ATTACHMENT I

PERFORMANCE WORK STATEMENT (PWS)

DoDEA PACIFIC GUAM DISTRICT STUDENT

TRANSPORTATION SERVICES

06 Aug 2013

Introduction: The Department of Defense Dependents Schools-Pacific/Department of Defense Elementary and Secondary Schools Guam (DoDEA-Pacific/DDESS-Guam) is composed of four schools. Andersen Elementary School and Andersen Middle School are located on the northern part of the island on Andersen Air Force Base for which approximately 504 students require daily commuting services. Guam High School and McCool Elementary/Middle Schools are located in the surrounding area of the Naval Base located in the Southern part of Guam; approximately 1,228 students require daily commuting services. Technical Exhibit 4 on page 39 has a map of Guam which shows the geographical scope of the district transportation operation.

1.0 Scope of Work: The contractor shall be required to provide and manage a full service student transportation program for DDESS Guam, to include, buses, drivers, maintenance services and all personnel to aid in the supervision, services, and equipment necessary to safely transport DoDEA Pacific students and other authorized individuals to and from their designated schools and alternate sites for classes and authorized school activities, to include after school activities, Career Practicum, curricular/co-curricular trips, activity shuttle runs, Far East Activities (FEAC) trips and special needs transportation service as identified on the route/trip schedules provided by the Government. The after-school activity runs are included in the operational day. Activity runs are scheduled routes to transport students home after school supported events on school days at approximately 1630 hours (reference Technical Exhibits 1a and b). SAFETY of the passengers is of the highest priority in the performance of contract services. Definitions of terms used throughout the body of this PWS are explained at Addendum A.

2.0 General Bus Requirements:

2.1 The Contractor shall provide and maintain an appropriate number of Type C or Type D school buses with a seating capacity of 44 or greater student seats per bus, meet the Government’s requirement and comply with current provisions of the Federal Motor Vehicle Safety Standards (FMVSS) and Guam law. In addition, the contractor shall provide three (3) Type A special needs buses equipped with a Americans with Disabilities Act (ADA)/FMVSS compliant wheel chair lifts. Special Needs buses must be capable of transporting a minimum of two wheel-chairs at any given time. The contractor is responsible for all maintenance, insurance, registration, license plates and safety inspections as required by Federal and Guam law.

2.2 The estimated workload is listed in Technical Exhibit 1a. and the Route Operation Example in 1b. Vehicle types are listed in Technical Exhibit 7.

2.3 All vehicles shall have the word “DoDEA” printed in 6 inch or greater black lettering and displayed on the side of the bus at the beltline. The contractor shall comply with FMVSS school bus markings. The body of each bus shall bear the word “SCHOOL BUS” in accordance with the Guam Law Specifications.

2.4 The contractor shall use school buses equipped with fully functioning climate control systems capable of maintaining the passenger compartment in a comfortable temperature range of 65-85°F (18-30°C) while students are on board.

3.0 Contractor Personnel: The Contractor shall provide a sufficient number of qualified personnel to provide all performance requirements specified in this contract.

3.1 Contract Manager:

3.1.1 The Contractor shall provide a Contract Manager who shall be responsible for the performance of the work. The contractor shall provide the name of this person and the alternate(s) who shall act for the Contractor to the Contracting Officer in writing at least 30 days prior to performance.

3.1.2 The Contracting Officer Representative (COR) and the Contracting Officer must be able to contact either the primary or alternate Contract Manager 24 hours a day regarding emergencies, severe weather notification, or other urgent matters.

3.2 Drivers. Drivers shall meet all Guam licensing and medical requirements for a commercial driver’s license (CDL with D-Endorsement) for passenger and school bus. Drivers shall be in possession of their license when operating a vehicle under this contract and must be available for inspection by the COR upon request.

3.3 Safety Aide. The primary responsibility of the Safety Aide is to ensure on board student safety for students with special needs as required by their Individual Educational Plan. The aide shall assist students during pre-boarding transportation, during daily commutes and de-boarding the vehicle.

3.3.1 Aides must have a clear understanding of emergency and evacuation procedures, be physically capable of evacuating students, be familiar with students and the route, and be knowledgeable regarding the disabilities of the students. Aides should ride the bus in a location that will provide them opportunity to provide effective oversight.

3.3.2 The contractor shall provide professionally trained Safety Aide personnel who do not pose a threat to the health, safety and security of students while performing duties.

3.3.3 The contractor shall ensure that Safety Aides receive the necessary training to manage moderate to severe special needs students.

3.3.4 The contractor shall ensure Safety Aides receive and complete “Nonviolent Crisis Intervention” training (http://www.crisisprevention.com ) from a certified Crisis Prevention Institute (CPI) instructor prior to performing duties in the PWS.

3.3.5 Safety Aides shall ensure students requiring the use of Wheelchairs and other related Child Safety Restraint Systems (CSRS) are properly secured prior to the school bus being put into motion.

The STO will inform the contractor of students requiring the use of a CSRS.

3.3.6 The contractor shall maintain and have on hand required documents within each Safety Aide’s folder as prescribed by the local Student Transportation Office (STO) while performing their duties.

3.3.7 Safety Aide personnel shall ensure that only authorized students and DoDEA personnel board the bus as specified or directed by COR.

3.3.8 Safety Aides shall ensure hand-to-hand custody of their assigned students to their assigned sponsor, parent, guardian and school officials.

3.3.9 Safety Aides shall not be rotated among special needs buses as this is upsetting to the special needs students. The Government expectation is that there will be continuity of personnel coverage for Safety Aides with respect to their special needs students. A change in Safety Aides requires COR approval.

3.3.10 Safety Aides shall work in close concert with drivers, forming a professional and mutually supportive relationship.

3.3.11 Safety Aide personnel shall be seated at a location that affords the best possible vantage point for overall observation. Standing and walking around a stopped school bus is permitted;

however, extra caution should be taken by contractor employees by firmly gripping the top of bus seats while standing or walking on a slow moving school bus. For safety reasons, standing and walking on any moving school bus should be limited whenever possible.

3.3.12 Safety Aides shall alert the driver when safety conditions warrant non-movement or halting of the bus.

3.3.13 Safety Aides shall execute emergency evacuation plans provided by the local STO.

3.3.14 Safety Aides shall be familiar and know the characteristics/features of assigned school bus safety equipment and the school bus routes, runs, stops to include local STO identified school bus route safe havens.

3.3.15 Safety Aides shall correct on-the-spot observed unsafe actions by student(s) that may result in injuries, and ensure good order and discipline when unruly student behavior interferes with the driver’s ability to operate the bus safely. 3.3.16 Safety Aides shall work in close concert with drivers, forming a professional and mutually supportive relationship.

3.3.17 Safety Aides shall participate in school bus safety training and evacuation drills held twice during each school year upon request by the local STO.

3.4 Office Personnel. The contractor shall provide one employee at the northern student transportation office located on Andersen Air Force Base and one employee at the southern student transportation office located on the Naval Base to provide transportation office support and customer service. The contractor shall provide an employee at the north, Monday through Friday, 0700-1600, and at the south, from 0730-1630, with a one hour lunch (North 1100-1200 and South 1200-1300), except Federal Holidays. The contractor shall provide these employees on the first business day of August through the last day of the school year. These office personnel shall possess basic office, computer and customer service skills.

3.5 Criminal Background Checks.

3.5.1. This contract requires unsupervised contact with students and/or unescorted access to school facilities. The contractor shall provide to the COR proof of an acceptable criminal background check prior to any employee being granted unsupervised contact with students or unescorted access to school facilities IAW DoDI 1402.5, Criminal History Background Check on Individuals in Child Care Services. See General Information, Page 11 for link access.

3.5.1.1 The criminal background check consists of the following:

Local background check, which can be obtained from local Law Enforcement, Police and/or Sheriff’s office.

State Criminal History repository check from each state in which the employee resided during the last ten years.

Local Installation Records Check. (Only required if the employee had regular access to the base for the past two years or longer.)

3.5.2 The contractor shall maintain all criminal background check results and make them available to the Government as required by FAR 52.212-5(a)(2).

3.5.3 The contractor shall submit all forms required for Installation Records Checks within five (5) business days of date of contract award in accordance with the procedures required by the respective installation and provide the results to the COR.

3.5.4 Contractor employees have the right to obtain a copy of the background check and challenge the accuracy and completeness of the report. The COR shall coordinate any such requests with the Contract Manager for distribution to the contractor employees within five (5) business days after contractor’s request.

3.5.5 If the Contractor receives or discovers information that a Contractor employee has been arrested or charged with a criminal offense that could result in license or certification suspension or revocation, or disqualification/denial of a satisfactory background check review under DoDI 1402.5, the Contractor shall not allow or permit the employee to work at the school/district until the Contracting Officer determines in writing that the return of the Contractor employee to the work site

Guam Student Transportation Services –Page 5 is appropriate in writing. Examples of such offenses include, but are not limited to, offenses of moral turpitude; harm to a child; acts of physical or domestic violence; illegal possession or use of a weapon; reckless and negligent driving; driving under the influence of alcohol or drugs; or possession or use of a controlled substance.

4.0 Specific Tasks:

4.1. Route Management. A sample route system for Guam is shown in Technical Exhibits 1a, 1b, and 1c. The Government shall provide the route and run schedule in a format similar to the referenced sample. The contractor shall perform the transportation service as requested by the COR.

The contractor is encouraged to provide suggestions for improvements and efficiencies to the COR.

The Government’s route system and bus stops shall be in accordance with the Department of Defense (DoD) 4500.36R, Chapter 6 requirements. For the purpose of providing service, the island of Guam is designated as the district’s commuting zone. For additional zoning information, reference is made to Technical Exhibit 5, Guam Transportation Boundaries Memorandum. The contractor shall provide the appropriate size bus to meet the run’s ridership and should coordinate with the COR to maximize vehicle utilization and capacity. The contractor shall alert the COR if the actual ridership exceeds the bus seating capacity and the COR shall adjust the route within one business day.

4.1.1 The contractor shall normally provide commuting, activity and special education school bus service between 0600 and 1800, Monday through Friday for not more than 180 school days. For planning purposes the school year calendar is provided at Technical Exhibit 3 as a reference. No commuting service is required on Federal Holidays. Curricular trips normally occur on school days between 0900 to 1500. Co-curricular trips normally occur on school days between 1500 to 2300 and at any time on non-regular school days including weekends, and legal holidays. Activity trips normally occur on school days between 1430 to 1800.

4.1.2 Drivers shall adhere to the times and bus stop route order listed on the approved route schedule.

Routes shall be developed so that all buses shall arrive at their designated schools between 5 and 15 minutes prior to the school starting time. All buses shall be in place to pick up students 10 minutes prior to the end of the school day. Any deviations in the order of the route or deviations in time greater than 5 minutes shall be reported to the COR. The contractor is exempt from this requirement if delay is caused by actions/circumstances beyond the contractor’s control. Whether a circumstance is “beyond the contractor’s control” will be determined by the government following consultation with the contractor. The contract manager and COR shall modify the route sheets to make any necessary improvements and revisions. While subject to change, bell times have varied slightly over the past 5 years. A table containing current bell times for each school is provided below:

4.1.3 The Contractor shall provide transportation support for curricular, co-curricular and cooperative work experience and FEAC trips as requested by the COR. Estimated number of hours for this type of transportation support is provided in Technical Exhibit 2.

4.1.4 The COR will electronically transmit a Trip Request form to the Contractor no later than fifteen

(15) days prior to the scheduled co-curricular/curricular activity to include Career Practicum and FEAC trips to schedule service.

4.1.5 Extended Year Instructional Program (EYIP). When ordered by the government, the contractor shall provide transportation support for Extended Year Instructional Program (EYIP) Services. This program normally occurs late June through mid-July for not more than 4 weeks. The estimated number of hours for this type of transportation support is provided in Technical Exhibit 1a.

4.1.6 The contractor is required to transport special education students. Buses and drivers must comply with and FMVSS standards and Guam Law. The Contractor shall provide a safety aide on all special needs buses to ensure the student’s security, safety and comfort while riding the vehicle.

The contractor shall provide curb-to-curb service IAW with the student’s Individual Education Plan (IEP) or Accommodation Plan. The safety aide will release the student only to the designated adult at the home, school, child care provider or Child Development Center.

4.1.7 The contractor will provide two (2) office personnel to operate the transportation offices, north and south. These two positions will maintain the government’s student transportation database, currently BusTrack, or other system of records. The Government reserves the right to implement a new software database as technology advances. The Government’s intent is to import the existing database into any new database. The contractor’s office personnel shall enter and update student data and route information. The contractor shall create and issue student bus passes to students. The contractor shall print and issue new school year student bus passes and route information to parents one week prior to the first day of school. The contractor may use mass mailing using Military Postal Service or in-person pick up. These two contractor office personnel will also provide customer service and resolve customer issues.

4.1.8 The contractor shall perform student ridership counts quarterly during the school year. The contractor shall coordinate with the COR for the specific dates and the contractor shall develop the data collection method in a spreadsheet format for review and acceptance by the COR.

4.1.9 The contractor shall participate in two school bus evacuation drills per school year per industry guidelines for safe student evacuation. The COR will provide the specific dates and details to the contractor.

4.2 Routes and Changes. When requested by the COR, the Contractor shall have up to two working days from the time of receipt to implement an operational route change. The Contractor is

Guam Student Transportation Services –Page 7 encouraged to provide route changes and changes to passenger load that contribute to safety or efficiency of services to the COR.

4.2.1 Severe Weather and Unforeseen Situations. When informed by the COR of severe weather or hazardous driving conditions that result in cancellations or delays, the contract manager shall reschedule or cancel performance as requested. The contract manager shall advise the COR of severe and hazardous conditions which warrant a schedule change; however, only the COR is authorized to adjust the operational day. While performing under this contract, school bus drivers shall respond to unforeseen events such as severe weather, road closures, major construction, etc., as directed by Guam Law Enforcement or US authorities.

4.2.2 Early Dismissal. When school is dismissed earlier than normally scheduled, the Contractor shall have vehicles at the school(s) and ready for services within two (2) hours of notification by the

COR.

4.2.3 Other Adjustments. The COR may reschedule busing services when unforeseeable events (e.g., suspension of school or change in school program) require adjustment. In such an event, the COR will advise the Contractor of required adjustment(s) to the bus schedule(s).

4.3 Route Display. Contractor shall clearly display vehicle route number signage on the front and right side of the vehicle.

4.4 Bus Operations and Maintenance.

4.4.1 The contractor is responsible for performing all scheduled, unscheduled maintenance and repairs.

4.4.2 The contractor shall provide a School Bus Maintenance Plan identifying the contractor’s methodology and process for ensuring vehicles used under this contract are safe, properly maintained, inspected and comply with Federal Motor Vehicle Safety Standards (FMVSS) and Guam law.

4.4.3 When the contractor identifies an act of vandalism on a school bus, the contractor shall prepare a written repair estimate and submit the estimate to the COR within one week. The COR shall submit the estimate to the contracting officer with a recommendation and request funding.

4.4.4 The contractor is responsible for cleaning the interior and exterior of the vehicle. Before each run, the interior shall be free of trash, graffiti, seats free of visible dirt, windows free of hand prints and grime.

4.5 Repairs. The contractor shall keep the buses in good repair, condition, and working order and shall furnish any and all labor, parts, mechanisms, and devices required to keep the buses in good mechanical working order. The contractor shall be compensated for actual or estimated cost, as determined equitable by the Contracting Officer Representative (COR) if the cost is below the micro-purchase threshold or the Contracting Officer, for repairs due to vandalism for which the Government and authorized personnel are responsible.

4.5.1 Payment for Repairs. Payment for repairs will typically be made under the contract’s designated repair CLIN. This repair CLIN is not to be used for repairs which are otherwise covered by or are the responsibility of the contractor in accordance with the terms of the contract.

5.0 Safety Requirements

5.1 Transportation Standards and Procedures. The Contractor shall comply with CDL driving standards, Guam traffic laws and the transportation standards and procedures outlined in Addendum F of this PWS.

5.2 Contractor shall report any accidents or incidents IAW Addendum G of this PWS.

5.3 Communications. The contractor shall provide a reliable form of voice communication which shall allow the drivers to speak with the contract manager, COR and other buses. The contract manager shall be able to immediately contact the COR and emergency personnel.

5.4 The contractor shall ensure all vehicles and equipment are secured on the bus at the end of the day.

5.5 The contractor shall ensure drivers visually inspect the interior of the bus after each run to ensure no students remain on the bus.

5.6 Pre-Inspection. Using a COR approved contractor generated system of record (form), the drivers shall perform and document a preoperational/ Safety inspection of each school bus scheduled for use on that day’s route. The contractor shall report any operational or safety concerns to the COR.

5.7 Post-Inspection. Drivers shall inspect their buses at the completion of each run for any remaining students or personal belonging, packages, etc. The driver shall turn in all personal belongings or packages left on the bus to the STO. The STO in turn shall notify the COR. The driver shall immediately notify the STO and the COR of any student(s) remaining on the bus at the completion of the run. After notifying the COR the driver shall ensure the student(s) are transported to the location specified by the COR.

6.0 Government Responsibility and Furnished Equipment

6.1 Installation/Base Passes. The COR will provide the Contractor with the required forms to request installation passes and assist in processing requests as outlined in Addendum B.

6.2 Contractor Training. The government shall provide one (1) eight (8) hour comprehensive training session prior to the beginning of each school year to cover anti-terrorism, student management, district policies and procedures, use of child safety seats, handling students with disabilities, safety procedures, loading zone familiarization and operations, emergency evacuations/reporting procedure, safe havens, safety precautions at loading zone and bus stops. The contractor is responsible for training new employees hired after the government’s training is offered. The Government shall also provide software and administrative process training to the contractor’s customer service employees.

6.3 Parking. The government will provide parking on both the Andersen AFB and Navy Base Guam for required vehicle fleet and employee privately owned vehicles.

6.4 Fuel. The government will provide fuel (diesel and/or regular unleaded gasoline fuel types), at no additional cost to the contractor, for all buses used in the performance of this contract. Buses will utilize government assigned fuel keys using either the Navy Fuel Facility or the Andersen Air Force Base fuel. The bus driver is responsible for fueling the vehicle.

6.5 Facility and Furniture. The government will provide shared office space, telephones, computer, printer, fax machine, office furniture, office supplies, and utilities to accommodate the contractor employees at the Student Transportation Office located in the North and South part of Guam.

Detailed list of equipment will be provided at contract award.

6.5.1 Computer and Internet Agreement. Contractor employees with access to government computers are required to sign DoDEA form 6600.1-F1, “DoDEA Computer and Internet Access Agreement for Employees, Contractors, and Volunteers,” June 2004, prior to gaining access to DoDEA’s information technology resources. This includes connecting to a DoDEA network in order to obtain access to the Internet. No user’s account will be assigned to a contractor unless the DoDEA form 6600.1-F1 has been signed and is on file. A record of the signed agreement shall be maintained by the contractor and a copy shall be provided to the COR.

7.0 Quality Control

7.1 Quality Control Plan (QCP). Contractor shall submit a QCP to the contracting office which adequately addresses how the Contractor plans to evaluate and maintain a Performance Standards Summary for services described within this PWS.

7.2 Vehicle List. Not less than 20 calendar days before the first day of performance and as changes occur, the Contractor shall provide the COR a typed list of all COR inspected and approved vehicles to perform services under this contract.

7.3 Complaint/Resolution Report. The contractor shall provide a Complaints/Resolution Report to the COR every Monday for the previous week’s data. The contractor and COR will coordinate the electronic format.

7.4 Maintenance Record. When requested by the COR, the contractor shall allow the government to inspect and if necessary, copy vehicle maintenance records.

7.5 Mileage Reports. The contractor shall maintain mileage records and furnish them upon request to

COR.

7.6 Defective Performance. The COR will notify the Contractor in writing in case of defective performance. Defective performance properly identified to the Contractor by the COR and then corrected properly and in a timely manner shall not result in a Contract Discrepancy.

7.7 Student Misbehavior. In cases of serious misconduct (such as vandalism, assault, battery, fighting, etc.), drivers shall stop the vehicle at the soonest practicable time and shall immediately contact the Student Transportation Office who will then contact the COR for further instructions. In less serious cases of misconduct, such as passengers making excessive noise or standing while the bus is in motion, the driver shall stop the vehicle on the side of the road until order is restored and then

In the event of an incident that impedes continuing the bus route safely, the contractor shall immediately contact the Student Transportation Office who will then contact the COR for further instructions. In all cases of misconduct the contractor shall notify the COR immediately. The contractor shall document all misbehavior and send a copy to the COR after completing the bus route.

8.0 DELIVERABLES

8.1 Student Ridership Report. The contractor shall provide Student Ridership Report to the COR quarterly during the SY. The contractor shall count and document for 3 consecutive days (by bus route and run) the number of students on each commuting and activity route. The contractor shall be required to submit this information to the COR quarterly.

8.2 Student Misbehavior Report. The contractor shall provide a student Misbehavior Report to the COR as necessary. The contractor shall document all misbehavior and send a copy to the COR after completing the bus route.

8.3 Complaint/Resolution Report. The contractor shall provide a Complaints/Resolution Report to the COR every Monday for the previous week’s data.

8.4 Personnel Report. The contractor shall provide a personnel report to the COR and Contracting Officer on a quarterly basis. The personnel report shall be divided into four sections as follows:

8.4.1 Section I-Contractor Personnel. Section I shall provide a list of all contractors’ employees performing under this contract. The list shall include employee’s name, position, work location, date of the Criminal Background Check (PWS Section 3.5), employees’ date of hire and termination date.

8.4.2 Section II-Bus Drivers. Section II shall contain a list of all bus drivers performing under this contract to include the drivers name, driver’s license number, expiration date and State, date of most recent driving record check.

8.4.3 Section III-Employee Training Record. Section III shall contain a list of employees and their current training records and dates in accordance with PWS section 6.2.

8.5 Accident/Incident Report. The contractor shall submit an Accident/Incident Report to the COR and Contracting Officer immediately following accident/incident.

8.6 Communications. The contractor shall provide a reliable form of voice communication, which shall allow the driver to speak with the dispatcher, other buses, Student Transportation Office, and the COR.

Addendum A – Definitions

Definitions - In addition to the definitions contained in FAR 52.202-1, the following also apply to this contract:

A.1 Accidents - Vehicle-related events in which a Contractor’s vehicle with student(s) on board is the cause or focus and results in property damage, however slight, or causes injury, however slight, to student(s) and/or other person(s).

A.2 Activity Run - A run that departs the school after normal school hours to transport students who participate in co-curricular after-school activities from the school to housing areas or transportation terminals.

A.3 AQLs - Acceptable quality levels in compliance with PWS.

A.4 Authorized Passengers - Individuals authorized to be transported under the contract, to include students, DoDEA Pacific officials, military/Local police, security personnel, and others specifically authorized by the COR.

A.5 Actual Rider - A student who is authorized to ride a DoDEA/DDESS Pacific bus and does so on a given day.

A.6 Career Practicum (CP) - A job education program requiring curricular transportation services from the school to base facilities.

A.7 CDR - Contract discrepancy report (CDR) describes contractor deficiencies/non-compliance with

PWS.

A.8 Child Safety Restraint System (CSRS), also referred to as Adaptive Seat Device, child safety seat, child car seat, and booster seat - A restraining device, conforming to Federal laws, used to supplement a seat belt when there exists a requirement to secure a child during transportation. The age or size of a child requiring such device is normally defined by Federal or local laws, but generally applies to children weighing less than 40 pounds.

A.9 Commuting Area - A geographic area that determines a student’s eligibility for transportation.

A.10 Co-curricular - Transportation provided for authorized after-school activities to/from activity sites, airport and school transportation.

A.11 Contracting Officer’s Representative (COR) - An individual designated in accordance with subsection 201.602-2 of the Defense Federal Acquisition Regulation Supplement and authorized in writing by the Contracting Officer to perform specific technical or administrative functions.

A.12 Contractor - A commercial activity that provides school bus services in accordance with this Performance Work Statement (PWS).

A.13 Curricular - Transportation provided for authorized field trips, Career Practicum (CP) shuttle trips, shuttle bus runs between schools, runs to gym (normally during school days).

A.14 Danger Zone - The area around a bus at a stop where most student injuries occur. It is an area

1.83 meters (6 feet) to both sides of the vehicle and 3.05 meters (10 feet) in front of the vehicle.

Particular care is required when a bus stop has less than 1.83 meters (6 feet) clearance between the road edge and the designated waiting area. The most critical areas are immediately to the front of the bus and at the right rear. See Technical Exhibit 6.

A.15 Department of Defense Education Activity (DoDEA) - An agency of the U.S. Department of Defense responsible for the operation of schools for eligible children of Government authorized personnel.

A.16 Duress - A situation involving control of the vehicle being taken over by someone other than the driver or attendant, or similar serious incident that places the bus and its passengers in a critical, life-threatening situation.

A.17 Expanded School Transportation Security Inspection - A thorough, driver-conducted security inspection, using the School Transportation Security Inspection Checklist, before each run of any school transportation vehicle without an assigned security attendant, to be performed only when ordered by the COR to meet elevated security conditions (See Addendum B).

A.18 Extended Year Instructional Program (EYIP) - The EYIP program provides additional educational services at the conclusion of the normal school year for special needs students. The ESY program occurs normally between June and July for 20 school days.

A.19 Far East Activities and Athletics Activities (FEAC) – Events for high school students in sports, math, engineering, foreign language, and the visual, performing and culinary arts that require transportation support.

A.20 Field trips - School study trips, also known as curricular trips.

A.21 Improvised Explosive Devices (IED) - Those devices placed or fabricated in an improvised manner incorporating destructive, lethal, noxious, pyrotechnic or incendiary chemicals, designed to destroy, disfigure, distract or harass.

A.22 Incidents - Any events that occur on/around the school loading/unloading zone or during school transportation services that have an adverse effect on either the performance of this contract or passengers.

A.23 Mid-day Run - A run which transports students to/from school and their home approximately 1000-1300 during school days.

A.24 Non-Service Day - This is a day on which no School Bus Services are required. The COR will identify such days.

A.25 Operational Day (OD) - Normally, an operational day is between 0600 to 1800 Hours. Service is required Monday through Friday unless otherwise notified. The route schedules determine the exact service hours. School make-up days are operational days.

A.26 Pass and Registration Office - An office normally on US Military Installations authorized to register individuals into the Installation Access Control System.

A. 27 Performance Work Statement (PWS) - A document that describes a service in terms of output requirements and the required quality level or standard of acceptable performance of those outputs.

A.28 Type A School Bus: the smallest category of FMVSS compliant school bus with a seating capacity > 10 students. May be equipped with wheel-chair lifts.

A.29 Type C School Bus: Typically transports between 36-78 students, GVWR > 23,000 lbs., engine is mounted forward of the windshield and entrance door is behind the front wheels.

A.30 Type D School Bus: Typically transports >54 students, GVWR >20,000lbs. Engine is mounted near or behind the driver. Engine may be forward, mid or rear mounted. This type of bus is also called a shovel nose.

A.31 Quality Assurance Evaluator (QAE) - A Contracting Officer’s representative (see DFARS 252.201-7000) who has been appointed to inspect Contractor-provided services.

A.32 Quality Assurance Surveillance Plan (QASP) - A plan developed and used by the Government to inspect and evaluate Contractor-provided services.

A.33 Quality Control - Those actions taken by the Contractor to control the performance of services to ensure requirements of the contract are met.

A.34 Quality Control Plan (QCP) - The contractor developed Quality Control Plan states the contractor’s program as to how the contractor inspects and evaluates the work performed to ensure their work meets the technical requirements and quality specified in the PWS.

A 35 Rapid Gate - An access verification system for Installation Pass and DoD Identification (ID) cardholders that are registered into a database and assigned installation access privileges. All contract personnel servicing this contract must be registered in Rapid Gate.

A.36 Registered Rider - A student who is authorized to ride a DoDEA Pacific bus, but who may choose not to ride on a given day.

A.37 Route - A route consists of one or more runs (includes Mid-Day runs), scheduled in one operational day.

A.38 Run - A segment of a route composed of at least one pick-up point and one drop-off point.

A.39 School Bus Services - These services are for the repetitive daily transportation of students (and other authorized individuals) to and from their designated schools and other education sites.

A.40 Special Needs Riders - A student with a physical or mental disability who has special transportation documented on their individual educational plan (IEP) as a related service as specified in the Americans with Disabilities Act (ADA).

A.41 Sponsoring Official/Organization - A designated DoDEA Pacific individual and/or organization at the School Bus Office, District Transportation Supervisor, or District-level that performs Installation Pass responsibilities or has oversight based on the relationship to the Installation Pass applicant.

A.42 Student - An individual who is officially enrolled for attendance at a DoDEA Pacific school.

A.43 Student Counts - A report of the number of actual riders on each school transportation run by each bus stop.

A.44 Student Transportation Office (STO) - Manages school bus operations, routes, stops, and schedules.

A.45 Unsatisfactory/Incomplete Service - A service output that does not meet the standards of performance detailed in this contract.

Addendum B - Security Standards and Requirements

B.1. Installation Passes.

B.1.1 The Guam Transportation Program Analyst/COR will ensure sponsored bus contractor personnel have a legitimate requirement to enter the installation.

B.1.2 The contractor shall prepare the appropriate form(s) for each authorized installation-pass applicant for the minimum number of installations to which access is required on installation. If access is required to more than one U.S. military installation, justification may be required.

B.1.3 All individuals seeking an Installation Pass must have a Background check.

B.1.4 The contractor shall return Installation Passes to the issuing Pass and ID Office when the contractual relationship that served as the justification for the Installation Pass changes or is terminated. When an employee terminates their employment with the contractor, the contractor must also return installation pass to the Pass and ID office within 3 work days.

B.1.5 Contractor personnel that use Contractor privately owned vehicles to access on a recurring basis US Forces Guam installation in support of school transportation may be required to register the vehicle as part of the installation pass application process.

B.1.6 Applicants shall submit a copy of the following documents with the application:

B.1.7 A copy of all required background-check results.

B.1.8 Contractor employees shall only use the Installation Passes to perform work under this contract.

The Contractor is responsible for controlling U.S. installation passes issued to Contractor personnel.

Installation passes remain the property of the U.S. Government; passes shall be returned to the COR upon expiration of the pass or bus contract, when a Contractor employee is no longer employed by the Contractor or requires access, or when requested by the COR.

B.1.9 Contractor personnel who are denied an Installation Pass shall be removed from performing service(s) under this contract immediately upon Contractor's receipt of such notification from the Government.

B.1.10 Pass and Registration will take a digital photo and fingerprint the contractor’s employee.

Refusal to provide a digital photo and digitized fingerprint minutia data will result in not receiving an Installation Pass.

B.1.11 When necessary, a Temporary Installation Pass may be issued pending completion of a required background check. A Temporary Installation Pass is valid for up to 90 days and may be extended with reasonable justification

B.1.12 Contractor personnel shall always secure the installation pass and other government-issued documents to prevent loss or theft, and never leave them unattended on the bus. If lost or stolen, the Installation Pass holder shall report the loss or theft to the COR, the U.S. Military Police or Security Forces Police station, and Pass and ID Office immediately. The Installation Pass will be flagged as lost or stolen. The sponsoring organization must submit a new application to the same Pass and ID Office where the original Installation Pass was obtained.

B.2 Security/Force Protection Conditions.

B.2.1 In the event security threats increase, the Government may require:

B.2.2 Contractor to implement alternate routes or schedules.

B.2.3 Inspection of Contractor vehicles and/or parking areas by U.S. military local security personnel.

B.2.4 Contractor to park vehicles used in performance of this contract in a secure installation/site identified by the Government.

B.2.5 Contractor to perform security inspections as directed by the Government.

B.2.6 Contracting Officer shall handle any resulting cost or schedule alignments equitably.

Addendum C

Contractor Personnel Standards and Requirements

C.1. Removal of Contractor Personnel. The Contracting Officer reserves the right to ban any driver for cause.

C.2. Health. Drivers and office employees must be free of communicable diseases and physical or mental impairment that would affect the ability to perform duties under this contract.

C.3. Language Ability. The Contract Manager and Alternate and Lead Drivers must be able to speak, read and write the English language when communicating with the COR, school officials and Contracting Officer.

C.4 The contractor’s employees shall be authorized to legally work in the USA.

C.5 The Contractor shall not employ persons identified as a potential threat to the health, safety, security, general well-being, or operational mission of the installation or its population.

C.6 Safety and Security Training.

C.6.1 The primary and alternate Contract Manager shall attend an annual Government-sponsored Safety and Security Training Session. Sessions normally are held in July or August as coordinated with the COR.

C.6.2 Prior to starting the school year, the government shall provide the contractor’s drivers, safety aides and replacement drivers, a minimum of eight hours safety and security training covering the topics presented in the annual safety and security training session. The Contractor shall prepare a memorandum that identifies the date, time, location, names of instructor(s) and trainee(s), and a brief statement, of the content of material presented (e.g., instruction syllabus).

The contractor is responsible for training all their employees hired after the government’s annual training.

C.6.3 The Contractor shall provide drivers training to include:

C.6.3.1 Proper passenger seating and fastening and wearing of CSRS or seat belts if they are available.

C.6.3.2 Use and function of the school bus cross view mirror system.

C.6.3.3 Safety and Security concerns/standards listed in Addendum B, C, D, E, F, and G herein.

C.7 Personal Equipment.

C.7.1 Drivers shall wear shoes with enclosed toes and heels, and wear Contractor provided name tag (with picture) while performing under this contract.

C.7.2 Driver must have operational two way communications (radio or cell) with the dispatcher, contract manager, COR and preprogrammed emergency/contract manager’s phone numbers, in accordance with Guam laws.

C.8 Background Check. IAW with DoDI 1402.5, individuals who come into contact with student must be cleared by a Local background check. The Contractor shall maintain the most current background checks on file and shall make them available to the COR upon request.

C.9 Criminal Offense.

C.9.1 The Contractor shall not hire anyone with a felony criminal record convicted or listed in any sex registry to perform under this contract. The contractor shall not use under this contract any employee that appears to pose a threat to children, history of violence, or threat to security. The Contractor shall immediately inform the COR when it is learned that an employee under this contract has been arrested for a criminal offense. The Contractor shall also immediately inform the COR when any action is taken to suspend or revoke the driver’s license of any driver performing under this contract.

C.9.2 The contractor shall immediately remove from performance on this contract any employee charged with driving while impaired (drug or alcohol), drug or alcohol abuse, a felony, child sex offense, or illegal use or illegal possession of a weapon during contract performance.

C.10 Contractor Employee Conduct. During performance of this contract, to include in and around the contracted vehicles and on school grounds, Contractor employees shall not:

C.10.1 Use verbal assault, foul language, personal or racial insults, or threats of personal violence, or comment on the personal appearance of students.

C.10.2 Engage in any conduct of a sexual nature, verbal or physical, to include reading or display of nudity or pornographic material.

C.10.3 Engage in physical contact with students, except as required for reasons of safety, first aid or CPR, or show verbal or physical affection toward students, or photograph them.

C.10.4 Use tobacco products, eat or drink, or report for work under the influence of or impaired by alcohol, drugs, or medications which may affect the ability to perform safely under this contract.

C.10.5 Sell, give to or accept from students any beverage, food or tobacco product, or any gift or item, irrespective of monetary value.

C.10.6 Contractor employees shall dress in a neat, professional manner and shall not wear clothing with insignia reflecting religious, political or social messages or slogans.

C.11 Personnel List. Not less than twenty (20) calendar days before services begins, the Contractor shall provide a typed list of all personnel to perform services under this contract to the COR. The Contractor shall provide a dated, revised personnel list to the COR as changes occur.

The list shall include each person in alphabetical order in the following manner: full name (last name, first name, middle initial), date of birth, job title (driver, manager, etc.), country of citizenship, identification document number/passport number, dates of CPR/First Aid certification and date of most recent Safety/Security training.

C.12 Driver’s License/Professional Certifications. The Contractor shall certify that all Contactor drivers have the correct licenses and certifications for the type vehicles they are to operate. The Contractor shall not utilize drivers with more than two moving violations or more than one reckless driver within a five year on this contract. The contractor shall not use employees who have had their CDL or D and/or S-endorsement suspended or revoked in any other state. The Contractor maintains a copy on file and, upon request by the COR, make available for viewing the driver’s licenses and certifications for the type vehicles they are to operate.

Safety Procedures: Drivers shall follow their CDL/endorsement training, U.S. and Guam law.
