QUESTIONS AND ANSWERS

General Questions -

Question Section Interested Party Question Government Response 1 SF1449 Block 8 states the proposal is due 12:00 PM

23 Jul 2021. Please confirm time zone.

The proposal has been extended to August 2, 2021.

Standard Form (SF) 1449, block 8 was revised to reflect the extension Offer Due Date/Local Time.

Correction: SF1449, Section L4(A)(1)(a) was revised to reflect:

Submission of proposals shall be emailed before/by Offer Date/Local Time (Eastern Time) indicated on page 1, lock 8 of the solicitation (Standard Form 1449) to:

2 Section B CLINs 0003, 0004, and 0007 (and comparable ones in option years), show 200,000 as max meals and/or additional meals and/or lot. While on page 24 of 106, it shows these CLINs as $200,000, not in meals.

Is the contractor to show these CLINs as a set dollar amount? Please clarify.

The amounts in CLINs 0003, 0004, 0007 and all option CLINs are the Government’s Not to Exceed dollar amount.

Yes, Offerors are to show the set dollar amounts on their proposal.

3 Section I- Clause 52.222-

The solicitation includes FAR Clause 52.222-42 on page 53 of the solicitation while the Clause is not checked (X) off on page 48.

Will the Government please include the check (X) on par 48 for consistency?

No, per the solicitation (SF1449), page 53 FAR 52.222-42 is incorporated by FULL TEXT.

Therefore, a check (X) within FAR 52.212-5 referencing FAR 52.222-42 incorporated by reference is not required.

4 Section I- Clause 52.222-

Please verify that this contract falls under an SCA contract determination, reference FAR 52.222.

The Service Contract Act (SCA) applies to this contract. See updated Attachment 13 J-C4 SCA

WD 2015-4259 R14.

5 Section I- Clause 52.222-

The government included FAR Clause 52.222-42 Statement of Equivalent Rates for Federal Hires and an informational Wage Determination table.

Noted within this section is Executive Order 14026. Per EO 14026 signed April 27, 2021 wages are calculated pursuant to special certificates issued under section 14(c) of the Fair Labor Standards Act of 1938 (29 U.S.C.

214(c)), shall be at least $15.00 per hour, beginning January 30, 2022 and beginning

This requirement falls under the Service Contract Act (SCA). Therefore, the Offeror must comply with the SCA and paid a minimum wage based on a determination by the Department of Labor of the average rates and benefits for similar work in private industry in the same locale as the service contract from the performance start date through January 29, 2022.

Beginning January 30, 2022, per EO 14026, the Offerors shall incorporate a $15.00 minimum wage within their base year pricing proposal.

January 1, 2023 annually thereafter as determined by the Secretary of Labor.

For the labor categories that currently have minimum wage requirements below the $15.00, will the Government please confirm that Offeror’s are expected to utilize a $15.00 per hour minimum direct labor rate for pricing within the base year?

6 Section I- Clause 52.229-

The RFP does not include FAR Clause 52.229-4, Federal, State, and local taxes. As this is a multi-year ID/IQ contract, would the Government add this clause to the solicitation and resultant contract in the event there are subsequent upward adjustments in the FICA or Medicare Tax rates?

FAR Clause 52.229-4 is not applicable to this requirement in accordance with FAR 29.401-1(b).

FAR 52.229-3 is included in the solicitation which is the applicable FAR clause in per FAR 29.401- 3(a).

7 Section I- Clause 252.217-7027

Under the Clause 252.217-7027 section of the solicitation the government requires that the contractor agrees to submit a firm fixed-price proposal and certified cost or pricing data supporting its proposal. There are no instructions in Section L for a certified cost or pricing data requirement. As this is a competitive procurement, the expectation is that there will be adequate price competition in accordance with 15.403-(C)(1) Adequate price competition, as prescribed by the referenced 15.403-1(b)(1).

Certified cost or price data is not required.

Therefore, no instructions are in Section L.

Correction: FAR 52.252-3--ALTERATIONS IN SOLICITATION (APR 1984) was added due to the modification of DFARS 252.217-7027 deleting the certified cost or price data requirement.

DFARS 252.217-7027 was modified to reflect:

(a) A Firm Fixed-Price (FFP), Indefinite Delivery Indefinite Quantity Contract (IDIQ) is contemplated. The Contractor agrees to begin promptly negotiating with the Contracting Officer the terms of a definitive contract that will include

(1) all clauses required by the Federal Acquisition Regulation (FAR) on the date of execution of the undefinitized contract action, (2) all clauses required by law on the date of execution of the definitive contract action, and (3) any other mutually agreeable clauses, terms, and conditions.

The Contractor agrees to submit a firm fixed-price proposal and required attachments supporting its proposal.

8 L5 This section states, "Text and graphics portions of the electronic copies shall be in a format readable by Adobe (PDF), MS Word, and/or MS Excel." However, graphics that are created in PowerPoint and then imported into the proposal are not searchable.

Please eliminate graphics from this requirement.

The Government is not requesting graphics with the Offeror’s proposal.

This section states instructions to Offerors includes graphics in their proposal.

Please resolve this discrepancy and amend Section L6 Proposal Content Chart or L8 1) Volume Content Volume I: Administrative as appropriate.

9c. See response to 9b.

10 L6; L8 Section L6 Proposal Content Chart lists Tax Identification Number, CAGE Code, DUNS Number as the third requirement in Volume II: Administrative. However, Section L8 1) instructs Offerors to include this information in the Cover Letter.

Please resolve this discrepancy and amend Section L6 Proposal Content Chart or L8 Volume I: Administrative as appropriate.

The Government requests Offerors to review Section L6 Proposal Content Chart Volume I:

Administrative, 3rd bullet: Tax Identification Number, CAGE Code, DUNS Number. It is not in Volume II: Administrative.

See response to 9a.

11 L6; L8 There is a discrepancy in the order of Volume I: Administrative requirements in Section L6 Proposal Content Chart and Section 8 1). Please resolve this discrepancy and amend Section L6 Proposal Content Chart or L8 Volume I: Administrative as appropriate.

See response to 9a.

Please clarify if Offerors are supposed to use the Attachment #10 J-L-3 only or is the form just a guide and all information is to be transferred to our own template in Word?

Yes, Offerors must use the attachments provided.

Attachments J-L3 Past Performance Data Sheet and J-L4 Past Performance Questionnaire Sheet were converted to fillable PDF.

Offerors may use their own template with Attachment J-L3 for additional pages as long as it does not exceed the page limit.

L-3 Past Performance Data and to add Contractor name and cage number to the bottom of the form underneath the Government’s footer.

If we are indeed required to use Attachment J-L-3, are we also required to use the Government’s header and not our own?

No, Offerors are not required to use the Government’s header. Offerors are permitted to use their own header.

16 L7 Section L7 7) directs Offerors to register in SAM and complete and all representations and certifications required by this solicitation. However, L6 and L8 1) indicate that this documentation should be included with the proposal.

No, the Offeror shall include the completed SF1449 and amendments in Volume I:

Administrative as indicated on SF1449 section L6 Proposal Content Chart.

18 L8 Due to the FOUO nature of the facility clearance certificate verification request, will the Government please provide their preferred method of submission for this portion of the proposal response?

The Defense Security Service, Facility Clearance Branch provides the result of the Clearance Verification Request when requested. A copy of this letter will be sufficient and included in Volume II of the offeror’s proposal.

The Offerors shall submit their electronic proposal via email before/by date/time indicated on page 1, block 8 of the Solicitation (SF 1449) in accordance with section L4 Proposal Submission Due Date (A)(1).

19 L8 19a. The RFP allows a maximum of five pages for the organizational chart section of Volume I; however, other than the chart itself, the Government does not tell the Offerors what additional information/ discussion should be included in this section of the proposal.

19a.Correction: L8 Volume Content: 1) Volume I:

Administrative 2nd paragraph outlines the information to be included for the following:

Representations & Certifications Continuity of Operation Plan (COOP) Organization Chart Management Plan Quality Control Plan

19b. The Management Plan PWS 1.6 asks for a staffing matrix and staffing plan that are more logical to the discussion of the Offeror's organization. Or could these the Management Plan and Organization Chart sections be merged and the page allocation increased?

Please provide additional direction for these sections of the proposal.

19b. The Offeror may merge the Management Plan and Organization Chart, should they choose but it must not exceed the combined page limits.

See response to 23b.

20 L8 Will the Government please confirm that they would like PPD and PPQ documents submitted as separate documents from the Volume III document, as instructions indicate not to edit PPD and PPQ document templates?

Yes, the Offeror shall submit Attachment J-L3 Past Performance Data (PPD) Sheet and Attachment J-L4 Past Performance Questionnaire (PPQ) Sheet as separate documents.

Attachments J-L3 PPD Sheet and J-L4 P Sheet have been converted to fillable PDF.

21 L8 Will the Government confirm that the 8(a) program welcome letter from the SBA qualifies as “a copy of the company’s 8(a) certificate”?

No, the Government will not accept a welcome letter. Offerors must provide a copy of the company’s Small Business Office 8(a) certification.

22 L8 Will the Government allow past performances which have an average annual value of $1M in lieu of $5M TCV?

No, the Government’s scope and magnitude of this project requires Offerors to have a $5M minimum total contract value, standard level of experience that would support a favorable Confidence Assessment Level.

23 L8;

PWS 1.6.1

23a. The requirements in L8 for the Management Plan are significantly different than the requirements in PWS 1.6.1. L8 directs Offerors to "submit a Management (PWS 1.6.1) discussing its approach to quality control, resource management, and possible performance issues related to PWS Part 5." PWS 1.6.1 directs Offerors to "convey an understanding of all tasks specified in the PWS and describe an approach to satisfy these requirements."

PWS 1.6.1 then goes on to instruct offers to address seven elements including property management, staffing, corporate support, and training that are different from the L8 elements quoted above. Please clarify which requirements/tasks/approaches Offerors are to discuss.

The Government is asking contract references to return completed PPQs to the Offerors. Information by contract references in PPQs is considered sensitive and normally not shared with Offerors.

The Government maintains it is the responsibility of the Offeror to obtain the Past Performance Questionnaire (PPQ). PPQs must be included in the Offeror’s Volume III: Factor I Past

Request the Government change the requirement to instruct contract references return the PPQs directly to you and instruct Offerors to include the first page of the PPQ in their submission.

This security clearance is a PASS / FAIL requirement to be received by the Government no later than the proposal due date.

26a. The SECRET facility clearance only applies to the Prime contractor in a traditional prime-subcontractor structure, which is comprised of a single prime contractor and multiple subcontractors. However, any contractor’s personnel, prime or subcontractor, supporting this contract must have an individual secret clearance.

26b. Does SFC requirement pertain to Subcontractor Partners?

26b. Yes, the Subcontractor Partners must have an active FSC. The Prime contractor is responsible for ensuring security procedures are met in order to perform the duties at all contract locations.

Therefore, yes, the prime contractor is responsible in ensuring subcontracting partners adhere to the requirements.

27 Attachment 1 The formula in Cell F5 appears to be linked to another cell instead of reflecting a multiplication formula.

Can the offeror update the worksheet to correct formula?

Correction: The Government removed formulas in all the cells in Attachment 1 J-B-1 Pricing Submission Worksheet.

Yes, Offerors may enter the appropriate formula on applicable cells for their pricing proposal.

28 Attachment 1 The total formula is missing for each period.

Can the offeror update the worksheet to correct formulas in cells F12, F21, F30, F39, F48, and F57?

29a. Correction: Due to character limitation on the Government’s contracting writing system, the description was shortened in SF1449, Section B, CLINs 0003 & 0004; and all options CLINs were revised to reflect:

o CLIN X003 Dining Facility Services – Add Short Meal o CLIN X004 Dining Facility Services – Add Full Meals

In addition, the Extended Description was revised to include:

o CLIN X003 Additional Short Line Meals:

o CLIN X004 Additional Full Service

Meals:

29b. Is Attachment 1- J-B1 correct and if so should the Schedule B be updated to reference the same as Attachment 1- J-B1?

30 Attachment 1 & 2

CLIN 0007 is labeled "SURGE" on the Attachment 1 & Schedule B, however on Attachment 2 - Additional Meal Cost it's not shown as part of the surge information.

Should this be corrected to show CLIN 0007 in Attachment 2?

No, CLIN 0007 is not shown on Attachment 2 J- B2 Scheduled Price List. See response to 25.

Attachment 1 J-B1 Pricing Submission Worksheet is provided to assist the Offeror when composing its proposal and the Government when evaluating pricing.

31 Attachment 2 Can the government verify that the column header "Number of Staffing" is referring to a Full Time Equivalent (FTE) count?

See response to 30.

33 Attachment 2 The breakout of # of Meals to Prepare does not align with the CLIN Structure. For example, CLIN 0003 is for 1-100 Short Line Meals on Attachment 1 and CLIN 0003 is requesting 1-100 and 101-350 on Attachment 2. Please update to be consistent.

See response to questions 2 and 29.

34 Attachment 2 Instructions to Offerors is to enter all applicable costs per hour IAW PWS Section

5.3.2 Optional Meals. Should the

Instructions and subsequent Column header be referencing Price per Hour vs. Cost per Hour?

Correction 1:

Attachment 2 J-L2 Schedule Price List, Instructions to Offerors was revised to reflect:

On this page, the price per hour (price/hour) is the sum of the hourly rates of all contracting staffing in support of PWS Section 5.3.2 Optional Meals.

The negotiated price will be the hourly rates used for the proposal when optional / additional meal services and surge support are requested. The offeror shall identify the labor categories and the number of contracting support in the staffing support column. NOTE: This is just an example, as the offeror's proposed staffing may vary. Staffing to prepare 1-100 meals may consist of 4 cooks, 1 stock clerk, and 4 food service workers for $50/hour; whereas staffing to prepare 101-350 meals may consist of 5 cooks, 1 stock clerk, and 6 food service workers for $75/hour.

Correction 2: Attachment 2 J-L2 Schedule Price List, Header Column was revised to reflect:

Price/Hour

Correction 3: Attachment 2 J-L2 Schedule Price List, included an additional column titled:

Staffing Support

35 Attachment 3 Will the solicitation be updated to incorporate the newly incorporated federal holiday of Juneteenth into Section 1.6.4 Recognized Holidays?

Correction: PWS Section 1.6.4 Recognized Holiday was revised to reflect Juneteenth National Independence Day as a recognized holiday.

36 Attachment 3 Will the Government please confirm a productive person-year should be priced at 1880 hours/year, exclusive of Surge?

Yes, 1880 hours/year is a productive person-year.

37 Attachment 8 37a. “5. Offerors, provide copy of secret clearance” Will the Government please clarify how they would like offerors to display this?

37b. DISS does not allow export of clearance confirmation, will the Government allow submission of SSN or other PII to verify clearance of proposed Key Personnel? If requesting SSN or other PII for key personnel, will the Government please provide a secure method for submission of

PII?

37a. See the response to 18.

37b. No, the Government will not allow submission of SSN or other PII for Key Personnel to verify active clearance status.

The Offeror shall provide a memorandum on company letterhead from their Facility Security Officer confirming the Key Personnel’s clearance status. At a minimum, the memorandum must include the following:

Please clarify if the Government wants the name of the Government Contracting Agency or the name of the subsidiary/company/contractor that is performing the work on the given contract reference?

Attachment 10 J-L3 Past Performance Data pertains to the current or previous contract that the offeror is preforming or performed.

Section 1 Complete Name of the Reference, the Government is requesting for the information of the customer receiving the services. The customer reference may be a Government agency, commercial firm, or other organization.

40 Attachment 13 The SCA Wage Determination was provided for the Pennsylvania County of Adams.

Provide the applicable Wage Determination for work performed at Site C and Ft. Detrick, which are in the state of Maryland.
