JUSTIFICATION FOR OTHER THAN FULL AND

OPEN COMPETITION (OTFAOC)

Federal Acquisition Regulation (FAR) Part 6 Justification & Approval (J&A), Supporting

Procurements under FAR Part 12, FAR Subpart 13.5, and FAR Part 15

Purchase Request Number: HC101318QA711 Contract Number: TBD

Task/Delivery Order Number: NA

Procurement Title: TELECOM ACQUISITION OF 2.5GB ETHERNET

Estimated Value: $66,000.00 Statutory Authority: FAR Subpart 6.302-1- 10 U.S.C. 2304(c)(1)

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (OTFAOC)

Justification for OTFAOC Number: NA

Upon the basis of the following justification, I, as Contracting Officer, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of FAR Subpart 6.302-1.

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

DEFENSE INFORMATION SYSTEMS AGENCY (DISA);

DEFENSE INFORMATION TECHNOLOGY CONTRACTING ORGANIZATION

(DITCO)

2. NATURE/DESCRIPTION OF ACTION(S):

The nature of this action is to issue a Contract Service Authorization (CSA) with Period of

Performance not to exceed 12 months. The new CSA is needed to avoid break in service until the fully competed service is installed, tested and accepted by the Mission Partner. FY19 O&M funding will be used.

3. DESCRIPTION OF SUPPLIES/SERVICES:

The service covered under this action (HC101318QA711) is to provide a temporary 2.5GB Ethernet service.

The estimated cost of support for the NTE twelve month POP is $66,000.00

4. IDENTIFICATION OF STATUTORY AUTHORITY:

(a) Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C.2304(c) (1). (FAR 6.302-1/DFARS 206.302-1);

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:

Cavalier/Windstream (CTLL) is unique in that it is the only contractor able to perform the service and continue to execute the service without the Government assuming an unacceptable level of risk of having the service interrupted and jeopardizing the Government’s mission.

CTLL is currently performing the service, and no other contractor can take over the technical requirements and provide continuity of services. Additionally, CTLL keeps 24/7 surveillance of this circuit to avoid service interruption and to restore at a moment’s notice.

(a) Description of events.

- CTLL is currently providing the service. CTLL maintains 24/7 surveillance of this circuit and it is capable to keep the circuit working and to restore the service at a moment’s notice.

- DITCO PL8211/IQO has determined that a temporary order (sole source) CTLL will ensure continuity of services to avoid disruption of this critical service.

- The process to compete this service will start immediately. A combined synopses & solicitation will be posted to FedBizOpps and the acquisition strategy would be Full &

Open Competition.

- This J&A will support temporary order to CTLL for a not to exceed period of 12 months. This temporary order will be discontinued once a new contract for these services is competed, awarded and installed.

(b) Justification.

(1) Minimum Government requirements.

The minimum Government requirements are to provide, install, and maintain a

2.5GB WAVE SERVICE BETWEEN BLDG 182, ROOM 125, 4850 LEIGH AVENUE,

FORT SMITH, AR., AND BLDG 3900, ROOM 147, 8705 INDUSTRIAL BLVD,

TINKER AFB, OK.

(2) Proposed sole source contractor.

CTLL is the current contractor providing the service.

Discussion regarding cause of the sole source situation.

There is a critical need to continue to provide the services until the permanent solution is competed, awarded and installed.

(3) Demonstration of unique source

CTLL is a unique source because it is the current subcontractor with the technical capabilities to provide continuity of services or restore the service immediately. No other source can provide or restore the service immediately or within 24 hours.

(4) Procurement discussion.

The only adequate source at this time is CTLL as this contractor is in the unique position to provide the service being the current provider

6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES

The original solicitation was properly synopsized and posted to FedBizOpps for 30 days and competition was achieved. Based on Market Research Report (MRR) there is a reasonable expectation that once the new requirement is posted in FedBizOpps

(FBO) two or more responses will be received.

7. DETERMINATION OF FAIR AND REASONABLE COST:

The Government performed an evaluation of the offeror’s proposed prices to ensure it was fair and reasonable. A determination was made by the contracting officer that the quoted price represents the best value to the Government, as defined in FAR 2.101 and results in the lowest overall cost alternative (considering price, critical need, and administrative costs) to meet the Government's needs. The contracting officer also determined the pricing information valid for comparative purposes. Certified cost and price data are not required for this commercial item acquisition in accordance with FAR

15.403-1(b) (3). The contracting officer has determined the price is fair and reasonable, based on one or more of the following:

a. Comparison of the proposed prices to historical and existing prices paid, whether by the Government or other than the Government for the same or similar items.

b. Comparison of the proposed prices with competitive published price lists or published market prices of the similar commodities.

c. Comparison of proposed prices with the Independent Government Cost Estimate.

8. MARKET RESEARCH:

A Market Research Report was conducted when the original CSA was awarded. A new MRR will be conducted when permanent solution(s) is competed.

9. ANY OTHER SUPPORTING FACTS

See Contract file for CSA VETS000058EBM

10. LISTING OF INTERESTED SOURCES:

CTLL was the only source contacted, no other sources was contacted. There is a critical need for continuous service; therefore, the only source contacted was CTLL as it is already providing the service.

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

DITCO IQO will compete the requirement within 30 days.

(a) Procurement History.

The current CSA VETS000058EBM was issued to VETS for a period of performance of

36 months. CTLL is the subcontractor of record; therefore, it is currently providing the

2.5GB service.
