Attachment 1 - Performance Work Statement (Basic Contract)
Performance Work Statement Portable Chemical Toilets for Naval Special Warfare Command (NSWC)
1.0 BACKGROUND
1.1 Naval Special Warfare Command (NSWC) required portable chemical toilet placement and servicing to accommodate NSWC staff and students.
2.0 REQUIREMENTS
2.1 PRODUCTS AND SERVICES: The Contractor shall provide two (2) types of portable chemical toilets, standard and VIP, as indicated by location below.
2.1.1 All toilets shall be fully stocked with toilet paper in a quantity sufficient to last between service calls.
2.1.2 VIP toilets shall contain a sink with a filled fresh water reservoir, hand sanitizer, and paper towels. Sink shall discharge grey water into the holding tank.
2.1.3 All portable toilets shall be completely self-contained units which meet OSHA requirements and have a hasp which will allow the portable toilets to be locked from the inside.
2.1.4 Servicing shall include restocking paper towels, hand sanitizer, and fresh water for sinks; removal and disposal of waste matter; cleaning of toilets; and replenishment of any sanitary fluids in the grey water collection containers.
2.1.5 The Contractor shall provide all personnel, equipment, tools, materials/supplies, transportation, supervision and other items and services necessary to perform services.

2.2 LOCATION 1: Camp Billy Machen in Niland, CA
2.2.1 The Contractor shall provide continuous placement of portable chemical toilets, as described at the Task Order Level.
2.2.2 The Contractor shall service no less than twice per week. See PWS 2.1.4
2.2.3 The Contractor shall check-in and check-out with the Camp Billy Machen quarterdeck, or assigned point of contact, before and after each pumping service.
2.2.4 It is not anticipated pumping service will be required in between service iteration dates. However, if requested by the Camp Billy Machen quarterdeck, the Contractor may be required to service the chemical toilets in between iteration dates no more than twice.
2.3 LOCATION 2: Multiple locations at Naval Amphibious Base (NAB) Coronado
2.3.1 The Contractor shall provide continuous placement of portable chemical toilets, at the locations on the base and quantities described at the Task Order Level.
2.3.2 The Contractor shall service standard portable toilets not less than three times per week. See PWS 2.1.4.
2.4 LOCATION 3: Multiple locations at Naval Amphibious Base (NAB) Coronado, Temporary Portable Toilets
2.4.1 The Contractor shall deliver portable toilets for temporary placement in locations coordinated by NSWBTC Operations prior to delivery as described at the Task Order Level. Point of Contact is: NSWBTC Deputy Operations Officer TO BE PROVIDED UPON CONTRACT AWARD.
2.4.2 Delivery shall be between 0800 and 1200.
2.4.3 Removal shall be after 1300.
2.4.4 The Contractor service twice per week. See PWS 2.1.4.
2.4.5 Type of portable chemical toilets and day duration will be distinguished at Task Order Level.
2.5 LOCATION 4: Naval Amphibious Base (NAB) Coronado, CA in the vicinity of 3632 Guadalcanal Rd. Bldg. Vietnam Memorial Field, Temporary Portable Toilets.
2.5.1 The Contractor shall deliver portable toilets for temporary use described at the Task Order Level.
2.5.2 Delivery shall be between 0800 and 1200.
2.5.3 Removal shall be after 1300.
2.5.4 Type of portable chemical toilets and day duration will be distinguished at Task Order Level.
2.5.5 Rental of these portable toilets are not expected to exceed three days. If toilets are needed more than three days the Government may indicate a requirement for servicing in accordance with PWS paragraph 2.1.4.
2.6 LOCATION 5: Other locations not identified. To Be Negotiated (TBN), Continuous or Temporary Portable Toilets.
2.6.1 The Contractor shall deliver portable toilets for continuous or temporary use.
2.6.2 The type of Portable Toilet (VIP or standard) will be distinguished at Task Order Level.
2.6.3 Delivery and removal will be distinguished at Task Order Level.
3.0 EMERGENCY SERVICE CALLS
3.1 The Contractor shall have the capability to respond to emergency calls at all locations.
3.2 Contractor shall respond to Emergency Service Calls within 24 hours.
4.0 COMPLIANCE WITH ENVIRONMENTAL AND SAFETY LAWS
4.1 The Contractor shall comply, and assure that all subcontractors comply, with all applicable federal, state, and local laws, regulations, ordinances, policies and standards related to environmental matters. The Contractor must comply with all applicab1e federal, state, and local safety requirements. The Contractor shall also comply with the American General Contractor's Safety Manual and the Occupational Safety and Health Act.
5.0 SPILL CLEANUP
5.1 The Contractor shall bear financial responsibility for cleanup, transportation, disposal and restoration cost in the event a spill or accident is caused by the Contractor.
6.0 HOURS OF OPERATION
6.1 Non-emergency service calls will be scheduled for 7:30 AM – 3:00 PM, Monday through Friday, to exclude weekends and federal holidays.
6.2 RECOGNIZED HOLIDAYS: The following Federal legal holidays are observed:

6.3 Performance shall conform to professional commercial and industry standards and be performed in a manner that will maintain a satisfactory condition and professional base appearance.
7.0 CONTRACTOR MANPOWER REPORTING
7.1 The Contractor shall report the amount of hours required for performance of services provided under this contract for the NSWC via a secure data collection site. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013. 8.0 QUALITY ASSURANCE
8.1 The Government will inspect the Contractor's performance under this contract using surveillance methods appropriate for the nature and complexity of this requirement. The Contractor will be given the opportunity to correct or address any adverse findings resulting from the Government's inspection consistent with the Inspection/Acceptance clause in the contract. Failure to correct any adverse findings or failure to deliver all products/services described in this contract may result in non-acceptance of the products/services by the Government. Failure to meet the standards of this contract may result in a deduction of price at least equal to the value of the unperformed or poorly performed requirements. Performance will be evaluated to determine whether or not it meets the performance standards of this contract. Re-performance at no cost to the Government is the preferred method of correcting any unacceptable performance. The Contractor shall provide the Government written response why the performance standard was not met, how performance will be returned to acceptable levels, and how recurrence of the cause will be prevented in the future. Failure to perform in accordance with this contract could also result in termination of the contract for cause and/or adversely impact the Contractor's ability to be selected for future contracts as documented in the Contractor Performance Assessment Report System (CPARS).

10.0 INFORMATION USE
10.1 The contractor hereby unequivocally agrees that it shall not release to anyone outside the Contractor’s organization any information, regardless of medium (e.g., film, tape, document, contractor’s external website, newspaper, magazine, journal, corporate annual report, etc.), pertaining to any part of this contract or any program related to this contract, unless the Contracting Officer has given prior written approval. Furthermore, the contractor is prohibited from using any Naval Special Warfare Command logos and /or other trademarked identifiers in any way without first receiving a specific license to do so.
10.2 Request for approval shall identify the specific information to be released, the medium to be used, and the purpose for the release. The contractor shall submit the request to the Contracting Officer at least 45 days before the propose date for release for approval. No release of any information related to this contract shall be made without specific written authorization by the Contracting Office, other than that required for performance of the requirement.
11.0 PERIOD OF PERFORMANCE:
11.1 Period of Performance: Period of performance will be for a total of five years. Resulting contract will involve five, one-year ordering periods. Date of ordering periods to be established upon award.
