Questions and Answer H92240-22-T-0016; NSW Gear Issue BPA Solicitation

1. Assuming each BPA call will be under the Simplified Acquisition Threshold (SAT), will the Berry Amendment be applicable to this solicitation?

a. BA will be set to the CALL ORDER level in accordance with current FAR thresholds (currently $150k). While anticipated orders will generally not be above the SAT, there is no definite go/no-go for requirements above that threshold. CALL ORDER Requests breaking the BA threshold will be appropriate / researched to alleviate conflicts.

2. (Page: 9, 52.212-1 / Volume II-Factor 1 – Technical Capability, Para C & D) Is there a specific format for alternative item technical information and will photos be required?

a. No specific format required; photos accepted. As long as salient characteristics are defined to determine comparative, it will be sufficient for submission.

3. (Page: 9, 52.212-1 / Volume III, Factor 2 – Price) Is there an estimate on annual individual item quantities, as this will affect responses to the Berry Amendment compliance as well as discounting pricing for increased volume of individual products?

a. There is/are no current estimate(s) on individual items. Further, items may be added to this BPA item list for the life of the effort.

4. (Page: 10, 52.212-2 / Factor 2 – Volume III - Price) How will the pricing be evaluated, and will the first year carry more weight than the following years two through five due to instability in current supply chain issues?

a. Pricing for this solicitation will be evaluated in accordance with FAR 13.106-3(a); LPTA. No weight will be carried for the out-years; however, all orders will be competed at the CALL ORDER level.
