FAR 52.212-2 “ADDENDUM”

1. BASIS FOR CONTRACT AWARD

a. Authority: This solicitation is entered into under the authority of 10 USC 2304 and the Federal Acquisition Regulation (FAR) Part 12 Acquisition of Commercial Items procedures.

b. The Government intends to award a single Blanket Purchase Agreement (BPA) resulting from this solicitation to the responsible contractor whose offer conforms to the solicitation and is determined to be the best value to the Government. The Government is utilizing the Lowest Priced Technically Acceptable (LPTA) source selection process. The Government reserves the right to award a contract based upon initial proposals. The Government will make a single award resulting from this solicitation. The Government intends to award without discussions, but reserves the right to conduct discussions, if determined to be in the Government’s best interest.

c. LPTA is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. LPTA may be used in situations where the Government would not realize any value from a proposal exceeding the Government’s minimum technical or performance requirements. The Government will select the offeror that is evaluated to have an acceptable technical approach (technical specifications), an acceptable past performance record with the lowest price. Offerors must satisfy the requirements described in the Statement of Work (SOW), as well as, other Request for Quote (RFQ) requirements. Proposals that take exception to any requirement shall be deemed unacceptable.

Proposals are evaluated for acceptability but not ranked using the non-cost/price factors. The evaluation will be conducted in accordance with FAR 12.6, 13.3, and Section M (Clause 52.212-2 Evaluation Addendum) of the RFQ.

d. Unless all offers are rejected, the Government intends to award a single, firm fixed price BPA to the responsible Offeror whose offer, conforming to the solicitation, is determined to be the best overall value, price and other factors considered.

e. Electronic copies of each volume shall be submitted through the Solicitation Module of the Procurement Integrated Enterprise Environment (PIEE) at https://piee.eb.mil. Proposals submitted by mail or hand-carried will not be evaluated (Exception for system outage. See below). Proposals sent through proprietary or third party File Transfer Protocol (FTP) sites or DoD SAFE will not be retrieved. It is the responsibility of the Offeror to confirm receipt of proposals. All proposals received after the exact time specified for receipt shall be treated as late submissions and will not be considered except under facts and circumstances allowed by the Federal Acquisition Regulation (FAR). For instructions on how to post an offer, please refer to the Posting Offer demo: https://pieetraining.eb.mil/wbt/sol/Posting_Offer.pdf.

2. EVALUATION FACTORS

a. The evaluation will be based on a complete assessment of the Offeror’s proposal. Proposals shall be evaluated on the following:

(1) Factor 1: Technical

(2) Factor 2: Past Performance

(3) Factor 3: Price

i. Order of Importance. Factor 1: Technical is of equal importance to Factor 2: Past Performance.

The offeror must be deemed acceptable under Factors 1 and 2, before Factor 3: Price will be evaluated. Low price will then be the determinative factor between the offerors deemed acceptable under Factors 1 and 2.

b. Factor 1: Technical – The Offeror shall provide a strategic overview that demonstrates an overall understanding of the mission, strategy, and goals of the SOW. Based on the information presented in the SOW, the Offeror should clearly and concisely describe their technical approach and capability in how they will perform the tasks presented. The Offeror shall provide a narrative describing their capability to perform the work in the SOW. The evaluation of the Offeror’s technical volume will assess whether its proposal will satisfy the Government’s minimum acceptability requirements. The Technical Evaluation Panel will evaluate the Offeror’s proposal against these requirements to determine whether the proposal is acceptable or unacceptable. If Factor 1 is found unacceptable, the proposal will not receive any further evaluation and will be out of the competition.

c. Factor 2: Past Performance - The Government will evaluate how well the offeror has performed on contracts that have been determined to be both recent and relevant to the SOW. The Offeror’s past performance reference may submit past performance information on the attached past performance questionnaire (See “RFQ 22R0050 Past Performance Safety Glasses”). Each past performance questionnaire must correspond to an experience example submitted. The POCs identified on the questionnaire must be able to provide information on the quality of your performance.

i. Past performance is a measure of the degree to which the Offeror satisfied its customers in the past and complied with Federal, State, and local laws and regulations, as identified as the Prime Contractor or direct employee or consultant. The Government may contact some, all or none of each Offeror’s customers past performance reference as identified in its Volume III submission.

ii. The Government may also use other information available from other sources to evaluate an Offeror’s past performance, which may include, but not limited to: Past Performance Questionnaire, Federal, State and local Government agencies, Better Business Bureaus, published media, electronic databases such as the Contractor Performance Assessment Reporting System (CPARS) and the Past Performance Information Retrieval System (PPIRS). Interviews with other Government or commercial personnel contacts not provided by the offeror may also be utilized.

The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the Offeror.

iii. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 13.106-2(b)(1)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” Offerors with an unacceptable past performance rating will be afforded an opportunity to address alleged deficiencies.

d. Factor 3: Price - In accordance with FAR 15.404-1, evaluation will be based on price analysis techniques to determine if they are fair and reasonable, and reflect a clear understanding of the requirement.

The Offeror shall provide a firm fixed price. The pricing volume shall be submitted as a separate document.

The pricing volume must differentiate between prime, subcontractor, and teaming partner labor. No adjectival ratings will be used to evaluate Price (See “RFQ 22R0050 Pricing Safety Glasses Spreadsheet”).

i. For evaluation purposes only, the total evaluated price is the sum of the total prices submitted for the base ordering period and all additional option periods. In addition, the prices submitted for each of the pricing spreadsheet tabs, will be evaluated as the total overall price. In addition, one half the final option year price (for the potential FAR 52.217-8 extension) will be considered as part of the total evaluated price. The Government may determine that a proposal is unacceptable if one of the additional ordering period’s prices are significantly unbalanced. Evaluation of additional ordering period pricing will not obligate the Government to exercise the option.

3. RATING METHODS:

a. FACTOR 1 - TECHNICAL: The Evaluation Process for Factor 1 is specified below. The rating reflects the assessment on whether the proposed “meets” or does “not meet” the minimum requirements of the solicitation. The evaluation of the Offeror’s proposal against these minimum requirements shall be determined “acceptable” or “unacceptable” and shall utilize the technical ratings listed below:

Technical Acceptable/Unacceptable Rating Method

Adjectival Rating Description Acceptable Proposal meets the requirements of the solicitation indicates an adequate approach and understanding of the requirements.

Unacceptable Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is un-awardable.

b. FACTOR 2 - PAST PERFORMANCE: There are three steps performed when evaluating the past performance factor: recent, relevant, and quality (how well the offeror performed on the prior contracts).

1. Step 1 – Recent. The first step is to evaluate the recency of the offeror's past performance. Recency is a measure of time that has elapsed since the past performance references occurred. If a reference is outside/before the timeframe listed below, then that reference will be rated “not recent” and will not be further evaluated as a part of the past performance factor. Each of the contract references must pass the “recent” step in order to proceed to step 2 – relevant.

(a) Using “RFQ 22R0050 Past Performance Safety Glasses”, the Performance of each reference must be on going or completed within the previous three (3) years of the date of this solicitation (not before March 1, 2019). If performance is ongoing, the offeror must have completed at least 6 months of performance to be considered recent for evaluation purposes. Past performance not considered recent will not be evaluated or considered.

2. Step 2 – Relevant. The second step is to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. The relevancy rating is a measure of the extent of similarity between the service effort, complexity, dollar value, contract type, and other comparable attributes of past performance examples, and would provide the most context and give the greatest ability to measure whether the offeror will successfully satisfy the current requirement.

a. Relevancy Ratings and Definitions:

i. Relevant: The past performance contract reference involved similar scope and magnitude of effort and complexities this solicitation requires.

ii. Not Relevant: The past performance contract reference does not involve similar scope and magnitude of effort and complexities this solicitation requires.

b. Relevant Project is defined as:

i. Three (3) contract references for furniture relocation and installation services to reconfigure existing office furniture.

ii. The total contract value is a minimum of $35,000.00.

iii. The offeror must be the prime contractor. (Note: Subcontractor contract references will NOT be rated relevant).

3. Step 3 – Quality. The third step is to determine how well the offeror performed on the prior contracts.

This step will assess how well the contractor performed to determine the ability of the contractor to successfully perform the proposed contract requirements based on its performance on similar contracts in the past.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “Neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable”.

4. The Technical Evaluation Panel will assign an adjectival rating that indicates its past performance assessment of the contract references as indicated below.

Past Performance Acceptable/Unacceptable Rating Method

Adjectival Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

c. FACTOR 3 – PRICE:

1. The price factor will not receive a rating, but the evaluated price must be found to be fair and reasonable in order to be eligible for award. The pricing evaluation will be based on price analysis techniques found in FAR 15.404-1 to determine if they are fair and reasonable. Price analysis will be used to determine the total evaluated price to support the selection of the lowest priced, technically acceptable offeror. For evaluation purposes, the total evaluated price will be:

(a) The total prices submitted for the base ordering period and all additional ordering periods (See “RFQ 22R0050 Pricing Safety Glasses Spreadsheet”).

(b) An amount equal to one-half the final option year price (6 months) to cover the cost of the potential option under FAR 52.217-8.

2. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
