HMGP Supplemental Conditions Summary
This document contains supplemental contractual conditions issued by the City of Fort Myers, Florida, applicable to Hazard Mitigation Grant Program (HMGP) funded projects in addition to existing CDBG-DR Supplemental Conditions. The conditions establish requirements for the Cultural Center at Roberto Clemente Park design services contract, a multidisciplinary architectural and engineering project for the Lee County Black History Society. The project encompasses approximately 15,000 square feet of new construction, including a two-story facility with a 200-seat auditorium, gallery and exhibit spaces, archival storage, recording studio, catering kitchen, and integrated building systems. A non-mandatory pre-submittal meeting is scheduled for April 8, 2026, at 10:00 a.m. at Fort Myers City Hall, with electronic submissions due by May 4, 2026, at 2:00 p.m. through the OpenGov portal. The selection committee meeting is anticipated for May 14, 2026, with potential presentations on May 22, 2026, and City Council approval targeted for June 2, 2026.
The supplemental conditions establish federal compliance obligations including the Buy Clean requirement encouraging low-carbon, environmentally friendly construction materials with reduced embodied greenhouse-gas emissions; adherence to 2 CFR 200 federal provisions; compliance with the Vietnam Era Veterans' Readjustment Assistance Act of 1974 (VEVRAA) for contracts valued at $150,000 or more, requiring non-discrimination and advancement of protected veterans; and compliance with Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act. The contract is funded through multiple federal and state sources including FEMA, CDBG-DR administered by HUD, State Revolving Fund, and FDOT Local Agency Program funds, with compensation structured on a not-to-exceed fee basis compensating actual personnel hours at specified rates plus reimbursable expenses. Selected firms must maintain professional liability insurance of $1,000,000 with $100,000 maximum deductible and comply with Davis-Bacon prevailing wage requirements, Section 3 housing employment opportunities for contracts exceeding $200,000, Equal Employment Opportunity standards, E-Verify immigration verification, and liquidated damages of $904 per day for failure to achieve substantial completion within the specified timeframe.
