Confidence Based on the offerors recent/relevant performance record, the

Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the offerors recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the requirement effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

Offers that receive a ‘No Confidence’ past performance rating shall be deemed ineligible for award regardless of price or technical acceptability.

In the case of a contractor without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the contractor may not be evaluated favorably or unfavorably on past performance, but evaluated as “Neutral” (see FAR 15.305(a)(2)(iv).

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

FACTOR III – PRICE

Price will be evaluated in accordance with FAR 15.404-1 (Proposal Analysis). Evaluation will be based on price analysis techniques to determine if they are fair and reasonable and reflect a clear understanding of the requirement. The Offeror shall provide their proposed firm-fixed prices in the bid schedule (attached) which will be used to evaluate cost for the award. The price factor will not receive a rating.

For evaluation purposes only, the total evaluated price is the sum of the total prices submitted for (a) the base period, (b) all option periods, and (c) the six-month extension authorized by FAR clause 52.217-8. For purposes of determining the evaluated price for the six-month 52.217-8 extension, the total price is calculated as one-half of the total price of the final option year. Evaluation of options shall not obligated the Government to exercise the option(s).
