(b)(4) Product Information: Large Wire Shopping Carts are going to be evaluated by the Technical Evaluation members in accordance with the Government Evaluation Documents (see attachment B). Please note that some specifications are going to be evaluated by product samples, and others will be evaluated based on written documentation submitted, as indicated on the heading of each evaluation worksheet. Below indicates what is expected for each method.

PRODUCT SAMPLE TECHNICAL EVALUATION:

Offerors are required to submit three large wire shopping carts, at no additional cost to the Government, to Defense Commissary Agency, Supply/Equipment Acquisition Division DeCA (LEAE), Attn: Kristine N. Poltrick, 1300 E.

Ave, Fort Lee, VA 23801-1800. These are due by the solicitation closing date, as indicated on page 1 of the solicitation. The Defense Commissary Agency shall not keep these carts. The contractor shall schedule pick up for the samples at no additional cost to the Government 30 days after the solicitation closing date.

PROPOSAL TEHCNICAL EVALUATION:

Offerors shall submit descriptive literature, a matrix, specifications, drawings, cut sheets, or other information that demonstrates that their proposed products meet or exceed ALL the specifications of the Commissary Equipment Description (CED). Additionally, offerors shall include the expected life cycle of the equipment in order to determine the duration for parts support. Be sure your documentation clearly shows which model is included in the proposal. Be sure to explain and/or illustrate how each specification in the CED is met or exceeded, but do not simply copy the CED into your technical proposal.

(b)(6) Price: Provide your best firm fixed price offer for each line item and enter the total price for the maximum quantity for each line item on the price spreadsheet provided as attachment to the solicitation. The price spreadsheet provided at Attachment C should be completed and submitted in both Excel and Adobe format. Price should be no more than two (2) decimal places. (ex $197.63) FOB Destination is required for this award; therefore, please include any shipping costs into your unit price for each item. All Continental United States delivery locations are FOB Destination. All Outside Continental United States (OCONUS) delivery locations (Alaska, Hawaii, Far East, Puerto Rico, and Europe) will require packaging and preparation for overseas shipment, and are considered to be FOB Origin. These shipments will be “door to door” in nature with no cost to the contractor outside the required packaging and preparation for overseas shipment.

(b)(8) System for Award Management: Offerors must update the System for Award Management (SAM) at https://www.acquisition.gov. On-line representations and certifications must be completed at this site. If the offerors has any exceptions to 52.212-3, paragraphs c thru u, that apply specifically to this solicitation then complete the applicable paragraphs (52.212-3 is included in full text in this solicitation) and submit them with your offer to this solicitation. The offeror only needs to complete paragraph (b)(2) of FAR 52.212-3 Alt I and submit with their proposal if in SAM. Per FAR 4.1201(a): Prospective contractors shall complete electronic annual representations and certifications at SAM accessed via https://www.acquisition.gov as a part of required registration (see FAR 4.1102).

By submission of a proposal, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror (refer to clause 52.204-7 System for Award Management (SAM) October 2016).

(b)(10) Past Performance References: Submit at least 5 references; companies that you have conducted business with over the last five years for delivery of products that are similar to those listed in this solicitation.

Offerors should notify references that DeCA will contact them to complete past performance surveys and that they should respond promptly. Include the following information for each reference:

i. Name of Company

ii. Address of Company

iii. Name and Title of Point of Contact

iv. Phone Number/Email Address

v. Type of Contract Agreement

vi. Period of Performance of Contract/Agreement

vii. Annual Dollar Value of Contract/Agreement

Past performance references are due 7 days prior to the closing date of the solicitation.

(c) Period of Acceptance of Offers: The period for acceptance of offers is 90 days. In the event discussions are held, the offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for submission of final proposal revisions.

ADDENDUM 52.212-4

TERMS AND CONDITIONS - COMMERCIAL ITEMS

The following information is added to the respective paragraphs of FAR 52.212-4:

(a) Inspection/Acceptance: Delivery orders will be issued and accessed through the Electronic Document Access (EDA) System http://eda.ogden.disa.mil via https://wawf.eb.mil. Contractors must complete the on-line registration available at the website in order to retrieve documents displayed there.

Delivery is required 30 days after receipt of delivery order. Delivery to commissaries shall be made between the hours of 7:00 am and 3:00 pm local time, Monday through Friday, excluding official Government Holidays. Delivery orders will contain the delivery location and any other necessary delivery instructions. The contractor can find the delivery address and points of contact information for each store at www.commissaries.com

(c) Changes: The government may issue unilateral administrative modifications that do not affect the substantive rights of the parties. Examples of administrative modifications are corrections in the payment office address or changes to the accounting and appropriation data.

Contract modifications will be issued and accessed through EDA.

(g)(1)(v) Shipping: FOB Origin. All Outside Continental United States (OCONUS) delivery locations will require packaging and preparation for overseas shipment. These shipments will be “door to door” in nature with no cost to the contractor outside the required packaging and preparation for overseas shipment. “Door to door” means DeCA will book the container from the Contractors facility “door” (Shipping Location) to DeCA’s “door” (Ultimate Shipping Destination). When DeCA issues Delivery Orders for these door moves, container delivery information will be specified.

(g)(1)(vi) Shipping: FOB Destination. All Continental United States (CONUS) delivery locations are FOB Destination. Box 11 on page one reflects other than FOB Destination, however, all line items are FOB Destination except as noted in (g)(1)(v) and the line items descriptions.

(i) Payment: Funding will be provided on individual delivery orders. Payment will be made by Defense Finance and Accounting Service (DFAS). Contract payments will be processed electronically via EFT through the Defense Finance and Accounting Service (DFAS). Prior to DFAS releasing any contract payment, the contractor must submit a COMBO invoice using Invoicing, Receipt, Acceptance and Property Transfer (iRAPT formerly known as Wide Area Work Flow (WAWF)). A COMBO invoice is used to invoice for supplies or services and enables the vendor to create a separate invoice and receiving report from the same data entry session, eliminating the need to re-key data. After a COMBO invoice is received, a Government representative will acknowledge acceptance and receipt of the service via iRAPT. After all items are properly submitted, the contract payment will be processed via DFAS electronically.

The contractor must access the WAWF Vendor Tools on the DFAS website and complete the requirements to obtain an active WAWF account. This will allow the contractor to submit invoices via WAWF so that payments can be processed electronically through Electronic Funds Transfer.

For additional WAWF information, see clause 252.232-7003 ELECTRONIC SUBMISSION OF

PAYMENT REQUESTS AND RECEIVING REPORTS (MAR 2008).

Clause FAR 52.213-1, FAST PAYMENT PROCEDURE (MAY 2006), applies only to shipments destined for locations outside the continental U.S.

(End of Clause)

ADDENDUM 52.212-2

EVALUATION – COMMERCIAL ITEMS

The following information is added to the respective paragraphs of FAR 52.212-2:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, is the Lowest Price Technically Acceptable (LPTA) offer to the Government. Only one award is possible.

The LPTA process is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. The LPTA process does not permit tradeoffs between price and non-price factors (FAR 15.101-2).

The following factors shall be used to evaluate offers:

Factor 1 – Technical Acceptability of Product Factor 2 – Past Performance Sub-Factor 1: Timeliness Sub-Factor 2: Quality of Product Sub-Factor 3: Business Relations Factor 3 – Price The offeror will be determined acceptable if their proposed product receives an acceptable rating for each aforementioned Factor.

The large wire shopping cart will be determined technically acceptable if all specifications outlined in CED 2E02-B are met. Technical acceptability will be based on evaluating a combination of proposal submissions and product samples, as indicated in Attachment B Government Evaluation Documents. There is one evaluation sheet for each method being used. The contractor will be required to deliver three product samples to be used as part of the technical evaluation.

Past performance will be based on data collected from past performance surveys received from the offeror’s customers rating the offeror on timeliness, quality of service, and business relations. All Government sources of information will be gathered through Past Performance Retrieval System (PPIRS) and Contractor Performance Assessment Reporting System (CPARS), as applicable.

Price will be evaluated based on other prices received, historical data, market research and/or the government estimate. A price will be calculated for the base year and all option years combined and will be used as the total evaluated price and the estimated award amount.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The government reserves the right to issue an award without discussions.
