About this file

This is a supplemental conditions document for the Hazard Mitigation Grant Program (HMGP) that applies to grant projects administered by the City of Fort Myers, Florida, in conjunction with the CDBG-DR program. The document establishes mandatory compliance requirements for all contractors and subcontractors participating in HMGP-funded projects, including the Cultural Center at Roberto Clemente Park design services solicitation. The conditions require contractors to acknowledge and comply with federal regulations, specifically 200 CFR Appendix II, and Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act. No specific project timeline, response dates, or award dates are provided in this supplemental conditions document.

The supplemental conditions impose several key requirements on contractors. First, applicants are encouraged to employ environmentally friendly construction practices and low-carbon materials with reduced embodied greenhouse-gas emissions compared to industry averages, as documented through environmental product declarations. Second, the Vietnam Era Veterans' Readjustment Assistance Act of 1974 (VEVRAA) requirements apply to contracts valued at $150,000 or more, mandating non-discriminatory treatment and affirmative employment steps for protected veterans, including disabled veterans, recently separated veterans, active duty wartime or campaign badge veterans, and Armed Forces service medal veterans. Exceptions to VEVRAA apply to contracts under $150,000 and those with certain government entities. By submitting a response, contractors certify their understanding and compliance with all applicable federal provisions and disaster relief requirements.

HAZARD MITIGATION GRANT PROGRAM (HMGP)

SUPPLEMENTAL CONDITIONS

These terms and conditions apply to the HMGP Grant projects, in addition to the CDBG-DR Supplemental Conditions.

1. Buy Clean. Applicant encourages the use of environmentally friendly construction practices in the performance of this Contract. In particular, Applicant encourages that the performance of this Contract include considering the use of low-carbon materials which have substantially lower levels of embodied greenhouse-gas emissions associated with all relevant stages of production, use, and disposal, as compared to estimated industry averages of similar materials or products as demonstrated by their environmental product declaration.

2. Federal Provisions. All Federal Provisions of 200 CFR Appendix II apply to this solicitation. By submitting a response, the Contractor certifies that they have reviewed, understand, and are in compliance with 200 CFR Appendix II.

3. Vietnam Era Veterans’ Readjustment Assistance Act of 1974 (VEVRAA), as amended; 41 CFR Part 60-

300. This Act requires employers with Federal contracts or subcontracts valued at $150,000 or more, and contracts or subcontracts for indefinite quantities (unless the contracting agency has reason to believe that the cost in any one year will be less than $150,000), to treat applicants and employees without discrimination because they are a disabled veteran, recently separated veteran, active duty wartime or campaign badge veteran, or Armed Forces service medal veteran ("protected veteran"). Covered contractors must also take steps to employ and advance in employment qualified protected veterans.

Contracts covered by VEVRAA are subject to the implementing regulations found at 41 CFR Part 60-300.

Exceptions:

• Those for less than $150,000;

• Those for indefinite quantities where the agency determines that the cost in any one year will not exceed $150,000;

• Those for work that is performed outside the U.S. and for which employment activity decisions were made outside the U.S.; and

• Those with state or local governments, except for the specific government entity that participates in work on or under the contract.

4. Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act. In addition to the federal provisions above Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act also applies to this solicitation.

By submitting a response the Supplier title certifies that they have reviewed, understand, and are in compliance with Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act.
