PERFORMANCE WORK STATEMENT
PERFORMANCE WORK STATEMENT
FOR
The Department of Defense Education Activity (DoDEA) Medical Services
1. General Information and Scope of Work.
1.1 Agency: The Department of Defense Education Activity (DoDEA) serves the educational needs of about 71,000 dependents of military and civilian employees by providing pre-kindergarten (PK)-12 instruction in 165 brick-and-mortar schools worldwide. Student enrollment varies based primarily on the deployment of military troops worldwide. In North America, DoDEA operates 52 schools located in seven states, Puerto Rico, and Cuba. In Europe and the Middle East, DoDEA operates 65 schools located in Germany, England, Netherlands, Belgium, Italy, Spain, Turkey, and Bahrain. In the Pacific, DoDEA operates 48 schools located in Korea, Japan (mainland and Okinawa), and Guam.
1.2 Background: DoDEA requires services by medical professionals to evaluate and support requests for reasonable accommodations, transfers, voluntary reassignments, various leave programs, other than economy/coach accommodations (OTECA), and employee and dependent medical travel (EDMT) from DoDEA employees world-wide.
1.2.1. Under the Americans with Disabilities Act (ADA), DoDEA is required to provide reasonable accommodation (RA) to employees and applicants for employment with known physical or mental disabilities to ensure they have full access to equal employment opportunity, unless such accommodation would cause an undue hardship to the Agency. When the disability is not obvious, the Disability Program Manager (DPM) may require medical documentation to make a determination regarding whether the requestor has a covered disability, whether the requestor needs a RA because of that disability, and what RA(s) would be effective. The medical documentation submitted may include a description of the disability; the nature, severity, and duration of the disability; the activity or activities the disability limits;
the extent to which the disability limits the requestor’s ability to perform the activity or activities; the RA needed and/or requested; and whether the use of a mitigating measure might eliminate the need for a RA.
To help ensure an appropriate determination is made, the contractor shall assist the DPM in reviewing the medical documentation submitted.
1.2.2. Each school year, interested overseas educators may apply to transfer to another school and/or location through the DoDEA Transfer Program. Exceptions to the deadline for submitting an application is limited to those instances in which the educator could not submit the application due to medical considerations, or for those who are declared excess after the deadline for the application submission has passed. Additionally, educators that request medical reconsideration with approved medical documentation may receive reconsideration and a change in assignment.
1.2.3. Subject to mission requirements and the reasonable exercise of management discretion, it is the DoDEA policy that voluntary reassignment (VR) will be considered for employees whose applications provide sufficient information and/or documentation to justify such a request. For consideration due to medical reasons, applications must include supporting medical documents.
1.2.3.1. If a civilian medical practitioner on the economy provides a medical statement, the physician’s statement must be in English, or translated to English. It must indicate the specific medical condition (diagnosis), prognosis, the medical basis for inability to remain in the current location/position, the medical basis for the ability to work at the designated new location/position, and the type of medical care, climate or environment needed to relieve the medical condition. The statement must also include documentation that the medical condition cannot be treated on the economy in the area where the employee currently works.
1.2.3.2. The contractor shall make a recommendation by reviewing the medical documentation submitted by the applicant, identifying if the employee or family member can or cannot be medically treated in the local area, and identifying the locations the employee or family member can be treated.
1.2.4. Under the EDMT program, employees assigned to a foreign permanent duty station (PDS), and their dependents, may be eligible for funded transportation to a designated point (DP) where proper treatment is available as approved by the Authorizing Official (AO), when a medical or dental treatment is unavailable at, or near, their foreign PDS.
1.2.5. It is a Department of Defense (DoD) policy, per the Joint Travel Regulations (JTR) at par. 020206-K, that OTECA (business class travel) may be used due to medical or special needs. An AO should also consider physical characteristics when determining the class of travel and the options for accommodating those special needs. Other travel options to be considered before approval of OTECA travel include:
economy plus, bulkhead seating that provide extra leg room, or two adjoining coach seats.
1.2.5.1. Any accommodation for special need requires that a medical authority provide a written certification of the medical condition or special need. Authority to use upgraded accommodations is limited to the disabled or special needs traveler and their attendant, if required by the medical condition or special need. A medical authority must recertify the traveler’s medical condition or special need in writing every six months, for a temporary condition; every two years for a lifelong condition.
1.2.6. Various leave programs such as the Voluntary Leave Transfer Program (VLTP), requests to use leave under the Family Medical Leave Act (FMLA), and requests to use advanced leave require employees to provide administratively acceptable medical documentation, in addition to other absence requests, as stipulated in policy. The contractor shall assist the Employee Relations (ER) Specialist in determining if the documentation adequately supports the employee’s request.
1.3 Scope of work: The Contractor shall provide medical expertise to support medical-related services in reviewing, analyzing and assisting DoDEA ER Specialist in determining if the documentation sufficiently supports the requested services.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
Addendum to Paragraph (a). Paragraph (a) is changed to read as follows:
(a) The Government will award a single Firm-Fixed Price Indefinite Delivery/Indefinite Quantity contract (IDIQ) contract, for a 5-year period, which includes a Base Period of one (1) year and four (4) one-year Option Periods, to the responsible offeror whose offer, conforming to the solicitation requirements represents the lowest price technically acceptable offer, meeting the minimum requirements of the non-price factors, Technical and Past Performance, listed below. This solicitation is being competed under FAR Parts 12 and 13.
The Government will first evaluate the lowest-priced response. If the Government determines that this lowest-priced response is technically acceptable, the Government intends to select that lowest-priced response for award and not conduct any further response evaluations. However if the Government determines that this lowest-priced response is not technically acceptable, then the Government will evaluate the next lowest-priced response for technical acceptability. Again, the Government intends to select that next lowest-priced response for award, if it is technically acceptable, and not conduct any further response evaluations. The Government will continue this process of evaluation (evaluating the responses in order of lowest price to highest price) until the Government finds a technically acceptable response. However, while the Government intends to use the above described evaluation procedure and does not intend to conduct exchanges with offerors, the Government may, in its discretion, conduct exchanges with offerors if exchanges are determined to be in the Government's best interest.
Minimum requirements for non-price factors:
Factor 1 (Technical) — Receive an overall rating of Acceptable Factor II (Past Performance) — Receive a rating of Acceptable or Neutral
Factor I: Technical. The Government will evaluate the Offeror’s response to determine if the offeror’s response clearly demonstrates the Offeror’s ability to perform each objective and constraints as described in the Performance Work Statement (PWS).
Factor II: Past Performance. Will be evaluated to assess the Offeror’s ability to successfully meet the requirements based on the Offeror’s demonstrated recent and relevant record of how well the Offeror performed on previous contracts. Offerors without recent, relevant, sparse or no past performance record will receive a neutral rating, which shall be considered “acceptable.”
Factor III: Price. Will be evaluated for reasonableness in accordance with FAR 13.106-3.
Factor IV: Representations and Certifications. Will not be evaluated, but will be reviewed for completeness.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 calendar days.
(End of clause)
52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 15 calendar days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 calendar days days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months .
Note: If the FAR 52.217-8 extension is exercised, the total duration of this contract shall not exceed 6 months after expiration of the effective period, including all modifications thereto.
