About this file
This is a Request for Quote (RFQ) for K9 Multi-Purpose Canine Procurement issued by Naval Special Warfare Group One (NSWG1), a component of United States Special Operations Command (SOCOM). The solicitation number is H9224026QE076, with an offer due date of September 4, 2026 at 10:00 AM.
The Government seeks to procure six (6) age and breed-appropriate adult multi-purpose canines (MPCs) for delivery by September 30, 2027, with four option periods for six canines each in subsequent years (through September 30, 2031). Delivery is FOB Destination to NSWG1 Supply Office Comptroller at Silver Strand Training Complex, San Diego, California. All canines must comply with the requirements specified in Attachment 1 (Product Description), Attachment 2 (NSW MPC Program Canine Supply Protocol), and pricing outlined in Attachment 3 (Pricing Sheet). (a) . As used in this provision-Definitions
Foreign person means any person other than a United States person.
Specified Federal procurement payment means any payment made pursuant to a contract with a foreign contracting party that is for goods, manufactured or produced, or services provided in a foreign country that is not a party to an international procurement agreement with the United States. For purposes of the prior sentence, a foreign country does not include an outlying area of the United States.

Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the IRS.

(1) It is is not a foreign person; and

(e) If the Offeror represents it is a foreign person in paragraph (d)(1) of this provision, then-
(1) The clause at FAR 52.229-12, Tax on Certain Foreign Procurements, will be included in any resulting contract; and
(2) The Offeror shall submit with its offer the IRS Form W-14. If the IRS Form W-14 is not submitted with the offer, exemptions will not be applied to any resulting contract and the Government will withhold a full 2 percent of each payment.
(f) If the Offeror selects "is" in paragraph (d)(1) and "partial or no exemption" in paragraph (d)(2) of this provision, the Offeror will be subject to withholding in accordance with the clause at FAR 52.229-12, Tax on Certain Foreign Procurements, in any resulting contract.
(g) A taxpayer may, for a fee, seek advice from the IRS as to the proper tax treatment of a transaction. This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. For questions relating to the interpretation of the IRS regulations go to https:// www.irs.gov/help/tax-law-questions.

Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Award will be issued to the quote determined Lowest Priced Technically Acceptable (LPTA) with acceptable past performance. In order to determine a quote technically acceptable with acceptable past performance:
(1) The Government will query the offeror in SAM to confirm registration and determine whether the firm is a small business. Firms not registered in SAM and/or that are large businesses will not be considered for award.
(2) Quotes will be ordered from lowest to highest price based upon the auto-calculated total evaluated price calculation under Attachment 3 - Pricing Sheet;
(3) The Government will review the technical submission for the lowest total evaluated priced quote. The Government will review the technical submission and ensure the offeror has adequately demonstrated their ability to deliver breed appropriate adult canines. The determination of technical acceptance resides solely with the Government. If the lowest priced quote is determined technically unacceptable, the Government will evaluate the next lowest priced quote in the same manner, continuing until a technically acceptable quote is determined. If no quote is determined acceptable the Government reserves the right to revise requirements via amendment or cancel the solicitation.
(4) The past performance acceptability review may be limited to the contracting officer's knowledge or previous experience with the offerors' past history in providing the supply/service being acquired. The KO may also consider past performance information from a wide variety of sources both inside and outside the Government. This may include reviewing performance information reported to the Contractor Performance Assessment Reporting System (CPARS), SAM, as well as other sources of information. At the contracting officer's discretion, offeror may be required to submit contract references. If required, offeror will be notified separately and in writing of the requirement to submit past performance references. Offeror shall not submit references unless requested. Any adverse past performance findings may result in quote being determined unacceptable.
(5) Pricing shall be evaluated in accordance with FAR Part 12.204(a). The Government may request additional price information from the offeror and the offeror shall comply with the Government's request for supplemental information.
The Government reserves the right to revise terms and conditions of the solicitation prior to the closing date via issued amendment of the solicitation. Any solicitation amendment, if issued, shall be posted on the SAM.GOV website. If no technically acceptable quotes are received, the Government reserves the right to cancel solicitation/not issue an award.
(b) . The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Options Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) . A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall Notice of award result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
