52.212-2 (ADDENDUM)

FAR 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) This procurement is being conducted as an acquistion of commercial items in accordance with the format in Federal Acquisition Regulation FAR Part 15, Contracting By Negotiation. A Lowest Price Technically Acceptable (LPTA) source selection process will be used for this solicitation since best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. Accordingly, award will be made to the single, responsible Offeror whose proposal is determined to be the lowest-priced, technically acceptable offer. The Government will evaluate the following factors for technical acceptability: Technical Capability and Past Performance. Price will be evaluated for price reasonableness. A rating of “unacceptable” for any non-price factor or subfactor will result in a proposal being rated “unacceptable” and that proposal will not be eligible for contract award.

(b) To be eligible for award, the Offeror’s proposal must be rated as technically acceptable, conform to all required terms and conditions of this solicitation, have fair and reasonable pricing, and include all information required by the solicitation. Additionally, Offerors must have an affirmative determination of responsibility and be registered in the System for Award Management (SAM) database to be eligible for award.

(c) Factors and Subfactors to be evaluated:

Factor 1 – Technical Capability

The Government will evaluate each proposal in the area of Technical Capability to verify ability to meet the requirements listed in the Performance Work Statement (PWS). This factor will be evaluated to determine the Offeror’s capability to perform the tasks outlined in the PWS by reviewing how the Offeror addresses the following subfactors:

Subfactor 1 – Technical Approach

The Government will evaluate each Offeror’s technical approach to determine the Offeror’s ability to perform the objective requirements listed in Sections 2.2 through 2.3 of the PWS within the constraints listed in Section 3.

Subfactor 2 – Management and Staffing Plan

The Government will evaluate each Offeror’s Management and Staffing Plan to determine the Offeror’s ability to perform the objective requirements listed in Section 2.1.1 through 2.1.3, within the constraints listed in Section 3, paying particular attention to Sections 3.2.4, 3.2.5, 3.3, and 3.5.

Subfactor 3 – Transition-In Plan

The Government will evaluate each Offeror’s Transition-In Plan to determine the Offeror’s ability to perform the objective requirements listed in Section 2.4.1 of the PWS within the constraints listed in Section 3.

Subfactor 4 – Corporate Experience

The Government will evaluate each Offeror’s proposal to determine that the Offeror has prior corporate experience as a prime contractor performing services similar in size and complexity to those services outlined in the PWS. “Similar in size and complexity” means: similar in dollar amount, type of work, managing work in multiple geographical locations, and number of Offeror employees working on the contract. Corporate experience is defined as the prior experience of the Offeror’s organization as an entity and not the prior experience of individuals working for the Offeror. If the Offeror is proposing subcontractors, their experience as a prime contractor on other contracts will also be considered in the overall evaluation of demonstrated corporate experience, but will not be used as the sole basis to judge an Offeror’s corporate experience.

The Government will rate each proposal in the area of Technical Capability, including factors and subfactors, as follows:

Technical Capability Rating

Rating Description

Acceptable The proposal meets the requirements of the solicitation.

Unacceptable The proposal does not meet the requirements of the solicitation.

Factor 2 – Past Performance

The Government will evaluate the Offeror’s recent and relevant past performance to determine the vendor’s likelihood of success in meeting the requirements outlined in the PWS. Recent is defined as contracts that have been completed within the past three years or are currently being performed. Relevant is defined as work similar in scope, complexity, and magnitude to the work described in the PWS. In the event past performance is not available, the Offeror may not be evaluated favorably or unfavorably on past performance. Instead, a neutral rating will be assigned to the Offeror.

The Government may consider past performance information in the Offeror’s proposal, information obtained from questionnaires, or any other means available.

The Government will rate each proposal in the area of Past Performance as follows:

Past Performance Rating

Rating Description

Acceptable

Based on the Offeror’s recent and relevant performance record as a prime contractor, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the Offeror’s performance record is unknown (as indicated above).

Unacceptable

Based on the Offeror’s recent and relevant performance record as a prime contractor, the Government does not have a reasonable expectation that the Offeror will successfully perform the required effort.

Factor 3 – Price

Offeror price responses shall be evaluated in accordance with the price analysis techniques outlined in FAR subpart 15.404-1 – (Proposal Analysis Techniques) to determine the reasonableness of total evaluated price.

(d) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. This evaluation will include an evaluation of a potential option to extend services for 6 months (as allowed by FAR 52.217-8) to run after the completion of the last annual option period. The Government will extrapolate the vendor’s pricing of the last annual option period to arrive at a price for the potential six-month option to extend services. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(e) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
