PERFORMANCE WORK STATEMENT
Section C: Performance Work Statement
Part 1: General Information
1.1 Introduction
The purpose of this contract is to fulfill the need for Mitigation and Restoration Services at the Pentagon. The primary purpose of the procurement will be to secure a contract vehicle for mitigation and restoration services at the Pentagon Reservation; however, the Contract will have the flexibility for scheduled mitigation and restoration services as well. Washington Headquarters Services (WHS) manages and administers the Pentagon Reservation and other DoD owned facilities in the National Capital Region (NCR). The Contract may also be used as a basis for catastrophe or emergency work at all WHS-administered facilities in the National Capitol Region. The Pentagon is the headquarters of the United States Department of Defense (DoD) and the world’s largest low-rise office building.
It is at once a building, an institution, and a national symbol. The Pentagon has also been identified as the “Energy Efficient and Environmentally Sensitive Showcase Building” for DoD.
The Pentagon’s three occupant groups (military, civilian, and contractor) contribute to the planning and execution of the defense of the USA. The Pentagon houses 23,000 employees and has over 6.6 million square feet of floor space contained within five floors and 17.5 miles of corridors. As this Contract is to be administered by WHS, it will provide support to both WHS and all Tenant Organizations in the Pentagon. WHS also provides services to delegated leased facilities in the National Capital Region (NCR) and at other WHS-managed, government owned facilities off the Pentagon Reservation. The DoD population in the NCR is over 60,000.
1.2 Background
This Contract will support government mitigation and restoration services on an as-needed, immediate response basis. The procurement does not have an established incumbent and is considered a previously unidentified need.
The successful bidder will be required to provide identified mitigation and restoration services at the levels described in this Performance Work Statement (PWS) and to provide verifiable evidence that these services will be available as-needed in each renewal period. The contracted services shall be delivered at a “level of service” that results in a product consistent with showcasing the Pentagon as a symbol for the general public, nation and international dignitaries. The contract is offered as a one-year contract with a possible additional four, one year (1) options depending on the Contractor’s performance and/or other factors.
In providing the required services for this contract, the Government will use CPARS to assess performance. In order to earn the highest ratings, the contractor must have “substantially exceeded the contract performance requirements, without commensurate additional costs to the Government”.
1.3 Objectives
The objective of this contract is to minimize damage from catastrophic events in terms of both property damage and reduced service provided by WHS and/or Tenant Agencies. Catastrophic events include sudden water intrusion, fire severe weather and other events that might damage the WHS-managed facilities. The selected contractor will provide the level of service that is required to re-establish and maintain normal operation on an “accelerated schedule”. An “Accelerated Schedule” is defined as a schedule that will re-establish normal operation with minimum down-time; to include adequate staffing and overlap of trades to conduct work in the most efficient manner achievable. It is expected that all mitigation efforts will be in accordance with “industry standard” levels of effort or greater, and that all restoration will comply with all codes and standards in use at the Pentagon to include everything from building structure through finishes. A non-exhaustive listing of “industry standards” that are expected for performance may be found in Section 2.1 Core References.
1.4 Scope
The selected Contractor shall be responsible for providing all labor, equipment and materials to complete projects from mitigation through return of the restored space to the Tenant. This contract is intended to be broadly defined to allow WHS to use Contractor services on non-emergencies and emergencies at other WHS facilities within the NCR. Examples of non-emergency projects that may be included under this Contract are listed in Appendix J-C1, and examples of projects that are excluded from the contract are included in Appendix J-C2.
The selected Contractor must be able to respond to a WHS request for emergency service at the Pentagon Reservation within two hours, at the level requested in this PWS. The selected Contractor must also enter into a contractual agreement to provide emergency catastrophe response to the Pentagon as required by the PWS and at the established response times. The Contractor will be guaranteed a minimum dollar value of task orders totaling at least $100,000, during the base contract year. In addition to emergency mitigation services, the selected Contractor may be asked to provide, and must have access to all disciplines and resources required, to restore damaged tenant space to pre-catastrophe conditions on an accelerated schedule. Restoration services shall be solely at the discretion of WHS through the Contracting Officer (KO). WHS reserves the right to complete restoration services either in-house or through outside contract vehicles. As restoration services will not be required on an emergency basis, but rather an accelerated schedule, and the scope of restoration varies from project-to-project, it is the intent of WHS to have the contractor use RS Means © to price labor and material costs to complete the restoration. The cost basis on many restoration items such as systems furniture, carpet, ceiling tile, paint and other finishes may come from single or limited sources as often these materials are only available from one provider and/or are under exclusive purchasing agreements with the Government. Services related to cleaning of structure and contents (ex. upholstery) are to be considered mitigation and shall be included as Loaded Labor and/or Equipment CLINs.
The selected Contractor may be asked to provide, and must have access to all disciplines and resources required, to restore damaged items of a unique nature. Items of a unique nature include but are not limited to, historic documents, articles of historic significance, and other items of value as defined by WHS. The need for “specialized restoration services” shall be solely at the discretion of WHS through the Contracting Officer. As specialized restoration services will not be required on all projects, and vary widely based on restorative techniques, these services shall be negotiated between the Contractor, KO and COR.
The selected Contractor may be required to sub-contract currently unanticipated services required on an emergency basis to facilitate the restoration of the Pentagon Reservation grounds and facilities. The nature of these services cannot be anticipated and will be addressed on a case-by-case basis by WHS. If required, the emergency services shall be negotiated between the Contractor, KO and COR.
This is not a Requirements contract. WHS, based on the Government’s best interest, has discretion to obtain services within the scope of this contract from Government personnel or other contractors.
1.4.1 Specific Requirements
This contract requires the Contractor to provide the following services, including, but not limited to:
• Provide Emergency Mitigation services on an as-needed basis for the Pentagon Reservation at the levels defined in this PWS;
• Provide Scheduled Mitigation services on an as-needed basis for the Pentagon Reservation;
• Provide Restoration services on an as-needed basis to bring damaged Tenant space to pre-damaged conditions on an accelerated schedule;
• Provide Specialized Restoration services for the restoration of unique items on an as-needed basis;
• Be capable of providing Emergency Mitigation, Restoration, and Specialized Restoration services to other WHS facilities in the NCR, when requested, using the cost basis of this procurement; and,
• Provide unanticipated emergency services that are currently undefined.
1.4.2 Mitigation and Restoration Services
WHS is responsible for providing “tenantable space” to the Tenant Agencies that use the Pentagon Reservation facilities. As such, WHS is responsible for mitigation of damage and restoration of tenant space in the wake of catastrophic events. Catastrophic events as defined here include, but are not limited to, large water intrusion events, fire damage, wind events, and/or events that may include water, fire or other damage to space that is otherwise structurally safe and absent of significant occupational hazard. It is not the intent of this contract to address catastrophe damage that includes significant risk of exposure to life threatening conditions or environmental stressors (ex. hazardous materials).
1.4.2.1 Emergency Mitigation
The Contractor shall provide Emergency Mitigation services on an as-needed basis for the Pentagon Reservation. The services described will be fully staffed and equipped at levels required by this PWS. The “level-of-service” for mitigation activity will be industry standard (ex. IICRC S500 & S520) or greater.
1.4.2.1.1 The IDIQ line items described in the Attachments will form the basis of compensation for services under this contract. WHS will use the general classifications of Loaded Labor, Equipment, and Materials to determine compensation. Attachment J-B1 provides IDIQ lines for Loaded Labor Categories, Equipment and Materials and RS Mean Co-efficients for Priced and Non-Priced items; and Attachment J-B2 provides lines for profit and overhead mark-up on services that are primarily or entirely subcontracted. These rates will be used to arrive at the negotiated FFP. The intent is, to the greatest extent possible, negotiate the FFP order before work commences. However, some work may be directed by the Government before a FFP order can be negotiated. In that event, the process outlined in 1.4.2.1.5 applies.
1.4.2.1.2 Expendable items for use with rented equipment are included in the quoted rates. Examples would include carpet cleaners must include soap, and HEPA vacuums and air scrubbers must include filters. Additionally, workers labor is to include all PPE and tools required for work. An Example would be that respirators, safety glasses and brooms are to be included for a general laborer that sweeps up floors.
1.4.2.1.3 It is recognized that mitigation services are subject to frequent innovations in technology with a resulting cost savings available to service users through shortened down-time and/or equipment requirements. This procurement has been written to allow for the Government to allow Substitutes to be used when a net cost savings to the Government in actual cost and/or reduced down time can be demonstrated. Any mitigation technology that is not identified in the line items of this Contract is a Substitute and must be approved in advance by the CO with technical input from the COR.
1.4.2.1.4 Material waste generated on the Pentagon Reservation shall be cycled through the existing Pentagon waste disposal stream. The Contractor shall supply the labor and equipment necessary to transport the waste from the area of damage to the designated waste containers.
1.4.2.1.5 Undefinitized Contract Action Tracking. In some cases in the event of an emergency, direction from the Government may be given to perform work prior to the negotiation of a Firm Fixed Price order (based upon the contractual unit prices). The contractor agrees to follow the Government’s direction to perform without a Firm Fixed price order. During the period after an emergency authorization to begin work and prior to the establishment of a final Firm Fixed Price for the work the following requirements apply: A daily accounting of all labor, equipment and materials, shall be maintained and presented to the COR or Alternate COR (ACOR) for “Acceptance” on a daily basis. The information presented is subject to 100% verification by the COR/ACOR. Any invoicing that does not include documented Acceptance will not be paid by the Government.
1.4.2.1.6 Project Status Tracking. A weekly accounting of all Contractor activities, status of progress, time lines for material needs, completion projections and project milestones will be presented to the COR/ACOR at formal meetings for any project that will extend 14 calendar days or longer. Any conditions that will substantially change time lines will be promptly brought to the COR/ACOR attention in writing, regardless of meeting date. Project Status Tracking shall be presented at the weekly meetings in written form using appropriate software capable of presenting the data clearly and concisely. E-mail is acceptable as preliminary notification, but must be followed with formal written documentation.
1.4.2.2 Scheduled Mitigation
The IDIQ line items for loaded labor, equipment, and materials will also be used for Scheduled Mitigation projects. Scheduled work is work that is requested with more than 24 hour lead time. Scheduled work includes mitigation work related to mold, fire, or water damage, as listed in Attachment J- B4. Labor rates for scheduled projects shall be reduced by the Contractor’s proposed multiplier identified in Attachments J- B1. As with emergency response these projects will use the IDIQ line items to form a basis for “Firm Fixed Price” task orders.
1.4.2.2.1 The IDIQ line items described in the Attachments will form the basis of compensation for services under this contract. Task orders will be negotiated as firm-fixed prices. WHS will use the general classifications of Loaded Labor, Equipment, and Materials to determine compensation. Attachment J-B1 provides IDIQ lines for Loaded Labor Categories, Equipment and Materials and RS Mean Co-efficients for Priced and Non-Priced items; and Attachment J-B2 provides lines for profit and overhead mark-up on services that are requested entirely as sub-contract. These rates will be used to arrive at the negotiated FFP.
1.4.2.2.2 Expendable items for use with rented equipment are included in the quoted rate.
Examples would include carpet cleaners must include soap, and HEPA vacuums and air scrubbers must include filters. Additionally, workers labor is to include all PPE and tools required for work.
An example would be that respirators, safety glasses and brooms are to be included for a general laborer that sweeps up floors.
1.4.2.2.3 It is recognized that mitigation services are subject to frequent innovations in technology with a resulting cost savings available to service users through shortened down-time and/or equipment requirements.
1.4.2.2.4 Material waste generated on the Pentagon Reservation shall be cycled through the existing Pentagon waste disposal stream. The Contractor shall supply the labor and equipment necessary to transport the waste from the area of damage to the designated waste containers.
1.4.2.2.2.5 Proposals for Scheduled Mitigation projects are due to the CO within 7 calendar days of request.
1.4.2.3 Scheduled Restoration
The Contractor will be required to provide Restoration services on an as-needed basis for damage related to mitigation at the Pentagon Reservation and/or WHS-Owned facilities in the NCR. The services described will be at the sole discretion of the Government and may be addressed through in-house or alternate contracts if it is determined to be in the best interest of the Government. However, it is anticipated that due to the accelerated schedule that will be required for restoration, that the Contractor will normally be required to provide this service.
1.4.2.3.1 Pricing Restoration Task Orders
1.4.2.3.1.1 UNIT BOOK PRICING: The Contractor shall use RS MEANS® as the primary device for estimating labor and material costs required to complete the work specified in Restoration Task Orders only. RS MEANS® does not cover every task that might be accomplished by specific trades. If work requirements cannot be directly developed using RS MEANS®, then the Contractor shall provide an alternate means to determine cost upon KO’s approval.
1.4.2.3.1.1.1 The Contractor shall be responsible for obtaining this software and maintaining the most current version or update of RS MEANS® Facilities Construction Cost Data Estimating Program.
1.4.2.3.1.1.2 The “Bare Cost” unit price data provided by the RS MEANS®
Company shall serve as the basis for establishing the value of the work performed on a unit price basis.
1.4.2.3.1.2 ECONOMIC COST ADJUSTMENTS: Economic cost adjustments for various project locations will be established through the use of RS MEANS® City Cost Indexes.
1.4.2.3.1.2.1 The Contractor shall use the calculation methods as prescribed in RS
MEANS® to adjust national average costs for specific geographic locations.
1.4.2.3.1.2.2 The Contractor shall use the city index that most accurately describes the geographic location of the project. For example, for task orders performed at the Pentagon, the Arlington, VA city index should be used.
1.4.2.3.1.3 NON-PREPRICED ITEMS (NPI): NPI’s are labor, material, equipment, etc, costs that are required for performance of a Task Order, but are not represented (or only partially represented) in RS MEANS.
1.4.2.3.1.3.1 The contractor must include justification for any proposed non-pre-priced items. The contractor shall first attempt to price all unit prices using the computerized database provided by RSMEANS® Cost Works. If an item is not included in this database or if the contractor’s computer system is not available, the contractor shall use the hard copy of the RSMEANS® Facilities Construction Cost Data to price the items. If the contractor cannot locate a particular item in either of these sources, the contractor shall then extend the search to the other RSMEANS® cost data guides before considering it a non-pre-priced item.
1.4.2.3.1.3.2 When NPIs are proposed, the contractor shall submit three competitive quotes for same items.
1.4.2.3.1.3.3 In the event where obtaining three competitive quotes is not practicable, the contractor shall submit, in writing (as part of the task order proposal), documenting relevant reasons (e.g. market availability, sole-source, etc) why the submission of three competitive quotes was not performed.
NOTE: Although NPIs will be negotiated, this shall NOT be construed to include elements of work which are incidental to or customarily required for performance of a priced item of work.
1.4.2.3.1.4 EXCLUDED ITEMS: All items under Division 01–General Requirements shall be fully excluded from use as line items in pricing Task Orders issued under this contract.
These costs shall be covered in the contract coefficients. In special circumstances, certain items under Division 01 may be utilized as line items in pricing task orders in accordance with section 1.4.2.3.1.4.1
1.4.2.3.1.4.1 Items listed in the following paragraphs shall only be used in instances where special circumstances occur. Ordinarily, most of these items will be covered in the coefficient, but in some cases the expected incidental nature of such items of work becomes considerably more than incidental. For instance, cleanup and general housekeeping of the work area on a daily basis shall be included in the coefficient, but special cleanup procedures such as for highly specialized areas may be added as line items “above and beyond” what would normally be expected.
Construction aids and facilities would normally be excluded, because line items in other parts of the Unit Price Book already cover them. Barriers and enclosures should usually be part of the coefficient, because contractors should own a certain amount of sawhorses, traffic cones, temporary fencing, etc., and when some of these are used, they can be re-used in other projects.
However, when a delivery order calls for specialized traffic control devices, or barriers and/or fencing of an unusual type, then these line items are allowable to cover the special need.
Paragraph “g” below, concerning dewatering shall be handled as indicated.
a. Subdivision 01 11 31 - Professional Consultants
b. Subdivision 01 52 - Construction Facilities
c. Subdivision 01 54 - Construction Aids
d. Subdivision 01 55 - Vehicular Access and Parking
e. Subdivision 01 56 – Temporary Barriers and Enclosures
f. Subdivision 01 74 – Cleaning and Waste Management
g. Dewatering is partially excluded in that excavations that are called for in the task order that become filled with water due to inclement weather or that is resultant from the contractor’s negligence through rupturing utilities shall be dewatered at the contractor’s expense and not paid for as a separate line item
h. Additional quantities/items for waste, lap, damages due to delivery, protection of government property, license, certifications, etc. will not be allowed in the estimates.
These costs shall be accounted for in the contractor’s coefficient. Line items in the UPG/UPB are installed prices, complete with material, labor and equipment cost, unless otherwise noted.
1.4.2.3.1.5 COEFFICIENTS: The coefficients will be applied to the total of all direct material and direct labor costs as identified in R.S. Means or non-pre-priced items in order to reflect the Contractor’s indirect costs (as well as costs identified as excluded items in section
1.4.2.3.1.4 and profit. The coefficients for this contract are divided into “Main” and “Adjustment” categories. Attachment J-B1 provides list of contractor’s coefficients that will be utilized for the base and all option periods.
1.4.2.3.1.5.1 Main Coefficients: This category of coefficient can be either “UNIT BOOK PRICING” or “NON-PREPRICED” Coefficients. For every restoration task order under the Mitigation and Restoration services contract, one or a combination of these coefficients will apply.
1.4.2.3.1.5.1.1 UNIT BOOK PRICING: The Contractor
shall apply this coefficient for R.S. Means line items used to develop prices for scheduled restoration task orders being performed during standard construction work hours.
1.4.2.3.1.5.1.2 NON-PREPRICED: The Contractor shall
apply this coefficient for Non-pre-priced line items used to develop prices for scheduled restoration task orders being performed during standard construction work hours.
1.4.2.3.1.5.2 Adjustment Coefficients: This category of coefficients provides price adjustments that reflect special Task Order requirements. The adjustment coefficients are distinctly identified as “NON-STANDARD HOURS”. The adjustment coefficient may apply in accordance with the Task Order requirements.
1.4.2.3.1.6 NON-STANDARD HOURS: The Contractor shall apply this coefficient for scheduled restoration projects that will be performed during non-standard work hours.
1.4.2.3.1.7 SAMPLE CALCULATIONS: The following table shows sample calculations that demonstrate how the coefficients will be applied. The numerical values for the coefficients shown are examples only. The actual coefficients used during the contract for the base and all option periods are listed in attachment J-B1.
Example 1: Task Order for a scheduled restoration project to be performed during non-standard hours. All elements of the restoration task orders are priced using R.S. Means.
Example 2: Task Order for a scheduled restoration project to be performed during standard hours in a location where special security requirements apply. All elements of the task order is priced using non-pre-priced items.
Example 3: Task Order for a scheduled restoration project to be performed during non-standard hours at a location where special security requirements apply. Task order requirements are priced using a combination of R.S. Means and non-pre-priced items.

1.4.2.3.1.8 In the event the Government exercises its unilateral right under FAR clause 52.217-9- Option to Extend the Term of the Contract, the coefficients for the performance of task orders during this period will be the latest coefficient(s) agreed upon in the contract or subsequent modifications.
1.4.2.3.2 The Contractor will be furnished with a schedule of all approved finishes and materials for Pentagon space. These schedules shall form the primary basis for finishes, but may be modified at the sole discretion of the Government. At no time will variance from building standard be allowed without prior, written authorization from the KO.
1.4.2.3.3 Re-build shall be to current Pentagon code and any existing deficiencies shall be brought to the attention of the KO and COR for direction before action is taken.
