(b) The “original” paper copy shall have no staples and no holes punched in it.

(c) All other paper copies shall be submitted in separate 3 ring loose-leaf binders, which when open, lay flat. No staples shall be used. A cover sheet shall be posted at the beginning of each volume, clearly marked as to volume number, title, copy number, RFP identification, and the offeror’s name. The same identifying data shall be placed on the spine of each binder.

(d) Proposals are required to be submitted in hard copy by mail in accordance with 252.204-9000 and electronic submission on CD with the hard copy to the Contract Specialist. Failure to receive hard copies or electronic copy by the specified due date and time will deem the entire proposal late. Receipt of only the electronic copy on CD of the proposal is considered not in compliance with the RFP.

L.1.2.1 252.204-9000 Notice to Potential Offerors-Official DTRA Addresses in the National Capital Region (NCR) (DEC 2007)

1. Offerors are responsible for submitting proposals and any proposal modifications/revisions to the designated office by the date and time specified in the solicitation. For the purposes of this clause, the “designated office” is the office appearing in the attention line of the mailing addresses in paragraph 2 below. Proposals received after this exact time will NOT be considered unless it meets one of the exceptions stated in the paragraph below.

2. DTRA has 2 official mailing addresses in the NCR. Due to heightened security measures, hand-carried proposals cannot be accepted, therefore offerors are to select one address below based on the method of mailing.

a. The official United States Postal Service (USPS) mailing address for DTRA:

Defense Threat Reduction Agency

Attn: BE-BCB/Michael D. Jackson 8725 John J. Kingman Rd. Stop 6201

Fort Belvoir, VA 22060-6201

b. DTRA cannot accept packages delivered via commercial express and ground carrier to any address other than the one listed below. For all incoming packages to DTRA activities in the Washington DC area (this includes packages sent via Federal Express, DHL, Airborne, UPS and other commercial carriers), use the following address:

Defense Threat Reduction Agency

Attn: BE-BCB/Michael D. Jackson 6200 Meade Road

Fort Belvoir, VA 22060-5264

Note: This address shall also be used in all contracts for delivery of supplies/materials.

3. If mailing via USPS, offerors are cautioned to allow 1-2 days for processing and delivery of all proposal information to the designated office after it has been received at the DTRA mailroom. This mail processing delay is unavoidable, so offerors are encouraged to carefully select the mailing method to ensure timely receipt of proposals.

* Mail sent without an office symbol may be misdirected within DTRA. Please use the most current office symbol assigned. If an office symbol changes during the term of this contract, the contracting officer may advise of this change via letter in lieu of a contract modification.

L.1.2.2 ADDITIONAL INFORMATION ON PROPOSAL SUBMISSION, MODIFICATION, REVISION, AND WITHDRAWALS:

(a) Submission, modification, revision, and withdrawal of proposals.

(1) Hard copies of proposals, along with the electronic copy on CD, are to be submitted via mail using the instructions provided in 252.204-9000 directly to the Contract Specialist. In order to be considered compliant with the RFP, offerors must submit proposals both ways. Proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) show the time and date specified for receipt, the solicitation number, and the name and address of the offeror. Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper.

(2) The first page of the proposal must show—

(i) The solicitation number;

(ii) The name, address, email, telephone and facsimile numbers of the offeror;

(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;

(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror’s behalf with the Government in connection with this solicitation; and

(v) Name, title, and signature of person authorized to sign the proposal.

Proposals signed by an agent shall be accompanied by evidence of that agent’s authority, unless that evidence has been previously furnished to the issuing office.

(b) Submission, modification, revision, and withdrawal of proposals.

(i) Offerors are responsible for submitting proposals, and any modifications or revisions, so as to reach the Government office designated in the solicitation by the due date and time specified in the solicitation.

(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(1) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(2) It is the only proposal received.

(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.

(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(v) Proposals may be withdrawn by written notice received at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.

(c) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified in the solicitation (unless a different period greater than what is requested in the solicitation is proposed by the offeror).

L.1.3 PROPOSAL FORMAT

L.1.3.1 Guidance This section provides general guidance for preparing proposals as well as specific instructions on the format and content of the proposal. The Offeror’s proposal must include all data and information requested by the Information to Offer (ITO) and must be submitted in accordance with these instructions. - Be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated assertions. Extraneous, repetitious, or wordy submissions are not desired and could result in lower ratings.

b. Scope. The restrictions described herein shall apply to performance or participation by the Contractor and any of its affiliates or their successors in interest (hereinafter collectively referred to as "contractor") in the activities covered by this Clause as prime contractor, subcontractor, cosponsor, joint venturer, consultant, or in any similar capacity.

(1) Maintenance of Objectivity: The Contractor shall be ineligible to participate in any capacity in contracts, subcontracts, or proposals therefore (solicited or unsolicited) which stem directly from the Contractor's performance of work under this Contract. Furthermore, unless so directed in writing by the Contracting Officer, the Contractor shall not perform any services under this Contract on any of its own products or services, or the products or services of another firm if the Contractor is, or has been, substantially involved in their development or marketing. In addition, if the Contractor under this Contract prepares a complete, or essentially complete, Statement of Work to be used in competitive acquisitions, the Contractor shall be ineligible to perform or participate in any capacity in any contractual effort which is based on such Statement of Work or specifications. Nothing in this subparagraph shall preclude the Contractor from competing for follow-on contracts.

(2) Access To and Use of Government Information: If the Contractor, in the performance of this Contract, obtains access to information such as plans, policies, reports, studies, financial plans, or data which has not been released or otherwise made available to the public, the Contractor agrees that without prior written approval of the Contracting Officer, it shall not: (a) use such information for any private purpose unless the information has been released or otherwise made available to the public, (b) compete for work based on such information for a period of six (6) months after the completion of this Contract, or until such information is released or otherwise made available to the public, whichever occurs first, (c) submit an unsolicited proposal to the Government which is based on such information until one year after such information is released or otherwise made available to the public, and (d) release such information unless such information has previously been released or otherwise made available to the public by the Government.

If, however, in compliance with this clause, the Contractor discovers and promptly reports an organizational conflict of interest (or potential therefore) subsequent to contract award, the Contracting Officer may terminate this contract for convenience if such termination is deemed to be in the best interest of the Government.

Accordingly, the Contractor may at any time seek a waiver from the Contracting Officer by submitting a full written description of the requested waiver and the reasons in support thereof. If it is determined to be in the best interests of the Government, the Head of Contracting Activity will grant such a waiver in writing.

f. Modifications: Prior to a contract modification, when the Statement of Work is changed to add new work or the period of performance is significantly increased, the Contracting Officer will request, and the Contractor is required to submit, either an organizational conflict of interest disclosure or an update of the previously submitted disclosure or representation.

L.4.0 VOLUME III – PAST PERFORMANCE PROPOSAL (PPP) (FACTOR 2)

L.4.1 VOLUME ORGANIZATION

The volume shall be organized according to the following outline:

Table of Contents

Glossary

Section 1, Team History and List of Team Effort

Section 2, Past and Present Performance Information, Form L-1

Section 3, Past Performance Questionnaire, Form L-2

L.4.2 SECTION 1, DESCRIPTION OF TEAM HISTORY AND LIST OF TEAM EFFORT

(a) The Offeror shall provide a brief description of team history (within the past 5 years, if applicable), organization, a description of facilities and operating locations, products, services, customers.

Many companies have acquired, been acquired by, or otherwise merged with other companies, and reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes have taken place during the time of performance of relevant present or past efforts or between conclusion of recent past efforts and this evaluation. As a result, it is sometimes difficult to determine what past performance is relevant to this acquisition. To facilitate this relevancy determination, include in this proposal volume a "roadmap" describing all such changes in the organization of the Offeror for the past 5 years and also include a “roadmap” for all team members identified in a Teaming Arrangement or Letter of Commitment for their efforts. As part of this explanation, show how these changes impact the relevance of any efforts the Offeror identifies for past performance evaluation and performance confidence assessment. Since the Government intends to consider present and past performance information provided by other sources as well as that provided by the Offeror, these "roadmaps" should be both specifically applicable to the efforts the Offeror identifies and general enough to apply to efforts on which the Government receives information from other sources.

If there is no team arrangement, as defined in paragraph L.1.1.4, then this section does not need to be addressed.

(b) Prime contractor shall provide a list of all subcontractors, description and percentage of effort to be performed.

L.4.3 SECTION 2, PAST AND PRESENT PERFORMANCE INFORMATION (Attachment Form L-1)

The offeror shall provide a maximum of five (5) relevant present and past performance references for the prime and a maximum of five (5) relevant present and past performance references for subcontractors. Present and Past Performance Information shall include recent contracts within the past five years that the offeror considers most relevant in demonstrating the offeror’s ability to perform the proposed effort. Include rationale supporting the assertion of relevance. For a description of the characteristics or aspects the Government will consider in determining relevance, see Section M, M.2.2.2, Factor 2: Past Performance. Limited Liability Corporations are allowed to submit a maximum of five relevant present and past performance references for the lead member.

This information is required on the offeror. For each Relevant Present and Past Performance reference, the offeror shall provide a narrative and a Present and Past Performance Information Form (Attachment L-1). Each offeror is requested to submit the narrative and the information shown in Attachment L-1 for each relevant contract fifteen (15) days prior to the date set for receipt of proposals. Also, place a copy of the Present and Past Performance Information Form (Attachment L-1) in your proposal. Failure to submit early proposal information will not result in offeror disqualification.

In addition, offerors shall submit a consent letter authorizing the release of adverse past performance information to the Government, so the offeror can respond to such information. For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the offeror's performance.

L.4.4 SECTION 3, PAST PERFORMANCE QUESTIONNAIRE (Attachment Form L-2)

The offeror shall ask each reference to complete a Present and Past Performance Questionnaire (PPPQ) (Attachment L-2). The responsibility to send out and track the completion of the PPPQs rests solely with the offeror. Completed PPPQs shall be emailed to the Contract Specialist (CS) at michael.d.jackson@dtra.mil. The offeror is responsible for ensuring the receipt of the PPPQs by contacting the CS identified in paragraph L.1.1.1 to confirm receipt. The offeror is responsible for sending Attachment L-2 to references who will subsequently submit information directly to the CS. The questionnaires must be received directly from the offeror’s customer, prime and subcontractors, reference. Any questionnaires received from the offeror will not be considered. The offeror (prime and subcontractor) shall include a list of references with client’s names and agency/company requested to ensure the Contract Specialist will be anticipating responses to L-2 submissions.

L.4.5 Specific Content

Offerors are required to explain what aspects of the contracts are deemed relevant to the proposed effort, and to what aspects of the proposed effort they relate. This may include a discussion of efforts accomplished by the offeror to resolve problems encountered on prior contracts as well as past efforts to identify and manage program risk. Merely having problems does not automatically equate to a little or no confidence rating, since the problems encountered may have been on a more complex program, or an offeror may have subsequently demonstrated the ability to overcome the problems encountered. The offeror is required to clearly demonstrate management actions employed in overcoming problems and the effects of those actions, in terms of improvements achieved or problems rectified. This may allow the offeror to be considered a higher confidence candidate.

L.5.0 VOLUME IV – PRICE PROPOSAL (FACTOR 3)

L.5.1 General

Offerors are to complete Schedule B of the solicitation. A template is included in Section J, Attachment 6 for the offeror to include details of the elements included in the burdened rates. Price analysis will be performed for the firm fixed priced contract line items (CLINS) by comparison of the proposed prices for the basic contract only. In order to determine price reasonableness, and in lieu of price data, Offerors are to provide their fully burdened rates for each labor category to include Secretarial, Clerical, Desktop Publisher/Editor, and Event Coordination and a total amount for travel.

The price proposal should describe the costs associated with your organization satisfying the requirements of this solicitation. The proposal should be prepared simply and economically, providing straightforward, concise delineation of capabilities to satisfactorily perform the contract being sought.
