About this file

This Justification and Approval (J&A) document is for a sole source contract awarded to Warrior Service Company LLC, a Service-Disabled Veteran-Owned Small Business (SDVOSB). The Department of Veterans Affairs, Network Contracting Office (NCO) 2 intends to award a one-year Firm Fixed Price (FFP) Indefinite Delivery/Indefinite Quantity (IDIQ) contract valued at $3,249,542.00 for Durable Medical Equipment (DME) delivery and set up services. The contract will cover Veteran patients in the Hudson Valley, Bronx, New Jersey, New York Harbor, Northport, and their entire catchment area, with a performance period from December 14, 2025, through June 15, 2027.

The sole source justification is based on Warrior Service Company LLC's proven track record of providing these services and the impracticality of competing a short-term contract. The current contract expires on December 14, 2025, and a new long-term VA Northeast Consortium (VANEC) contract is being processed. The services include transportation, set up, installation, labor, supervision, patient education, safety management, and infection control for DME, required 24/7 including holidays. The NAICS code for this procurement is 621610, and the contract will serve as an interim solution until a new long-term contract can be awarded.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition

Acquisition Plan Action ID:36C242-26-AP-1099

1. Contracting Activity:

2.

Department of Veterans Affairs, New York/New Jersey Healthcare System, Veterans Integrated Services Network (VISN) 2 Downstate, James J. Peters Veterans Affairs Medical Center 130 West Kingsbridge Road, Bronx, NY 10468

3. Nature and/or Description of the Action Being Approved:

This requirement is funded via a 1358.

Network Contracting Office (NCO) 2 intends to award a sole source contract for Durable Medical Equipment (DME) delivery and set up services to Warrior Service Company LLC, a SDVOSB, for the procurement of Durable Medical Equipment delivery and set up services for Veteran patients located in the Hudson Valley, Bronx, New Jersey, New York Harbor, Northport and their entire catchment area (including outpatient clinics). The proposed sole source contract is for a one-year Firm Fixed Price (FFP) Indefinite Delivery/Indefinite Quantity (IDIQ) contract with an optional 6-month extension. The performance period is December 14, 2025 through June 15, 2027. The total estimated value of this procurement is $3,249,542.00. This award will serve as an interim contract action until a new, long-term contract can be awarded.

The services and supplies are currently being provided by Warrior Service Company LLC via contract 36C24220D0092. The current Firm Fixed Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) contract will expire on December 14, 2025.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

Warrior Service Company LLC will provide Durable Medical Equipment delivery, set up, installation, and associated services to Veteran beneficiaries. The requirement is for all materials, transportation of equipment, set up, labor, supervision, patient education, safety management, and infection control as necessary for patients receiving prescribed DME as outlined in the Performance Work Statement (PWS). These supplies and services are required twenty-four (24) hours per day and seven (7) days per week including holidays.

The NAICS code for this procurement is 621610, PSC code N065.

4. Statutory Authority Permitting Other than Full and Open Competition:

41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.103-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR 819.7009 (DEVIATION)- up to $5,000,000. Check the specific VAAR clause used below:

( X ) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a certified veteran-owned small business

5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Warrior Service Company LLC has a proven track record of providing these services to the Hudson Valley, Bronx, New Jersey, New York Harbor, and Northport VA Medical Centers and their entire catchment area (including outpatient clinics) throughout the lifecycle of the current contract in place which expires December 14, 2025. It will take approximately six (6) to nine (9) more months to continue to process and ultimately award the new VA Northeast Consortium (VANEC) contract

Due to the high startup costs and lengthy transition period required for another vendor to assume the supply and services, it is unrealistic to acquire these supplies and services from another vendor for this short period of time.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.201 and, if not, which exception under FAR 5.101(b) applies:

Due to the need to have a new, short-term contract in place at the time of expiration of the existing contract, additional sources were not sought out for this requirement. The current contract was awarded to Warrior Service Company LLC at a fair and reasonable price.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The Contracting Officer will determine fair and reasonableness of the proposed prices through a comparison of those prices to the Independent Government Estimate (IGE) and market research. Existing prices under the current contract with Warrior Service Company LLC were determined fair and reasonable prior to award and it is expected that pricing would remain the same or similar, however, the Contracting Officer will not award a contract without a determination of fair and reasonable pricing being completed.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

A sources sought was not posted for this requirement.

SBA was searched for NAICS code 621610 and yielded 7,159 results. It was also searched for NAICS code 621610 and key word “Installation” and yielded 2 results.

SBA SDVOSB Search was searched for NAICS code 621610 and yielded 552 results. It was also searched for NAICS code 621610 and key word “Installation” and yielded 1 result. It was also searched for “Warrior Services Company” and it is a verified SDVOSB.

FPDS was searched for “Medical Equipment Installation” and yielded multiple results which helps to establish the NAICS code and will help determine price reasonableness.

GSA was searched for keyword “Medical Equipment Installation” and there were no relevant results.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

None. The current contract with Warrior Service Company LLC will expire on December 14, 2025.

This short-term procurement is required to provide uninterrupted DME delivery and set up services until a long-term contract is awarded. It would be impossible to compete a short-term requirement and would not be practical for a new contractor to begin providing these services in such a short amount of time given the transition activities that would need to occur.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

None

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

Competition was not sought because Warrior Service Company LLC is currently providing these same services on a contract that expires December 14, 2025. At this time, the current contract expiration date does not allow for adequate time to solicit for and evaluate offers. The current effort in place to award the new VANEC DME delivery and set up services contract will ensure competition is sought after to the maximum extent possible.

12. Requirements Certification:

I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
