STATEMENT OF WORK

Literacy Accommodation Suite for Grade 1-12 Students with Disabilities

1.0 INTRODUCTION

1.1The Department of Defense Education Activity (DoDEA) serves the educational needs of the dependents of military and civilian employees by providing PK-12 instruction to about 74,000 students in 171 brick-and-mortar schools. Student enrollment varies based primarily on the deployment of military troops worldwide. DoDEA’s curriculum, resources, and student achievement scores on standardized assessments compare favorably to those of high-performing US public school systems.
1.2In North America DoDEA operates 57 schools located in seven states, Puerto Rico, and Cuba. In Europe and the Middle East, DoDEA operates 66 schools located in Germany, England, Netherlands, Belgium, Italy, Spain, Turkey and Bahrain. In the Pacific, DoDEA operates 48 schools located in Korea, Japan (mainland and Okinawa), and Guam. DoDEA also operates a fully accredited Virtual High School with its main office in Virginia and teaching hubs in Germany and Okinawa.
2.0BACKGROUND
2.1DoDEA has been using literacy accommodation (text-to-speech) software for about ten years. This resource meets the needs of a subgroup of our students with disabilities.
3.0SCOPE
3.1DoDEA requires a comprehensive literacy accommodation suite that includes text-to-speech features primarily as support for teachers of a subgroup of grades 3-12 students with disabilities, i.e., of students whose individualized education program (IEP) requires this accommodation. Systemwide there are approximately 630 special education teachers who serve 8,700 students. Approximately ten percent or 870 of those students require literacy accommodations. Of that number, a handful of students in grades 1-2—fewer than 20 students systemwide—may require this accommodation as well.
3.2Systemwide DoDEA has the following estimated number of schools and enrollment for grades 3-12 for the 2016-17 school year:

3.3DoDEA expects to award one contract for a base year and five option years.
4.0REQUIREMENTS

4.1 Essential Features: The Contractor shall provide a literacy accommodation suite that includes the following eight features:

1) Ability to run on PC and tablet devices (currently DoDEA uses Windows and Apple IOS for its special education program).

2) Flexible licensing so that student may use it both at school and at home.

3) Ability for students to select the best voice for their learning/listening style, for example, choice of multiple high quality synthesized voices; adjustable reading rate and pitch; multiple voice language options.

4) Bimodal color highlighting of words, sentences, or paragraphs as they are spoken.

5) Ability to read text in at least two or more formats: DOCX, Google Docs, PDF, EPUB, RTF, Daisy, and on the Web (Chrome, IE or MS Edge).

6) Compatibility with Bookshare.

7) Optical Character Recognition (OCR) and scan capabilities to include scanning and reading paper as well as locked PDFs or image/text files online while retaining the original format and color.

8) Word prediction to support spelling and writing.

4.2 Optional Features: The Contractor shall provide a literacy accommodation suite that includes at least six of the following fourteen features:

1) Ability to be managed and supported from one centralized location for use throughout DoDEA.

2) Customizable toolbars/user interface so that teachers may lock specific features.

3) Keyboard shortcuts for critical features/commands for use on PCs.

4) Text magnification capability and color contrast options.

5) Dictionary supported by pictures.

6) Translator tool for at least the following languages: Spanish, German, Korean, Arabic, and Japanese.

7) Integrated study skills tools which may include one or more the following: highlights, voice notes, annotations, extract notes options for outlining, and summary guides.

8) Support text-to-speech for Mathematical Markup Language (MathML), which provides ability to use text-to-speech to read complex math and scientific equations.

9) Concept mapping to create and edit graphic organizers.

10) Custom word banks or lists.

11) Word prediction includes phonetic and grammatical corrections.

12) Multiple dictionaries that that include text-to-speech for definitions and homonym and synonym check/tools.

13) Spell check which includes text-to-speech for selections such as phonetic and/or contextual spelling options.

14) Speech-to-text capabilities.

4.3 General Requirements

1) Resources shall be free of racial, color, national origin, age, disabling conditions, sexual, religious, and ethnic bias, and shall present a balanced coverage of multi-cultural contributions, where appropriate.

2) Section 508 Compliance—Contractor resources, wherever applicable, shall meet the following requirements:

· IT Requirement: All electronic hardware and software procured under this contract/ purchase order must comply with Section 508 of the Rehabilitation Act of 1973, as amended, (29 U.S.C. 794d) and the Architectural and Transportation Barriers Compliance Board Electronic Information Technology Accessibility Standards (36 CFR part 1194). Further information is available at the following URL: http://www.section508.gov.

· Section 508 Deliverable Requirements: The activity to be performed relates to or requires the use of Electronic and Information Technology (EIT). Section 508 must be considered as a requirement for the outputs/ deliverables including functional performance, information, documentation, and support requirements under this acquisition to ensure that it considers specific Section 508 accessibility requirements. Further, the outputs/ deliverables should not adversely affect accessibility features of existing EIT technologies. Standards from 36 CFR part 1194 Subpart B, C, and D have been determined to apply to this acquisition. Solicitation respondents must describe how their background and experience will enable them to at least meet those technical provisions identified as applicable in the Government Product/ Service Accessibility Template (GPAT), per (Attachment 1).

3) OCR Requirement: Contractor shall provide two digital Optical Character Resolution (OCR) copies of all print materials. A digital copy of these materials shall be provided in one or more of the following formats:

· Digital Accessible Information System (DAISY)/ National Instructional Materials.

· Accessibility Standard (NIMAS) with cascading style sheet.

· HyperText Markup Language (HTML).

· Portable Document Format (PDF), (unlocked, embedded fonts, single page).

· Rich Text Format (RTF)/Word document

· KESI format, edited (compatible with Kurzweil 3000 version 12 Text to Speech software) that will not require further modification by DoDEA.

4.4 Professional Development—The Contractor shall provide online training and webinars that are appropriate for both special education teachers and para-professionals.

4.4.1 Online Training: Provide online modules or links to training videos that provide an overview of the suite and educate teachers on the ways to use the features effectively.

4.4.2 Webinars: Provide four 1-hour webinars each year which include approximately 45 minutes of instruction and approximately 15 minutes for questions and answers. Each webinar shall be repeated three times at times conducive to viewing by our educators in the Americas, Europe, and the Pacific. Record and archive each webinar; place the webinars on the vendor’s website and made available for DoDEA use throughout the life of the contract. Provide a skill checklist with links to training videos/information.

4.5 Technical Support: The Contractor shall provide online technical support along with consultation via telephone, videoconference, or email. Responses to emails shall be within one business day of receipt.

4.6Post-Award Conference: The Contractor shall participate in a post-award video- or teleconference within five business days of award.
5.0TECHNICAL REQUIREMENTS
Software and Cloud Testing Requirements
5.1.1All online resources, cloud-based services and instructional software shall meet Department of Defense and DoDEA Information Assurance requirements (as defined below). Software, cloud services and associated websites shall undergo comprehensive testing to ensure that they pose no security risk to the DoDEA infrastructure. Any IT component of the Contractor’s proposal that fails to meet DoDEA’s Information Assurance and Technology requirements will be excluded from further evaluation.
5.1.2DoDEA Information Assurance Testing and Validation will include, but not be limited to, ensuring that the Contractor software solutions do not modify DoDEA’s underlying system security configuration and/or interfere with other installed software. Standard software will undergo pre- and post-installation scans on a clean computer image and over 70 other security and malware validation checks.
5.1.3In accordance with Department of Defense policy, cloud-based services shall undergo a supplemental series of validations. These validations closely mirror the Federal Risk and Authorization Management Program (FedRAMP) Internet Cloud vetting processes and include interviews and deep system architecture inspections with the Contractor. Contractors shall be prepared to discuss underlying details of their environment in the following seven areas. Failure to provide this information when requested shall automatically exclude Contractors from further evaluation.

1. Vendor Data Collection and Distribution Controls

2. Vendor System Management and Security Controls

3. Vendor Data Storage and Data Access Controls

4. Vendor Data and Metadata Retention Controls

5. Vendor Development and Change Management Processes

6. Vendor Test and Development Environment Security Controls

7. Vendor Data Breach, Incident Investigation and Response Mechanisms

5.2Basic DoDEA System Requirements: In accordance with Section 5.1 (above), DoDEA requires the use of software which may be installed and/or accessed in a stand-alone environment, network environment, or web-based environment that is compatible with standards cited herein. All software shall be completely functional on a standard DoDEA desktop WITHOUT the need/requirement for administrative-level user rights or a requirement to insert media (CD/DVD) to execute the software. Software shall not require modifications to folder permissions while executing. In addition, all software shall be compatible with the following hardware baseline:

5.3DoDEA Software License Keys: License keys and electronic downloads for software purchased by DoDEA under this guidance shall be provided to the Contracting Officer’s Representative (COR) with a copy of the same to the following email address: SOFTWAREAPPROVALS@HQ.DODEA.EDU. Software shall NOT be provided directly to DoDEA school, district, and/or area offices unless explicitly identified in the Performance Requirements.
5.4DoDEA Information Assurance Supporting Elements / Requirements
5.4.1DoDEA is subject to Federal statute and United States Department of Defense policy and guidance. These requirements include, but are not limited to, the Information Assurance requirements defined in:

· Department of Defense Directive (DoDD) 8500.01E, Information Assurance, which may be found at http://dodcio.defense.gov/Portals/0/Documents/DIEA/850001p.pdf

· The DoD Risk Management Framework (DODRMF) per DoDI 8510.01, per http://www.rmf.org/component/content/article/56-consulting/65-rmf-dod.html and http://www.dtic.mil/whs/directives/corres/pdf/851001_2014.pdf

· Department of Defense Security Technical Implementation Guidance (STIG), which may be found at http://iase.disa.mil/stigs/Pages/index.aspx

5.4.2 These guidelines serve as a pillar of the Defense Information Assurance Program (DIAP), of which the following supplemental Contractor mandates shall form:

· Contractor shall provide security patches and upgrades, to include third-party applications, in response to public released security vulnerabilities associated with their software solution. Any deviations from this requirement shall be approved in writing by the DoDEA Chief Information Officer.

· Contractor shall develop and provide software upgrades within 30 days of notification should any of the software/plug-ins be found vulnerable and non-compliant with Defense Information Security Agency (DISA) and/or National Security Agency (NSA) standards. Software upgrades and patches shall be included in the licensing cost and be performed at the least disruptive times as determined by DoDEA. Prior to award, Contractor software shall be subject to all new or updated Department of Defense/DIACAP requirements.

5.4.3All windows, fly-out menus, etc. shall work from within an environment that blocks popup windows. In addition, all web-based software shall not (wherever possible) require the use of streaming videos or downloads, such as Java Applets.
5.4.4All software packages shall support unattended installation methods used by enterprise software packaging and deployment systems, i.e., Microsoft SCCM 2012. Older 16-bit software will be automatically denied per this requirement.
5.4.5Any portion of the Contractor's solution that involves Internet access by DoDEA students has a duty to comply with the relevant requirements of the Children's Internet Protection Act, Pub.L. 106-554, § 1(a)(4) [Div. B, Title XVII, § 1701], Dec. 21, 2000, 114 Stat. 2763, 2763A-335. Any part of the Contractor's solution that collects or stores agency-owned or agency-controlled personally identifiable information has a duty to do so in accordance with the relevant requirements of the Privacy Act, 5 U.S.C. (See http://www.archives.gov/about/laws/privacy-act-1974.html.)
5.4.6Contractor solutions that collect information from children under the age of 13 through the Internet must comply with the relevant requirements of the Children's Online Privacy Protection Act, 15 U.S.C.A. § 6501 et seq.
5.4.7Contractor’s solution shall be robust enough to serve the needs of a large community of learners dispersed across the world using a variety of bandwidths. They shall be scalable and able to expand to meet future growth, both in terms of the instruction and the size of the student body.
5.4.8Any opportunity for data integration of student or teacher accounts shall adhere to Federal government and DoD guidance for security of personally identifiable information available from the following URLs:

5.4.9All Contractor staff having access to DoDEA student and/or teacher personally identifiable information shall take the DoD Privacy Act/ Personally Identifiable Information (PA and PPI/PII) training before gaining access to the data and yearly thereafter. Contractors who have a DoDEA username and password may access the training on DoDEA's intranet. All other contractors shall access the PA and PPI/PII slides, a link to which to which is found at www.dodea.edu/employees/index.cfm. Contractors shall send written confirmation listing the staff members that have taken the mandatory PA and PPI/PII training to the COR.
5.5Maintenance and Support: Maintenance and support shall be available for the duration of the contract. Maintenance is defined as automatic distribution of upgrades and revisions that can be accomplished using the Internet and/or email. Any upgrades to online digital materials shall include compatibility with DoDEA school-level technology and DOD requirements. Contractor shall not contact schools directly but shall coordinate the dissemination of upgrades or revisions through the COR and shall provide electronic access of the updates and/or revisions to the COR for testing. Contractor shall be able to provide DoDEA with reporting capability regarding usage rates related to any component of the digital resource (s).
5.6Contractual Non-Disclosure Agreement Requirements: The Contractor may be required to sign Non-Disclosure Agreements (NDA), which prohibits the disclosure, publishing, divulgence, or release of any information obtained during the performance of the contract.
5.7Applicable Federal Laws and Regulations: As a U.S. Government entity, DoDEA is required, when entering into terms and conditions/ terms of use/end user license agreements with Contractors, to follow the applicable Federal laws and regulations. Accordingly, in order for a Contractor to be eligible for award of a contract, the provisions of a Contractor’s terms and conditions/terms of use/end user license agreement for the contractor’s digital resources shall be permitted within Federal law and agency rules and regulations.
6.0PERFORMANCE AND DELIVERY SCHEDULE

6.1 The Contractor shall furnish all services to be performed and all items to be delivered in accordance with the following delivery schedule:

ADDENDUM TO FAR 52.212-1

ADDENDUM TO FAR 52.212-1 – INSTRUCTIONS TO OFFERORS -- COMMERICIAL ITEMS

1. Addendum to Paragraph (b) Submission of Quotes: In addition to those requirements as stated in paragraph (b), the following are added and shall apply to the submission requirements in response to this solicitation:

(a) Quote Structure and Content – Vendors shall submit quote packages consisting of the following separate/distinct volumes for evaluation purposes and include the content identified herein:

1. Volume 1 - Administrative. This quote volume shall include the following:

a. A cover letter with the vendor’s Tax Identification Number, Dun and Bradstreet Number, Cage Code, and point of contact information;

b. Completed Standard Form (SF) 1449.

c. Completed FAR Clause 52.209-7, Information Regarding Responsibility Matters;

d. If the vendor is registered in System for Award Management (SAM), a copy of completed paragraph (b) of FAR provision 52.212-3, Offeror Representations and Certifications; or if the vendor is NOT registered in SAM, a copy of completed paragraphs (c) through (o) of FAR provision 52.212-3, Offeror Representations and Certifications.

2. Volume 2 – Technical Capability. This quote volume shall:

a. Not exceed 20 pages in length.

b. Vendor shall demonstrate their understanding of the requirement and ability to provide the supplies and services outlined in the Statement of Work.

c. NOT include any references to proposed pricing.

3. Volume 3 – Past Performance Information. This quote volume shall:

a. Provide information on at least three recent contracts for supplies and services relevant to those required in the SOW. “Relevant” is defined as work similar in complexity and magnitude to the work described in the SOW. “Recent” is defined as contracts that have been completed within the past three years or are currently being performed.

b. Use the following forms to provide the necessary information for each “recent” and “relevant” contract submitted:

i. Attachment A, Past Performance Part I must be completed and submitted by all vendors for all three recent contracts; and

ii. Attachment B, Past Performance Part II is a questionnaire that must be forwarded by vendors to a minimum of three references. References must complete and submit the questionnaire directly to the DoDEA Procurement Division.

c. The Government reserves the right to consider Past Performance information from other available sources.

d. Attachment C, DoDEA Cloud Vendor Information Collection, must be completed.

4. Volume 4 – Price. This quote volume shall:

a. Be in Microsoft Excel. All items must have a price or be marked “NSP” for “Not Separately Priced.” Each item will state the description, ISBN number, quantity, unit, unit price, and estimated amount. A separate line item must be prepared for item being proposed for the base and five option periods. A final total of the Base and Option Periods is required in the Excel Spreadsheet.

b. Reference the Contract Line Item Numbers (CLINs) Sub-CLINs in the SF1449 Schedule of Supplies as suggested CLIN structures. In lieu of this schedule, the contractor may submit fewer or more CLINs, whichever may be appropriate to their standard commercial practice.

(b) Quote Submission Requirements –

1. Copies, Format and Quantities:

a. One electronic copy of Volumes 1-4.

2. Closing Dates and Delivery Methods/Addresses::

a. Complete Quote Package (Volumes 1 through 4): The closing date for complete quote packages is August 8, 2016 at 11:00 A.M. ET via email.

The electronic copy of Volumes 1-4 shall be sent by email to the Contract Specialist at Noah.Mitchell@hq.dodea.edu. DoDEA has a maximum email limit of 10MB. Vendors shall confirm receipt of their electronic copy by return email from the Contract Specialist. The vendor agrees to hold the prices in its quote firm for 120 calendar days from the date specified for receipt of quotes, unless another time period is specified in an amendment to the solicitation.

(c) RFQ Questions – Questions in regards to this RFQ shall be submitted in writing via email to Noah Mitchell at Noah.Mitchell@hq.dodea.edu with the subject line, “Questions DoDEA RFQ Wins10 Migration,” no later than 11:00 AM ET on July 15, 2016. A consolidated list of all questions and answers will be provided via an amendment to the RFQ posted to www.Fedbizops.gov.

52.204-17 OWNERSHIP OF CONTROL OF OFFEROR (NOV 2014)

(a) Definitions. As used in this provision--

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Contractor and Government Entity (CAGE) Branch to identify a commercial or government entity, or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Contractor and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as an NCAGE code.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (JULY 2013)

(a) Definitions. As used in this provision--

Administrative proceeding means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.

Federal contracts and grants with total value greater than $10,000,000 means--

(1) The total value of all current, active contracts and grants, including all priced options; and

(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).

Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(b) The offeror ( ) has ( ) does not have current active Federal contracts and grants with total value greater than $10,000,000.

(i) In a criminal proceeding, a conviction.

(ii) In a civil proceeding, a finding of fault and liability that results in the payment of a monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more.

(2) If the offeror has been involved in the last five years in any of the occurrences listed in (c)(1) of this provision, whether the offeror has provided the requested information with regard to each occurrence.

(d) The offeror shall post the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the System for Award Management database via https://www.acquisition.gov (see 52.204-7).

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Technical and Past Performance is more important than Price.

Technical and past performance, when combined, are equal.

Final award will be made on the Best Value Continuum approach.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (APR 2016)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.

(a) Definitions. As used in this provision --

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
