The following information is added to the respective paragraphs of FAR 52.212-4:
1. Delivery Orders:
(a) Offerors awarded a contract resulting from this solicitation will be given an opportunity to provide a proposal on individual projects to furnish and install shelving as the requiremnts are identified during the duration of the performance period, unless the contractor requests consideration for only certain areas. In addition, awardees need not be given an opportunity to be considered for a particular order if the contracting officer determines that:
(1) The agency need for such services is of such urgency that providing such opportunity would result in unacceptable delays;
(2) It is necessary to place an order to satisfy a minimum guarantee.
(b) Offerors are not required to submit a price for every project; however, negative responses are required.
(c) A statement of work and layout plan will be provided with every request for proposal. It will contain the performance date, time, and other necessary information,as well as the criteria that will be used to evaluate proposals and determine the successful offeror. The standard performance period for de-installation of old shelving and the installation of new shelving is 12 hours. Occasionally an extended time period is granted IAW the statement of work for the larger stores. The contractor's price must include all related costs associated with the performance of the project to furnish and install shelving.
The request for proposal will include the Department of Labor wage determination applicable to the project.
(d) Evaluation for award of each delivery order will be Lowest Price Technically Acceptable (LPTA).
Award will be based on price, past performance and tecnical acceptability.
(e) Delivey orders will be issued and accessed through the Electronic Document Access System (EDA) at http://eda.ogden.disa.mil. Delivery orders will be placed in accordance with FAR 16.505(a)(7). Delivery Orders will be competed as appropriate and the successful award will reflect all costs associated with the resets; including providing the shelving, delivery, and installation.
(f) Evaluation of shelving project performance.
(1) Each delivery order to furnish and install shelving will contain a performance evaluation to be completed by the DeCA HQ reset coordinator after the completion of the installation. The performance evaluation will contain a rating of the following elements of the service performance: Quality of Products, Timeliness/Schedule, and Business Relations. Past performance will be rated acceptable or unacceptable.
(2) The information contained in these evaluations will be used to create a past performance data base for consideration in awarding future delivery orders. If a contractor's recent performance differs significantly from the information in the past performance database, the Government reserves the right to use the more current information for future awards. Some situtations that may impact future awards include, but are not limited to, cancelled resets due to the contrator's inability to perform, adverse reports of performance, trends in performance such as lateness, and/or inability to complete projects on time.
(g) The Government reserves the right to obtain services elsewhere if none of the contractos are available for performance at a reasonable price.
2. Guarantees: The minimum value the Government guarantees will be purchased under each multiple award contract awarded as a result of this solicitation is $1,000.00. The minimum value stated applies to the entire contract period, base plus exercised option periods combined. The maximum value for all orders issued against the contract is $3,000,000.00, base plus option years. The quantity stated within the CLIN for the base and option years is the maximum number of orders that will be issued for all contracts for one year. That maximum quantity can only be changed by contract modification. If the option year(s) is not exercised, the Government will not guarantee any minimum purchase for that period.
3. Wage Determinations: Award(s) will be covered by the Services Contract Act (SCA) of 1965 as amended.

(c) Equal Employment Opportunity is the Law (OFCCP 1420)
6. Administrative Modifications: The Government may issue unilateral written modifications that do not affect the substansive rights of the parties. Examples of administrative modifications are corrections in the payment office address or changes to the accounting or appropriation data.
7. Payment Procedures:
(a) Funding will be provided on individual delivery orders. Payment will be made by Defense Finance and Accounting Service (DFAS). Contract payments will be processed electronically via Electronic Funds Transfer (EFT) through DFAS. Prior to DFAS releasing any contract payment, the contractor must submit an invoice COMBO using Wide Area Workflow (WAWF) electronic commerce. An invoice COMBO is used to invoice for supplies or services and enables the vendor to create a separate invoice and receiving report from the same data entry session, eliminating the need to re-key data. After an invoice combo is received, a Governent representative will acknowledge acceptance and receipt of the service via WAWF. After all items are properly submitted, the contract payment will be processed via DFAS electronically.
(b) The contractor must access the WAWF vendor tools on the DFAS website and complete the requirements to obtain an active WAWF account. This will allow the contractor to submit invoices via WAWF so that payments can be processed electronically through EFT.

ADDENDUM TO 52.212-2
FAR 52.212-2
Evaluation Commercial Items
Evaluation Factors & Methodology
(a) The Government will award a maximum of three indefinite delivery indefinite quantity contracts resulting from this solicitation to the responsible offerors whose offers conforming to the solicitation will be most advantageous to the Government, price and other factors considered. This requirement shall be evaluated using the Lowest Price Technically Acceptable (LPTA) evaluation criteria. The LPTA process is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. The Government will only award one contract per brand of manufacturer. The following factors will be used to evaluate offers:
1. Technical
2. Experience and Technical Capability
3. Sample Project
4. Past Performance
(a) Timeliness
(b) Quality of Products
(c) Business Relations
5. Price
Technical:
Technical factors and sub-factors that match the specific evaluation criteria for the RFP and assess whether the offeror’s proposal will satisfy the Government’s minimum requirements. Offeror(s) will be determined to be technically acceptable if their proposed product complies with the commissary equipment description (CED).
Technical Acceptable / Unacceptable Ratings All factors and sub-factors must receive an “acceptable” rating in order to be considered for award
Rating Description Acceptable Proposal meets the requirements of the solicitation Unacceptable Proposal does not meet the requirements of the solicitation
Experience and Technical Capability:
1. Company. Provide background information on your company, such as the following
Corporate headquarters location Production facility location o Production operation hours o Any time periods during the year that production is shut down o Production capacity of the facility(ies)
Commercial retail operations with whom you have contracts to furnish and install shelving, and time frames of those contracts o How does your company handle project management of the projects?
o How does your company handle transport of the shelving to the job location
If by contracted carrier, describe your relationship with the carrier; ie, number of years you have been doing business, number of carriers you use, etc.
o Describe the procedures your company uses to accept return of excess shelving.
Describe in detail the practices your company uses to handle installation, i.e., through its own employees or a subcontractor.
o If subcontractor, describe your relationship with the subcontractor(s), i.e., number of years you have worked with them, type of projects completed, etc.
Describe either your company’s current practices or potential capabilities to provide tags on shelving equipment which would allow store personnel to easily identify the shelving manufacturer after installation.
2. Personnel. Provide detailed information on the key personnel who will be responsible to handle the administration of this contract, including
Personnel who may prepare project estimates, including the bill of materials, installation labor, and delivery; project management; and contract management. Describe their qualifications, experience, and provide a listing or description of key projects they have managed.
Describe the corporate structure that your company uses to complete shelving projects.
3. Contingencies. Describe in detail the resources that your company has, or procedures that would be used to handle contingencies that would occur during a shelving installation, such as shorted product, labor shortages, or other issues that could occur to jeopardize completion of the project on time.
Offeror(s) will be determined to be acceptable if they provide adequate information describing their company and how they will perform work on projects.
Sample Project:
The sample project will be used to evaluate an offeror(s) understanding of the requirement, and their ability to offer a fair and reasonable price to complete the project. Offeror(s) that receive contract awards will compete for actual individual shelving installations as each requirement is identified. Offeror(s) will be determined to be acceptable if they show that they understand the requirement and demonstrate a successful plan for the sample project.
Past Performance:
The past performance evaluation is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements.
The evaluation of past performance will be an assessment based on a consideration of all relevant facts and circumstances. It will not be based on absolute standards of acceptable performance, but an offeror's overall past performance. The Government is seeking to determine whether the offeror has consistently demonstrated a genuine concern for customer satisfaction, and timely delivery of goods. This determination is a matter of judgement. Past performance will also be assessed on delivery orders for future delivery orders.
Past performance shall be used as an evaluation factor, unless waived by the PCO in accordance with FAR 15.304(c)(3)(iii). It shall be evaluated in accordance with FAR 15.305 and DFARS 215.305. However, the comparative assessment in FAR 15.305(a)(2)(i) does not apply. Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table C-2.
Past performance should be initially evaluated to determine whether the offeror’s present/past performance is recent, and relevant or not relevant to the effort to be acquired. The solicitation shall establish the criteria for recency and relevancy in relation to the specific requirement being procured. In establishing what is relevant for the acquisition, consideration should be given to what aspects of an offeror’s contract performance history would give the most confidence that the offeror will satisfy the requirements of the contract that is contemplated to be awarded as a result of the evaluation of proposals in the current procurement.
Second, the past performance evaluation should determine how well the offeror performed on the prior contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305
(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
Past Performance Acceptable / Unacceptable Ratings Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note above)
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
Price:
Total evaluated price will be determined by applying each offeror’s unit price to the estimated quantity and totaling the CLIN. There will be a 10% increase for all subsequent option year CLINS based on the offeror(s) price to estimate total contract value. Base and option periods prices are estimated. Delivery Orders will be competed as appropriate and the successful award will reflect all costs associated with the resets; including providing the shelving, delivery, and installation.
