SOLICITATION/CONTRACT FORM

The required response date/time has changed from 16-Dec-2022 12:00 PM to 22-Dec-2022 12:00 PM.

The following have been added by full text:

ENCLOSURE 3 Q&AS

Solicitation H9821022R0022 Questions and Answers

9 December 2022

PWS 1 INTRODUCTION

1.1 The DPFSO within the Defense Service Support Center Directorate requires a comprehensive fulfillment and fully integrated advertising and marketing service to support the Computer/Electronics Accommodations Program (CAP); Employer Support of the Guard and Reserve (ESGR); Federal Voting Assistance Program (FVAP); and the Military to Civilian Transition Office’s (MCTO) which includes Yellow Ribbon Reintegration Program (YRRP).

Q1: Does the government expect to increase the number of supported directorates during the contract periods of performance?

Q1. GOVT RESPONSE:

The quantity of known directorates are as stated.

PWS 4 REQUIREMENTS

4.1.3.1 Maintain adequate warehouse square footage dedicated to supply, warehousing, and inventory management of PIL product items.

Q2: What is the approximate warehouse square footage required for storage of PIL items and trade show displays?

Q2. GOVT RESPONSE:

The required warehouse space should be commensurate for storage of the stated PIL inventory levels.

4.7. The contractor must support all 54 State/Territory ESGR Committees with one distribution area in each State/ Territory with the exceptions of California, New York and Texas, which will have two distribution areas.

Q3: Will the distribution of Patriot Awards need to be segmented within any given state(s)? If yes, please specify the requirements.

Q3. GOVT RESPONSE:

The COR will provide a list of designated ESGR Representatives to receive the Patriot Awards, which may be segmented by zip code.

4.7.2 Provide up to eight additional tailored awards requiring the direction and approval of the government; design, create and provide certificates and awards, as well as padded padfolio, for

DPFSO.

Q4: Will any of the potential “eight additional tailored awards” require any form of automation or integration with a government system?

Q4. GOVT RESPONSE:

No automation or integration with a government system will be required for the “up to eight additional tailored awards.” These are expected to be one time limited production.

Q5: Will any of the potential “eight additional tailored awards” require production at scale such as the Patriot Awards (PWS 4.7)?

Q5. GOVT RESPONSE:

These are expected to be one time limited production.

PWS 7 CONTRACTOR TRAVEL

7.1 Occasional travel is required. All travel shall be approved in advance by the COR or CO.

Contractor travel reimbursement claims shall include applicable documentation to support actual costs incurred (e.g. airfare and hotel/lodging receipts). No fee or G&A shall be applied to travel costs; only actual costs will be reimbursed. Failure to provide appropriate documentation may result in a loss of reimbursement of travel expenses. (pg. 22)

Q6: Will the government set an NTE price for travel, or should it be estimated and included in CLIN 0004.

Q6. GOVT RESPONSE:

Yes, the government will establish a NTE for the travel CLINs. Offerors should not proposed a price under CLINs X004.

PWS 8 SECURITY

8.2 - Cybersecurity requirements apply to all contractor that have Information Technology (IT) systems or applications that receives, processes, ordering systems, displays, or transmits DoD information. Contractor will ensure IT systems or application will be acquired, configured, operated, maintained, and disposed of consistent with applicable DoD cybersecurity policies, standards, and architectures.

Q7. If the government’s required security and functional requirements change over the performance period. Will the offeror be permitted to submit a request for contract modification to account for any increased LOE and cost?

Q7. GOVT RESPONSE:

The Government does not anticipate cybersecurity policy, standard, or architecture changes that will significantly impact the performance of these requirements.

8.3 - All Cybersecurity designated positions shall be Non-Sensitive positions for UNCLASSIFIED IT Level I access, as determined by the Government per position responsibilities. The contractor shall assure that individuals assigned to the positions of this contract, as determined by the Government, have completed the designated Tier BI or equivalent according to the Defense Counterintelligence and Security Agency (DCSA) and The Office of Personnel Management (OPM) investigative alignment.

Q8: When will the government determine the contract positions as IT Level II or Level I?

Q8. GOVT RESPONSE:

PWS Section 8.3 revised to clarify intent.

Q9: Does the IT level designation apply to ALL contractor personnel assigned to the contract or only personnel assigned to Cybersecurity roles per DoD 8570.01- M.

Q9. GOVT RESPONSE:

IT level designation apply only to personnel assigned to Cybersecurity roles per DoD 8570.01-M.

8.3.8 - Contractor personnel with Tier background investigation who are assigned to perform work under this contract shall be suitable to obtain a DoD Credential, also known as the Common Access Card (CAC).

Q10: Do all contractor personnel require a CAC, or is this requirement limited to persons with access to DoD information systems?

Q10. GOVT RESPONSE:

Common Access Cards will be limited to personnel requiring access to DoD information systems.

8.5.1 The Contractor shall allow access only to those employees who need the sensitive information to perform services under this contract and agrees that sensitive information shall be used solely for the purpose of performing services under this contract. The Contractor shall ensure that its employees will not discuss, divulge or disclose any such sensitive information to any person or entity except those persons within the Contractor’s organization directly concerned with the performance of the contract.

Q11: Will the government identify the “Sensitive Information” before sharing the information with the contractor (e.g., markings)?

Q.11. GOVT RESPONSE:

Yes, the Government will appropriately mark all “Sensitive Information” prior to dissemination to the contractor.

Q12: Does a contractor-defined Non-Disclosure Agreement (NDA) meet the intent of this requirement, or will contractor personnel be expected to complete a DoD-issued NDA (e.g., SF312 or similar)?

Q12. GOVT RESPONSE:

A contractor-defined Non-Disclosure Agreement (NDA) will meet the intent of this requirement.

8.6 Position of Trust Requirements. The Defense Counterintelligence and Security Agency (DCSA) and The Office of Personnel Management (OPM) offers Tier background investigations (BI), Tier-1 (T1), Tier-2 (T2), Tier-3 (T3), Tier-4 (T4), and Tier-5 (T5) for Position of Trust (POT) determination. The T5 being the most stringent investigation and T1 being the least stringent.

The Government is responsible for the cost of POT or sponsor a DoD-determined equivalent background check for UNCLASSIFIED access. A BI equivalency will be according to the investigative alignments offered by the Office of Personnel Management and the Defense Counterintelligence and Security Agency (DCSA) here, https://www.dcsa.mil/Portals/91/Documents/pv/GovHRSec/Position_Designation_Investigation_ Type_Chart_Sept_2017.pdf

Q13: Please clarify the Position of Trust tier background investigations as they conflict with the referenced “Position Designation Investigation Type Chart” in the URL. The PWS refers to a T5 BI as a Position of Trust BI; however, the chart comports to an NSS background investigation which utilizes the SF86 vs. the SF85 for POT.

Q13. GOVT RESPONSE:

The NSS designation for this requirement is Non-Sensitive with a T1 BI.

8.12.3 At a minimum, all Contractor personnel must obtain/maintain a favorable Tier 1 or equivalent BI. This requirement is critical in order to access the database systems within DHRA and its Directorates. The DHRA-DEOC Security Office or COR will notify the Contractor if security requirements change.

Q14. Please clarify if T3 or T1 is the expected minimum. This PWS appears to conflict with PWS 8.8.4, which states, “Tier 1 for Non-Sensitive – Low Risk: All https://www.dcsa.mil/Portals/91/Documents/pv/GovHRSec/Position_Designation_Investigation_Type_Chart_Sept_2017.pdf https://www.dcsa.mil/Portals/91/Documents/pv/GovHRSec/Position_Designation_Investigation_Type_Chart_Sept_2017.pdf

Personnel whose access to military PII is limited to data entry or singular search capability require, a minimum, a favorably adjudicated Tier-1 (T1) BI.”

Q14. GOVT RESPONSE:

T1 BI is the requirement for this PWS.

8.15 Controlled Unclassified Information Requirements for DoD Contractors.

Q15: Is the expectation for the contractor to be the originator of the CUI and therefore be responsible for the markings, or is the expectation that the contractor will maintain markings wherein the DoD serves as the originator and has affixed the required markings? The underlying assumption in DoDI 5200.48, Controlled Unclassified Information, is that the government is the originator of the CUI and is responsible for markings.

Q15. GOVT RESPONSE:

There is a shared responsibility in the identification, creation, sharing, marking, safeguarding, storage, dissemination, decontrol, disposition, destruction, and records management of CUI documents and materials. CUI shared from the Government or generated, managed, or transmitted by the contractor shall be in accordance with Part 2002 or Title 32, CFR, as incorporated into the contract.

8.27.5 Continuous Monitoring: The contractor will use continuous monitoring capability and expertise to use and operate the government-directed cyber tools such as Endpoint Security Solutions (ESS), Tanium Assured Compliance Assessment Solution (ACAS), Splunk, and DoD/DHRA/DMDC mandated technology for application management security and compliance tools. In addition to continuous monitoring, the contractor will remediate findings that result from the various scans. Timelines noted in above section. (emphasis added)

Q16: Will the government fund the licensing cost for these applications?

Q16. GOVT RESPONSE:

ACAS will be provided by C5ISR CSSP for vendor use.

Q17: If a given cyber tool cannot be deployed on a commercial cloud environment (e.g., AWS GovCloud, MS GovCloud, etc.) due to technical limitations, will the government permit and fund an agreed-upon alternative solution?

Q17. GOVT RESPONSE:

ACAS will be provided by C5ISR CSSP for vendor use.

8.27.8 Contractor will adhere to DMDC coding standards.

Q18: Please provide a reference to the actual DMDC coding standards.

Q18. GOVT RESPONSE:

References on code scanning:

https://dhra.deps.mil/sites/DMDC_intserv/cyber/Policy/CSD-POL-04.pdf

The CSD-POL-04 Application Hardening Policy calls for:

Applications that have no open vulnerability are still mandated to scan after every security scanner upgrade. Upgrade includes security Rule Packs, STIG or any upgrade that the Cybersecurity Division determines can potentially identify any new or zero day finding.

Sonatype gets updated monthly and Fortify quarterly.

https://dhra.deps.mil/sites/DMDC_intserv/cyber/Policy/DMDC-CHO-3.pdf DMDC-CHO-3 states the following:

All application production release approvals must follow an approved POA&M;

They can't approve to production if they have not scanned their application and submitted a PoA&M to Cyber for approval. They can only deploy to production once Cyber has approved their POA&M.

Applications that are not managed or hardened according to Reference DMDC's memos and CSD-POL-04 will be brought to the Directorate Director level for action requiring potential decommissioning and removal from the network.

8.30 Cybersecurity: Applications/Software Applications Development: Support cybersecurity within the software development process and ensure all development practices follow the rules, regulations and best practices identified in DoD 8500.1, NIST SP800-53r4, DISA STIGs & SRGs and DMDC Information Management Operating Procedures.

Q19: Will the government agree to a limited licensing agreement to protect the offeror's intellectual property and proprietary rights consistent with FAR 12.212 Computer Software (https://www.acquisition.gov/far/12.212) for its commercial software used during the performance of the contract?

Q19. GOVT RESPONSE:

The Government will accept the standard commercial software license agreements, customarily offered to the public, unless the license agreements are inconsistent with federal law

16 MANDATORY TRAINING REQUIREMENTS FOR CONTRACTORS

16.4 To the extent that the Contractor must provide images, text, or other government property to third-party manufacturing or production any subcontractor or provider, the Contractor shall require the third-party to abide by the same restrictions and limitations required herein.

https://dhra.deps.mil/sites/DMDC_intserv/cyber/Policy/CSD-POL-04.pdf https://dhra.deps.mil/sites/DMDC_intserv/cyber/Policy/DMDC-CHO-3.pdf https://www.acquisition.gov/far/12.212

Q20: Please identify the specific “restrictions and limitations” that the offeror’s “subcontractor or provider” and vendors must comply with.

Q20. GOVT RESPONSE:

The contractor shall flow down limitations and restrictions on images, text, or government property to third-party manufacturing or production, or any subcontractor or provider selected by the prime contractor.

Q21: Is this requirement specific to 16.2, mandatory training? If yes, as written it could extend to hundreds of personnel at an offeror's subcontractor, provider, or vendor to include front-line press operators, shop floor personnel, and conceivably any of their staff who may interact with the production of items defined in the PIL. Additionally, it will require the offeror to enter into a multitude of third-party agreements and consume no less than 8 hours per individual for each subcontractor, provider, and vendor employee to comply. The net effect will be increased product, production, and administrative cost to the offeror and, thereby, the government.

Q21. GOVT RESPONSE:

The mandatory training is applicable to the positions designated as Cybersecurity positions.

ADDENDUM TO FAR 52.212-2

EVALUATION OF OFFERS

1.0. INTRODUCTION.

1.1. The Government will evaluate all proposals in accordance with the factors and criteria established in the

Request for Proposal (RFP). The criteria provide the basis upon which each evaluation will be based, are established before receipt of the proposals, and are intended to ensure that the evaluation will be a structured process employing equitable measures. Proposals will be evaluated and a contract awarded under the Best

Value Continuum, using the Tradeoff approach, to the responsible Offeror whose offer is considered the most advantageous to the Government, price and other factors considered.

1.2. The Government intends to evaluate proposals and make award without discussions. The Government reserves the right to conduct discussions if the Contracting Officer later determines discussions to be necessary.

1.3 Offerors are cautioned that “parroting” of the PWS with a statement of intent to perform does not reflect understanding of the requirement or capability to perform. Typographical errors are indicative of a lack of attention to detail and may result in a weakness noted against the proposal.

1.4. Pass/Fail Factors will not be used.

2.0. EVALUATION FACTORS

2.1. Factor 1 Technical. Offerors will be rated at the factor level for Factor I Technical. Technical will be assigned one overall Technical Rating in accordance with the Table at 5.1 below.

2.1.1. The purpose of the technical factor is to assess the offeror’s proposed approach, as detailed in its proposal, to satisfy the Government’s requirements.

2.1.2. Risk assesses the degree to which the offeror’s proposed technical approach for the requirements of the solicitation may cause disruption of schedule, increased costs, degradation of performance, the need for increased Government oversight, or the likelihood of unsuccessful contract performance. Risk will be assessed as one aspect of the technical factor rating.

2.1.3. Any proposal receiving a rating of “Marginal” or “Unacceptable” is deemed to have a risk that is so high that award cannot be made against the proposal and the proposal will not be further evaluated and is ineligible for award.

2.2. Factor 2 Past Performance.

2.2.1. The Past Performance Evaluation is an assessment of the offeror’s probability of meeting the solicitation requirements, based on past performance as a prime contractor. The Performance

Confidence Assessment rating is assessed as an overall factor after evaluating aspects of the offeror’s past performance, focusing on performance that is relevant to the requirements and cost or price.

2.2.2. Recency refers to the state or quality of being current (within the last four years). The more recent the contract, the greater the likelihood that the offeror has the capacity to perform in a like manner.

Information regarding contract performance that is recent and has a logical connection with the matter under consideration indicates relevancy.

2.2.3. Relevancy refers to information that has a logical connection to the technical scope under consideration, such as similarity of product/service/support, complexity, dollar value, contract type, use of key personnel (for services).

2.2.4. Quality refers to how well the offeror performed past contracts. The quality of the offeror’s past performance, general performance trends, and usefulness of the past performance information will incorporate into the performance confidence assessment.

2.3 Factor 3 Price. Pricing shall include all processes necessary to meet all the criteria outlined in the

PWS. The total evaluated price will be the sum total of all CLINs, inclusive of all option periods except the optional six-month period of performance utilizing FAR 52.217-8.

3.0. EVALUATION FACTOR CRITERIA

3.1. Criteria for Factor 1 Technical.

Element A: Technical Approach and Methodology

The Government will evaluate the Offeror’s approach for providing complete program management support that shall fully integrate, manage, control, and document all phases of the contract requirements. The Government will evaluate the Offerors ability to manage the Product Items List (PIL), adherence to the warehouse management, and inventory control; and online customer account management; order management; shipping; customer service operations; concerning branding, marketing, graphic support, and conference/exhibit life cycle support;

management of awards; orderly transition of contract service; and Government data integrity and confidentiality.

Element C: Risk Management Framework (RMF)

The proposal shall demonstrate the Offeror’s understanding of RMF and the ability to apply Risk Management

Framework (RMF) to Department of Defense (DoD) and federal information systems as described in National

Institute of Standards and Technology (NIST) SP 800-37 as well as the proper Assessment and Accreditation

(A&A) procedures defined in the NIST SP 800-115. Additionally, the Offeror shall demonstrate that proposed personnel engaged in or supporting the RMF are appropriately trained and possess professional certifications consistent with DoD Directive 8140.01 and supporting issuances.

ELEMENT D: Transition of Contract Services

The Government will evaluate the offeror’s transition of contract services plan and its ability to transition services from the incumbent, located in Wichita, KS. The Government will evaluate the Offerors ability to work with the incumbent contractor to inventory and ship current warehouse government owned stock property to the new offeror’s location, and contact and arrange for shipping of applicable Voting Assistance Forms from General

Service Administration (GSA) locations to new offeror’s location. Additionally, the Government will evaluate the

Offeror’s supply chain management processes and systems, and its full functionality of their ordering processes and systems.

3.2. Criteria for Factor 2 Past Performance Factor. The Government will conduct a past performance evaluation based on the Offeror’s previous performance of major or critical aspects of the requirement to determine the probability of the Offeror successfully performing the solicitation requirements.

3.2.1. The Government will consider each Offeror’s demonstrated current and relevant record of performance in supplying products and services as a prime contractor.

3.2.2. Potential sources of performance data are Government sources such as the Past Performance Information

Retrieval System (PPIRS), SAM.gov, Federal Awardee Performance and Integrity Information System (FAPIIS), questionnaires, and/or non-Government sources, such as commercial past performance references submitted by an

Offeror.

3.3. Criteria for Factor 3 Price. The Government will evaluate the Offeror’s total proposed price as the sum total of all pricing contained on the Pricing Template, inclusive of options.

The optional six (6) month period of performance, utilizing FAR 52.217-8, shall not be considered part of the

Offeror’s total evaluated price. The optional six-month period will be calculated by dividing the fourth option year proposed price by one-half.

The Government anticipates that adequate price competition will establish a fair and reasonable price. However, if the Government does not receive adequate price competition, it will evaluate price proposals in accordance with one or more of the price analysis techniques prescribed at FAR 15.404-1 to ensure price reasonableness of the services being provided to the Government, considering the specific terms and conditions and relevant commercial practices.

4.0. ORDER OF IMPORTANCE.

4.1. Proposals will be evaluated based on best value to the Government using the trade-off approach. For this solicitation, factors are listed below in descending order of importance. Price will be evaluated separately and will not be scored.

1. Technical

2. Past Performance

3. Price

4.2. Technical and Past Performance, when combined, are significantly more important than cost or price.
