4. Concerning Clin Item #0004. There is no possible way for any of the Bidders to provide a cost for unforeseen repairs to the existing Commissary equipment and even if we do place a value on the Clin Line item there will be a possibility that the true value of the work could be much more in terms of time and costs. If the bidders place a dollar value for this unforeseen repair of the equipment and the cost for the work goes above the stated amount will the owner reimburse the awarded Bidder for the difference?
Answer: CLIN 0004 will be a not-to-exceed amount of $10,000.00. Once awarded, any amount not used will be de-obligated from the CLIN at contract closeout. Any overage in excess of the $10,000.00 must be reviewed and approved by DeCA. If approved, a modification will be made to the contract for the overage amount.
5. Concerning Clin Item #0004. The not to exceed amount is to be $10,000 per the description in the Clin. Can the owner instruct all bidders as to the amount we are to provide in this line item? After completion of construction, the Bidder could return the dollars not used to the Owner or be reimbursed for the overage that was used in the case that the value exceeds the stated amount. Another possibility is that this Clin could be removed all together. Please clarify.

57. Back in January 2014 we did the unit selection & were basis of design for DHU-1 & 2 a CU-1 & 2 on drawing M-601 dated 1-27-14. However, the current M-601 schedule dated 11-21-14 has Munters units selected for units AHU-1 & 2 and CU-1 & 2. Since the performance is similar, we would like to find out if the dual path unit designs from Jan 2014 are still valid or are there new design parameters particular to the Munters units. I tried to run the Munters model number thru their website & it did not recognize it.
If we are not basis of design we would still like the opportunity to bid the project but we need to know exactly what specs to design the equipment to. Your help in this matter would be greatly appreciated.
Answer: Equipment provided should meet or exceed all performance requirements listed in the schedules and specifications.
