STATEMENT OF WORK
Perpetual Licensing for Online Courses
1.0
INTRODUCTION
1.1.
The Department of Defense Education Activity (DoDEA) serves the educational needs of the dependents of military and civilian employees by providing PK-12 instruction to approximately 87,000 students in seven states, twelve foreign countries, Guam, and Puerto Rico. The number of students varies based on the deployment of military troops worldwide. DoDEA’s curriculum, resources, and student achievement scores on standardized assessments compare favorably to high-performing US public schools.
1.2 DoDEA is divided into three administrative areas. DDESS (Domestic Dependent Elementary and Secondary Schools) covers the schools in seven states and Puerto Rico, and for administrative purposes, Cuba. DoDDS (Department of Defense Dependent Schools) is divided into DoDDS-Europe and DoDDS-Pacific. The former administers the schools in England, Germany, Italy, Belgium, Netherlands, Spain, Portugal, Turkey, and Bahrain. The latter covers the schools in Korea, Japan, and for administrative purposes, Guam. DoDEA also operates a fully accredited Virtual High School with its main office in Virginia and teaching hubs in Germany and Korea.
2.0
BACKGROUND
2.1 DoDEA is seeking to expand course offerings delivered via its Virtual School Program.
3.0
SCOPE
3.1 DoDEA requires perpetual licensing of online courses that can be customized to its specific requirements for students in grades 4-12 and used in perpetuity to expand courses offered through the DoDEA Virtual School Program. The course offerings will serve a range of student needs from credit replacement to acceleration including supporting the transition from middle school to high school.
· All online courses—both core curriculum and Advanced Placement (AP)—will be taught by DoDEA teachers.
· Courses will be equivalent to a one-semester unit or a full year or two-semester unit.
· Courseware shall be designed to run on DoDEA’s adopted Virtual Learning Environment (VLE).
3.2 DoDEA expects to award one contract for the performance period for a base year and four 12-month option years, beginning on or about June 30, 2011. The number of courses to be purchased is difficult to estimate because DoDEA’s enrollment may change and the number of online courses DoDEA’s Virtual High School offers may change. However, DoDEA expects it will require 25-30 high school level (grades 9-12) full-year and semester courses plus related online teacher resources in the base year. In Option Year 1: DoDEA will require 5-7 middle or high school courses plus related teacher resources. Option Year 2-5: DoDEA requires licensing of 5-7additional high school, middle/upper elementary courses plus teacher resources.
4.0

4.1.2 Provide comprehensive online course content and assessment materials for each course represented in the menu of offerings. DoDEA will provide the instructor.
4.1.3 Provide courseware listed from among the eight curricular areas below:
Eight Curricular Areas

3. Science (Lab-based for high school)
4. Social Studies

6. Career & Technical Studies
7. Health & Physical Education
8. Fine Arts
4.1.4 The exact course titles to be licensed will be finalized at the Post-Award/Implementation Plan meeting.
4.1.5 Be designed modularly or contain modules or units equivalent to one semester (.5 units), or a full year two semesters, (1.0 unit) equivalent for high school courses.
4.1.6 Provide courses that:
· Are designed to run on DoDEA’s adopted Virtual Learning Environment (VLE). Content is IMS Content Packaging Specification conformant. Coding will not disable LMS features when the content is used. Multiple authentications are not required for users to access content.

· Provide student material in a digital Optical Character Resolution (OCR) format, or PDF format that is compatible with common OCR devices to convert written text into audio format. If not already available, the Contractor may be required to convert student texts into this format.
· Reflect a multicultural approach that is free of racial, color, national origin, age, disabling conditions, sexual, religious, and ethnic bias and presents a balanced coverage of a variety of cultures accurately and authentically, avoiding stereotypes. Materials should also promote gender equity.
4.1.7 Permit DoDEA to modify courses content to meet its needs.
· Content does not contain code that limits full functionality in other delivery environments such as smartphones and PDAs. Software and plugin requirements are provided.
· Content components can be replicated or updated in their entirety or in their individual parts.
· Content adopts a file naming convention that is unique, descriptive, meaningful and consistently applied as it related to the organization of the content.
4.1.8 Demonstrate that all copyrighted materials are properly cited. The use of any materials not protected by fair use will occur only after permission is granted by the copyright owner.
4.1.9 Ensure that all courses and course content are evaluated regularly and updated periodically to improve their effectiveness in raising student achievement.

4.2.1 Have course goals and objectives that are (1) clearly stated, observable, measurable, achievable, (2) aligned to national content standards for each subject area, and (3) compatible with DoDEA learning standards and objectives, which may be found at http://www.dodea.edu/curriculum/.
4.2.2 Include the following:
· Course requirements that are consistent with courses goals, representative of the scope of the course and clearly stated.
· Clear, complete course overview and syllabus.
· Content and assignments of sufficient rigor, depth and breadth to teach the standards being addressed.
· Information literacy and communication skills incorporated as an integral part of the curriculum.
· All necessary orientation materials, textbooks, workbooks, lab books, or other materials needed for completion of the course. These may be available online or provided by the Contractor at no additional cost.
· Instructor resources/notes, assessments, recommended rubrics, assignments, and answers/explanations for teacher use.
4.2.3 Be student-centered, and incorporate a variety of ways to learning and multiple levels of mastery of the curriculum.
4.2.4 Emphasize 21st century skills such as learning and innovation skills; self-directed learning, and global awareness in the course and assessments.
4.2.5 Include the following:
· Course unit that describes the objectives, activities and resources that frame the unit of instruction and a description of the activities and assignments that are central to the unit.
· In each lesson a lesson overview, content and activities, assignments and assessments to provide multiple learning opportunities for students to master the content.
· Include a variety of audio, video and graphical media elements that are engaging and relate directly to topics covered in order to accommodate different learning styles and stimulate active participation.
4.2.7 Provide opportunities for appropriate instructor-student, student-student and student-content interaction to foster mastery and application of the material.
4.2.8 Include appropriate readability levels, written language and mathematical requirements for all content-related topics, readings and activities and assessments.
4.2.9 Provide authentic background information and applications that enrich course content.
4.3 Course Assessments—Each course will:
4.3.1 Contain adequate and appropriate assessment methodology to assess students’ mastery of content including both computer-scored and teacher-scored feedback that is appropriate to the outcomes, activities, and technologies.
4.3.2 Utilize formative and summative assessments to verify student readiness for the next lesson and to support student and teacher needs for feedback.
4.3.3 Incorporate flexibility for the teacher to assess students in a variety of ways.
4.3.4 Include grading rubrics and models for the teacher to use in implementing the course.
4.4.
Training and Support—The Contractor(s) will:
4.4.1 Content Professional Development: Provide selected members of the DoDEA content development teams with approximately 20 hours of professional development delivered by Contractor subject matter experts (SMEs) to provide guidance and resources for course implementation. Any IT component of the Contractor’s proposal that fails to meet DoDEA’s information security and technology requirements shall be excluded from further evaluation.
5.2 All software/Plugins/Add-ons shall meet DoDEA’s following requirements:
5.2.1 DoD Information Assurance Certification and Accreditation Process (DIACAP) [Accreditation Process (DIACAP), 28 November 2007, which may be found at the following URL: http://www.dtic.mil/whs/directives/corres/pdf/851001p.pdf].

52.212-2 EVALUATION-COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate the offers: Technical, Past Performance, and Price. The order of importance of these factors is: Technical, Past Performance and Price. When combined Technical and Past Performance are significantly more important than price. The government is using Simplified Acquisition Procedures for this procurement.
Evaluation Factors:
Factor 1: Technical Capability/Quality of Products and Services. Offerors will be evaluated on how well they demonstrate their ability to perform the requirement as set forth in the Statement of Work as well as on the general quality of the proposed products and services.
Factor 2: Past Performance: Offeror’s Past Performance will be evaluated to determine the offeror’s likelihood of success on the present requirement.
Factor 3: Price: Price will be evaluated to ensure price reasonableness. Price will be considered by the Government when determining the best value offer.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. .
Addendum to Provision:
(d) If the subject solicitation has been issued as a Request for Quotation, all references to offer and offeror are hereby changed to quote and vendor respectively, except for in paragraph (c), which stands as written. If a quote is provided, the Government may make an offer based on all or part of a vendor’s quote, as originally presented or as subsequently modified.
(e) If any component of the contractor’s offer or quote is not acceptable to the Government, then the Government may reject the offer or quote without further evaluation.
(End of provision)
CONSENT TO DE-OBLIGATION OF EXCESS FUNDS AFTER FINAL PAYMENT
(a) This paragraph is an addendum to FAR 52.212-4.
(b) The Contractor agrees that, after final payment has been made, the Government may unilaterally, and without obtaining further approval from the Contractor, adjust the final quantities of goods and/or services delivered and accepted under this contract and adjust the final price of this contract to conform to the total amount paid as of the date final payment was made.
(c) In accordance with FAR 4.804-3, the paying office shall close the contract file upon issuance of the final payment voucher. No contract modification will be issued to de-obligate the excess funds.
(d) If this contract is a type of indefinite-delivery contract (e.g., indefinite-delivery indefinite-quantity, requirements), this paragraph shall apply to each order issued under the contract on a case-by-case basis.
(e) This paragraph shall be deemed to be written agreement of the parties as contemplated by the changes paragraph of the Contract Terms And Conditions – Commercial Items clause of this contract (FAR 52.212-4(c)).
