Question and Answer – RFP #: HE1260-13-R-0003

22 Aug 2013

DoDEA Pacific/DDESS Guam District Student Transportation Services

1. Reference Wage Determination

Discussion The wage determination attachment provided does not have a wage classification specific to “Safety Aides.” There are wage classifications for Bus Aide (Occupation Code 31020) and “Child Care Attendant” (Occupation Code 24570).

Question/Comment Does either of these occupation descriptions satisfy the Safety Aides requirement? If not, can you provide the specific wage determination for Safety Aides?

Government Response Based on the classification category of Bus Aide (occupation code 31020) this code is the most appropriate fit.

2. Reference SPED Buses

Question/Comment Are the SPED buses intended for the specific use of SPED students or can that equipment be utilized to service regular daily commuting students along with SPED students at the same time?

Government Response The SPED buses and equipment are intended for the specific use of the SPED students.

3. Reference Pages 87 and 90 of the Solicitation

Discussion On Page 87, item (a) it states that the Government will award one contract resulting from this solicitation to responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. On Page 90 of the conformed solicitation, Factor 3 Price, paragraph (c) indicates, A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Question/Comment Can you please clarify if this means that an offeror can submit a bid proposal for part of the scope of work outlined in the PWS or not?

Government Response Offerors are required to submit a proposal based on the entire scope of work outlined in the PWS.

4. Reference ESY

Discussion In response to DoD response #8., the Government’s response is all ESY associated costs are addressed in CLIN 4. CLIN 4 only addresses ESY special needs transportation and CLIN 3 only addresses ESY safety aide services relative to special needs transportation operations support.

Question/Comment Where, if any, are non‐special needs ESY commuting support and transportation services to be addressed? Or can the Government confirm that there are no non‐special needs ESY commuting and transportation services required? Historically, has there ever been a requirement for the use of non‐SPED buses for the ESY program?

Government Response The ESY program is devoted to special needs transportation service support. There is no requirement for the use of non‐SPED buses for the ESY program.

5. Reference In Response to DoD Response #26.

Discussion The Government’s response is that the 41.0 PM hours example is based on current route experience. This doesn’t seem like a reasonable number, and if the current incumbent has access to more reliable and detailed information, than the incumbent provider of services will be able to more accurately assess costs and provide a more reasonable price proposal.

Question/Comment Can the Government confirm this data, and even better, provide detailed route information that will allow us to provide a more accurate and responsive price?

Government Response The referenced data can be provided upon individual request;

however, this information will not be posted and is considered for official use only.

6. Reference In Response to DoD Response #27.

Discussion The Government response is that these times may be adjusted, but once again, based on this response the incumbent provider may have access to more accurate route data allowing for more accurate and reflective pricing proposal.

Question/Comment Will the Government reconsider providing more detailed route information?

Government Response The referenced data can be provided upon individual request;

however, this information will not be posted and is considered for official use only.

7. Reference In Response to DoD Response #28.

Discussion The Government response is that the route samples are based on actual routes, but once again, based on this response the incumbent provider may have access to more accurate route data allowing for more accurate and reflective pricing proposal.

Question/Comment Will the Government reconsider providing more detailed route information?

Government Response The referenced data can be provided upon individual request;

however, this information will not be posted and is considered for official use only.

8. Reference In Response to DoD Response #23, #24, and #25.

Discussion The Government’s response is that the examples provided are based on current routes, but once again, based on this response the incumbent provider may have access to more accurate route data allowing for more accurate and reflective pricing proposal.

Question/Comment Will the Government reconsider providing more detailed route information?

Government Response The referenced data can be provided upon individual request;

however, this information will not be posted and is considered for official use only.

9. Reference Page 48 of the Solicitation.

Discussion Section H indicates that “The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Department of Defense Education Activity (DoDEA).

Question/Comment Should the Government be unable to release more detailed route information to assist in putting together a competitive price proposal, can past historical labor data be provided in regards to bus driver hours?

Government Response The referenced data can be provided upon individual request;

however, this information will not be posted and is considered for official use only.

10. Reference Collective Bargaining Agreement (CBA)

Discussion The CBA provided stipulates in Article 22, Section 4 on Page 20 that in the event of a change of contractors, an employee is hired by the successor contractor, the successor contractor becomes responsible for all accrued but unaccredited vacation due the employee.

Question/Comment Will an equitable adjustment be authorized in the event that a new contractor hires existing employees of the incumbent contract and must payout accrued vacation pay based on the table provided in Section 2 of Article 22 of the CBA?

Government Response According to 29 CFR 4.173, the successor contractor is not entitled to an equitable adjustment.

11. Reference Extension Request.

Discussion We would like to ask that an extension of the RFP Submittal Response Date be considered to allow adequate time for the offerors to finalize their proposals based on the Government’s response to the above questions.

Government Response The Government has extended the submittal date to 4 Sep 2013 @ 4:00 PM Japan Standard Time (JST).

Please note: Previous questions and answers posted on 14 Aug, 15 Aug and 20 Aug should state 2013 for the year.
